Okay, yesterday was my NOA2.

Today I couldn't call NVC because they're having a power outage.

My next step is to get DS-3032 email format sent from my wife's (The alien relative) email address.

Problem is, my wife doesn't have internet and isn't in a town that has internet.

Can I just send the DS-3032 for an e-mail account made on her behalf, as if she created it?

File a I-130 petition for your wife, your son will need to be documented as a U.S. citizen. You do so with a Consular Report Of Birth Abroad.

I hate to be the bearer of more bad news, had you used your foreign address, your I-130 would've very likely been approved rather quickly.

You can call the National Customer Service Center at (800) 375-5283, which changes your address for the specific application you've submitted. Plus you call complete the AR-11 online.

i just called and talked to them she told me it was a vaild request that falls under the human bracket of the expedite descriptions. now its off to the CSC director for a approval. I will pray and hope for good news!!!

I want to expedite my wifes i-130. what i want to know can it be possible to submit one for her when she is 5 months preggy and doesnt have the resources to attend the doctor and buy proper food for herself in the philippines. what you think i should do


A request to expedite based on your wife being pregnant is not a reason for the request to be approved. From start to finish an I-130 -- to issuance of a IR-1/CR-1 is in the 9 months range.

That form you got would be the I-797 or your NOA. I would call back to the military help line and talk to that same contact or someone else if he isn't available. However, the I-130 with overseas addresses have been getting pretty fast approvals from USCIS.

If you have your actual orders, mail a copy of your orders with an attached a copy of your NOA. Write "Military Expedite" on the outside of the envelope also.

Your current income exceeds 125% of the Poverty Guidelines for a family of two -- your income is sufficient. You can include a cover letter with the I-864 explaining you had no employment in the previous years, hence, no three years of income tax returns. Include a letter from your employer indicating your annual income and include recent pay stubs.

I did not send any pay stubs. I'm not saying this would for sure work for you, but in our experience it did. All I sent is a letter from my employer stating when I would start working, what my income would be, and that it was not a temporary position. I also sent a letter of explanation that I wrote so they would know that my job status had changed since my last year's taxes were filed and I included on there what my expected annual income would now be.

As a side note, one thing you will find is that overall on VJ people will tell you to take/send more evidence than what even USCIS or NVC requests (e.g. according to the instructions on the I-864, there is no need to send recent pay stubs unless requested to do so. Here's what they say..."You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a Government official. For example, you may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income, or income from any other source, you may also include evidence of that income.")

All that to say this, I don't think it's a bad thing to send pay stubs, etc., but at the same time it is not something that USCIS specifically looks for. It is always good to be over-prepared rather than under-prepared. So really, it's your call as to whether you want to try sending it with or without the pay stubs. It may result in an RFE, but then at the same time, not sending it for a month will also result in a delay.


Agreed, however, in the case of the OP, he has no tax returns from previous years to submit. So pay stubs would not hurt in his case, he has no other way to document any income other than the letter from his employer.

You really need to submit the pay stub(s) to substantiate your income and support your claim of employment.

Why file the I-129F? The I-129F will be administratively closed and the I-130 will be processed for the purpose of a IR-1 or CR-1 visa. At least it was free so your husband only lost his time.

Your son will derive his immigration benefits as a result of your approved petition, if he is included in the petition.

I'm sure Darnell will fill you in about the K-3, which is basically a dead visa option.

Keep in mind, that is only the first leg of the processing completed at USCIS, there will be further processing once the approved petition is sent to NVC. Filing from abroad, seems to avoid the long wait at USCIS for approval.

Do not submit a I-129F in addition to the I-130 and your petition will be processed relatively fast. Even if you do submit a I-129f, it'll be closed administratively. Once approved at USCIS and the case is complete at NVC -- there are only 2 visa options available, based on how long you've been married.

Less than 2 years = CR-1 -- which gets your wife a 2 year Green card and 2 years or more = IR-1 -- which means she receives a 10 Green card.

There are quite a few members that have filed the I-130 from abroad. USCIS has been approving I-130s with a foreign address relatively fast. For example, there was one recently that was approved in 7 days from NOA1 to NOA2.

The K-3 visa is an obsolete visa, your visa options will be IR-1/CR-1.

Don't worry or stress over it, like I said, it's normal for the CO to want or request an NBI with AKA.

Look at it like this, that means the CO had no other concerns if all he/she wanted to see in addition to
the documents you submitted was the NBI with AKA.

Hi guys, just want to ask, I've done my interview today and the consul told me that they still need 1 more document from me, and I can send it via 2GO, So I already did too today. But they didn't tell me if I'm approved or not, they just took my form for visa delivery 2GO. What should I do?

There is nothing you can do but wait, the decision is in the hands of the consular officer. Many beneficiaries get approved without any indication from the CO and most are told immediately.

Since they kept your visa, that is a good sign.

I read on the US Embassy Manila website that you have to have a paternity DNA test before the Embassy will grant the baby US Citizenship , anyone know about this? They said the parents and baby go to St Lukes, have the samples taken, then mail the kit to the US for analysis before they give anything.


Actually DNA testing is voluntary, "The testing option is normally offered to applicants who have tried, but have been unable, to meet the legal requirement of establishing a biological relationship (filiation) on which nationality may be based."
