Anyone out there care to share the entry process of IR1, how long did it take to you pass through? Did you have to leave the line to go to another room?

The reason I ask, is that one of the connecting flights where my wife will enter is only 55 minutes and I am wondering if we can make that?

Everything is ready but he doesn't know if he needs to include payments with the petition or wait until the I-130 is approved? Also can anybody please give us an information or step by step about filing a petition I-130.. Again is the payment will be sent together with the his I-130 forms? THank you

i am new to this site,i really need your advice, newly wedd and my husband have some bad memories in the past,he was in jail for case of sexual assault though he already finish his sentence. i was worried it might be a problem for the visa application since he is the one who petition.thank u for all your advice it would be highly appreciated..



Sexual assault is a very broad term that covers many forms, including attacks such as rape or attempted rape, as well as any unwanted sexual contact or threats.

In his/your case, it is probably best to consult with a lawyer.

It was do i choose the k3 or Cr1??? The denial was never actually stated why except she did not believe we had a bona fide relationship...I am older, we met online, He did not know what city my best friend lived in Northern California...and how can I have children at my age. The outcome seemed predetermined before the interview...with out sounding bitter. I am not, it just would have been so much easier to appeal while the papers were there and give her the additional info she needed. I would have been with my man at this moment.
But I got to see Morocco again and converted in October...God works in great ways. And we are married.


Did not know the best way to file with the K3 or Cr1.

OP be ready to respond to any NOIR (Notice of Intent to Revoke) as a result of that denial, you have a pending 212(a)(6)©(i) in the beneficiary file. If you do not respond it becomes a misrepresentation in the file.
Resulting in a nasty surprise when your husband gets denied at his next interview.

no.....you misread my story

I already got B1B2 visa, now I am in my home country applying CR1,but since my husband was the one who invited me to go to USA have a busniess trip, I wonder if it will be an issue with my CR1 Visa bcs I didnt go to the busniess trip I went visited my husband as a friend back then and we got married , also I overstay for 14 days...



If you are questioned during your interview about the reason for getting the B1, be truthful. Your intentions were for business, that is the point you make.

You overstayed the B1 by a few days, but you left, that is the important fact.
You got married and you exited the country, then your husband filed the I-130 petition. You did it the right way OP so as to aviod the issue of fraudlent intent.
The fact you got married in the US is no big deal, relax, you should be fine.

OK so I had random thought. I received noa2 on October 25 the..nvc rec,d it on halloweem:-) now when I call they give me the standard answer that I should receive some info in 2-4 weeks. I have heard ppl say I should call everyday untol I get a case #, but honestly will my calling really make that happen? Heck I spend so ,much time worrying abut this process to

Be patient , calling daily will not change or speed up the process of assigning your case #.

Now, no homicidal rampage please, that will get you a booking number at the county lock-up, but no NVC case #. :D

Yes your copies are so you will have a record of what you sent and should your package get lost by USCIS, the post office, DHL, FEDEX, etc, you will be able to submit another package without losing your mind. :)

I was in the philippines for over 4 years and just got back to states several months ago. I'm currently petitioning my wife and am currently filing for I 864 affidavit of support. I'm using a family member as a joint sponsor but i ran into some questions in the process. I had no income for the last 4 years while in the philippines and hadn't filed any taxes. The form asks to file an income tax return or a letter stating that I was not required to file.
My questions are:
1. What type of letter is acceptable?
2. Do I have to file? I was reading the IRS form and it said I wasn't required to since I had no income.
Please Help!



1. I think your letter stating why you were not required to file tax returns should cite the section of the IRS code, thus making it very clear why you did not file for the years not filed, It would not hurt. Short and simple is probably a good idea also.

Like the other poster stated, since you are the one filling out the I-130, "YOU" means your husband (petitioner) as if he is filling out the petition.

I was just curious as to why you're the one doing the work, it is usually the USC/petitioner leading off the process with a I-130 or I-129F.

Since you are NOT in the U.S., you will apply for the visa in Manila.

So you fill in the blanks on the right side of that question.
