Sorry to know you've lost almost 3 months in the process. By now, your case very likely would've been 'complete' (minus any issues) had the IV docs arrived at NVC.

 

Getting the tracking and delivery confirmation/details from the paralegal is the next step in discovering what happened to your IV docs and who dropped the ball.

I've got a question on the visa I should be applying for as well as what the background checks may cover.

 

I'm American, my wife is Filipina. We have been together a year, and married for 6 months. We have a child on the way at the beginning of June; which I already know what I need to do for him and his CRBA. So first order of business in my particular situation. 

 

My wife and I were married and Singapore, she and I were both working there at the time. We currently "live" in the Philippines. I say that with quotations, because I work offshore, which is a month at work and a month off, which allows me on my off time to stay here on my tourist 30 days each time. Now, the dilemma is that she was previously married 5 years ago, but as most know, annulments and quite hard to get here in the Philippines; therefore, we cannot register our marriage here. So my question is, does the background check look for any previous marriages from the NSO? She has always kept her maiden name, even on her passport, and never changed it during her previous marriage. We are hesitate to start the process, because we aren't sure about what the process entails. We have sought some information on the annulment as well, but it is quite an expensive and very long process. We'd like to be able to get as much information as possible in all of our options.

 

Secondly, what sort of visa should I be applying for? I assume a CR-1, and can I file for it here in Manila? Thank you for any and all information you can offer. 

 

The first process you must to start is the process of getting an annulment for your wife. 

 

There is no way around

  • a properly recorded annulment
  • an NSO issued CENOMAR
  • a legal marriage to your wife

Then you can consider filing an I-130 Petition to start the immigration ball rolling.

Yes, she'll need to show her CEMAR but since this "second" marriage took place in Singapore, the issue will not be that the current marriage doesn't show.  The issue will be the CEMAR will show she is STILL married to her first and only legal husband.

 

The OP has not been back since I mentioned this, so he's either sleeping, having a major OH HECK moment or grasping at straws for how to ask about a way around this.  There isn't one besides an annulment followed by a legal marriage.  Fortunately AND unfortunately married is married.

 

Pushbrk, I'm going with the 6 words highlighted in red--after he wakes up.

For you (the spouse) he would file the I-130 Petition.  However, regarding the children -- is he the biological father of your children?  That  will determine how to proceed with regard to the children.

 

Assuming he is the father (and not the step-father), considering you said "our kids.," then they should be entitled to US citizenship. In that case, a Consular Report of Birth Abroad process for the children would be needed.

Yes we were doing things in a speedy manner,I have my docs readily available whenever lawyer would ask, since i have been reading here in VJ, I had all the civil docs (ready) and some other stuff they(lawyers office) might ask from us, and will just hand them what they need/ask.

 

Late approval because we were asked for an RFE.

 

Right now, we are still waiting for the completion of the review and of course the blessed day for an INTERVIEW that is hopefully will be set soon. 

 

thanks again, it feels better that there're people replying to me who understands and whose been in (bit) similar to my situation. 

 

You see, you are the one doing the heavy work by providing the supporting docs -- and the lawyer is filling in the blanks of forms.  Hanging out since Feb to the 3rd week in May is a lot of lost time.  Hope your case gets moving soon.

At what stage is your case in the process? 

  • Has the AOS bill been paid?
  • Has the AOS package been mailed?
  • Has the IV bill been paid and civil documents submitted?

Looking at your timeline with a late January approval and the case transferred to NVC in early Feb -- you should be done with the medical/interview or  worst case scenario -- waiting to interview. Provided you/your husband were diligent with submitting the AOS and IV packages in a speedy manner.

If you SENT (not just filled out) the G1145, you are most likely to get a notification within a couple weeks of filing, IF your petition was accepted.  If it was NOT accepted, you will not get any receipt notice, and it may take several weeks to get notice of rejection and the returned package.

 

I agree with you and I get your point of "SENT" rather than simply 'filled out.'

 

I assumed the OP understood the importance of not only filling out the G-1145, but including it with the petition as well. Otherwise, why bother filling the document out.

For some it's as soon as a week and for others, more than a week to a couple of weeks +. There is no standard time frame for intake and notification.

Call NVC @ (603) 334-0700 M-F from 7AM - 12 AM EST (press 1 to speak with an operator). Give  the operator your case number, then ask for your Invoice Identification Number.

 

Also give the petitioner's and beneficiary's email addresses -- do this and all correspondence (initial information package, invoices, instructions, interview letter, checklists, etc) from NVC will be sent by email.  Expect nothing from NVC until you've done this and do not wait around to hear from NVC -- you and your spouse must take charge to get your case processed, in a timely manner.

 

Your interview will be scheduled on your behalf -- you will not schedule your interview.

Is what you have a duplicate of  the marriage contract?  You need a certified true copy from the LCR.  You can get the NSO copy of the marriage contract much faster than 6 months if you ask for Advanced Endorsement and pay extra at the LCR.

1.  The 3-5 days quoted are an approximate time frame, not an exact.  All cases are different and it is not unusual to wait more than a week for the IV bill to be invoiced.

Unless you

  • just don't have the time
  • have difficulty following instructions
  • have a criminal background of epic proportions, thus, making a lawyer helpful
  • have extra cash you no longer need

you and your wife can do this.

 

All of the required supporting documents and personal information, would be gathered by you and your wife, only to be turned over to a lawyer, who would then fill in the blanks of various forms. However, a lawyer can slow the process -- but make it faster, nope. 

 

Since the beneficiary (your wife) is in the Philippines, the I-130 Petition would get speedy processing by USCIS.

has anyone ever heard of this? i've been trying to do some research on this! my fiance was previously married to a us citizen. the ex-wife never petitioned for him to join her but instead filed for divorce. now a few years later, here we are and i want to petition my fiance. my problem is there is no divorce in the philippines. i've heard 2 things -

1. my fiance has to file something called a petition for recognition of foreign divorce decree with the regional trial court in the philippines

2. on the manila us embassy website it stated: a common basis for refusal is a prior marriage for the beneficiary or the petitioner that has not been legally terminated. there is no divorce in the philippines. a consular officer will only accept a death certificate or a court ruling of annulment or presumptive death as evidence that a filipino marriage has been terminated. an american may terminate a filipino marriage through a us divorce.

so i'm so confused! i don't want to submit the petition without knowing what to do...but no agency can give me a straight up answer....how frustrating!


What are you confused about?

If your USC fiance has a signed off divorce degree from a judge from a court here in the U.S., then he is legally divorced. If you were ever married in the Philippines, then you need to have a legal annulment from the courts there. The only problem will be if he is not legally divorced or if you are not legally annulled...then you can not be granted a visa because you or he are still legally married.

So basically what you are reading on the embassy site are the reason (s) why you would be denied in the cause of not having a legal divorce or a legal annulment.

Does it makes sense to you now?

What your fiance needs to do is to get a copy of the final divorce decree from the court that issued/granted the divorce. If he does not know the court or the county where the divorce took place, he will need to contact the ex-wife to see if she will give him a copy of it or just even provide the information about the county where the divorce took place. It would be a very big help to him if she would provide the copy or even the case number and the county where she filed for the divorce.

Holy Mole! That is no small sum. Your effort to acquire the information and gather docs, you might as well fill in the blanks yourself. You'll feel better for having done it yourself. That is cash better saved and spent on your wedding, the honeymoon, airline tickets and the visa process.
