Darnell you are correct, thanks for pointing that out. I was multi-tasking and got the figures backwards and did not finish my thought on that point.
My finished thought would have been "you only need to be 125% above the poverty, not 100% as stated on here."

Since you're your fiance filed a I-129F for the K-1, he will submit a I-134 (Affidavit of Support) therefore you only need to be 100% above the poverty level, not 125%.

And from what you have written here, with both a part-time and a full time postion as a RN, he will meet the guide lines with no problem.

GG just arrived yesterday to the usa on 11-11-11. They told us our 90 day date is Feb 8th even though it should be Feb 9th? Anyways what I want to know is do we turn something in at the 90 days? If so, what? or Do we only have to be married by the 90 days?

Also I know this is nearly the same question but if we have something to turn in Does it have to be turned in by the 90 days or only have to be married on a date before the 90 days?

We're getting married on Feb 4th. What I'm trying to get figured out is if that is enough time before our 90 days of the 8th.

What happens at the point of the 90 days? I mean what do we need to do?

I'm trying to make sure I'm above poverty level but I'm not sure about 2 things. Do they base it on gross or net pay? I also have other deductions on my paystubs for pre tax medical insurance, 401k and child support. Are those deductions also considered when trying to make the 125% poverty line for 2 of $18,387? I hope smbody understands what I'm trying to ask and can help me...thanks for any help.

I feel a bit dubious about crossing the border while I-129F is pending, although most of people on these forums say there shouldn't be a problem visiting on B2 in such situation, provided that sufficient ties are presented. Last time I visited my GF I got pulled into secondary inspection (second time ever, POE ORD), but everything went smooth :thumbs: and I managed to ask the CBP officers a few questions. I got an answer that in 9 out of 10 cases one would be returned back home, cause they come here to stay and adjust despite having their petition pending. So yeah, after that I decided I'd like to stay in the US and wait there for our approval.

Also, I noticed that I-129F processing times are a bit shorter than 6-9 months ago, I guess it's possible to get the NOA2 after 3-4 months of waiting? If so, that's great news and makes my plan even more feasible :)

I think it may affects a Philippine marriage since it hasn't been legally recognized but then again all I need is a Legal capacity from my embassy to get a marriage license so I will not go through NSO. No need or requirement for you to get your previous marriage recognized in by a Philippine court. The process of getting an annulled/voided marriage or divorce recognized by the Philippine court is not simple and does not apply to you.

You are correct, your ex will need to endure the process of the court recognizing the voided marriage should she want to marry in the Philippines again.

OP be ready to respond to any NOIR (Notice of Intent to Revoke) or NOID (Notice of Intent to Deny) should you get one.
You have a pending 212(a)(6)(c )(i) in the your file. If you (the petitioner that is) fail to respond, USCIS will revoke the approval of the petition. If that happens it becomes a finding of misrepresentation in the beneficiaries file.

Even if you get married, this will result in a denial at the interview for your CR1.

No, it will not cause any trouble, people move all of the time. He simply does a change of address, you are aware of the new address should the CO ask you about it, so no problem.

I really appreciate all for taking time to share your thoughts. I believe that we can still work out on this. I just need to listen to some thoughts out here before I / we could finally decide as this is a serious matter. I don't wanna make a decision that I would regret later. There was no problem with my Fiance before then just recently he felt so much pressures. He is just the type of person who wants to be prepared all times. He has an excellent credit rating as he is financially responsible. He is a good man and we do have a very good communication. I just think we just have to delay or take time for now. Time is running fast for our visa expiration but in the essence it is best to pray and ask God for guidance. I trust God to take care of us. Hopefully whatever outcomes we have it would be for our mutual benefit. I'm very optimistic that this situation is just temporarily and that things happened for a reason. I posted a couple of hours ago after days of research as a last resort, thinking it was a lost cause and when it came time to process the paperwork id be taking the biggest shot in the dark of my life! But within 2 hours, every question i was worried about has beeen answered:) thank you both sooo much!

Will my wife have to wait even after shes had her interview and been approved to come to america, if shes had the child already? I would think they would let a lil baby come with the mom. But i could also see them saying, hold on, you have to wait till the birth abraod form and the babies passport is approved b4 your wife can come to the U.S. with the child. And whats the bio pade of the babies passport going to look like? Are they gonna take a picture of a baby? passports are valid for ten years, what about 9 years from now when i take my kid to see his relatives in the philippines, when he hands baggae check in his passport and the guy opens it up to see a babies photo lol??? Is that really what happens?


After the birth of your child, you and your wife need to take the necessary steps to secure a CRBA and passport so any travel delay is kept to a minimum. Yes pics of the baby and both parents are required. Read this and this.

As far as taking the baby to see the relatives in 9 years from now, you have enough to be concerned with now in this process -- You can worry about 9 years from now, well, 9 years from now.

Bob makes a very valid point about your medical and interview. Simple math says your visa will expire long before March 2013.

It's far easier to reschedule an interview than to get an expired visa reissued.

At this late stage of the process -- you should have your case number.

My husband received a phone call 1st week of March 2012 (gosh, it took a year to find out the result) saying that our CR1- visa was denied again coz we are married less than 2 years.

Tell (do not ask) him you want to see a copy of the I-797 he received from USCIS. He can even show the I-797 to you on via webcam.

Yes you need to file a separate I-130 and fees for your fiancee's child. That I-129F you plan to file will be closed administratively -- the K-3 is an obsolete visa option. After your I-129F is closed, the I-130 will continue to be processed so your fiancee can apply for the IR1/CR1 visa.

What you can do is write "See attachment" in that area. Then attach a sheet of paper with that particular question # -- then explain you do not know the dates or other details. make sure that sheet of paper is attached to the I-130.

Personally at this point I would not cancel anything -- stop digging holes for yourself, don't complicate things. :)

Now that you have two different interview dates -- I would just attend the earliest scheduled interview. After attending that interview, I would send an email to the immigrate visa unit to cancel the other interview. What you don't want to do at this point is for some embassy employee to get confused and cancel both interviews based on an email you send or some other attempt by you to cancel one of the two interviews that are scheduled.
