Just wondering if any USC here has ever been married to a Filipina before and married her in the Philippines, brought her here on Family Based Immediate Relative VISA (what they used to call it when I did it) and has since divorced here in the US and has since successfully petitions for Filipina Fiancee K-1 VISA? I'm asking because I did this and based on some recent posts I just got a little unnerved and worried about my previous marriage on record in the Philippines and any possible problems that may cause my Fiancee at her CFO semimar or VISA interview or getting VISA issued or even for AOS later. I have a certified copy of my divorce decree ready for her for the interview. I know I am free to marry here in the US.

Here is my situation exactly:

- Years ago married a Filipina in the Philippines (Traditional Church wedding and also filed with Civil Registrar) Remember jumping through many hoops just to get license and then more hoops to get married there!)

- She filed for divorce many years later here in the US. Divorced finalized and I have certified copies of decree.

- I petitioned for current Filipina Fiancee on K-1 and I-129f approved and we are waiting medical exam and interview and CFO seminar, etc.

Just want to know first if any USC petitioners here have ever married a filipina before in the Phils and then divorced here in the US and petitioned for Filipina Fiancee on K-1 and been successful getting the K-1 VISA for her? How did the USEM and CFO view your previous marriage to first wife in the Philippines? Did they even know? Did you have to annull the marriage in the Philippines? Did you have to do anything? Was it non-issue? Should I be concerned?

I've searched previous posts and can't seem t find any others. Not saying there aren't any, just not that I've been able to find.

So the success of the interview would depend on the affidavit? Is a big percentage of it being approved rite? Thanks so much everyone!



A successful interview will depend on several things like; how well prepared you are with the required docs, proof of your relationship, your background, knowing answers to questions about your fiance, ability to answer questions about the information in the petition, etc. You might get 10 questions or 2 questions, that depends on the CO.

With regards to the I-864, as long as you meet the guide lines based on family size and the income is stable, you should be ok.

be wise in your choices.. they are life altering.. INTERNET Relationship is different then in REALTIME..

you don't need lawyer.. just do lots of research in here.. there is tons of information from people that have screwed up before you.. so learn from their mistakes..

either process will still take time.. 6-9 months *average IF you don't make a mistake for the GOVERNMENT has a question..

take your time.. crosse all T's and dot all I's..

I would also look at the top of this page and click on "Portals" and post in the forum for Iran. That way you can ask questions to those with knowledge of the K-1 process with regards to an Iranian fiancee.

We both had a GREAT time together in Cebu
Money never seemed to be an issue until I returned home

As mentioned before, you'll need a waiver if you petition again within 2 years. You should not have a problem in the future, many have successfully petitioned a second time.

It certainly is a sad situation for you, but look at it this way... it is better to be aware of this now rather than later.

In addition to the registered letter withdrawning the petition, I personally would cancel the check (stop payment) on
the very same day I have a receipt as proof of sending the letter.

Was the baby listed on the I-129F and a G-325a completed? If yes then list him/her on the 156, if not-then no

The DS- 230 would not apply to a US citizen, he is not applying for an immigrant visa nor alien registration

Yes I paid 550 php departure tax when I leave Philippines in Sept



The $340 you paid when you filed the I129f is the fee to file the petition.

Your fiancee will have to pay the K1 visa fee before she can schedule her interview.

Entirely different fee.

OP, relax and stop pulling your hair out :D this is not a fast process, besides you're probably better looking with hair.

Your wait was not long enough to be outside of the guidelines. Get your MNL case #, schedule your medical, pay the visa, then schedule your interview.

The threads with advice to avoid ceremonies are numerous on this site. The CO's view of a "religious ceremony" is quite different from an opinion.

Besides, not sure how there could be a "religious ceremony" that wouldn't be viewed as a marriage, in a country that takes such a serious view of marriage as to not allow divorce.

I think you can have the religious ceremony in the Philippines, but legal marriage has to be in the US for k1 visa holders.

Your partner can apply for a tourist visa (which is not easy to get), other than that, there are no U.S. immigration benefits for gay couples.

I live half way between Spokane and Seattle on the South Half of the Colville Indian Reservation. It is 2800 feet elevation here, and it was 19 degrees F. this morning. We get lots of snow, wind, drifting, road closures, and freezing temperatures, 5 above to 35 below F. We visit Spokane often, and we were in Seattle last April. I had a chance to go with friends to the Philippines November and December, but my circumstances for that did not work out, as I rent a couple of houses, and renters have not cooperated with me very well, but things are getting better, so maybe I will be able to visit the Philippines in the not to distant future, hopefully! I love it!



Ouch that is cold! I live in Southern California but here in Atlanta for business... and it is already cold here to me, had to put my shorts away.
