Typically the visa is valid for 6 months, but please check YOUR visa to see what the expiry date is and make certain you arrive in the USA before that date.

There is no date you must travel 'by,' however, you have 6 months to enter the USA.

So you can travel any date you want, just get here before 6 months.

Hi!

I have been so blessed the past few days. I arrived here in the States safely, I just got married, and just today, I had my first job interview and was accepted!

Now...here's my issue...I didn't think I'd get a job right away. I just recently applied for my SSN, and I'm just going to apply for my EAD...my work starts next Monday. Can I go ahead and work? It's just that this is such a big opportunity for me.

Oh okay... So this means, my fiance has to make an exact duplicate of the i-129f package he submitted to USCIS in order for me to have a copy of it during my embassy interview...



Yeah, you fiancee should have made duplicates of every document he sent to USCIS. That way if that package had gotten lost on the way to USCIS, he would be able to resubmit the entire package again, based on his copies of all the documents.

Outside of having a completed case because of, criminal convictions, the need to seek waivers or other complicated issues...no lawyer needed. And they can not speed up the process, so save your money.

You complete parts 1 and 2, the doctor signs off on part 5, then submit the form.
If you're near Durham, there's a doctor I know of that does it at a reasonable cost.

What did the CO tell your fiancee after the interview?

dont worry CO might verfying some of ur fiancee's docs., better to e-mail the embassy so u know if the visa was issued or still pending for review... bcoz even they said she is approve before printing the visa they still need to have final check with all the docs. if they said visa is already been issued then call 2go.. and get ur tracking no. sometimes MNL is there tracking no. but sometimes they give other tracking no.

We both dont want American citizenship (no offense to Americans reading this).
Hence he has been LPR for +/- 10 years and not applied for naturalisation

I dont want to fly in and out - did that the last 2 years, the relationship starts and stalls each time I go in and out.

We just want to marry, and for me to live there permanently with whatever Visa is the RIGHT one..

so I ask whether this is the RIGHT process :
1. Use B1/B2 - enter US
2. Get married there
3. Apply I-130
4. Sit and wait (What is the interim visa called? and will I be able to enter/exit US) - important questions



There is no visa that will allow you to live here permanently being married to a LPR, once he files the I-130. If you enter on a B1, you will have to exit and wait for your visa to be available...as in years.

If you do not marry, you can come and go in accordance with the tourist visa you have. Since he does not wish to naturalize, there lies the problem.

See the post by Gary. Ten (10) years, why so long to become a citizen? There are benefits for doing so as you are learning.

They cannot live together somewhere else. His fiancee is an LPR, not a citizen. If she establishes residency anywhere else she loses her LPR status.

The best route, really? wait until she becomes a citizen and then file for a K-1. Visit as much as possible in the meantime. Even if she has to wait four years to be a citizen it will still be faster than an I-130 for a Malaysian. Promise!

She cannot petition you with a K-1. That is for citizens only. She can marry you first (anywhere in the world) and then petition you with an I-130. Be prepared to wait 2 -5 years for a visa number.

Once the LPR gets married and submits the I-130, doesn't that put his foreign born spouse in the F2A catagory which means a long wait. Wouldn't being in that catagory

The K3 visa exists, sort of. Most of the time, the K3 gets administratively closed at NVC stage and you are forced on the CR-1 path. The CR-1 is a better visa as you get a greencard immediately upon entering the USA (ie can work, get a drivers license).

You don't convert status, your husband petitions for you to be allowed to apply for the CR-1 visa; the visa results in a greencard when you enter.

Yes, you can get married in the USA on your B2 visa, and husband can start the CR-1 process immediately afterwards. You will have to leave the USA when your tourist visa time is up- usually 6 months. You can continue to use your B2 to visit while the visa is processing, but must do the medical and interview in your home country.

1. I have a B1/B2 visa, can I travel to the US and we get married in US (instead of Malaysia)? - so that we are not apart for such a long time (I will be in the US with him when the K3 visa is in process)

2. If we do get married in Malaysia, and the K3 process begins from here (he returns to the US, because he has to work), can I still travel in and out of the US to visit him (short durations)?

My fiancee in Vietnam got her k-1 visa approval yesterday and in preparation for her trip to america I found this entry in the USCIS website regarding entry into the united states.

The part I want to ask is what documents needs to be preserved in the seal when she receives her visa letters? I just don't want her to start opening every letter in the packet if certain ones or all needs to be unopened. Thanks all!


The packet will have "Do Not Open" written on it, act accordingly. Tell her to only remove her passport, be happy and have a safe trip.

Just wondering if any USC here has ever been married to a Filipina before and married her in the Philippines, brought her here on Family Based Immediate Relative VISA (what they used to call it when I did it) and has since divorced here in the US and has since successfully petitions for Filipina Fiancee K-1 VISA? I'm asking because I did this and based on some recent posts I just got a little unnerved and worried about my previous marriage on record in the Philippines and any possible problems that may cause my Fiancee at her CFO semimar or VISA interview or getting VISA issued or even for AOS later. I have a certified copy of my divorce decree ready for her for the interview. I know I am free to marry here in the US.

Here is my situation exactly:

- Years ago married a Filipina in the Philippines (Traditional Church wedding and also filed with Civil Registrar) Remember jumping through many hoops just to get license and then more hoops to get married there!)

- She filed for divorce many years later here in the US. Divorced finalized and I have certified copies of decree.

- I petitioned for current Filipina Fiancee on K-1 and I-129f approved and we are waiting medical exam and interview and CFO seminar, etc.

Just want to know first if any USC petitioners here have ever married a filipina before in the Phils and then divorced here in the US and petitioned for Filipina Fiancee on K-1 and been successful getting the K-1 VISA for her? How did the USEM and CFO view your previous marriage to first wife in the Philippines? Did they even know? Did you have to annull the marriage in the Philippines? Did you have to do anything? Was it non-issue? Should I be concerned?

I've searched previous posts and can't seem t find any others. Not saying there aren't any, just not that I've been able to find.
