thank you so much!!! yah my husband filed 2 visas.. kinda freak me out cause the immigration person in USA asked him to do so.. that's kinda strange though..


Ok, I think what your husband did was to submit both an I-130 and a I-129 petition, he
did not file for 2 separate visas at once...that is not possible.

I have to assume he was told to file both petitions (at the same time) for the purpose of a K-3 visa.

What will happen is the I-129 will be administratively closed at USCIS and the I-130 will be processed
and you will immigrate on a CR1 visa.

Ok, since you are already married, then you are not eligible for a fiancee visa.

The fiance (e) visa is those that are not currently married.

If you are the wife OP, then your husband only needed to file an I-130 petition
I think what you mean is your husband submitted an I-130 and a I-129,

So exactly which petition did your husband/fiance file? It is nor very based on the information you provided.

You can forget anything to do with a K-3, that will be administratively closed at USCIS.

IR-1 or CR-1 -- depends on the length of marriage.

Just as you have been advised, the approved I-129F will be administratively closed at NVC in other words, your K-3 case will be closed and the approved I-130 will be processed as a IR-1/CR-1 case -- depending on the length of your marriage. The length of your marriage determines which visa you're issued. Yes, the petitioner (your husband) will be contacted by NVC for further precessing of the I-130.

Thank all for that information. I am new to all of this. And I need as much help as I can get on this topic.

 

View this chart for bit of comparison.  The wait times to get the visa can safely be reduced by about 50% +/- a month or so to compensate for the extended time waiting to get an interview.

That is very true but at least they will assign him a interview appointment instead of the headache of the k1 where you have to schedule a interview yourself online. At this point where there is so few but hundreds of people are trying to get a slot. Good Luck

 

Oh I agree with you, I would take the NVC wait after case complete any day.  I would not want to be glued to a laptop or need to keep an ear tuned for the c4c alert hoping I can beat the other hundreds of folks clamoring for the same date.

I agree, save your time and effort by submitting only an I-130 minus the I-129F. 

 

Getting the actual visa interview is a challenge at the NVC stage due to expedites for those affected by Typhoon Haiyan, plan on six months +/-.

They are already behind by ages in their process on top of that this. CSC are like the trains in india ,once a train is late it keeps on getting late because it has to provide way for the other train thats on time because in certain areas there is only one track.

When I send off this form and all the supporting documents do I need his original signature on the DS230 and actual passport size pictures and original bc and marriage license?

Yes the signature on the DS-230 Part1, must be original. Yes actual passport size pics. Original/certified copies of marriage license and birth certificate.

Well without the passport you can get her the appt so that will delay your process. Call the Visa Center and at least get her number case..to get the appt you will have to have the number case which starts with HAV and her passport number. As soon as you get that you can get the appt. She will receive a telegram letting her know her case is in the consulate and she needs to go a pick up the forms or your can print them out for her. As soon as you get the appt which hopefully its soon but at least 6-9 months from now. Get the appt set up and then call and make an appt for the medical ( which by the way expires after a year not six months. Get her the appt for 2 months before her interview..giving her enough time to get results and for her to be able to use it here for her Adjustment of Status because if it expires then she will need one here again. Good luck..here to help my husband and I got marry yesterday.

No you will be fine we all have gone though this different name on passport and GC all you need to do is carry your marriage certificate as CO's realise you would not have had time to change name on passport. You'll be ok have a great trip. Just make sure you book the air ticket in name on passport as they have to match.

I'm sure this is probably the same type of rice I've eaten on many occasions in Thai restaurants and it's likely the rice I get when I have papaya salad (som tum). I'm traveling, so my favorite basmati rice is not available, however, this Thai Hom Mali Jasmine rice is available. I've researched this rice online, but I'd like to hear from those familiar with it.

I live in Irvine and I remember reading about this accident. It is a shear miracle your cousin is still alive based on those pics. It is clear the force of the impact of those vehicles was tremendous. I hope your cousin will have a full and speedy recovery.

Well lucky for us her Mother lives in Vietnam with about 9-10 other brothers and sisters in the same nearby area. I love my mother-in-law dearly but from afar. It would drive me nuts if she lived with us. She already tried to control how we live and my wife just tells her what she wants. The only thing now that she is ragging us on about is that we have not given her grand kids yet. The last I heard we have been apportioned at the least two kids and more if one is not a girl.

I was happy when we finally got the church wedding done last year as she was relentless on us doing so. No matter how much we tried to tell her we were trying but the church was making us jump through hoops she would just keep saying we were not trying and then even giving us how she is going to die unhappy with her daughter living in such sin. When we got married finally and sent her some pics she demanded more pics and video as proof. I was happy that she could finally die in peace and happiness.

Well now for the past year it is how she will die unhappy as we haven't had kids yet. I do find it amusing by now and even tell her that I am trying as often as possible to have kids. I even tweak her and say that we will have no girls but all boys.
We are supposed to go back to Vietnam this next year and be there for two weeks and one week in Australia to visit my babes two brothers married there. At the end of my two weeks I was supposed to head to Thailand for a few days to visit a friend there and also a friend of mine from Texas is flying in. Well my mother-in-law says that we will spend the whole time in Vietnam and I will not be going to Thailand.Posted Image


Like I said before I love her but from afar. I for one am glad she will not be living with us but if it was needed I would handle it somehow.

@luckytxn : I shouldn't be laughing but I find your situation amusing because it is so similar to ours, except at least living with you MIL is not the only option for you, like it is for us :lol: . We're not religious so a civil wedding was enough, though the fact that our engagement was private (American style) and that he did not bring his parents to their house to ask for my hand still gets brought up once in a while (to me of course, but I don't tell my husband to save him from the "guilt").

I cannot even count how many times we were pressured to have a baby as soon as possible. To put it into perspective, I am 25, my husband is 24, we're both in grad school which will take another 4 years if not more, so having a baby is not even remotely in our agenda. My parents' reason for this is that if we wait too long to have a child, it will be unhealthy, to which I reply by saying that making babies is not the ultimate goal of our union, and that we're not against adoption (which is actually the truth) if it comes to that. As you can probably imagine, their blood pressure went through the roof everytime this conversation happened B-) (lol, I just realized I'm a terrible daughter)


I had to smile as I read your first post, even chuckled a few times as I read to the last one. I went through the same thing with the parents of my ex-wife, as I am sure has happened with many spouses of Asian women.

The cohesiveness of the Asian family is a wonderful thing, but it does come with a price (not to insinuate this is bad) with regards to the in-laws. One doesn't just marry the daughter, the parents are included, any guy not aware of that will learn it in short order At least you know that storm is coming and you are preparing mentality, kind of like a real storm, just button down the hatches and hang on.

And the baby issue, that is the holy grail for Asian parents. Yeah, any resistance on that subject will cause an immediate increase in heart rate and elevated blood pressure.

My step-kids both passed the written test the first time, but both failed the driving test the first time. My step-son failed because he didn't put on his windshield wipers before leaving the carport at the DMV (it was lightly sprinkling). My step-daughter, on the other hand, nearly clobbered a parked car leaving the DMV parking lot. She was taking the test in the driving instructor's car, and the test administrator wrote on the denial sheet that he had to use the instructor's brake pedal or she would have hit the car. :wacko:

My step-daughter needs to practice a lot more, but my step-son has already bought a car and drives it to work every day.

My wife likes to be chauffeured. She's passed to written test, but hasn't made any attempt to learn to drive a car. I took her to a shopping center parking lot to practice a few times, but I think she needs the professional VN instructor we hired for my step-kids.



There are five different tests in Vietnamese. Hope you've got a cheat sheet for every one of them. :whistle:

Tiff, do not go away and be a stranger after your husband arrives. I know you will be busy doing the family and wifey stuff, just come back and give us an update and surely let us know what his POE experience was like...of course when you can find a few free minutes of not being in your hubby's arms. :D

In fact, write about the POE experience first...then get in your hubby's arms and stay there, how's that for a comprimise?

Hi Tiff,

the length of time to first clear immigrations will depend on the time of day/evening of arrival, and how busy the international terminal is with other arriving flights. Could be only 15-20 minutes or could be 1 hour or more, just depends. Then he"ll have to clear customs, same applies here. I checked the POE reviews for Houstaon and I only found 1, so that was no help. I hope your hubby has a safe trip and a big CONGRATS to you!
