I don't know what they based their expiration date on. Issuing a visa on 7 Feb 2012 and having it expire on 23 Feb 2012, is just wrong! Why would they issue a visa that can never be used given that she would have to go through a seminar in the Philippines and it takes a couple days before she actually has the visa in her hands due to delivery delays? Why don't they have some kind of checks in the software that prints the visa to prevent this kind of foolish error? If she would have used the visa before it expired, she would have been overstaying her visa before she could have even gotten a return plane ticket, let alone us getting married.

Certainly is a real mess you have here Jim. I'm not sure of the procedure how the staff at USEM checks visas before shipping them out the door, but we are the best checks to ensure accuracy and discover mistakes by USEM, long before the tickets are purchased. I know what I said is like putting on a rain coat after one is already wet.

The K-1 visa expires upon reporting to CBP at the POE, the K-1 is a single use, one time visa. Your 90 day count down to get married has nothing to do with the K-1 expiring, it expired at the POE, you have 90 days from the date of POE. Therefore, had Eve flown prior to Feb 23, she would have been fine.



The U.S. Embassy may not even allow her into the building to get this corrected, and I have sent them emails in the past, and even in this case, but they only respond with their canned reciept message saying they will get back to me in 7 days because they get too many emails.

Eve is so upset with the situation that she doesn't even want to go to the U.S. Embassy and try to get in to fix the problem. The last problem with them not being able to find a Cenomar that we had proof had been delivered to them took me having my U.S. Senator contacting them to get it resolved. I have sat on the phone listening to it ring for over an hour when trying to call the U.S. Embassy with no answer.

The 23 Feb 2012 date doesn't match up to any medical date or anything like that.

So short of me buying a plane ticket and going to the U.S. Embassy in Manila myself to get this resolved, what can I do to get this fixed?

I understand your sentiments considering the hassles you and Eve endured prior to the current fiasco. I know they can be rigid with regards to locals having an appointment before entering the embassy, however, this will take some time to straighten out. Getting on a plane will be a pain just to get this corrected.

There is no time frame set I stone when one must schedule the interview, you have lots of flexibility with doing so. You can certainly set up the interview when you have your docs prepared and you're ready to move forward. Once you have your case #, the next move is yours and nothing happens until you make it happen. You're not under the gun to set up and proceed with the interview from NVC or the U.S. Interests Section.

You gotta figure the time to transfer the case from USCIS to NVC to assigning a case # will easily take a week or more, then the case is transfered to the U.S. Interests Section in Havana.

Now that you have a heads up, can get some of the documents ready before your trip?

I think you might have the 2nd fastest time to NOA2 recently here on VJ.

That is pretty darn fast, 21 days to NOA2.
There is no mandated time one must schedule the interview. Some couples slow down the process after the the NOA2 based on their needs.

You have no worries with the petition expiring anytime soon., so you have time.

Before or after the interview at USEM, your fiancee needs to must CFO counseling, after which a sticker will be placed in her passport. Your fiancee must attend that counseling and get that sticker before she can exit the country. Here the link to the CFO website.

You could be waiting forever to be contacted by USEM, it is up to you and your fiancee to make things happen now. You will now pay for you the fiancé I-129f petition there in Philippines. Fee is U.S. $350 / P15,218. Send a little extra as it is bases on current exchange rate. If your fiancé passes her Medical They will give her a date to come back to SLEC and get her results and medical will CD of chest X-ray

On the interview date she will have a time most likely 6:00 - 6:30 AM to be at the Manila USEM. She needs to have all her required documents in hand, appointment letter, and passport. Again refer to K1/K2 Interview Preparation Instructions as for what is needed. Make sure she has all papers organized. It makes for a easier processing at the embassy and shows seriousness. Buy a organizer with tabs. Label the tabs for each requirement.

Once at the embassy, she will fall in line. They will take her appointment letter, check passport and assign her a number. At the embassy they don't allow any electronic devices.

You are not allowed to enter the U.S. Embassy/Consulate while carrying any of the following items:

battery-operated or electronic devices such as mobile phones, digital diaries, digital watches, pagers, cameras, audio/video cassettes, compact discs, MP3s, floppy disks, laptops, or portable music players
large shoulder bags/purses - only bags that can be carried by hand will be permitted
bags such as travel bags, backpacks, briefcases, suitcases, leather, cloth bags, and zip folders - you can only carry plastic bags containing application-related papers
food items (refreshments are available for purchase in the waiting area)
sealed envelopes or packages
cigarettes, cigars, match boxes, lighters

If she needs her cell phone they will ask her to check it in at the security section. They will give her a card so she can retrieve at the end of interview.

They will give her a form to fill out on how to deliver the passport with visa. Either it's deliver to her home address or she can go pick it up at a 2GO location.

Once inside, she will need to look on the board for her number to be called. She will go to the window and ask for her paperwork. Then she will be finger printed. They will tell her to wait again. Once her number flashes again, she will have her first interview with Filipino consulate. They will ask her a few questions and check and process her documents. (MAKE SURE SHE HAS ALL REQUIRED DOCUMENTS). If all is in order she answered all questions to satisfaction. She will then wait again for her number to flash again on the board. Then she will have her final interviewer US consulate. Consulate will process her paperwork and ask a few questions. If all is in order she will be told to wait again for her number to flash. Then she will go to the 2GO window where they will take her passport. They will give her a receipt (make sure to ask if they do not give one).

That's it for the USEM interview. You can now breathe a little easier.

Now if there is a problem. They will give a 221g form and state what the issue is. Now you will need to get them whatever they want in order to proceed. Now this is pull a long process when your in Admin Review. Look on VJ for Admin Review stories.

It will take 5 - 10 days for 2GO to receive visa and passport from USEM.

Once you have received your passport with visa. Now its time for CFO (Commission on Filipinos Overseas). Now CFO seminar can be done in the beginning before obtaining the visa and passport. You will need to return to get the CFO sticker and Stamp in the passport after receiving the visa passport upon approval and delivery.

No he does not have to wait until (next year 2013) he files a tax return denoting 'single' as his filing status. Based on the date on divorce decree, it'll be obvious the divorce was finalized after the tax return was filed. The date on the divorce decree is more important, not the filing status on the tax return.

For purposes of the K-1 petition, the divorce decree has no impact ("no baring") on the previously filed tax return. At the consulate level, the tax return is to show proof of income and that tax returns were filed. Whereas the divorce decree proves he is legally free to marry.

Are you talking pre interview or post interview? Post interview is the only time I know of when a consulate will accept documents by mail with regards to a K-1 petition, unless the Embassy where you (the beneficiary) will interview has a very different protocol. The I-134 should be in the beneficiaries possession at the time of her/his interview. Usually copies are fine, however, they can and do ask for an original I-134.

Hello to everyone,

A little background on my situation first: I meet my Russian girlfriend in July of 2011 on the internet. I visited her for a month in December 2011 and January 2012. Everything went great, now I want to bring her here (California) with K-1 visa.

My question is regarding the I-134 affidavit of support form. I make a little over $30,000 per year, however 2012 is my first year working (I was formerly a student and did not work), therefor I am unable to show a tax return for 2011 or any tax return for that matter. Now, I understand I can get a co-sponsor for this (I can get multiple co-sponsors if necessary). However, I read that for some countries where the fiance(e) lives (Russia in my case), I must prove to them that I can financially take care of them. I tried to go on the Russian Consulate's website to find out more information on this, but I was unsuccessful in doing so.

So my question is, does anybody know what the Russian requirements on this is? (I cannot show the Russian consulate a tax return, but I can provide them with co-sponsors, check stubs, and bank statements showing I currently have over $35,000)

Any help is greatly appreciated!!! Thank you!


Regardless of the consulate, petitioners must demonstrate an income at least 125% of the Poverty guidelines. As part of your I-864 package, you'll explain why you were not required to file tax returns.

Don't wait for any letter or package from USEM, how fast you get through the final steps and land in the arms of your honey is mostly up to you now -- provided you pass the medical and interview.

Register online for the medical at St. Luke's, registering online will save time on the day of the actual medical. This is the link to St. Luke's, note the required documents for the medical.

Before or after your interview at USEM, you'll need to attend a CFO counseling session. If you have the visa -- you get a CFO sticker placed in your passport after the counseling session. If you attend the CFO counseling before you have the visa -- you return to CFO with your certificate to get the sticker. That sticker is required before you can exit the country. I think you might be hung up on the total number of pages of the decree. What is important is the divorce decree be a certified copy from the county, with the embossed county seal, signed by the judge and dated. With the date that shows both parities to the dissolved marriage are restored to "status" of a single person, that is the important page. The government does not care about all of the attachments that deal with how any personal and real property was handled.

Hi. I sent a letter to my fiance in the philippines via postal service and she never recieved it. After waiting for over a month she went to the p.o. and tried to collect it herself. However it is long gone and no where to be found. It made me think. If I have to send important papers/documents how should I do it? Use an American company like Fed-ex or hire a courrier? I know there is scan and then email option but there are so many papers. She would be charged for each page she has to print. I have never sent a PDF file before. Not sure I know how. My next concern was when time for her to get her packet from the Embassy how will she get it if its mailed? She'll need that to follow the directions and schedule her medical and interview. Then, the visa; it gets delivered. I heard they use some courrier service called 2go or something. So hope no problem there. Just want to know what others have done in this matter. thanks VJ MEMBERS. Op, use Fed Ex or DHL. You can not count on your important documents reaching your fiancee in a timely manner (if at all) through the regular mail in the Philippines.
Sure it is not cheap, but the documents are more important than the cost to send them. Also, as mentioned, look into scanning the documents that can be scanned. Good luck.

Hey Bret, I agree with one of the other posters, you just started journey. Let your fiancee know this is not a speedy process, it is way too early for her to get upset. Once she starts to share the account she can make some VJ friends (Pinay and non-Pinay) and get more familiar with the process.

All this time though, I've been using my father's last name, and my mom, uses her last name of course, not my father's? In other words, my parents lied by saying they were married just so I can have my father's last name..Wont it be a problem?



I have never known or heard of the parents martial status being a problem for a beneficiary. As long as there are no misspelling issues with the name on your Bc, your parents status will not be an issue.
