i know!! When they schedule people, do they do it based on case number order, or type of visa. u would think that it is case numbers. does anyone know, how they schedule? based on what? like is there an order?

Just got off the phone. Only had to wait in line for about 15 minutes.. :thumbs:
She said that it doesn't matter if they have put the married or the maiden name on the DS-3032. Why, is cause they have received documents with both names at some point. (That's copies of my old passport I guess, that we used to show that I visited my hubby.) Anyways she said to sign with my married name even tho the document said my maiden name. And when I asked if I could email in the form, she said I could!

I'd suggest calling up NVC and inquiring. They occasionally mess up on the last name. Get it fixed by talking with an operator. Then, once that's fixed, continue signing with your married name.

Ok, i'm all new here and don't really know if i'm clicking and writing in the right places.. but i have a question :)
Just now when i was printing my DS-3032 form i noticed they put my maiden name on there, even tho we've used my married name in all the other forms. I couldn't really find a good answer to why and so on here.. but maybe that's just me that doesn't get how to search properly :D

Anyways.. why have they put my maiden name?
Should i still sign with my married name?
Do we have to do anything else than to fill in the DS-230 later on, that mentions both names?

Congratulations! Your request for the removal of the conditional basis of your permanent resident status has been approved.  You are deemed to be a Lawful Permanent Resident of the United States as of the date of your original admission or adjustment of status.

A re-entry permit is the option if you plan to be outside the U.S. for one year. As you already know first hand, any extended period of stay outside of the U.S. can be a hassle.

 

CBP officers have wide discretion--which means few options for maintaining permanent residence status.

Even if you want to you dont forget your sad past... so ask him to call or go to the city hall of where he got married or divorce and ask for a copy of the record... DONT LIE!!!!!!! Gather the documents!!!! All the lies come up to light in some point, so stop risking yourself

Your file was reviewed long before you arrived -- they knew you were coming, you had an appointment.

 

Your are a LPR with a valid GC, you are legally allowed to work. Just go to the nearest Social Security Office and submit an application for the SSN.

 

Wow -- what an amazing journey just to get to that N-400 interview! You endured a very long trip with three kids, limited finances, and got interrogated.

Your browser is likely the problem, try to download the form using a different browser.

 

Yes, it would be a problem if you submit the new version of the N-400 without the 2D bar codes, USCIS will reject it.

Hi everyone,
I had my interview today at Philadelphia. It went pretty well but he was a little confused by my name because I followed the traditional custom of changing my maiden name to my middle name which I did back during AOS and never had any problems. All my documents and Ids have this name. He asked me if I did a court change for it. He then said I'll probably do a name change oath taking for procedural purposes which is why he didn't give me an oath date on the spot, he said I will get a letter in the mail and it will be at my local courthouse. Other than that, it was pretty straightforward and took about 20 minutes.

Oh and he did ask me about my speeding ticket because I disclosed it and asked me if I paid it and I had the receipt, I said yes and that was that.

My question is, surely I'm not the only one he's encountered who has changed their name after marriage this way? It's not really that uncommon. He gave me the letter saying I am approved. Do you think everything is ok?

Not if the OP is going to wait 3-4 months like previous Canadians have had to wait for an interview. Then you lose a bunch of time on your medical validity. With the way things are going in Canada right now you want to wait until the interview is booked before booking the medical. You don't know when you would be able to book an interview.

I know that you need medical clearance for the interview. I mean scheduling-wise. Should I know my Medical appointment date before I schedule an Interview date.... I'm concerned that if the interview is before my scheduled exam, it would obviously conflict and I would be screwed.

It is never "...safe to expect" anything with regards to this process.

"...what possibility is there for her to be put in AP?" The possibility of being placed in AP exist for everyone, the CO can question anything and request additional documents, etc.

Just being presented with those penalties for cancellation would be enough to make me balk. Call them and get information about re-scheduling, just in case the need to do so arises.

Your husband/sponsor will complete the I-864.  The I-134 you did for the K-1 process was not legally binding -- the I-1864 is legally binding.

Thanks everyone for your inputs and help. As some people are telling me to contact lawyer, well I did that and as I said before that I am going to see him on this Thursday. Also, I am sure everyone or most people on this forum has lawyer but they come here seeking more help for time being and ask for other members personal inputs from their own experience in the past.
If everyone to contact the lawyers, which most of them do I guess then you tell them not to come here and ask other people suggestions and personal experience to get help because lawyer is helping you any ways ?

I though main purpose for everyone to be here on this forum is to learn from each others experience and help each other in their problems and share their joy once they come out from their Immigration problems.

Thanks any ways to the people who pointed that, since I have paid to lawyer and I should only ask them not here on the forum.

It is ok to seek input here from others, just know that some of the replies you get at times can be a little insensitive in tone. I would not take it personal, just the way some people communicate.

In my reply to you, I was trying to point out the Jan. petition was the one difinitely being denied and the July petition needed to be re-filed (based on the letter) according to the instructions. But since you have a lawyer, I would ask him/her since you paid for the service.

Hi there, my case is getting more and more complicated than I had thought of.

Let me start from beginning. I got my 2 years conditional green card on Feb 27th 2009.

On January 20th 2011, I filed for I751 with WAIVER. My wife was not ready to sign due to some misunderstanding. So, we filed for divorce and I filed I 751 with waiver. I got my receipt on 1st week of Feb. from USCIS. In March I got my biometrics appointment, which went fine.

In May I got later for interview on June 14th. Between January when I filed for I 751 and interview everything became fine with I and my wife and we got back together and decided to file jointly. So we withdrew our divorce application from court and went to interview together on June 14th. Interview went fin and we explained the interviewer what happened and what not. Impression I got from interview was that it should be good to go.

On June 27th I got letter saying that since we are not getting divorce any more, I need to refile I 751 with my wife signature on it and submit all the proof again with it. They gave me 30 days to refile the I 751 again.

On July 14th, I did that and sent all the proof again with new I 751. THE only mistake my lawyer did is that he told me not to send new check for USCIS fee, since I paid once in the past. SO being stupid I filed for I 751 with all the signs and proofs but did not send the check for immigration fees.

Now today, August 29th I got letter saying that my application has been denied because "not filling the I 751 properly".

This is what exactly it says on it. Its a plain white paper date August 25th.

"service record indicate that you obtained your conditional permanent residence status based on you marriage to (my wife name). You filed form I 751 seeking to remove the conditions on your residency based on a waiver of having a good faith marriage which was terminated through divorce. After the filling of the I 751 petition you advised the service that you and your spouse ceased your divorce proceeding and wished to continue with filling the petition jointly. In order to submit your joint petition, you must file it according to the instruction relating to such filling. On july 14th 2011, you submitted a joint I 751 petition signed by you and you wife. However, this petition is improperly filed and must be filed according to its instructions."

"Your I 751 petition filed on January 20th 2011 is hereby denied"


The letter mentioned the denial of the January 20th 2011 petition, not the July 14th petition. Then they informed you of the improperly filed joint petiton of July 14th 2011 with instructions of, "must be filed according to its instructions."

So refile the joint petition "according to its instructions" as you have been instructed to do by the letter, this time with payment included. Good luck.


I dont know what is my next step. I contacted lawyer and have an appointment on Thursday, but I am getting nervous now. Do I wait for USCIS to contact me again with removal proceeding or refile I 751 with USCIS fees.

It's obvious you're upset about your situation, I get that-we get that, but don't you think you're being harsh to the Op? There aren't many details other than what the Op posted, you can't say "your husband is a fool' or "you will be deported in 2 years!"

Your anger should be toned down a bit so you can focus on fixing your problem, not used to lash out against the Op here. She's merely seeking feedback for her situation, just as you sought advice about your situation.
