K-1 Fiance(e) Visa Process & ProceduresK1 Manila procedure
This is the link to USEM.

The fiancee can go to any branch of BPI and pay the visa fee ($350.00) then she (or you) will be able to set up the interview online at the USEM. Click here for the page to set up the interview. It will take a few hours or more before you will be able to set up the interview, just keep trying and eventually you'll be able to do so. The receipt she'll get at the time of payment of the visa fee is so very important, you'll need that receipt later and when schedule the interview online, or just the passport number when registering to set up the interview. She'll also need to have her passport with her at the time of payment at BPI.

Once you (or your fiance) have completed that, now she can register online for the medical at St. Luke's, registering online will save time on the day of the medical. This is the link to the page where you can read about what is required for the medical. Also click here to read a detailed medical exam review as experienced by a VJ member.

Before or after your interview at USEM, your fiancee will need to attend a CFO seminar, after which she'll get a certificate and get a sticker placed in her passport. If the seminar is done before the visa is issued, the fiancee will get a certificate, then she must return with that certificate, her passport and visa so the sticker can be placed in the passport. Attending the seminar and getting the sticker is mandatory before she can exit the country. Here the link to the CFO website, there you can read what you need to know about the seminar, the documents you need before you can attend.

P.S. Download all forms (and instructions for the forms) directly from USCIS or the USEM websites.

There is nothing you can appeal, you did not follow the instructions for submitting the I-129F petition.
Chalk it up as a loss of time, effort and $340.00, but you paid for an education and now you have your head
in the game as a result of this.

Click here for the USCIS website to find the instructions and a downloadable pdf of the I-129F and
read the "Guides" here.

Good luck.

That's a serious dilemma, what would really suck is to go through 2 months of treatment with your physician only to have St. Luke's want to put your fiancee through their protocol or a partial of it.

Maybe a doctor type will chime in here.

Withdrawing the I-129f petition will not cause any red flags, you're free to do so.
Have you considered getting married then pursuing the CR1 route to a visa?
That process will take from 8-10 months to complete normally. You can go slowly
in the CR1 process if you desire to do so.

K-1 Fiance(e) Visa Process & ProceduresHELP! COMPLETE change of personality.... :(

Everybody puts there best face on in the beginning. As time goes the true person is revealed. Now when you marry someone you have to say do I love the true person now that I know who and what he or she is. Can I deal with all the good bad and ugly of the person. The decision is yours at the end of the day.

There is no such thing as a perfect person. A perfect relationship. A perfect marriage. Its about how you understand the person and can you love them for for what they are worth.

The money you spend was all because you wanted and loved this girl. Don't complain now about the money part because all of us know in advance how much money we will spend on the petition, medical and visa applications alone. Not to mention the money you send to take care of him or her.

Me personally. I have learned, the more you chase, the more she will run. You need to stop. Take a break and go to Bohol, Lapu Lapu and see the sights. Go to Cebu city and take in a night of fun at a club or bar. Relax your mind for a seconds and think it over. Is it worth the efforts and time running a never ending race?

You seem like your a good hard working and dedicated person. You deserve better than this. Like the other people said. There are millions of others out there that would cut off their foot to treat you well and love you genuinely. There are women that don't care for the games, jealous rages and money. You are there in Philippines look once look twice and walaaaa!! You have a new potential friend.

At the end of the day everybody in world can tell you all the advise on what to do. You will be the one to make ultimate choose. Stay or Leave...

Good Luck and God Bless!!

Yet, more good advice!

Wally, been there and done that, with the exception of the DV.

If only 25 years ago, someone would have pulled me to the side or invited me to have a beer, talked some sense into me and rattled my cranium, it would've saved me many nights/days of agony and lots of money.

All the RED FLAGS were there, but didn't wanna acknowledge them.

K-1 Fiance(e) Visa Process & ProceduresHELP! COMPLETE change of personality.... :(

That's the thing!! Before this January, i never saw this side of her... our 1st year was the best though.... so sweet, caring, thought she's the perfect girl.... then last year when I visited her she acted less close to me and acted extremely jealous.... then this year is the worst. So.... what is her "true" self? The one that i saw who was COMPLETELY SWEET? Or the new one, who has did a COMPLETE 180 degree change? We can work, IF, she accepts her faults, and completely changes her ways..... yes, it hurts a lot.... but i dont feel like quitting just yet.

Why on earth are you trying to PUSH water UPHILL?

You can't make her accept her faults or change her ways, she'll do that when she grows up and matures, if ever. It is what it is.

You keep mentioning the amount of money you've spent on her, well, let me tell ya...have you seen the cost of a divorce?

Have any idea what a DV (domestic violence) charge would cost to get your ####### out of that pickle? Not to mention your chances of petitioning another Pinay with that jewel on your record would be next to impossible.

You want to try to put a price on a broken family?

Ever heard of child support, and the clown-show of having to deal with judges, lawyers and DA's?

Stop trying to make this relationship be what it is not - Wonderful.

Stop trying to make her be something she is not - kind, caring and committed.

I'm not saying any of this would happen to you, but you increase the odds when you marry someone that exhibits such behavior.

Step back and out of the forest so you can see the trees, there are numerous RED FLAGS here.

Since you have no clue, (I do not mean that in a negative sense) start
here and read the "Guides." Reading the guides will give you a good understanding of what you need to do next.

Your fiance will need to have a Green Card or Advanced Parole before he leaves the country. When you read the guides
this will make more sense to you.

Michael,

As the others have said, there will be no packet 3 sent to your fiancee, you and your fiancee are in the drivers seat now.

Use the link posted by RenCor to point you in the right direction.

You can register online for the medical at St. Luke's, registering online will save time on the day of the medical. Before or after her interview at USEM, your fiancee will need to attend a CFO counseling session, after which she'll get a stickers placed in your passport and the passports of her kids. If she attends the counseling before she has the visas, she have to go to CFO with the certificate showing proof she attended the counseling, then they will attach the sticker in her passport and the passports of her kids.. Attending that counseling and getting those stickers is mandatory before they can exit the country. Here is the link to the CFO website, you can read about the documents she'll need before attending.

K-1 Fiance(e) Visa Process & ProceduresThis is really annoying....

I just went through this process. The key is not getting an RFE for something you did wrong. We were approved 2 days ago with no RFE's. The process is frustrating but when you get approved look back at it like I am now, you will likely agree that it is done properly in many ways.

I watched the boards. I saw many couples break up between 1 and 4 months in. The fact is that many couples rush into this process and are truly not solid in their relationships. If this process was done any faster, many more couples would get married and have to get unmarried. Our approval took 5 months, 20 days. Our NOA2 was approved just after 4 months. We went through Vermont. I think they did a good job. I grew up in this great country and not everybody should be allowed in.

If you can't make it through 5 or 6 months, you'll never make a lifetime of marriage.

K-1 Fiance(e) Visa Process & ProceduresI want to know which affidavit of support form is require for K-1 applicant from Ghana

Hello friends I want to know which of the affidavit of support forms that is required at the US embassy in Accra-Ghana , I have been contemplating about this for sometime now and have already filled the I-134 form , but thinking if am doing the right thing, I want to know which of the forms is required for K-1 applicant from Ghana , I hope someone with recent experience can help me choose between the I-134 form and I-864 form, hope to hear from you guys soon.

The I-134 is the required Affidavit of Support for the K-1 visa applicant. The I-864 will be needed when you AOS, if you successfully immigrate to the U.S. via the K-1.

I would say "yes" Then attach a sheet of paper explaining that you felt there was a possibility you might've had a GC as a child, since your older siblings did have. I agree with canadian_wife, if they find it - you declared the info and a "no" answer can not be used against you. If they find nothing, then you're still ok. But at least you provided as much info you can remember from childhood.

It is confusing though as everyone talks about the California Service Center or the Vermont Service Center and that Texas no longer processes I-129F's but on the processing times page it shows graphs for the TSC processing !-129F's from 135 days ago...not bad for a center that doesn't process them.

K-1 Fiance(e) Visa Process & Proceduresg-352A just a little confuse

ok so here is the scenario, ok well i've been living here in indiana since 2003, then got moved to arkansas for my first station and was there for years, then moved here in indiana again same address as my first one,

so my aplicants address should be like this "indiana from 2003-2006, then arkansas form 2006- 2011, then indiana from 2011- present"

is this right?

You list present/current address first, then you work backwards to list the previous address to the oldest address.

and one more thing " do i have to use our address back in the philippines since they asked about last address abroad of more than 1 year?

Yes, you list Applicants last address outside of the U.S. of more than 1 year.

thanks guys

K-1 Fiance(e) Visa Process & Procedures6 Months...No NOA2

I submitted an I-129F petition package back in August 2011, got our NOA1 and a text message that said the case was forwarded to Vermont. Last month was our fifth month of waiting and I called USCIS to inquire about the case. The first person I talked to said that I needed to wait an additional 30 days before they would submit a service request. I waited another week or so and called again, this time the customer service rep said she would go ahead and submit the service request. I received an email two weeks later from USCIS stating "The status of this service request is: We have requested your file. Please allow a minimum of 60 days for a response".

Anyone have suggestions on the way forward? What are the odds that they lost our petition? Do they always say "we have requested your file", or is that code for looking under the desks? Do we just keep waiting, or are there other avenues available (i.e. Congressman)? Maybe I am making too much of all this...I know some cases take longer than others, just needing some advice and encouragement. Thank you in advance!

Unfortunately, it seems the K-1 process can be slower than it was 1-2+ years ago. There are no guaranteed times to process the I129F petition, the time given is a "goal" only. Some cases take longer, especially complicated cases with issues of overstays, waivers, background issues of the petitioner/beneficiary, etc. Not implying any of that applies to your case.

Hang in there and remain positive. There is no 'rhyme nor reason' at times with USCIC, e.g., not to pour 'salt in your wound' there is a VJ member that filed a K-1 in October and is now waiting for the interview. I know it's hard to understand how or why a K-1 filed in October gets approved before a K-1 filed in August.

Hang in there and remain positive.

K-1 Fiance(e) Visa Process & ProceduresWhat is the expiration date of petition on the visa

OP - The petition expiration is just that. It has four months after it's approved. In theory, the visa should be issue within this time frame. If it goes beyond the 4 months, the CO can extend it.
The visa expirations date indicates that visa must be used before date. Typically 6 months after it is issued.

K-1 Fiance(e) Visa Process & ProceduresI-129F Ques. 11
Since you're going to need a copy of your divorce decree anyway, that is a good place to start. Then you'll have her maiden name and you can at least fill in her name for #11. Then attach an additional sheet to the I-129F and explain in concise manner that you have no other information and why with regards to "A# and result" and "place and date of filing."

After you write her name in the space provided in #11, you should note e.g., '* see attachment,' so the adjudicator will know to see the attached sheet.

Maybe someone will have a better idea.

Good luck!

Per the Family Code of the Philippines.

Art. 176. Illegitimate children shall use the surname and shall be under the parental authority of their mother, and shall be entitled to support in conformity with this Code. The legitime of each illegitimate child shall consist of one-half of the legitime of a legitimate child. Except for this modification, all other provisions in the Civil Code governing successional rights shall remain in force. (287a)

The COs' at USEM are aware of this, they'll see you were not married to the father at the time of the child's birth and it shouldn't be an issue.
