Under no circumstances do you attend that interview and lie to the CO. Your double proxy marriage has been consummated, therefore, for immigration purposes you're married. A K-1 is not the proper visa for you. Had you not consummated the double proxy marriage, then the K-1 would have been proper.

It was suggested that you withdraw the K-1, the petitioner should write a letter explaining he was confused early on in the process as to the proper petition to file. Make it clear in the letter the petitioner was merely confused and did not attempt to cancel or misrepresent a material fact.

Indicate you have a better understanding of the proper petition to file, and you plan to submit a I-130.

Why attend an interview for a K-1 when you're married?, I would cancel that interview then start the process over.

Resubmit an entire package as you did the first time, but with the proper amount and new photos. Why be confused about a few pictures that were not returned to you, nothing you can do about that now.

Print new pics and submit them with the new package, assume nothing in this process.

As long as you have not submitted the I-129f to USCIS you're fine, submitting a completed 1-129f without that information included could be considered a "material misrepretation."

But as I understand you, you have not done so. So take the time to gather the additional court documents you'll need to address the issue.

Beneficiaries with far more serious criminal issues have been approved, so no need to stress, a 21 year old theft conviction should be simple to overcome.

Wow, that is a tough place to be in for your family.

No one can really tell you how to deal with the issue of should your wife stay or should she fly back to Texas to spend the holidays with you, that is a financial matter for you as well as a emotional issue for the little 7 year old girl that has not spent time with her mother in a few years.

You're kind of left with 6 in-one-hand and 1/2 dozen in-the-other hand.

If the wife stays there during this ordeal, you rack up hotel charges. If she flies back to TX, then returns to the Philippines later, that is another bite out of the wallet. You'll pay for flights from Mindanao to Manila for the swabbing to take place, then they'll return to Mindanao to wait for the results, then they have to fly back to USEM for the interview. Then at some point, after a successful interview, your family has to fly to the states.

So I guess you have to weight the cost of all that flying against the cost of leaving your wife there until this ordeal is finally over.
One thing for sure OP, it is so close to Christmas now, the little girl has not had a holiday season with her mother since she was 2 years old, but you've had the joy of being with your wife the past few holiday seasons. Would it be fair to say the little girl deserves this Christmas with her mother?

That's my 2 cents worth.

You do realize this is your own doing, right? You and your fiance caused your delay and misery.

Your interview was on Nov. 7 and on the 17th you provided the employment letter (I assume that's what you mean by "i send the letters")
and pay stubs to the USEM.

If those items were available to you before the 17th, why didn't you take them with you to the interview? It might have saved you the stress
you're feeling now.

No one can tell you how long it will take before they revisit your case and make a decision, as mentioned by "Frank and Raquel" the holidays are here
and pending cases suffer delays as a result of closures and limited hours. They kept your passport, that's a good sign.

You have your NOA2 now, there is no need to wait for the USEM to send you anything, the eligibility letter you might get,
might arrive to you well after you have completed the medical and interview at St, Lukes, some Pinays have gotten that
letter after they arrived in the states.

Have your fiance or you can do it, call NVC to get your MNL#. You have to take the lead to get your interview and medical complete.this site

1. Once you have your MNL#, go to any BPI branch (take your passport with you) and pay the visa fee.

2. Keep the receipt (s) you get as proof of the transaction... you'll need it later.

3. Log on to this site to set up the interview, it'll take a few hours to several before you can set up the interview after you'll paid the fee at BPI.

4. You log onto the SLMCEC website to register for the medical, there is no appointment, it is first come-first served, but the online registration will save you lots of time on the day of the medical.

oh ok. but i don't need to mail the pnp and nbi clearance to my fiance right? do forgive me for any stupid questions i may have. and please correct me if i'm wrong on this. i will be mailing him the ff: my birth cert, cenomar, our pics, receipts, chats on skype, fb, gmail, remittance receipts.

oh, and would you happen to know this. his income isn't enough but he gets a check from the government $1400 a month. anyhoo, so there are other forms to fill out, right? i asked my uncle for an affidavit of support. will that help?

The very first thing for you to do is to look up at the top of the page and click "guides" and read what documents will be needed and what to provide to your fiance in the US.

That way, you get a basic understanding of the process.

Thank you all so much! Those are some great responses, I just wish I asked questions here before I rushed and applied for a K-1. I probably should've consulted with a lawyer also. I didn't realize that the US government would rather have you sit on a couch then generate an income that would be spent in the US.

If I cancel K-1 petition, get married and apply for CR-1, would she be able to travel to the US as usual or would there be a restriction on her travel? Is canceling a petition a smart move?

The reason she wants to keep working is because I am in school and not generating much income at the moment, and we don't really want to live off of my parents (they will be my co-sponsors). That is why she wanted to work continuously until I am out of school and then she would take here well-deserved vacation. Also, due to the wedding preparations, it would be easier to leave the troubles of relocation for after the wedding.

Any other thoughts would be appreciated!



It sounds like she is using her head and has a very good reason to hang on to her job for as long as possible.

Sure you can withdraw the I-129F petition, get married, then submit a I-130 for your new wife. But "travel to the US as usual" would no longer exist with that I-130 in the system. She would now need to show very strong ties to Germany as proof that she has does not intend to immigrate here. Whereas previous trips she was a just a tourist, now with a pending I-130, in the eyes of a CBO, she has good reason to stay and she will have to prove otherwise.

It sounds as though she would be able to offer such strong proof that she has no plans to stay in the U.S. beyond any authorized stay. She would need to bring proof such as a letter from her employer explaining she is on vacation and is expected to return to work on a certain date, rental/lease agreement for her apartment, etc...

I just called USCIS National Customer Service Center to ask what month VSC is processing for K1. The lady told me they're working on month of Aug. Aug 12 to be exact. How come I am seeing K1 visas being approved for the month of Nov and Dec?


Simple...it's called GOVERNMENT. If you call tomorrow and speak to a different person, you just might get a very different answer.

Now relax, keep yourself busy and forget about the wait that you can do nothing about and which no amount of stress/worrying will make the process any faster.

Hello everyone.. I know some of you guys has gone through the interview process. For those who had worked on their affidavit of support. Kindly provide me some requirements I need to prepare for her Affidavit of Support. My employer has provided me a Letter of Employment with a base salary of 70k per year. Also, I don't have any tax transcript for year 2009, 2010 but I do have the 1040 Filing with W-2 for year 2010. Plus 3 recent Pay Stubs. Would this be enough supporting documents for my affidavit of support??? Please need your help..


Your 2010 1040 with W-2's are good, there is no requirement that you have transcripts.
At $70,000, you have solid income for the purposes of immigrations.

My reply was solely based on his statement:

I just assumed since the pregnancy was discovered during the medical, the docs took appropriate action with regards to vaccines.

If you think the cost of 2 visa fees are bad, wait until you have to AOS after your marriage.

You'll (your husband will) write 2 checks for filings fees as follows:

$1070 = for you;

$635 = for your daughter if application is filed at the same time as yours;

$985 = for your daughter if application is Not filed at the same time as yours.

The approval for you, the beneficiary, your daughter derives her immigration benefits through you. That is your approval, you will receive nothing more.


Have you read the "Guides" yet? Look along the top of this page in the blue header and click "Guides." That should be your next step so you can inform yourself, first.

Then...

Have your fiance call NVC to get your MNL#, once you have that, go to any branch of BPI and pay the visa fee ($350.00) then he (or you) will be able to set up the interview online at USEM. Click here for the page to set up the interview. It'll take a few hours or more before you'll be able to set up the interview, just keep trying and eventually you will be able to do so. The receipt you will get at the time of payment of the visa fee is so very important, you'll need that to schedule the interview online. She'll also need to have your passport with her at the time of payment.

Remember, you'll be paying the visa fees x 2., you and your daughter.

Once you (or your fiance) has completed setting up the interview, register online for the medical at St. Luke's, registering online will save time on the day of the medical. This is the link to the page where you can read about what is required for the medical.

Just got our NOA2 this week. Looking ahead, I have a few questions. :D

1. Do we wait for a copy of the I-134F from the consulate and fill out that one(will it have case specific info on it?) or can we print one off the internet and use it?

Download the I-134 from the USCIS website.

2. Do they need originals of any documents from the original petition submission, like divorce decrees, petitioner birth certificate, etc.?

Unless specially required that an original document be filed with an application or a petition, an ordinary legible photocopy may be submitted. Original documents submitted when not required will remain part of the record, per USCIS.

3. Do W2's, paystubs, bank statements, tax transcripts, etc. need to be originals?

4. How soon should I send this info to my fiancee? I don't want the dates too far from the date of the interview.

You can start gathering the docs now and forward them to her.

5. Is there anything my fiance can get going (like a police cert or something) prior to getting the packet from Dublin.

Any help would be greatly appreciated, especially if you have had experience with the consulate in Dublin, Ireland. Thanks!!

Yeah, if you're providing other sources of conversations and chats, then with regards to the Skype conversations, you can note you included them for the express purpose of showing the length of calls, whereas you've included chats from other sources that are not as private.

We all have those very private types of chats/personal conversations. Your package looks good, but what do I know, I've been awake all night...I see double now. I'm sure others will chime in soon to give you more feedback.

2. You can skip calling the "Call Center" for interview appointment.(You can setup appointment online). >> True - Correct. if you have a problem, you can call and get it done.

Before or after your interview at USEM, your fiancee will need to attend a CFO seminar, after which she'll get a certificate and get a sticker placed in her passport. If the seminar is done before the visa is issued, the fiancee will get a certificate, then she must return with that certificate, her passport and visa so the sticker can be placed in the passport. Attending the seminar and getting the sticker is mandatory before she can exit the country. Here the link to the CFO website, there you can read what you need to know about the seminar, the documents you need before you can attend.

P.S. Download all forms (and instructions for the forms) directly from USCIS or the USEM websites.
