You will send all of the required documents to prove and report your marriage to the Philippines government via the consulate in L.A., they will see you have a legal marriage, then you get a document called Report of Marriage mailed back to you with as proof you did in fact report the marriage.

 

Then, they make sure your marriage is documented at DFA and the Civil Registrar in Manila. You will be completing 4 separate Report of Marriage forms -- one of those forms gets signed and an official seal, which gets returned to you for your records.  Also, your original marriage certificate gets returned to you.  Hope that helps now.

Yes, that is correct. The mere $6.00 is the cost of the Consulate forwarding the ROM cert back to you. They will make sure it also gets back to Manila to be recorded at NSO.

So I guess you will decide what is best for you. However, I would personally get the pre-paid envelop so the documents could be returned using a FEDEX, or UPS to make tracking easy. Just go to any FEDEX or UPS store, buy the envelope, address it from the Consulate back to your home in Airzona, and pay for the fee right on the spot.

Yes you are okay, you will not incur any overstay if you depart prior to May 31.

Yeah, you do not start to incur unauthorized stay (overstay) until after the I-94 expires.  Between Sept 4 - Dec 02, was when you needed to get married to be within the 90 days required by the terms of the K-1.

If December 2, 2013 is the correct date of entry, then May 30, is 180 days. Do the ROM and exit as scheduled -- then you will be okay.

Yes will need a CEMAR to prove your marriage during the interview at USEM. However, if you stay beyond 180 days; you have an added  issue to deal with.

You can be the CFO before or after you get the visa. If you do it before -- you get a certificate and you must return to to get the actual stamp in the passport.

+1 A very slippery slope.
Some states also tag you as an sex offender if you are caught urinating in public. Some states require a child to be present, most don't. Now that is something that happens commonly in the Philippines. I hate to imagine the person who is barred from travelling because of this.

We all agree that the law's intent is good. The broadness of it catches a lot of other innocent people. Some view those are necessary casualties of war in the fight against sex offenders, others prefer to err on the side of caution.

Many folks hear/read the term 'sex offender' and think those in the database are all scum of the earth.  Having no idea that something like urinating in an alley or behind a building, someone seeing you in your own home naked, or an 18 year old in a relationship (sexual) with a 17 yr old will get one tagged as and required to register as a SO in some states for 15 years.

 

Seems rather excessive to punish folks and require one to be added to a SO database for such simple acts. Registered sex offender status and databases should be reserved for those that are sexual predators, child molesters, rapist, etc., rather than a wide net for things that have nothing to do with protecting women and children.

Finally! This is a welcome news to those who will undergo PDOS. My son woke up early and was in line at 5am, filed the application form, and was told to come back at 2pm for the seminar! How cruel that was! So the online application is a no brainer and should have been implemented months or years ago.

Does any one know what the embassy is going to want from my wife so that she can get her visa and her son visa approved.  His birth certificate does not list a father it is unknown and he has her last name.  He has never met his real father nor does he even know that I am not his biological father.  I am the only papa he has ever known.  with that said I have read few post in other section that seem to be based on the particular country as far as what is needed.  So what will the Philippines want from us?  I am filing both I-130s together.

Actually since the child is considered illegitimate in the Philippines -- the law gives the mother control of the child. You will need nothing from the father.

You must make a CRBA appointment -- you need that appointment confirmation printout.  You can't just walk-in to handle the CRBA.

Not necessarily Caryh.  Depending on the state/county and other details, one can start out in the hole with back child support.

 

With an original support order, from day one, I was $10,000 in arrears. Having never missed a payment once served, in 4 years of bi-weekly payroll garnishments that $10,000 grew to over $25,000 with state mandated annual 10% interest and $300.00 added each month that exceeded the state maximum amount for garnishments.

 

Not knowing the details here -- its hard to know why the $7300 was ordered.

Child support obligations are like any other debt in this process, it is not held against you.  Income is what matters, not debt.

My aunt was given a checklist of the documents she needed to bring. They said the amount of 400+ thousand pesos is the penalty for overstaying. He came in with a US passport. His birth is reported to the Philippine National Statistics Office and he was grant a recognition of being a Filipino. I just talked to my aunt and she said they are told my cousin could now apply for a Philippine Passport. The only problem now is the renewal of his US passport.

 

From your comments above, you said the US will not penalize him for overstaying. So I understand that he can renew is US passport without paying the 'penalty' they are imposing. I will tell her about this.

 

That 400+ thousand pesos is more than $9,000.00, that is very odd that USEM is assessing a fee for overstaying. Americans can not overstay outside of the U.S., the government couldn't careless if citizens didn't return stateside -- as long as they file and pay income taxes.

 

Have never heard of USEM assessing and collecting fees for overstaying on behalf of the Philippine government.

The U.S. government does not assess U.S. citizens any penalty for a passport renewal and the U.S. government does not assess/collect penalties for overstaying in a foreign country.

You don't have a "Case Complete' confirmation and there can still be delays.  Unless you've submitted AOS and IV documents, it's a bit early, one checklist would cause an unfortunate delay and a second checklist could really delay your case.

Your physical file is at the Embassy where your interview will take place. So contact U.S. Embassy Manila via email and explain you want to submit documents for your K-2's visa application.  With your case number, visa category, and name they can view your electronic case file and provide direction in this matter.

 

However, the way you want to attempt to simultaneously process a K-1 and a K-2 in different countries presents real challenges.

Are you doing a follow-to-join or will you actually fly to the Philippines to get your daughter so you both can travel to the U.S. together?

 

If you plan to travel with your daughter, then you won't need a marriage certificate. A follow-to-join means your daughter will travel to the U.S. later.

I remember sometime ago someone asked about number of immigrant visas that the MNL embassy processes. I just read a DOS report that says the MNL embassy issued over 34000 visas for 2013. That's roughly ~130/day (wow!). The number of applicants the see everyday would be higher since they only count issuances and I didn't account for holidays and closures.

FWIW, MNL is number 2 (or 3) on the list for 2013. Some embassy in Mexico issued over 60k visas.

 

That would be Ciudad Juarez, just across the river from El Paso. TX.

 

Consider the other types of visas processed, and 149,300 total visas makes MNL one busy place.

 

And folks wonder why AP takes so long.  Best to slow down and get it right the first time.
