obviously having a child together is a proof of relationship (you wouldn't have a kid with someone you're faking to be with, right?) but it's not all of it! We all have our personal histories, but if your relationship is genuine you always have other proof that shows it, either financially (joint ownership and responsibilities) and personal (Trips together, pictures, testimonies, etc...).
If having a child was the only valid proof, then how infertile couples would adjust their status? how would students that barely can make both ends meet?

we all have different story and circumstances so don't worry too much, as long as you are truthful there is no problem :)

It's been a while since we filed any official paperwork so I just have a few questions (maybe they are stupid) but I just want to make sure this goes over smoothly.

Do we fill out all the forms in CAPITALS or just normal?
Can I staple things together? Like for example there is a few electricity billy, or copies of tax transcripts that go together, or other paperwork that makes only sense if you see it together and to make sure it doesn't get separated.
Should I staple the I-751 together?

Question 10 on the form: Is your spouse currently serving... outside the US.
If he was deployed, would we mark YES? What if he is deploying AFTER we file the form?

We are moving some time next year. Would it be wise to put his parents' address as the mailing address in Part 1, under our home address?
Our home address is in GA, his parents' address is in WI. But we still have to file at the Vermond SC. Correct?

After we move, I can change our address online/with the corresponding form and it will reflect in their system and there will be likely no problems? Please say yes.

I'd be very grateful if you guys could take the time to ease my mind.

i only know that you should not staple anything together because they process it in a machine so they can refuse your file if you staple. You can use post it tabs to separate documents. I would not file under an address that's not where you live, because it would be inconsistent with the proof you guys will show regarding living together.
for the other questions, i'm not in the situation so i don't know. i would call USCIS and ask them. i know i read that sometimes they don't update addresses, but you can counter that by having a forwarding system in place with your post office and by calling the USCIS center every month or so ;)

if he travels within the validity of his green card, it's fine! we are just back from a vacation in Mexico, and i had no problem going back to the US, though the officer pointed out that my card would expire soon. i simply replied that i knew and that i had sent my application just before leaving for this trip. He had nothing to add and let me go.

Thanks for that clarification. Although, I'd just like to say that this new documentation is, in fact, "real", as our marriage is bona fide. We should have prepared these documents long ago, but were lax. It may not be satisfactory for USCIS, but it is real.

I honestly think that power of attorneys and wills are something that you should send, even if they're recent, simply because one wouldn't give power of attorney to another being unless there's trust between them. Same goes for the will. These are officially notarized documents so they have to have a certain weight in the file. In your situation i would send them with an explanation letter. Should any flag be raised, you can always convince them during the interview!
Not all couples are the same, I'm sure that a ton of US-US couples don't mingle their finances at all... that's really too bad that we have to fit a certain profile to get them to believe our love stories are real... Posted Image

Is your understanding that the I 551 is only for travel or to cover work authorization as well as travel and ability to stay?


my understanding is that the stamp and/or letter and/or green card confirms that you are a legal resident of the united states. when you travel abroad you will be required to prove that you are lawful resident upon entry on the US ( however, when i went to Mexico, i was required to provide the info before departing and upon re-entry) so regardless, when you go to a foreign country, you still need to check if your nationality requires to get a visa to go that particular country. for example, I'm French so i don't need a tourist visa to go to Brazil but my Husband does ( because he's a US citizen)

edit: Sorry i realize that i didn't answer your question: yes stamp/ extension letter covers work authorization and travel, but only on the US side if you will (and ability to stay of course since that's the purpose of the whole thing)

the only thing i know for sure is that the stamp or the letter or GC is used to reenter the USA. so if your nationality requires a visa to go to a country, you should get it regardless.

as for DMVm, i don't know but i would go in person to renew. this is such special case that i wouldn't trust doing it on the internet.

just real quick about the name on the deed, we were able to add my name to the deed even though I'm not on the mortgage, so you should be able to add your name as well (do it now if you can, not just before filling, which would look suspicious). This proves that you live in/ share ownership of the same place so I think it's pretty important. IMHO it has more value than showing bills in the same address (anyone can have their bills send to any address right?)

I see that peeps here told you not to, but I'm just sharing my experience. My husband had bought the house before we even met and all the bills are in his name (which we never changed), the only things I pay for is the pest control guy (i'm arachnophobic) and the cleaning lady. We had other assets in common though(car titles and insurance, join bank accounts, CC, etc...) I even put vet bills for our 3 cats.
I think I totally over killed it ,putting in the file any and all things we had in common. Try to get your name on the deed! :)

I think it's great that you are already looking into all this in advance, so can start saving the docs you will need! just for that, Thumbs up!

I'm almost ready to send so, affidavit or not. I have a lot of evidence for "human feeling" already (travel itineraries, photos, cards from friends and family to us....) to go with the "serious stuff" (house, car, cc, insurance, etc...) . Just a couple more days of printing and sorting all the documents, and we are good to go (since i already asked for them, if affidavits arrive in between, it won't hurt to add it to the file Posted Image)

Hopefully i can send on Friday so i'll be an April filer like in 2010! Posted Image

Also, RE: passport photos. I understood from the instructions that they're only needed in case you can't do biometrics b/c you're working for the gov't abroad (e.g. military) or something like that.

my window opened yesterday and that's also the day that the tax transcripts arrived. I'm now waiting for a letter from my employer explaining that my husband is my beneficiary for life insurance, that i was on his health plan until i was hired (then i got my own because it is cheaper to have both individual one than to be both on his) and that my function requires to be "on call" all the time so that they provide me with a cell phone (that why we don't have a family phone plan.
i spent 3 hours yesterday sorting through 2 years of mail (YAY! good that a least it was all in the same spot) so i found all the rest of the evidence we needed.
I just have a couple of questions:
- i read about 2 passport picture to send along with the file, but i read your lists here, and i don't see you guys send the pictures. Is this because they will take my picture during bio-metric appointment (and therefore no need for pics or print cards?) or should i put them in my packet anyway?
- Affidavits: i don't know what to do about this. In one hand, i don't want to bother friends and family, but on the other hand it would give some "human feeling" to the file, as opposed to just financial stuff. What do you think i should do? ( we have tons of proof of co miggling ressource and shared financial assets, and of course pictures, travel, etc affidavits would just be the cherry on top)

First of all don't be scared and don't let people scare you who say that you will get deported.

File your own taxes for 2009 as "Married Filling Separately". That way you don't owe any taxes and you filed your taxes on time as required.

For the previous years your husband should file (obviously when he is ready) "Married Filling separately" too. That way you will not be liable for his taxes. Because you didn't work in these years, you do not need to file taxes.

If you do, however, file "Joint" for the previous years with your husband, you will be liable for all his tax debt + it will look like you BOTH were irresponsible for filing taxes.

File your own taxes under "Married Filing Separately", gather ALL OTHER INFORMATION and don't even show the tax returns unless they ask for it. If they do ask for it, show your own tax return and explain that your husband's tax situation is complicated so you didn't file together. That's it.

Taxes are very complicated and you should not jeopardize yourself by filing Joint with your irresponsible husband.

If that helps, my mother got divorced after six months of marriage, her husband left the country, so she still went for her interview with her divorce papers and got the conditions removed, when all people told her she will get deported.

Let me try to explain this like I would explain this to a 6-year-old.

Even if she files her taxes for 2009, she (a) has NO RETURN for 2008 (or 2007, for that matter), and (b), she ownes the taxes for said years, as neither she nor her husband have filed.

Step down to a 5-year-old.

Somebody who owes the IRS taxes for two years, and somebody who cannot provide the requested tax returns, will not get a 10-year Green Card, nor will she be able to become a naturalized USC until this issue is resolved.

I rest my case, as I can't find out how to explain this to a 4-year-old.



She wouldn't need her return for 2007 or 2008 because she wasn't working. Her husband will have to file married filing separately for those years too and that will keep her away from his liability.

No need to insult here.

I hope you understand that when I said "bad resident" that I didn't mean that personally in any way.

The thing is this . . . the tax people and the immigration people have separate agendas.

As a married woman, you and your husband are a team. Each of you counts for 50% of this team. You can be a neat freak, if he's messy and they look at your house, it doesn't look as clean. If you are thrifty and he's wasteful, your balance sheet doesn't look as favorable anymore.
So if you pay your taxes, but he doesn't, you are 50% of a married couple that owes money to the IRS (assuming he even owes money).
That's the tax part.

Now to the immigration part. When applying for ROC, filing jointly, the I.O. wants to see proof that you guys are still a happily married couple, living together. Cornerstones of this are (highly preferable) jointly filed tax returns (unless tax reasons suggest separate filing), a joint residence, and the intermingling of finances in regard to banking and paying bills.

If you do not file taxes jointly, I'm very confident that your personal tax returns, even if filed as married, are not enough. IMHO it's very likely that they do want to see both of your tax returns, for reasons I already outlined in one of my earlier responses. For a moment try think like a drone. Why would a couple that is happily married and living together not file taxes jointly? Why would the wife not be able to provide the husband's tax returns? These are legitimate questions, and although you have a plausible answer to them, when it comes to evaluate your martial status, they may become obstacles on the way to your petition's approval.

Therefore I, and others, suggested that you work as vehemently as possible on beating some sense into your obviously stubborn husband's head. You may be able to circumvent the issue at ROC, although I doubt it, but in the long run you're hanging from the rope next to him. So instead of trying to patch the effect of the issue, try to go to the root and destroy it.

The first step may indeed be to get your hubby's pay stubs and payment information, put it all on the kitchen table, and sort out where he stands, tax wise. Saturday would be a great day to do that.


That's the problem that the husband does not want to file taxes. I just assume that it would be really hard for her to gather all the income forms for his income. That's why I think filing married filing separately would be better. Unless somehow she can make her husband change his mind.

Tax issues and immigration are different things. As I said before, lots of "loving" couples file their taxes separately. Filing separately has nothing to do with love or the marriage. It's about math and what makes sense tax-wise.

Now if they REQUIRE to see his tax returns (for immigration purposes i.e. sponsorship) that would be an issue. If it would be just for a proof of your marriage, I don't see how could they blame you/or assume your marriage isn't legit just because of his failure to file tax returns?

If she gathers plenty of other evidence, I don't see how tax filing status would be an issue?

Like my husband has all kinds of corporations, income from investmens and other sources, I will be filing separately to keep myself out of his complicated tax pot. It doesn't mean I don't love him, does it?

If you want to file taxes and your husband doesn't, you should just file "Married Filling Separately". Then you get the same deductions as filing "Single" and you will not be liable for your husband's taxes. That way you will show that you are a responsible resident filing and paying your taxes. Lot's of people do that and it isn't uncommon. Sometimes one spouse earns more than the other, maybe one spouse owes lot of taxes and the other one doesn't and so on. Lots of reasons and lots of people doing it.

You would be liable for his penalties and owed tax only if you filled "Joint" tax returns. So I wouldn't suggest doing that.

File your own taxes and try getting some other evidence as joint bank account, credit card, life insurance, car ownership with both names and etc.

Don't report him - that really wouldn't show that you are a loving married couple.

He should file his taxes, maybe he wouldn't even owe anything. But his reason for not doing so are only known to him.

I am a Canadian citizen. I am a permanent resident of the US (currently have my US 10 year green card, which I obtained after marrying my husband who is a US citizen). I was wondering if any of you know if it is possible for him to get Canadian citizenship while we are living in the US? We are thinking we might move back to Canada in the future and it would be so much easier if he could work right away etc...

A little difficult to follow what you are asking but I'll stake a stab at it.

You are petitioning to bring your fiancee here but not her child, right? Your intent is to have the child visit or move here in the future when he is older if he wishes? Did you include the child's name on the original I-129F petition? I am unsure if you need to include the child's name on the form DS156K if you are not going to utilize the K-2. And I don't believe you will need the child's birth certificate at the interview if you don't intend for him to accompany or follow within the one year period allowed on the K-2. But here's the clincher: The child WILL need a birth certificate to get a passport/visa to come here at a later time. In a number of years (5, I think) your spouse will be able to petition for her son to come here and live (much like you did for your fiancee), but the chances of him getting a tourist visa to come here for a visit are slim or none. The US embassy in the Philippines has a thing against granting tourist visas to USA unless there is solid evidence that they will return. ie: prestigious position, large business owner, rich, etc. One reason why filipinos make up the second lowest number of illegal immigrants in USA. If I was in your shoes, I would take along the child's birth certificate and copy just in case the consulate wants to see them. He will ask if the child will accompany or follow and your fiancee will want to say she will petition for him in the future. He is a child. He belongs with his mother (and new dad). I don't understand why your fiancee does not bring him here when she comes. But that was not a subject of your questions.

hi trey and Yodrak! thanks for giving sound advice with regards to our case. it was pretty much the advice i was looking for. i guess there was confusion in my identity... im going to be the stepmom...hehe im a girl. i agree the child belongs with the mother that is why my future husband and i decided to give his son enough time to be with his mom. the situation at hand with the ex g/f is kinda messy so biving it a year to settle custody even if it is a shared one would take quite a while. His son knows though and we have promised him that by 16 we will fix his visa and he will have privilages to come to the united states...even as a tourist or v or I-130 visa. =) we've never broken our promises to the kid.... and we do plan to come and visit him and spend time with him.

just to be safe, i think we will just take the original b/c as well as copies of it to the interview should the NSO not be able to provide us with a certified copy. i remember reading that they can return important documents to you if you need it back and make sure to bring photocopies... so thats just what we are going to do.

HI guys maybe someone can help me here. ive only gotten one answer and would like a consensus if that is not too much to ask...

The USE or DS156K asks for names of the children of the beneficiary. followed by the question accompanying and another to follow...


situation is, we plan for the child to follow or visit us as he wishes. we think that in the future when he is 13-16, he can make a better decision as to whether he wants to follow here in the states or come in for visits. I know within a year of my Fiance's approval the child gets derivatory status but we are not going to take advantage of that. so should we still check yes to answer the to follow question?

Second question, since this is not a K2 visa application as well, do we still need to bring the birth certificate of his son to the interview? we have filed a request with the NSO to provide us with Certified birth certificates but after a month of waiting, they come back to us with a negative response saying that they ahve searched their database as well as the physical archives yet found no record of the certificate itself. I find this so weird for them not to have it...

im worried how this will affect our interview. Good News (i think) we have the original birth certificate but i dont think it would be wise to submit the one and only copy of his child's birth certificate. Im thinking to bring the original b/c with us and make a photocopy, show the consulate the original but submit the photocopy instead... Bad news, my fiance's (the birth father) name was not included in the B/C as decided upon by his ex. Good news, we have a public document (notarized and signed by both my fiance and his ex) stating that he is the father of the child. I dont know, this is a whole mess right now. Help

hello! there are two fees that you have to pay at the CFO.
1. When you attend the seminar (part 1) you need to pay 250Php
2. to get the certificate plus the sticker when you get your visa. itll be Php400

For delbros, i think it depends where you send it. some go up to 1400 Php but i think that was because the delivery was kinda far.

id say send $50-100 but id go for 100 if your budget permits. better safe than sorry.

yep no difference on the medical whatsoever.... except having to lay down on the table and getting examined by the obgyn. :) i cant speak about the interview since we havent had it yet. paperwork wise it's all the same... ill be with my fiance on HIS interview on monday November 13. will keep you guys updated in the manila embasy forum.

titakey , CERRITOS! i think thats the closest pinoy are in OC. maybe im wrong but they have everything there. Chowking, pinoypinay restaurant, dj bibingkahan, goldilocks, red ribbon. there is also this karaoke place where they have comedians hosting and nang-ookray (making fun) of themselves and the performers. i cant remember the name of the club but it's hella funny. they also serve pinoy food there. Let me know if youre interested in going to that place. ill try to ask my friend where exactly it is. give you the address and stuff.

also if it means anything, we go to church here in irvine, along alton and culver. Its called st John Neuman (i hope i spelled it right) anyways, just to let you know, there isnt any mass said in filipino but there are alot of filipinos who go there for mass. especially at the 12PM mass...

my housband boy-toy felt that way too but he had too many hobbies to keep him busy. and i would make it a point to come home for lunch to keep him company.... and i kept reminding him to just try to appreciate downtime because when he starts to work full time, he's going to be wanting downtime... three months into his job, he already wants to go on a vacation... hahahahha

another tip: there's always TFC and GMA 7. i think comcast, dish network and cox have filipino channels they can offer you... depends where you live. if not, you can always go search for abs-cbn now and i think you can subscribe this for the PC so you can watch home grown tv shows. Another discovery of ours is this rental site for tagalog movies... let me know if youre interested. just PM me. :D

rechargeable phone cards cost about 13-17 cents a minute calling to the philippines. its pretty easy everytime you run out of minutes you just call them to recharge. sometimes they give you bonus minutes

hello guys... this may be a stupid question but please bear with me. i got my NOA2 in the mail today july 28 but it was approved july 24. i wish i came across this thread earlier. so here goes, it states in the letter to call NVC from 8am - 645 pm eastern time but doesnt say if it is only m-f. does that mean that they are open on weekends as well. after reading your posts i got excited. hihih...

Guys i finally got thru about an hour and a half ago. i was on hold for like forever though. they said they recieved my case today and assigned me a case number. the lady also said that it should be sent out within the next 2-4 weeks... she said to call in two weeks... hmmm im trying to control myself not to call in the next couple of days until someone posts that their paperwork has been sent out to their so's embassies... worst case scenario im calling this friday...
