2. Make the check or money order payable to U.S. Department of Homeland Security, unless:
C. If you live outside the United States, Guam, or the U.S. Virgin Islands, contact the nearest U.S. consulate or embassy for instructions on the method of payment.

I hope vsc will get to our file a bit quicker....I'm a bit confused also on how the dates can go backwards. Anyone have any ideas. Is the timeline dates a true reflection on what the service centres are looking at at present.

QUOTE (dcrespo314 @ May 21 2009, 06:58 PM) <{POST_SNAPBACK}>
Whats up people, this is for those of us who files in Feb 2009 in the Vermont section. In the month of Janurary 2009 there were roughly 99 petitions sent to Vermont (this is not the total number, just of the people that have registered there time line on this site) and out of those 99, 69 have been sent there NOA2, that's about 70%, the number might be even greater if you include the people that have not updated there time lines. In the month of Feb there were 98 petition sent, so hopefully in the next few weeks we should start seeing those petitions approved.. Just though i pass along the good news, i have to much time on my hands right now and decided to do the research haha kicking.gif

hi,

just saw your post. i am one of those feb filers, i hope to see our NAO2 coming along in the post soon. i just notices that we prettymuch have the same timeline. hope your journey goes quick and best of luck to you and financee

good.gif i agree, have one on hand to send in asap in case they RFE, chances are they probably will, since the form will appear incomplete to the uscis officer

K-1 Fiance(e) Visa Process & ProceduresK1 Issued. Can fiancee still visit on Tourist Visa?
As far as I am aware, if she has been approved and has the visa in her passport and enters US, she has to get married within 90 days of entry. She cannot leave once she has entered, the visa will become null and void and more than likely you will have to start the process again. It is a one time entry visa only.

Congrats as well on your NOA2...yeah it does look like we are neck-in-neck. I actually don't even know what a touch is, or how to see if i have one. Sorry I am answering you with a question...lol...but are you guys gathering things for the papers before they get to Peru? Or are you waiting? Also, when are we supposed to turn in the sponsor paper (and proof of being employeed, bank statements, etc). Good Luck!

Anna

A touch is regisered on the USCIS website. You need to be loged in to the website (they ask you for case number, and you create a username and a password- that way you can see if they are even reading your case at the moment- or doing almost anything).
After NOA2 you should be gathering papers right away- like the proof of relationship, police certificates etc. You will need them for the interview. You don't send them.
After NOA2 your case will be forwarded to the embassy in your counry and the embassy sends you a packet (3). The instructions will tell you what to do.
You don't send the affidavit of support or the documents supporting it, but take it to the interview. Just read the instructions carefully!
Right now it's tme to gather documents like; birth certificate, police certificate, evidence of relationship, affidavit of support, and get ready for the interview!
Good luck good.gif

I assume its because its being forwarded to the NVC

I have received a touch after the consulate in Dublin has sent me the packet 3 and after I have sent back the packet 3. Now I'm waiting for the last packet (4) with the interview date, and had a touch last week. First I started to worry! Then someone on the forum has said that if there was anything wrong they would notify you (e-mail).
Everything is ok. They register a touch even if they move your files from one cabinet to another!
Good luck.

PS I noticed that after a while of dealing with USCIS we all freak out!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

K-1 Fiance(e) Visa Process & ProceduresQuestion...has anyone been through an K-1 interview that had a violation of status under a previous visa stamped D/S (Duration of Status)???
[I am answering:
I lived with my au pair programme family in NY for 3 mnths, switched families and lived in Chicago for 2 months, then my situation got very bad(I was being abused by the family) and left on my own. Friends from Poland helped me out. I lived with them for 6 months then met my fiance, we moved in together for a year. Then some problems came up at home so I went back to Poland. I am living in Ireland now. We filed for fiance visa, got approved and March 3rd I have my interview.
The attorney is saying that I'll be ok, since D/S was stamped in my passport and there is no anlawful presence since neither IJ or adjdicator has found of the violation. Thats the story (short version).
Just wanted to find out if anyone here has experienced and interview with similar past.
I appreciate any info!

No, there was no finding of violation and left usa on own accord.

My understanding of Duration os Status is that a violation must be found by an adjudicator or an immigration judge.

Yes, this is the case law on D/S. Had you been through such an interview for a K-1? Do you know someone who has??

Did you work outside the realm of the Au Pair programme?

No, not at all.

Hmm. Then did you remain in the USA, after you concluded your Au Pair owrk? If you depart the US before a determination is made, then there is no period of unlawful status.

Yes, left the aupair early and stayed beyond a year. No determination or appearance before an immigration judge or adjudicator. We have researched all this and have supporting opinion from our atty. We are interested in the "real world" interview Q&A from the interview. Can you help???

Ok, so I understand the basics of why you need to get a medical exam at the embassy as part of the visa approval. What I don't understand is why the Beneficiary needs to sometimes undergo such tests as ECG, breast exam, ect.....Very strange. What is the reason behind such tests, since I thought the exam was to check for infectious diseases that could be transmitted to others, such as TB, ect... blink.gif

I don't know why, but some of the things they did to me were WEIRD and the nurse has told me that she doesn;t know why she's suppose to do that but thats what they require. They have even checked if I am really a Girl!!!!!!!!!!!!!!!!!!!!! It was embarrasing, but we do IT ALL for love!

QUOTE (reeses16 @ Mar 9 2008, 06:21 PM) <{POST_SNAPBACK}>
Hi! It seems like you just want her to come visit you as freely as you can visit her. Do you want her to visit you or live with you in the US? If you just want her to visit I don't think you should file for a K1. IF you file a K1 she can only enter the us once time, thats it. You have to marry within 90 days of her entering the US. And she can not leave the US until she has an approved travel document or her green card. At best it will take about 3 months to get her travel documents or green card after you've filed for them. At worst it could take up to a year or more.

I think a tourist visa might be a better fit.

I agree. She can apply for a tourist visa, and if you want to get married file for K1. During the time that it takes for the USCIS to approve the petition and for her to get the K1 visa she will be able to visit you in the US.
You dont at all need help from a law firm to get her a tourist visa. She just needs to be able to prove ties to her home country (business, children, maybe she owns a house there). My parents have gotten their tourist (10 year) visas to come and visit me while I was living in the US, and they have done it without the help of an attorney. Many people do that.
I would't hire a law firm because you can do all that paperwork alone with the help of visajourney. They are just going to rob you of your money, and on top of that you will not see them do anythig. Good luck!

It is different for different consulates, but usually it takes about 7 months since sending the petition, about 2-3 months from approval. Look at the vsa journey "timelines". Check people that applied in Mexico.

We went through K1 visa process in 2007. My then fiance tried to come every 4 months...That was hard. On the last visit- we went to the interview together at the Dublin Embassy and celebrated the Visa. That is when we conceived our beautiful son (who just turned 2 in November!).
my thoughts to you are- hang in there, enjoy your friends and family because- chances are that when you are here (USA) already- you will miss them all!!!!!!!!!!!
Please email me if you want to "talk". I have been there and wish I enjoyed my friends more back then...

I came to the US in 2008 on a K1. We got married on day 87... My parents were NOT there with me... And you know what? It doesn't matter because to be honest... A wedding is really not that big of a deal. There are other situations in life you will need your father more... Think about it. When you have children for example? Maybe now is the time to think about- how do I get my father to be able to come and visit in the future?
Good luck to you!

hello!!

I'm living in Ireland with my USC fiance. He has dual citizenship with Ireland and US.

We're filing for a K-1 fiancee visa and we don't know where to send the form. To the embassy in Ireland or to the embassy where we plan to live in US, which is Phoenix..

Thanks for the help! And also, does anyone know if someone from Ireland can file an affidavit of support for us or must the person filing be in US? we won't be filing for ourselves as we both plan to leave for US at the same time

DCF sounds good so. The only thing that I'm worried about is proof of bonafide marriage because we don't own any houses together or joint bank acc's etc, and we won't have any of these either because we'll hopefully be moving to the US as soon as possible. It does sound like a great option though, I just hope we qualify for it.

K-1 Fiance(e) Visa Process & ProceduresLiving in Ireland
Hi guys.

I am engaged to a US citizen and we were finding it hard to find a sponsor for the affidavit of support. We needed one because my US citizen fiance is living in Ireland and we plan to move to US together, so he couldn't sign for me.

Now I'm wondering if the person who agreed to sponsor us needs to file the affidavit for both of us or just me?

Also, would there be any complications about applying for K-1 visa seeing as my fiance is living with me in Ireland and not in US? can he still file to bring me over with him?

Thanks for the help!!

Hi! I'm from Ireland too and applying for K-1 visa. It says you need two to five of everything on the list. We have loads of photos and a few plane ticket stubs (we live together in Ireland although he is a US citizen so we don't have much in the way of emails and flights and stuff)

We have receipts of holidays we went on etc. We have our engagement ring receipt. Loads of photos will help, and if you have a real relationship you shouldnt worry too much. If you're going to be having a baby you need to file for a K-2 visa i think. it's different. The fee is 455 dollars for K-1 but not sure about K-2. It's not too bad. Her parents signing the affisdavit of support for you is totally fine as long as they tick the box saying they will FULLY support you as i presume you don't have a job yet?
