YOu can do all that but really as long as you have a return ticket and a home address to return to and copy of your 129 receipt you should be fine. They may not ask for 129 as they would,d not know so don't panic on that and you have to state where you are staying anyways on I-94w so that will have your fiancee's number and address on it. I visited my fiance also when we had 129 processing and I never had to show anything, was asked am I staying with -------- my now husband and I said yes and as I had been before they took 1 fingerprint and said welcome back Barbara have a nice holiday. I too was here for 87 days. You should be fine but you can bring the letter if you want from fiancee but hey anyone could write that, not really proof hey.

When my husband would visit me on the VWP before we ever got married, he would bring like his lease agreement from his apartment and some bills to show he is currently living there. Do you have a job? If show you could prove you are working, have a place, and dont plan on giving that all up at all until your fiance visa is approved.




Job finished back in June. Living at home.

I do have quite a bit of savings in the bank though! Maybe a bank statement would help!?!

So, I am visiting my American Fiancee in America (obviously :bonk: ), in 3 weeks. Visiting on the Visa Waiver program.

I have read LOADS of pages about bringing 'strong ties', problem is I don't have 'strong ties'.

After thinking about it, I have decided to bring:

1. The Copy of the I-129F which is now in the hands of the good people at USCIS :thumbs:
2. A letter from an instructor saying that I am registered for a course here, in Ireland, in December.
3. A letter from my Fiancee... (L)

Here's the thing, I don't know what she should put in the letter.

We were thinking:

To whom it may concern,

My name is ABC. I reside at DEF, 123, GHI, ... USA. My passport number is ###########. My social security number is #@#@#@#@.

Figure we will just continue as we are then, seems like the best bet even though it likely won't be done by November, we'll just have a unofficial ceremony type thing with family and then I'll go home and wait for it to complete.

Am I right in thinking that another viable option would be to cancel the K-1, marry properly in November on the VWP, but then go home again and apply for a K-3?



Ya, it's mad, isn't it!
I have a friend who went to the states on holiday, met a girl got married and stayed. Now has a green card! How is this possible... BECAUSE it wasn't his intent to marry! His intent was a holiday and he just so happened to fall in love and get hitched.

Since you are on their computers, your fiancee is on their, they have already started background checking her, they KNOW your intentions are to EVENTUALLY marry this person..... I'd be almost certain that you wouldn't get away with it.

As for the K-3... it takes as long as OR Longer than the K-1. Even when you get it you still have to go through all the Adjustment of Status. Nobody goes that route anymore due to the waiting times and hassle once approved. Most married people go for the IR-1/CR-1.

I would advise you to stick with the K-1. You applied in May, ya? Hopefully you will be approved soon. DON'T cancel it now.
The IR-1/CR-1 take 8-10 months. The last few months would have been for nothing!

Stick with the K-1. :thumbs:

I could be wrong but this is straight from the instructions " 4. Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it. " I believe that date will need to be earlier than the file date. Jim.

As far as I know, it means that; the Petitioner previously applied for a K-1, it didnt work out (break-up, change of heart, etc.) So, they need a waiver to apply for a second K-1

To work your fiance(e) will need to get an Employment Authorization Document. While a K-1 holder can technically obtain an EAD prior to getting married, the practical wait involved makes this option unfeasible (the validity of the EAD will expire before it can even be processed in most cases). Practically, a K-1 holder will need to wait until they file for Adjustment of Status (after getting married) and will co-file for an EAD (which should arrive on average within 90 days from the filing date. As a note, in order to be employed, it is required to have a Social Security Number which can be obtained by a K-1 holder after they arrive in the US (you should wait 10 days after entry to the US and no later than 10 days prior to the K-1 expiration date to go to the Social Security Office in your area to file for this; if you miss this time frame you must wait until after you are married and file for Adjustment of Status).

We are now both living in Japan.

The current plan is for me to return to the US in April to start working, and then get married in November of 2012. November of 2012 (or slightly before) would be when he would arrive in the US.

I don't know where to start in the visa process.

As Japan is a visa-waiver country for tourists, is there some problem in him coming over with the visa-waiver, getting married, and then changing his status?

Or, would it be wiser to get legally married in Japan and apply for a K3 visa?

Or is doing the K1 visa the smartest way to go?

It can be very overwhelming starting off! I know how you feel.

Ok, so you are in Japan, and you will leave in April.
You are engaged.
He's coming to you in November.

K-1 visa is your best option, in my opinion.

You can gather all the required info. and send it to USCIS from Japan. No issue there.

If you get it sent off, let's say, September at some stage, you will MOST LIKELY be approved by April.

You will go to the states in April, your fiance will do his medical and interview in Japan.

Once his interview is done and he is approved, he then has 6 months to enter the USA. THEN, you guys have 90 days to get married.

Wow...nothing is more beautiful than the site of my fiance's visa inside of his passport. 7 months after applying for our k1 visa, my fiance has his visa in his hand tonight, and is coming home tomorrow!! Thank you, God!! We have known each other for 11 years, and have been together for 7 years....so this day is really special for us. It is the end of our long distance relationship, and the start of our forever. Thank you to everyone on VJ who has helped us along the way. To all of those who are still waiting, hang in there. This day will come for you too. I remember reading posts like this one when we were waiting for our NOA2, and just couldn't picture ever posting this myself...yet here it is! It has been a long journey, and much has happened in the lives of my fiance and I outside of the visa process that has made being apart all the more difficult. We stayed strong though, because we knew that the day would come when being apart would no longer be a problem. I am here in Ireland with him (I came to attend the interview with him) and tomorrow morning, we will make our way home. No more goodbyes, no more counting the days until we see one another again. Holy smoke, I know I just filed our K1 pkg, however I was checking out the next steps in the process and the 2nd NOA, acknowledging K1 petition approved, the processing time for this step is 5 months alone? It seemed to not matter whichever service center, except Nebraska, (not sure what their times meant)...., but I've talked to people who were bringing their Filipina finace here and I know one guy said the whole process was 4 months...there were some 5 month folks...seemed 6 was sorta common..?

I mean it is what it is, but didn't think just that one step was 5 months. Too bad living near DC doesn't help or I'd just drive the 50 mins downtown and take care of it, if I could, lol.




When you get your NOA1, fill in that date in your 'timeline' and it will produce an estimated date on which you MAY be approved.

It depends on what YOUR embassy wants to see. I've seen people list the DS-160 as being required, bujt for us it was the DS-156, DS-156K, DS-157, DS-230, and the I-134. The embassy where the beneficiary has their interview will send that in packet 3. Some talk about packet 4 after submitting packet 3 to the embassy. We did not have to do that as the interview date was send along with packet 3. At this stage of the process it is VERY specific to the embassy and only those that had inteviews at the same embassy can offer accurate and correct information.

Yer, I am pretty much in the same situation as you. My POE would be Chicago, that place always makes me nervous anyway, ha, ha.

I don't think I would volunteer the visa stuff, but if questioned I would be honest. I would take a copy of return ticket too, and proof that my son is still here, and the visa stuff just in case. I think what I am learning is that there are no official yes or no answers, it's down to me and my fiance' whether we take the risk.

I am here for your help please.

I have seen this topic posted quite a few times, so I am going to read as much as I can, but obviously there are some issues that are unique to me concerning traveling to see my fiance' while in the K1 visa process.

Okay, we are 3 months in and awaiting for the NOA2. I am thinking about going to stay with my fiance' on a visitors visa for up to 3 months.

I know it's important to prove that you have ties to coming back to your own country in case border control get heavy. My issues are that I am working for a temping agency and would leave without a job to come back to. :no:

I am living in shared accommodation, so I would give up my tenancy here and plan to stay with a friend on my return while I complete the process. :no:

My 16 year old son would still be in the U.K - I will be applying a K2 visa for him as well as my K1. :yes:

Do I just travel as I have every time before and not mention the visa stuff?

I would really like your views, experience or knowledge in going through with visiting him.

Snail Mails
Photos of the 2 of you together
Phone records
Etc
Financial information
Last 2 years tax returns with W-2's
Recent paycheck stubs
Letter from employer
I-134

The beneficiary needs to start collecting:
Birth certificate
Divorce decrees (if applicable)
Single certificate
Vaccination records
Police report
Passport (with at least 1 year of validity left from date of interview)

Updated letters of intent to marry


Use this time wisely to gather what's needed next. Check it and check it again to make sure you have everything necessary
