This is really suck! I just got off the phone with NVC. They have not forwarded to the consulate yet. I don't know what is the hold up? The notice they sent me stated within 1 week.

Sometimes they take a little more than one week to foward the papers to the Consulate.... But keep calling and e-mailing! You shall hear something about it soon!

Is there way to check the status of my petition on the NVC website? I know the petition's at the NVC, I called on May 19th and got the case number. Do they have a status update web page like the the service centers have? Or is it all by telephone?


No... Since K-1 visas have a short stop at NVC, it doesn't enter in the automated system and you can't check the status in their web page!

The only way to get information is by e-mailing them or calling! I emailed them last Tuesday and they answered me today, saying my petition was already sent to Rio de Janeiro!

I understood perfectly. What many people don't understand is what constitutes a simple case and what small detail can cause major problems. VJ is lettered with tales of woe from people who found out once they were into it that their case was not so simple as they first thought it was.

So I repeat - a consultation upfront is always a worthwhile investment.

I agree that visajourney has a lot of tales... But it's not the case here and it doesn't mean people can't use the common sense! The conditions are perfectly clear and only the person can analyze if a lawyer is or is not necessary! In general, it's not! Or else 75% of the people here would hire a lawyer too! So, keep thinking carefully! A lawyer can be a good investiment, or just a waste of money...

Hmmm.. I guess John and Marlene and Yodrak didn't understand what the others said!

I didn't see anybody here saying that a lawyer is not necessary in ALL situations, but they specified the conditions for this and I completely agree with them!

If you have a simple case and are able to read the guides, FAQ's in this site, you can do it by yourself! But if the foreign fiance had overstayed a visa in the USA, have criminal background, serious diseases or anything that could make the visa to be denied, so look for a lawyer to get advice! Use your common sense! It's just not necessary to get a lawyer that will only fill out forms for you, since you have a little patience to do it!

And another thing... If choose to hire a lawyer, be VERY CAREFUL and check if this professional is really used to deal with these immigration visas... I have a friend that hired one about two months ago, and the "professional" sent the papers to the wrong place.... (it should be sent to Texas and she sent to Michigan... such a gross mistake!)

So, that's it... Think carefully about this and take your own conclusions!

Yeah... As far as I'm concerned, it's really very hard to get a tourist visa to USA... I know our countries are diferent, but I've heard about a lot of denial cases in Philipines as well as in Brazil... That's why I didn't want to spend time trying... We just decided for the K-1 and it was really the best option!

We didn't get a RFE, but they sent our petition back because my fiance forgot sending his G325A form and because they needed us to translate my divorce paper! They took more than 2 months to tell us what was wrong! That sucked... :crying:
There are some "details" in our package that I don't know if my babe did in the right way! So, I'm praying for us not to receive an actual RFE this time! :(

I think if she overstayed for less then 180 Days, she we not need a waiver and she is not subject to a bar.

The Bar goes like this.

If you over stay your visa for more then 180days and less then 1 year, you are bared for 3 years.

If you over stay for more then 1 year then you are barred for 10 years

In both cases you will have file a waiver, which is the I-601 to lift that bar.

If you are talking only a few days. Let her be honest and I don't think she will need a waiver.

She will have to go through the visa process and at the interview she can file the Waiver. How long was her overstay and how long ago. If it was under a year then there is a 3 year ban. If she has the 3 year ban they may not even ask for a waiver. Depends on the embassy. timing all depends on where she is filling from. Some waivers can take 3 months and some can take a year.

Hummm... I think she overstayed the visa only for some days! When she received the letter with the expired date and found out she was illegal, she came back to Brazil almost immediatelly!

This person was misinformed. You can not file for a waiver until you are denied at the embassy level durring your interview. They determine if you need to file a waiver and will instruct you on what you are being denied for and what you need to do.

You can research and ask around (immigrate2us.net is another good site) and make your own determination if you think you will need a waiver. You can construct your hardship letter with all your supporting documents and have it ready to file asap. Some embassy's allow you to file the waiver the same day as your interview and some do not.

I don't recall saying that she could file the waiver DURING the visa process, unless you are including the interview as being 'during' the visa process. Normally the interview is the last official step of the K1 process (save actually getting your passport back with the visa in it and entering at POE) unless a waiver is required. If she is denied the visa at the interview, she can subsequently file a waiver.

What Bailey is saying (correct me if I'm wrong, Bailey!) is that some consulates allow you to file the waiver as soon as they are denied at the interview - that very same day - and some consulates do not allow that.

Its really pretty straightforward.

Hummm... That's what I think too! It seems the government wouldn't analyze carefully the circumstances if they found out she overstayed the visa. I guess they simply would notice she overstayed, and would deny the visa! :huh:

I read a forum once where people discussed about waivers and a girl told that the waiver process is done before the K-1 or K-3 petition... She said that it's necessary because this way the government will "allow" you to start with a visa process. Then, once they "forgive" you, you can go into the visa process normally! But I also don't know if it's really like this. That's what I'd like to know... hehe If there's a way to do things together, it's much better, uh? ;)

If she thinks she will need a waiver she needs to gather her documents and have them ready at the time of her interview. Waivers are not filed for in advance and once it is requested you file then. Good luck.

Hello visajourney friends!

I have a friend that is thinking about going through K-1 visa, but she had already overstayed a vista once when she was in the US working as an Au Pair!

But, according to what she relates to me, she was not guilty because, a certain time before her visa expires, she asked for a permission to remain in the country for a few months more and they sent the authorization letter LATE and with the term expired!

So, do you think it's necessary for her to go into a Waiver process before applying for K-1 visa? If so, how long does this process take and what does she need to do?

Yes... I know there are tons of illegal brazilians in the USA, but there are a lot of people that have a good financial condition and show all evidence that they only want to visit their relatives up there, and they have their visa denied after a tiring waiting for an interview and money spent! Some of them live far from the Consulate and need to travel for hours to have their interview too! I've heard that it's even too difficult for moms to get their visas to stay for some days with their pregnant daughters in the USA!
I don't know if things will be fair someday, but charging this fee for the visa is the minnimum our country can do! :hehe:

I would only be favour to eliminate the visa fee if our government did a good research on it and was sure that this procedure would be able to increase tourism in Brazil! But actually, I also don't think it would!

Fui não, amiga... Liguei lá e consegui falar com uma pessoa direto no Departamento de Antecedentes Criminais... Mas a moça me disse que eles ainda estavam em greve e que "talvez" voltem a trabalhar na segunda, e também que não haveriam exceções para o meu caso, mesmo eu tendo explicado sobre a urgência... :crying:

De qualquer forma, o Consulado do Rio respondeu ao meu e-mail e disse que eu devo ir à entrevista normalmente, porque eles vão me orientar sobre como mandar o atestado depois (pelo que entendi, meu visto vai mesmo ficar pendente até eu enviar)...

Eu só espero que eles voltem logo, porque senão o meu visto irá demorar para sair e eu teria que adiar a minha ida... Era só o que me faltava... :unsure:

Meu... Aqui, o certificado de antecedentes regional pode ser até emitido pela internet na hora... Mas o nacional só indo pessoalmente até a Polícia Federal e demora de 10 a 15 dias! Ninguém merece! :(

Então, eu fiquei sabendo a data da minha entrevista porque, no mesmo dia que coloquei o pacote 3 no correio para eles, eu também mandei uns dois e-mails perguntando a data da minha entrevista (já contando que eles demorariam váááários dias para responder).... Eles responderam ao primeiro três dias depois, pedindo para que eu aguardasse, que eles ainda não tinham a data.... E o outro, dez dias ÚTEIS se passaram e nada de resposta! Então, eu mandei outro e-mail dizendo que eles não tinham respondido a este anterior e, educadamente, perguntando novamente... E não é que eles me responderam a esse 15 minutos depois, dizendo a data da entrevista? :blink:

Mas enfim, responderam....rsrs Eu fiquei sabendo que tem gente que dá ainda mais sorte e eles dizem a data da entrevista em uma semana, mais ou menos!

Se você não achar muito caro, você também pode ligar para eles umas duas semanas depois de enviar o pacote 3... Bom, são cerca de 40 minutos de espera, portanto, eu acho muito caro! rsrsrs

I went to Polícia Federal in São Paulo today to ask for my Atestado de Antecedentes Criminais and got surprised... They are paralized, asking for salary improvement! :(
I've read in Jornal O Globo that their last paralization was in 2004 and they stayed 2 months paralized! In case they take long to start working again, how will I do in relation to my interview? I e-mailed Rio Consulate asking, but they didn't reply yet... Anyone knows about it?

I'm getting panicked... :help:
