Looks like we're approved! The case status online still shows as Initial Review. The letter arrived today, not the normal heading but rather just a white piece of paper with text. But shows that date of decision was 8/27/2013 and we should receive the new green card within 60 days. We sent our stuff to the California Service Center, but what we received today appears to be from the Nebraska Service Center signed by NSC director Mark Hazuda.

Trying to patiently wait to see some sort of movement on our case but did have one question. For those that have received RFEs, does the case status update or change to reflect the RFE or does it stay in the "initial review" stage? I've been checking on ours daily and I'm not sure if we'd get an RFE or not so just curious.

Well today was the appointment for the biometrics. Drive all the way there to find out when we walk in that there was a power outage this morning so they're closed for the day. Now we have to find another day to go down there to have it done. Ridiculous. They should at least have notified the people who had appointments that "hey! we're not going to be open today so don't waste your time coming down here." Would have been nice.

Yeah, he was born here in the US. We just need to register his birth at the Brazilian Consulate. The closest one to us is in Chicago, which is about a 6 hour drive, so we haven't done it yet due to work schedules.

My husband is planning to apply for citizenship as soon as he can. We will also make sure that our son has both US and Brazilian citizenship so that he has the option of living in either country when he gets older.

You don't use the receipt number from the NOA1; you need to use the one from the biometrics letter.

I purchased round trip tickets for my fiancé, now husband because it was cheaper. He entered the US in September 2010 and we made his return flight for March 2011 because it was the cheapest we could find. We had no problems at all canceling the flight through United and actually have a discount on another flight if we purchase it before September 2011. Just make sure though that you do cancel the second return portion of the round trip ticket as it has caused problems for people adjusting status later on.

I received my NOA1 on April 19th and then didn't hear anything until I got the email/text from USCIS about my petition being approved on June 21st. I checked every day, several times a day between those two dates and it was always in initial review and the date of last update never changed, until I got the email/text.

My fiancé and I considered both. But after dealing with the bureaucracy of trying to marry in Brazil, we decided just to do the K1 route. We would have had to wait around 90 days from the time we filed to marry at the cartório till the time we could have actually married there and by then I would have had to come back to the US. So for us it was more of a K1 being the only possible option since I had already spent 6 months in Brazil and had to come back for school. Although it'll cost more money in the end and a bit more paperwork to deal with, I think it'll be better. Like others have said, it'll be nice to spend that first year of our marriage together rather than being separated. It's already hard enough being separated now as it is.

Those should be the forms you need to fill out. If I'm wrong, someone please correct me, but at least in Brazil they say

If you can get an email from the embassy or consulate there telling you which forms you need (which would probably the ones they told you over the phone), then I would just go ahead and do the ones that they tell you to do (the most up to date ones of course) and then also print off the email to show that that is what you were told to fill out.

Then since you are filing for AOS, you will file the I-864, both one for you and one for your co-sponsor. You will be the main sponsor, even if you have not been working, you will still be the main one and then other person will be your co-sponsor. You might also want to finish filling in your timeline so that others will know what step you are in the process. :)

If you are able to demonstrate the inability to pay based on the following situations and criteria, then I would say go for it. The worst that they can say is no and that you have to pay the full filing fee.

* Whether the individual has demonstrated that within the last 180 days, he or she qualified for or received a “federal means-tested public benefit”. This may include, but is not limited to, Food Stamps, Medicaid, Supplemental Security Income, and Temporary Assistance of Needy Families or other public benefit.

NOTE: Each agency’s public benefits are determined based on a unique set of criteria. Therefore, even though an individual has qualified for another agency’s benefits, it should only be one of the factors in determining the USCIS fee waiver request and should not be used as a definitive factor.

*Whether the individual has demonstrated that his or her household income, on which taxes were paid for the most recent tax year, is at or below the poverty level contained in the most recent poverty guidelines revised annually by the Secretary of Health and Human Services’ “Poverty Guidelines”.

*Whether the individual is elderly (age 65 and over, at the time the fee request is submitted).

*Whether the individual is disabled. Applicant should submit verification of disability (see below, How To Apply for a Fee Waiver.)

*The age and number of dependents in the individual’s family’s household who are seeking derivative status or benefits concurrently with the principal applicant or beneficiary.

*Humanitarian or compassionate reasons, either temporary or permanent, which justify a granting of a fee waiver request. For example: the applicant is temporarily destitute; the applicant does not own, possess, or control assets sufficient to pay the fee without a showing of substantial hardship; or an applicant is on a fixed income and confined to a nursing home.

*Any other evidence or factors that the USCIS Officer believe establishes an applicant or petitioner’s inability to pay the required filing fees.

I believe that you can apply for the fee waiver, but unless you sufficient evidence for the USCIS of why the fee should be waived, they will probably deny it and then you would have to resubmit everything with the appropriate fee.

My fiancé and I waited until his petition was received at his consulate. I had started to get together a list of the documents we still needed to get after the NOA2 and then made plans to do everything after the petition was received at his consulate. That gave us enough time to get things together since he had about a month and a half before his interview. I would suggest though that if your consulate schedules interviews rather quickly then I would start getting them after the NOA2, at least for us the police certificates took the longest as for one my fiancé had to travel 18 hours by bus to obtain it in person. I didn't send him the affidavit of support or the rest of the documents that I needed to send until much closer to the interview, about 2-3 weeks prior so that the pay stubs that I had printed were more recent.

I filled out and submitted everything on my own, with my fiancé's help of course. I double and triple checked everything I was submitting to make sure forms were filled out correctly, I was sending in everything that was necessary and that it was as organized as I could make it. I used the guides on this site (as well as others to just double check that I wasn't missing anything) and asked questions when I wasn't sure and I had no problems at all throughout the entire process from submitting the I-129F to receiving the visa. I know that every case is different, but for me it was much easier and better for me to do it all myself. My case was very straightforward. Two single people, both had never been married, no children, no overstay of visas as my fiancé had never been out of his country, had co-sponsor and had met twice in the just over a year we had known each other. I received no RFE and everything moved along smoothly and quickly for us. We were lucky, very lucky I believe to have such an easy time with no problems and a somewhat quick turnaround of a little over 4 months from petition submitted to visa received.

I think that if you feel that you can do it all on your own, study up on everything, go over the forms and check them over until you feel confident and comfortable. If you have questions, ask. The people here are great at giving you good answers to help. The guides are also an excellent source of information and help. But if it all seems like too much, then go with a service or attorney, but I would suggest checking them over very well to make sure what they are saying or offering is legit. I've read more times of services or attorneys causing more problems than helping. People losing time and money for simple mistakes that a service guaranteed wouldn't happen.

My husband was almost denied entry when he entered on his K1 in September. The CBP officer wanted to deny him based on me being a student. Thankfully another CBP officer told the one who wanted to deny him that he had to let him go cause there was no reason not to and that the fact I was a student and my co-sponsor made "###### money", as he said, wasn't good enough reasons.

My husband has never had a tourist visa. I visited him twice in Brazil before we started the K1 process (for about 6 months total). He never even had a passport, he got it during our K1 process. His first trip outside of Brazil was when he entered with his K1.

He needed it for the interview (with English translation, not required I don't think, but we went ahead and got it translated anyway since it'll be needed for the AOS). The only birth certificate I sent in was mine (the US Citizen petitioner).

I just submitted maybe 4-5 emails over the span of our relationship, the last months phone bill that showed calls to and from Brazil, about 10 photos, and our Ventrilo log for the last month. The only snail mail envelopes that I submitted were ones that I received from family (such as birthday and Christmas cards) while I was staying there, to show extra proof (besides the passport stamps and airline tickets) that I was actually there during that time at his address. For the interview I just submitted the originals snail mail envelopes (sent copies with the petition) and the actual airline ticket stub things as well as a few more emails from the time the petition was filed and the interview, another more recent original cell phone bill (1 month) and another copy of our Ventrilo log. We never received any RFEs during our K1 process and they didn't even bother to look at the new and original evidence we submitted at the interview.

My husband and I were in a similar situation to yours. I (the US Citizen) was unemployed at the time and we used my mother as a cosponsor. I filled out the I-134 and included a letter explaining why I had no tax returns to submit with it. Then I had my mother fill out an I-134 and I submitted her birth certificate, a printed sheet from her company website showing when she was hired, her title, her pay, and that she was employed full-time. I also included the most recent pay stubs (3 most recent) and also submitted her last three years worth of tax returns. It might have been more than necessary to submit, but we wanted to make sure that we didn't leave anything to chance. We did not include anything for a bank since her income from employment was enough.

When you arrive at the consulate you hand them your papers and they will look them over elsewhere before the interview (while you are waiting). My husband had no questions asked about what we submitted.
