Ah yeah, a friend of mine was a consular officer in one of Nigeria's neighbor countries; she told a similar story. And almost everyone gets rejected there, too. Fraud was a huge problem; sometimes there were people whose evidence would have been alright had they just told the truth, but they decided to supplement it with fraudulent documents and then they'd be rejected out of hand, and banned. Sad! But people there are really desperate to get here.

You are correct. That is a collective visa statistic. Despite the fact that the Embassy is in Abuja now, the line for visa's at the Lagos Consulate everyday, resembles the hot new ride at your favorite amusement park. Many hundreds in the queue. A sight to see for sure. The city of Lagos has many millions of people. Nigeria collectively has over 125 million citizens, although the estimates are considered well under the actual poulation.

I have nothing against legitimate petitions for any type of visa, only fraudulent ones. Simple as that.

I have followed the OP posts from day one, I am convinced of fraudulent intent.

Sure, either of us would go anywhere to be together, because we love each other and we're adaptable. That doesn't mean he has to pretend to be ambivalent about the United States.

Ive just come back from the usa.. and me and my Fiance were expecting a child as well.. We want to file for the k1 visa.. And What we want to know is this..


1) Can i vist the usa while it is proccessing..
2) Proof of support she does not earn 125% over the poverty line..
3) could some one a famly member of hers co sponsor me Eg her father..
4) process time, we will be in virginia

I want to be there for the babys birth.. and if we file now and i cant vist were thinking about her coming to australia..

We have known each other 2 years and spent 3 months in the states living together.. We want to do the right thing by the law..

We went to an Immigration lawer and he told us that i should come on a vistors visa then marry her and then apply for a spouse visa.. But we dont think his advice was legal or right.. He said he do it all for $3500...

Any advice on what's best would be great were really missing each other.. And love each other very much..

Don't marry her on a tourist visa; do file K1. It will take a few or maybe many months; there's no way to get more specific about processing time. You are not banned from visiting the US while your visa is being processed, but you're likely to be rejected at the port of entry if you cannot provide compelling evidence that you will return to Australia. And yeah, her dad can co-sponsor. No problem there!

Get your stuff together and file soon and you might make it for the baby's birth. No guarantees, though.

I have a colleague at work who met his girlfriend in Poland through a dating agency. She came here on a tourist visa in March, they got married while she was here, never left but filed for an adjustment of status and have the green card already. Am i missing something here. Here I thought these sort of things were illegal to do but he told me they had no problems during their interview. It is just not right that you get penalized for following the law but get rewarded doing things a** backwards with USCIS. I guess i am just ranting but it is extremely frustrating with what is happpening over at USCIS. 3 months in and I am still not getting anywhere along with everybody else affected by the new IMBRA law. My buddy made the comment that I maybe I should have my fiance fly to Mexico and have her smuggled across the border and file for the same adjustment. He was obviously joking but it seems it would be hell of a lot easier and faster than doing it the right way. How is this possible ?

For the interview, I know we must take evidence but does that mean all 400 emails that we have sent each other? And ALL of the pictures that we both have? And on my cell phone plan has the international long distance calling feature on it and I have been calling him on that for the past 2-3 years and I called the cellphone company and they told me they can only track 3 months behind but not 2-3 years and I believe that is one of the best evidence we have! So I'm not sure what to do??? Oh and as far as the pictures, can I take a memory card? Because if I get printouts it would be like over 500 pictures and i doubt they will look at each one. So I'm just not sure what to do on behalf of the evidence part of the interview.

Let me ease your worries a bit. You don't need to send all 400 emails, you don't need to send ALL pictures and you also don't need to have every record of your cell phone. Send a variety of each, but don't worry that you are not sending enough, just send a sample that will prove your relationship.

I sent copies of emails, cell phone bills, messenger transcripts, and photos. We had a good 200-300 pages of evidence. They never asked for any of it. My fiancee was approved no problem.

A K-1 visa is used to enter the US for purposes of getting married.  If you are already married before you enter the US (meaning if you get married in Canada before coming to the US), then the K-1 visa is no longer an option.  You will have to file for a CR-1 spousal visa.

 

If you decide to use a K-1 to enter the US and marry in the US, after marriage you can apply to change status and live here.  You CANNOT return to Canada unless you either have your Advance Parole (AP) document or you have your green card.  If you return to Canada before you have those things, you will have been considered to have abandoned your adjustment of status, and as such would have to refile for a spousal visa.

As always, however, it is at the discretion of the border officer.

Yeah, but if they could decided to deny entry because interview dates can be rescheduled and the green card isn't guaranteed. And that is NOT the kind of impression you want to make on a potential future employer. "Oh hi, I'm sorry, we're going to have to reschedule the interview because the border patrol wouldn't let me in, even though I showed them I had to be back next week for my IV interview. Let's reschedule for next week!" And then not only could you have burned that bridge, you have a denied entry on your record. Granted: it's Canada, not MENA, so they're not looking for any reason to deny, and it seems to be semi-common to have a denied entry or tourist visa.

But at the end of the day, it begs the question: in this economy, is it really worth it? Unless this is a cattle call interview, scheduling the interview after the visa interview shouldn't be a huge problem.

With a pending immigrant visa, you've got to be able to prove sufficient ties to Canada and that you'll return. Attending a job interview is pretty much the opposite of sufficient ties, because it shows you're looking to stay in the US.

Your interview is in 10 days. See if they can wait 2 weeks. If they ask why, just tell them you want your green card to be finalized first - and to be honest, they should want that as well.

I'm getting ready to file my affidavit of support in sponsoring my husband from Spain. I realize that I need to submit my past 3 tax year's information and that I must make 125% above the poverty line. I currently make well above that level, but within those 3 tax years, only made above that level for 1 year (I was in grad school). My question is - will it be necessary to get a joint sponsor? Or will that fact that I'm currently making a high salary be enough? I would hate to only submit my information only later to receive an RFE and have the process held up longer than it needs to be. After all, he is so far away and we have already been apart so long! Any advice anyone might have would be greatly appreciated.


Your fine, current salary is above the 125% level. One of my tax years the income did not meet the guidelines. Plus you will get a letter from your employer which will state the annual income for 2012 that also show your income well above the 125%.. Don't worry

AOS is only applied to the foreigner that has entered United States on a non-immigrant visa or K-1 visa and adjusts to a new immigrant status through USCIS. CR1/IR1 is granted for an immigrant visa from U.S. embassy/consular and will be granted for green card when enter United States.

I'm sorry but I think you still haven't quite understood the question. Kamhoe is talking about receiving the Green Card after you enter on an immigrant visa such as a spouse visa. At that point the application is complete and approved so there will be no mistakes or RFEs - they just need to produce and mail out the card. I did my POE last Sunday at Atlanta and they told me three to six weeks.


My experience is with K1, possibly the Cr1 is different and you started the Aos abroad? If thats the case then I apoligize for any misgivings. I had to marry first within 90 days then start my Aos.
