They are concerned with CURRENT income. They do want to see your past income as well, but most of their decision will be based on the current income. If you have the interview before your fiance starts work then you cant use that income--since it hasnt happened yet. But...if your fiance starts work before the interview, then you can use it. Debt isnt even looked at.

I would highly recommend a co-sponsor, if your fiance is working before the interview and can list her income it may be enough to approve the visa without the cosponsor. Its at the descretion of the CO. But to be safe, have one ready just in case.

There is no written law or rule that says how long you can visit in a years's time that would make you ineligible for a visa. If CBP let's you in and you leave by 90 days so not to overstay the visit, then you have done nothing wrong.


I was actually curious to see if London would actually WANT to see this type of evidence. In Colombia, which I imagine is a little more skeptical than the UK, they never asked me for ANY evidence. I brought a huge packet of evidence with me, they never asked for it.

The address is not important...you can even leave it out if you want. What IS important is that you state and affirm you are legally able and willing to marry within 90 days of arrival to the US. You don't need to write anything fancy so that it's in 'your own words'...just follow the example form and you will be just fine. In fact what you have is perfect.

Just want to mention one little detail: In the address part, there is no need to write USCIS under U.S. Citizenship and Immigration Services (its kind of redundant to write it twice).

You do not need to call for the case number. It is recommended to help move along your process but it is not needed. The NVC will mail you a hard copy with your case number, and it will automatically be sent to the embassy. The embassy should be mailing something when they have the approved petition.

The reason why you cannot use your personal vehicle is because it would create a hardship on you.  If you give up your car, your mode of transportation, it creates a hardship, and the affidavit of support forms won't allow it.  Now if you have a 2nd vehicle, you can use that.

You can use a vehicle only if it is not your primary vehicle...i believe you can use coin collections but you would have to have an appraisal. You can use almost anything for personal property but if it doesnt have much value i wouldnt even use it. Using anything with value less than $1000 is pointless and probably wont help much.

good.gif This.  When you submit the I-129f petition for fiancee, AT THAT TIME you have to be legally divorced and free to marry.  You cannot have the divorce finalized AFTER you send the petition.  If your divorce was not final, you will receive an immediate denial on your petition.  It does not matter if your divorce is final now, what matters is that it was final when you submitted your paperwork.  Unfortunately any money you sent in is lost as well.  In this case you would have to refile a new petition, with a new payment.

 

If your divorce in fact WAS final, and you submitted proof of that, then you are OK.  If the proof you submitted isn't good enough or they want something more specific, they will send you an RFE and ask for it.

First just need to clear up something that can be the cause of confusion: the I-129F is not a K-1 application. it is a petition and no visa is being applied for by sending in the I-129F and its supporting documents. An approval of the I-129F petition allows the foreign fiance(e) eligibility to apply for a K-1 visa through the US consulate in their country.

I am trying to start filling out the forms and have some questions because I want to be sure I fill them our correctly to avoid delays. Hope you can help me answer the questions...

 

*Will the embassy send the code needed to make an appointment to my fiance's email? I looked over our I-29f and my email isn't anywhere.

*N/A and None, is it really important which one I put in? What about for example in the question about children I put in N/A and then leave the rest of spaces blank, is that ok or should I write N/A in each one?

*Phone number of where I'm gonna live, is it ok if it's a mobile phone number? And where it asks about greencard address do I put in "same as item 10"?

*On present occupation I am not sure...I am not officially working, I am just helping out my dad in his office, so do I put in unemployed or what?

*Employent in the last 10 years, on location...do I need to put in just city and country, or the address or what?

*Where do you intent to work in the US? if I don't know do I put in "unknown" or what?

*Educational institutions attended, do I put in just stuff after highschool or do I include highschool, elementary, courses, stuff I didn't finish?

*In my case, name and address of present employer, do I put in None or the address of my dad's office?
*When do you intend to arrive in the US? well, I won't know until my visa is approved, so do I leave it blank or put in a tentative date?
*Name and Telephone Numbers of Person in U.S. Who You Will Be Staying With or Visiting for Tourism or Business. Uhm,,,I'm not going for tourism or business so do I just put in my fiance's info?
*Have you ever been in the US? do I just put in the info of the last time I was there or do I have to attatch another page for times before that?
*Have you ever been issued a US visa? Do I just put in info of my current tourist visa?

You can send an email to the embassy in Colombia when they have your approved I-129f packet.  Their email is: IVBogota@state.gov

 

You can use a mobile number.

 

If you are not presently employed, then just write 'unemployed'.

 

Just city and country is fine for last 10 years employment.

 

For the question 'Where do you intend to work', just put 'With Employment Authorization--Employer unknown'

 

For educational institutions, my wife wrote all schools she attended since primary.

 

For when you intend to arrive, put your estimated date, or tentative date.  We didn't put a tentative date until we had our interview date for the visa, and usually you will know if you are approved at your interview.
 

Answer all questions about previous visits to the US truthfully.  If it asks for the last time you were here, write it.  If it asks for your current tourist visa number, write it.

 

Sometimes the embassy in Bogota won't even ask for the form DS-230, just your DS-156 forms.  They never asked us for the DS-230.

Sending in proof of your relationship has no bearing whatsoever on the actual I-129f petition.  They will not send RFEs for lack of proof of relationship, as this is not a requirement.  So you will get approved whether or not you have the proof.  With that said, the 'front loading' is for the benefit of the embassy who will receive your approved petition.  Don't front-load expecting a higher approval rate on your I-129f petition because USCIS won't look at it.  Front-load in order to make a stronger case for when you actually have your visa interview at the embassy.

 

I would suggest sending in a sampling of your relationship evidence:  pictures, emails, chat logs, phone logs, etc.  In my petition for my wife, my I-129f packet was less than 40 pages.  We were approved in less than 3 months.

To provide the evidence of a genuine engagement for the visa interview, all you need is an updated letter of intent (similar to what you sent in for the I-129f) reaffirming your intent and willingness to get married.  This is ALL that is needed to prove the engagement.

 

Photos, chat logs, emaiils, phone logs, etc.  all just prove your relationship, not that you are engaged.  For proof they want something signed by you both stating and affirming your intentions to marry--THAT is your engagement proof.

At looonnggg last, I am free to assemble and file my I 129F!!! So now, good people, I have some more questions:

 

-Items like boarding passes, passport stamps, etc: My fiance wants to scan and email these things for me to print. I had read they have to be photocopies. Which is correct? Also, are black and white or color copies more preferable for this?

 

- Years ago I lived in Japan and had a few jobs there...but it was all on a US air force base. So do I need to list it as my last overseas address/job on the G 325A? Do these count as foreign addresses since military bases are US property? What if I can't get this info (it was 10 years ago and an APO address).

 

- In this first marriage, my name didn't change, and I have no marriage certificate, and one would be near impossible to obtain. Marriage certificates are for proving name changes only. I can easily get the divorce certificate. So would a post it note explaining that in that marriage my name didn't change be enough?

 

- I have just gotten divorced from my second marriage where my name DID change (yeah, bad past relationships abound). For this I will have my marriage certificate. I also will have both a divorce DECREE (orders about money, property, and custody) and CERTIFICATE (just vital statistics data, stamped but not signed by a judge). Which should I include? Or both?

 

- When it says I need my divorce decrees and birth certificate, front and back, do I need OFFICIAL copies or are photocopies ok? Color (for the birth certificate) or not? Does it need to be the hard to aquire long form, or will my basic short one be ok?

 

-At any point in this process will my fiance need his birth certificate? Does he need to send me his passport ID page, or just pictures of his stamps?

 

-I've read it should be written in black ink but signed in blue. Is this true?

Scanning and emailing, or photocopying and mailing is the same thing--they are still copies and either way is fine.

 

I wouldn't count your overseas jobs as a foreign location since it was on US military bases.  However I am not 100% sure on this, maybe someone that knows more can answer better.

 

For the I-129f, they do not need your previous marriage certificates.  All they need are your divorce certificates, because these documents prove you are legally free to marry.  Your previous marriage certificates are pointless.  Although a photocopy of a certified copy of your divorce certificate should be ok, sometimes it would still generate an RFE.  To play it safe, I sent in the original certified copy of my divorce certificate.

 

And as far as which divorce copy (decree or certificate), they only want the certificate where it states you are legally divorced and now free to marry.  The other stuff about property, custody, etc.  isn't needed, just useless information for your case.

 

The petitioner can include EITHER  a copy of the birth certificate (front and back) OR copies of all pages of the passport.  (Do not need to include both, just one or the other--this is to prove citizenship). 

 

The beneficiary will NOT NEED the birth certificate until the embassy interview.

 

The beneficiary's passport bio page is not needed until the filing of AOS.

 

You can sign in blue or black ink.  The reason they say to use blue ink is to prove it is an original signature.  However, now that you can make a good copy in color, signing in blue ink to prove its not a copy is bogus.  A tip I read here on VJ, is to sign your documents on something soft, like a magazine, so that it will actually leave an indentation where your signature is.  That will prove its original, not that you chose to sign in blue ink over black ink.

If your current income is above the poverty level, more than likely you will not need a co-sponsor.  My previous year tax returns were ALL below poverty level, but I had letters of employment and paystubs that showed my current income was sufficient (above poverty level).  I didn't need a co-sponsor.

You have nothing to worry about.  They look more at the CURRENT income than what you have made in the past.  In my case, ALL my previous tax years have been below the poverty line, but my current income I had 2 jobs and with the combined income I was over the poverty line.  I included employment letters and about 3 months of paystubs from both jobs.  I also included a co-sponsor as a 'just in case', because I was worried about my past tax returns as well.  They accepted my affidavit of support, without the co-sponsor.  They handed my co-sponsor's forms back to me and said they didn't need it.

So for evidence of citizenship, your fiancee submitted all pages of her passport?  You did not include the birth certificate correct?  The passport pages should have been sufficient evidence of her proof of citizenship.  Did she submit ALL pages (even the blank ones) ? 

 

They are asking for proof of US citizenship, which for some reason they don't have or the evidence they have isn't complete.  Suggest re-sending ALL pages of the passport instead of the birth certificate, and maybe explain that you are using the passport as proof of citizenship in lieu of the birth certificate.

 

For the I-129F petition, EITHER form of proof of citizenship is acceptable.

You can file the I-129f whenever you want, doesn't matter if your fiancee is still here in the US.  If anything it makes it easier because then you can fill out the paperwork together and she can sign all the forms that require her original signature before you send it.

 

The application will be processed normally, meaning it won't be delayed just because she is still in the US.  With that said, she will interview at the embassy in her country so she will need to return home for that when it comes time for her interview.

Hello. I am looking for some answers in regards to my submission of the I-134, affidavit of support. Any help would be greatly appreciated.

I've seen both that a K-1 visa sponsor needs to meet 100% of the poverty guidelines and 125% of the poverty guidelines. Which is it?

If it is the 125%, I fall 300 dollars short of the required amount for 2013. I was only working half of 2012 and my situation has greatly improved with a sizable hourly pay rate increase and 3 promotions in the NYARNG. That leads me to another question. I realize the National Guard is not considered active duty time, but we are in a drilling status that of which I am curious to know if on the I-134F I would be considered "active duty military." That would put me back in the parameters of acceptance to sponsor my K-1 fiancé.

With all of that said, if I am not able to sponsor my fiancé on my own, how do I go about getting a co-sponsor? I have one lined up. My 2 questions with that are, #1 do we have to live in the same house and #2 do we both fill out the I-134?

And finally, what do I need to send in with my I-134? I've seen so far that I need a copy of my tax return, letter from my employer, and copy of bank account withdraws and deposits along with date of bank account opened.

Any help is appreciated. Thank you!

 

Let me clarify the confusion behind the 100% and 125% guidelines for the I-134.  Even though the requirements state you only need 100%, for a K-1 visa most consulates are going to require 125% BECAUSE of the intent to immigrate.  The 100% guideline is designed for non-immigrant cases where the visa holder would eventually return home.  Even though the K-1 visa is classified as a non-immigrant visa, it is treated like an immigrant visa because the visa holder will more than likely stay in the US after marriage and adjust status.
