Pregnancy or having a baby has no affect on the process. If the baby is fathered or mothered by a USC, the child is eligible to be a USC on its own and that filing can happen at the Embassy. I don't understand how both of you can be pregnant but congrats on the future two-some or more!!!

If you marry, then you first have to withdraw the K-1 and then wait and then file CR-1.

To stop and get married now, wait for your marriage certificate, then refile for a CR-1, you're probably looking at over a year before being interviewed in Montreal. I'd just stick with the K-1. I don't know what you mean about your parent's beliefs? Because you're pregnant they believe you should be married now? Sorry, I don't understand....

If you have the baby before you get your visa, then you'll have your baby in Canada. Probably preferable anyway since it won't cost you any money which it surely would in the U.S.!

You will have to wait untill USCIS processes your petition and you get the NOA#2 called I-797C Notice of Action . But what i did is prepaired the same package for my fiancee and a photo copy of the NOA#1 and sent it too her , so she has that in hand (allso is good for her to study , to prepaire in interview ). She will eventually need that anyways , goodluck in your journey .

You should be getting an RFE , the G-325A Biographic Information , 4 pags must be completed by the petitioner (US Citizen0 . But the other 4 G-325 Biographic Information , for your forighn fiancee can be completed by you . But needs to be sent to him or her , so she can sign all four pages , then send them back too you so you can include them with yours . When you send it too the USCIS . Allso if you don't sent a photo copy of your Birth Certificate , and your fiancee Birth Certificate . You will be getting an RFE for that too , expect your RFE , sometime when USCIS starts processing your file .

Okay sorry to be really annoying with all the questions but, I just read up on the DCF and I don't understand.. typically it only takes 3 months!? why doesn't everyone do that instead of the K-1 then? Cause most people meet someone from another country , and when they do decide too meet they fall in love . And there is nothing in the world they will not do for the person they love . The only thing they want is to be together the rest of their lives , most people leave that country , when the visit ther sunificant other . Then when they return to the USA , everything is different without the person in their life . So they have no other choice but to file the petition in USCIS , while the USC is dominiciled in the USA . And other go into the other country and get married and its their decision , and it turns out to be the same thing as i said above . They cannot live without the other person in their life , so they file to bring that person to the usa .

two sided paper you make photo copy of staple that together , use paper for your notes , and attach that to your paper . Have all the documents to send uscis in the order they happened , like by date but with the petition on top . You should connected every document together , just like a puzzle so it will make more since to the adjuster in uscis working on your case ( so it wont just be a gumbled mess ). By using a seperate piece of paper . This is what i did in our petition

Her Maiden name , the name she had when you were born to her at birth . It would be on your birth certificate , under your mothers information . Just dont forget to include a photo copy of your birth certificate ( front and back ). The back side so they can see the seals on your birth certificate , and send the G-325A Biographical Information that includes your fiancee information on the 4 pages . And have her sign and date them , with the current date , and have her send you a copy of her birth certificate too ( front and back ). This is what we did , we took pictures of us together . And i sent them along with a photo copy of her photo id issued by her country , that shows that we both have meet in person . But that doesnt satisify the within 2 years , so we used boarding passes in ferry boat . When she took me too meet her family . And those boarding passes has both of our names on it with the time and date , we took the ferry . After i meet her parents , and they excepted me . We both went back to cebu in the same ferry , and went to the usembassy in cebu . Where we got our Marriage Contract called (Affidavit in Lieu of Contract to Conduct Marriage ). And we both filled out our Marriage License , both of you would have to apear in usembassy together to do this . Each country is different in the laws , if you wish to marry someone from another country . But it wouldnt hurt to go together in Usembassy , it will help to show a serious relationship .

No , you dont need an attorny . You can file on your own , many couples have . All you have to do is fill out forms , and read alot to get the visa . And you can find all that information online , and all members of visajourney are here to help .

The USCIS phone number is a 1-800 number and its located on your noa #1 ( Form I-797C Notice of Action ). the phone number Customer Service is :
1(800)375-5283 and yes it is a machine , this is the only number i know of that you can call USCIS on . The only way to talk to a person in customer service you have to follow the prompts (1) Enter your Receipt number using the phone located on your noa#1 (2) enter the prompt to change your address with USCIS (3) It will then ask if you want to speak to someone in customer service , say yes . And you will then be connected to speak to a person .

is it important to write who introduced us? i only wrote when we met, which was during my trip to pakistan some years ago.

So, I take that to mean, if her mom is your mom's best friend, and she introduced you to her daughter, that is the circumstance on how you met.

Everyone will have different circumstances. My own was about one paragraph, "I was introduced to Umit via her brother's wife Uncle, who works in the same company as I do. She wanted to practice english for her job. We commenced to chat with other via the internet, then in May 2008, I visited her in Istanbul, Turkey, and then Umit visted me in August 2008, and I proposed to her."

as you read the letter, you will noticed no one introduce us. I came to visit my aunt, then i saw her, she was my aunt's room mate at the time.


You have to assume that the CO will be an American. It is likely that they would conclude, based upon American societal norms, that your aunt introduced you to her roommate. How else would you know her if your aunt did not say, this is "Nham?" The COs are told that applicants must meet the test of convincing the average person. When I read your initial post, I concluded that your aunt introduced you to Nham. The family introduction is a red flag that you and she should be prepared to deal with, IMO. Just be prepared to build a solid case, because HCM is tough, as you are hearing from many sources here.

Your best option is to file for k1 visa , not a k3 . Its not only faster , it is cheaper too . I mean if you go to Cuba to be married , they will know you are a foreghner . They will have you pay more than someone that is a citizen of Cuba , cause they know you have money that's how you got there in the first place . All you need to file for fiancee visa , is to prove the both of you have meet in person 2 years prior to filling Form I-129F, Petition for Alien Fiancee , that you obtain from http://www.uscis.gov just click on the form tab , and you can print the from you own computer . Or ask them to send you the proper form by usa posta mail . And allso you have a relationship , which you can use your postal mail correspondance that you have enchanged from eachother . I recondment using the most current correspondence as posible from the both of you , based on the day you file your petition . You allso have to prove that the both of you are legally free to marry , which you will have to study the law of Cuba . To find out if you need a special document from Cuba Government proving that he is free to marry . Each country is different in the laws , and you will have to go to the usembassy in Cuba to get an affidavit , from the usembassy stating under oath that you are not currently married . Or have been married but you marriage is terminated due to divorse , or death of your spouse . If this is the case , make sure you bring any divorse decree or death certificate of you spouse . To prove that you have a terminated marriage . To prove that the both of you have personally meet in person , use a camera and take many pictures of the both of you in the picture together . But keep in mind that this is not enough proof that , the person you are filling for in the petition , is the person you meet in Cuba . That you want to marry , What i did on my k1 visa petition is i had my fiancee make a photo copy of her government issued Photo id that is not currently expired . And made sure that the photo copy was in the best quality so uscis can later do comparision of the government issued id and attached photo of the both of you together . If this is not an option on id , then when you go to the usembassy to get your affidavit stating that you are legally free to marry . Ask the embassy officer , if he or she can make an affidavit stating that the both of you have personally met in person in front of that embassy officer . Before you leave Cuba to go back to the usa , make you fiancee write on paper his intenshion to marry you . So uscis will know you have a consentually relationship , you both want the same thing . File your Form I-129F, Petition for Alien Fiancee , With all of your documents that you have used to travel to Cuba . Well...to begin with we are just about to begin the process of applying for a VISA. I leave for the Philippines on February 5 and will meet for the first time February 6. We are both very excited to meet face to face. After I return I will start an official time line of our events. So be watching for that to come.

My question is this however. She has her name misspelled on her birth certificate and her passport has the exactly same spelling with the same error. She wants to change the misspelled name on her birth certificate and has applied for the change, however that is not suppose to be completed until next month. Will there be a problem if the spelling of the name is different on her passport? OR should she just wait until she gets her VISA and arrives in the states to change the name spelling. OR should she change the name on her passport to match the birth certificate. Her funds are very tight...and I will probably have to pick up the cost and my thinking is to just leave everything the way it currently is and see about making the change once she arrives here...anyone else have this problem.

One more thing...can anyone give us anything we need to do during are meeting that will help with our process of getting her VISA? I am really very nervous about my upcoming trip...I fly from the states to Tokyo and then to Manila. I have never flown before so any help with this or things I need to know would be greatly appreciate.

When a person is born in the Philippines , there information gets put into a civil registrar at the local province their birth took place . Then when the parents or the person that was born ask for the birth certificate , that information on the birth needs to be sent to the national satistics office located in manila, philippines . Where they make the birth certificate , then from there the birth certificate gets sent to the person requesting the birth certificate . So to get the name changed cause it's an error , try to fix it at the civil registrar where her birth took place . The name change supposed to happen next month , when you hav'nt even meet yet in person and when the visa process takes 6 month to a year . No , i don't see you would have any problems because of her name change . Now if she would have her name changed after she receives her visa then you would have many problems .

When you go to the philippines , and if you both plan to get married there in the philippines . Have her apply for CERNOMAR (Certificate of no Marriage), and make sure she has a current photo id (SSS Photo ID) is the best (Social Security Systems). I will explain why in the philippines divorce is illegal , there is only two things that removes a marriage in the philippines , which is (a) death of your spouce (B) annulment , which i believe has to be within 30 days after marriage takes place . And for the ID , it's to prove who she really is . And the SSS ID is the most powerfull form of government issued ID in the philippines . And for you , you need to get an Affidavit in Liue of Contract to Conduct Marriage for American Citizens . From the US embassy either in Cebu or Manila , and ofcource you need your passport .

You need to prove you both meet in person within 2 years prior filing the petition , this is what i did (1) take photo's of both of you together (2) keep all receipts (3) Keep all boarding passes . When i meet my fiancee now my wife in the philippines , i used all the photos we had of us together . and the boarding passes from the both of us in cebu pacific . Which on the boarding pass , it says your name, date, age, and where you will be sleeping on the ferry . Take my advice while your there take your fiancee with you on an extra trip around the philippines using a ferry , it will do you both good . And in the future help you by establishing the requirement of meeting in person within 2 years of filing the petition . And the last thing when you put all this together have her send you a xerox copy of her photo id (Passport or SSS ID) cause if not all this just looks like just two people having their picture taken together . Or two people just on a ferry boat together , but not spending any time together .

And lastly , don't trust anyone in the philippines . I had my wallet stolen from a pit pocket in a bus from davao to lupon , and the people working on the bus were all involved . When some people in the philippines see an american , all they see is $$$$. Not all criminal types are in america , they are all over the world . And i have to say this the philippine people are very good people . There is more good ones than bad ones

Poverty guidelines are as follows: For a household of 6, 100% poverty level is $28,400 and 125% above poverty level is $35,500. However you must add $4,500 for each additional person, making your total income a minimum of $40,000.00. At $38,890.oo you will be a little short.

Does anyone know if my sister would need to count her husband in her "poverty line" count? He has his own job, making more than her actually, together they make over 40,000 a year....her income is just shy of 22,000. I really appreciate all of your help everyone!!

I am pretty sure if she has her own income she will not need to count husband in the household count. You might wanna check me on this one.

Hi. I am brand new here and need some help. I am engaged to a wonderful man from Jamaica. My I-129 was approved and I have received the packet of forms from the embassy in Jamaica. My question is about the affidavit of support. I have four children plus myself living in my household and i realize I add my fiance as the 6th member. I only made 14,890 dollars last year on my w-2, however, I receive 24,000 dollars a year in child support as evidenced by my divorce decree, receipts of direct deposit from the state, and my bank account. If I can include my child support than I am over the cut off for the 2009 guidelines of 125% of the poverty line by a little over a thousand dollars. Will they accept child support in considering my income even though child support is not listed on my tax return as it is non taxable income? If not, then does my co sponsor have to make above the guidelines? My sister will do it but she is married and although the income of herself and her husband is well above the guidelines for three, her salary alone is just under the guideline for three. Please help!! I am worrying myself sick over this!! Thank you!!

YES, it is super important that you list your daughter. It is ok that he is not listed on the BC, but I would have it and the signed paternity statement available.

You do not need to state that she will accompany him, as I assume she is a USC and that question is really asking who are the derivative beneficiaries of the application (i.e. who else needs a visa). If you are paranoid you could submit a supplement to question 5 on the DS-156K explaining your situation, but I would just check "no" to both options in number 5 (the child will neither accompany nor follow the K-1 because your daughter is already in the US).

Thanks to everyone with your help with my questions! I got the help I needed on my question about the affidavit of support so I have now moved on to filling out the other forms in my packet. Many of the forms ask for ALL children of the foreign fiance to be listed...here is my situation. My fiance and I have a child together who was two in June. In my state of Iowa, if the parents are not married at the time of the child's delivery, the father has to personally sign a paternity affidavit to have his name on the child's birth certificate. Because my fiance was and is in Jamaica, my daughter does not have a name of a father on her birth certificate. We do have a document that Orville signed and had stamped by a JP in Jamaica stating that he is our daughter's father. Do I list our daughter on these forms? If so, as she and I will be there for his interview, do I list that she will be accompanying him from Jamaica to the US or is that only for people who are bringing a child from their country with them? I do not want to fill it out incorrectly and have our visa denied. Any help with this would be appreciated!!

We were approved on 14 November. The case status still hasn't been updated online and I never got notification emails, but I got the NOA2 in the snail mail today.

Oh man!! It feels so good!!

We have to support one another.
Maybe that "ride" was not over 2 months but longer - before the application was even mailed. Some couples have been dealing with long distance for a very long time.
We never know what people are going through.




:no: How does a dozen or so people saying Congrats support me? I'm over 100 days into this with no valid reason for a delay other than incompentence at USCIS. You wait for 100 days or more and then you come back to me and tell me that we're here to support one another. We're all here to get approved. Only a very few of those who have gone ahead actually come back to lend their support, such as Gary with his timeline updates. He doesn't have to do that but he does. That's support. Jumping online and saying "what a ride" after only 60 days wait for your N0A2 isn't support... that's happiness for yourself and telling everyone here serves what purpose? Sure they have a right to express their happiness but no matter what you or anyone else says.. those who are still at CSC that are over 100 days of waiting for their N0A2 really only want one thing.. our N0A2!! I hope you get yours sooner than later.. but only until you've waited and waited and waited some more can you ever understand how any of us feel about it. The clock starts ticking when you you submit your application. How long you waited and were away from your loved one BEFORE you submitted your application doesn't add into the waiting time AFTER you submitted it. Gee.. just because someone waits a year or more before they submit the application for a K-1... that's supposed to make us all feel sorry for them?


Wishing your own suffering on other people is so childish. It's fine and very understandable to be frustrated, but invading someone's joyful NOA2 thread with your own pity party is just pathetic.
