i can relate with this situation. My USC fiance only send 1-129f and all other stuff except G-325A form. now we are on more than 4 months from our noa1.so what should we expect?


Your situation is a bit different if you are simply missing ONE form. They will prob send an RFE for that one form you are lacking. RFEs are sent for little things you are missing, maybe you forgot or didnt have the right information. They just wont send an RFE if the entire petition is just not there.

If they accepted the packet, that means they have enough information to proceed. Otherwise, the packet would have been returned.

As fast as the I-129F's are piling up at the service centers, I would wait for the RFE. Withdrawing the petition will take time to process, and could set the OP behind 6 mos or more.


Actually the reverse is true. Waiting for an RFE that wont come will delay the OP the time waiting for the denial plus time needed to wait for the new petition. A withdrawal will actually save time because you wont have to wait weeks for the denial. Withdraw, wait whatever time is required before refiling, and then refile.

In other words, waiting could take up to 10 months (4 months waiting for denial plus 6 months for new petition)

Withdrawing could take 6 to 7 months (time for withdrawing and waiting to refile plus 6 months for new petition)

Withdrawing is still the better choice in terms of saving time.

If the packet is incomplete, one of two things will happen, either they will return the whole packet to you, or they will send an RFE. Wait to see what happens. Don't refile yet.


An NOA1 was already received so the packet was accepted. Meaning now the only possible outcome is a denial. Withdraw and refile.

They will send an RFE if a few things are missing. If the entire petition is missing they will just deny it.

No, because the results from that xray are already in the envelope. USCIS could care less what the xray looks like, they care more that the beneficiary is medically ok to be here which is what her medical results would say that are in the envelope.

I would definitely include more evidence than an employer's letter, at the very least tax return transcripts because it proves you actually MADE that money. Who's to say that your employer letter was made up and you actually don't make the money it claims you make?

Bottom line, have as MUCH evidence as you can to prove your case.

Make sure you get a direct flight to hawaii, if you have a stopover in another country its the same as leaving the US.

Don't worry about him being denied. He'll just be processed, which may seem like a long while, and maybe ask a few questions and then let him on his way. It's a really simple process. We had to wait about 30 min at my fiancee's POE before getting called into a little office. He asked her one question, then told us we had to get married in 90 days. That was it.

And as far as calling you, I would simply recommend getting a cheap phone card and using one of the payphones to call. Don't worry everything will work out OK!!

The fact that you met originally was in 2006 instead of 2007 has no bearing of interest to USCIS. They only care about the LAST TIME you saw each other and that it was within the last 2 years. If you made mention of that, along with the proof, then you are good to go. As far as the error goes, you can clear that up at the visa interview.

I would definitely book the flight online and NOT through a travel agent. To be honest, if you can do immigration without a lawyer, you can book a flight without a travel agent. ;)


:thumbs: When I booked the flight for my fiancee, it was the same as just buying a normal one way ticket regardless of status. I bought 2 one way tickets (one for me and one for her) so that I could fly back with her and go through the POE with her. I booked through Jetblue on a flight I found through Kayak. I'm not going to spend extra on a travel agent when I can do the work myself, and still end up with a fairly cheap ticket.

The boarding passes, receipts are all good primary evidence of having met in person. The reservations and photos are also good but as secondary evidence. What you sent is perfect for proving that you met. The evidence of relationship, such as skype chat logs, messenger chat, emails, facebook, etc. are all pointless for the initial petition. Save these for the embassy interview.

You also have to take into consideration that USCIS does NOT care about proof of relationship. So you don't have to do translations for these because USCIS won't even look at it. All they want to see is the evidence that proves your case for the I-129f petition, which all has to be in English or translated into English.

Dont look at it as being 'necessary'. You should be including as much evidence as you can to prove your case, including taxes. The person looking at your case is going to make a decision based on the information there, so you want to make sure you have everything.

I included the employer letter, pay stubs and 3 years tax transcripts. If you get the tax return transcripts from the IRS you wont need to include w2s.

I know that for the I-134, you need to provide a letter from your employer, but what information does the letter have to contain? And what particular format should it be? My boss agreed to write one, but needed more info on what exactly to write. Are there any examples/samples out there? Or guides containing basic info?


Everything that needs to be included in the employer letter is stated in the instructions:

B. Statement(s) from your employer on business stationery showing:
1. Date and nature of employment;
2. Salary paid; and
3. Whether the position is temporary or permanent.


Just make sure that it includes all of the above on a company letterhead and you will be fine.

Honestly I think its a waste. Why pay someone $1000 just to double check what YOU did? There are no advantages to using a lawyer, all the information you already know. They cant add anything special to your case, not even added security. Doesnt matter if it is a high risk country...and in fact would you trust a lawyer to be absolutely perfect with your case? This is something very important to you, to a lawyer its just another case. And because it IS a high risk country its all the more reason to do it yourself so that YOU know its perfect.

Every flight I've taken back to the US they hand out the I-94s on the plane to those who need them along with the customs forms. Nancy got her I-94 on the plane. In addition, if you don't receive it on the plane you should be able to pick up a form at the table where they have all the other forms before going through immigration.

What penguin said is spot on. They are concerned more with CURRENT income, so if you can prove your current income is sufficient and will continue in the future you should be OK. Also the reason why the I-134 technically only requires 100% is because that form is also used for other non-immigrant visa types. When using it for a K-1 visa (which is considered a non-immigrant visa) they require 125% because there is intent to immigrate eventually by adjusting status.

In my case, my past income was horrible and not even close to the 125% as reflected in my previous years tax returns. However my current income is more than enough. To be safe I included a co-sponsor. At my fiancee's visa interview, they handed back my co-sponsor information (they didn't need it). They approved her visa with no problems.

Just use paperclips to keep like minded documents together, slide it all into an envelope and mail it. No need to use binders or anything like that. Once your petition is received they will TEAR IT APART and reassemble it how they want it, in the order they want it. For what it's worth you probably don't need to use paperclips, the benefit is more for you before you mail it.

If you sent an original letter of intent with your petition and you are getting an RFE for it, chances are they lost or misplaced it. You still need to send an original with the RFE.

Attaching a note saying the original was sent with the petition makes no sense at all...if they had it they wouldnt be sending the RFE.

As long as you say specifically where and when then its not too little. Trust me if you add more those details WILL be brought up at the interview. The CO spent a good 10 min asking my fiance to describe everything that was written in my 1 page answer to question 18.

For the initial petition to be approved they just need to know you met within the last 2 years with the proof you provide. USCIS doesnt care about the details, just the embassy. So although too much wont hurt the petition, it will come up at the interview which could make it a bit more difficult.

Sorry if this is common sense to some of you but I don't want to take any chances with this paperwork.

I was born on a US naval base in the Philippines (Subic Bay), and have always been a US citizen as far as I know.
I know that when I was a baby I obtained a US passport from Manilla and I have a current US passport (last renewed in 2006) and a US Naval Hospital birth certificate.

What do I answer for the following 2 questions?

I-129F Question #10:
- My citizenship was acquired through (Birth in the U.S., Naturalization, Parents)
- Have you obtained a certificate of citizenship in your name? (Yes/No)
If "Yes," give certificate number, date, and place it was issued.
*Note that my U.S. Naval Hospital birth certificate doesn't have an actual certificate number on it but it does say at the bottom "The official birth certificate for SavantGarde is available in Olongapo City, Republic of the Philippines.


My situation is exactly the same...I was born on a US naval base in the Philippines. You need to put BIRTH THROUGH PARENTS. On the line below where it asks if you received a certificate in your name, you put NO.

The amount of paper work didn't stop our case from being approved in less than 6 months at a time when VSC was approving at 7-8 months! At the interview, we weren't asked for a shred of evidence. YMMV obviously. Who can say it is overkill by going on amount alone? Over 200? Maybe. Over 100? It happens all the time.


Over 100 if you are frontloading...and that is understandable. But if there is no need to frontload your petition it is not necessary to send your relationship's life story. As for our case, they also never asked for a shred of evidence.

Honestly, 207 pages is overkill. More than 100 pages is overkill. My petition was 40 pages. There is a lot of stuff you dont need to include.

Beneficiary letter explaining styles of spelling her name--not needed
Copy of naturalization certificate OR copies of all pages of your passport--not both
Proof of ongoing relationship--suggest you condense it down to just a few pages...how many pages of proof do you have?
Support letters from friends and family--not needed
Full resolution receipts--if this is part of your proof of meeting, include it with that proof.
Additional documents (beneficiary's passport and birth certificate)--not needed

Although sending a wealth of information in your petition packet wont affect the outcome of your case, however the huge amount of paperwork could take longer to process.

They are concerned with CURRENT income. They do want to see your past income as well, but most of their decision will be based on the current income. If you have the interview before your fiance starts work then you cant use that income--since it hasnt happened yet. But...if your fiance starts work before the interview, then you can use it. Debt isnt even looked at.

I would highly recommend a co-sponsor, if your fiance is working before the interview and can list her income it may be enough to approve the visa without the cosponsor. Its at the descretion of the CO. But to be safe, have one ready just in case.
