Sounds like this is your NOA2, start gathering the evidence you will need for the interview stage. From what I understand your petition will be sent to the NVC, which will then be sent to the embassy. Each country is different so you will have to look into your country specific information and requirements, but generally you should be able to pay the visa fee and get an interview scheduled once the embassy receives the packet from NVC. That is how it is for Colombia anyways, your country may differ.

I think I wrote something like that, and underneath just had bullet points listing each piece of evidence. In the packet itself, I just had the copies of the boarding passes, passport stamps, and photos. I didn't write anything else, because it is clear what the evidence is.

For the I-129F petition, the only thing she needs to send you, is a signed copy of the G-325A form with her information--including passport style photo, and a signed letter of intent to marry. If she was married before, then a translated copy of her divorce decree.

Her birth certificate would be needed later on for the interview stage, and not sure about your embassy, but in Colombia it is not required to be translated to English.

Not necessarily. I was born a US citizen as well, but was not born here in the US. I was born in the Philippines where my Dad was stationed. I have a form FS-240 Report of Birth Abroad of a US citizen.

To answer your question, check yes if you have it, or no if you don't. I never received it, so I checked no. On the question itself, My citizenship was acquired through parents. And I also used my passport for proof.

I actually wrote a lot more than was needed and was approved no problem. If I had to do it again, I would just write in the little box a couple sentences. Make sure you include boarding passes and passport stamps because it is great proof of you being there at that specified time.

If you have a fairly straightforward case, then you may just end up wasting money on a lawyer, money you could save for other parts of the process, or a trip to visit your fiance. The forms are fairly simple and if you can follow the instructions, follow the guides, then you will be alright doing it yourself. I filed the petition myself, and was approved without an RFE. Just fill in the information they ask for, include some evidence, and you're good.

If the current state does not allow this type of marriage, then the petition would automatically be denied based on not being legally able to marry. For the I-134 you need to provide proof that you can support your fiance with current income. So figure out what your annual income is from your job, and if it is enough to support your fiance, based on 125% of the poverty guidelines, then you probably don't need a cosponsor. For a household size of 2 I believe you need to make just under $19,000. If you do need a cosponsor, they will fill out the same form I-134, just like you will have to fill out. Provide proof to back up your income: employment letter, paystubs.

Put the date when she signs it. The dates on our forms were off by about 6 weeks, because she signed them when I was there in May, and I sent the petition in July. My I-129f form was dated in July but the G-325A forms were dated for May. There were no problems whatsoever in my case.

I think this is extremely risky advice.

The OP would be filing a petition that they are not qualified to file. Page 4 of the instructions for the I-129F are pretty clear as to who may file. If the OP answers no on question 18 and then provides a reason for not meeting that doesn't satisfy the requirement I would think the petition would be out right rejected thereby losing both time and money.


What were your cousin's circumstances?

It doesn't matter if they send you an RFE because the evidence you would send back would show that you met AFTER you filed--they would still DENY your petition because they want the evidence you met before you filed. If you file before you meet again, you can't provide it--its as simple as that.

Not everyone you talk to will tell you the right thing--INCLUDING lawyers!!! The point of the fact is, this is YOUR case and if you screw up on it you pay the consequences--not the lady you talked to nor any lawyer that you may try to get.

If you aren't sure, you should use the co-sponsor just in case. It will not affect your case any differently and in fact may help you. And also let me say that they don't care what the past income was as much as they care to see what CURRENT income is. So the fact that he EARNED (past earnings) more than the yearly requirement will not get him by, as they want to see that he can continue the same earnings into the future when you are here.

The I-134 isn't used for just the K-1 visa process, it is also used for other visa processes in which case the 5 times rule would apply. Also in this case the I-134 only requires 100% of the federal poverty level however for a K-1 visa applicant they will likely require to see 125%. As a K-1 visa applicant you need to show 125% and or show assets that are equal to 3 times the amount needed. Hope this helps.

If the letters are for the interview stage at the embassy, then it depends if the embassy there allows documents to be in English or Chinese. The embassy in Colombia allows the documents to be in either English or Spanish so no need for translations. IF however they are for the I-129f petition, then it will need to be in English.
