YOU can apply for benefits, your fiance cannot. All the benefits you receive you should still be able to keep. I don't think it will hurt your case if you already are receiving them. They will be looking at the co-sponsor's information if you do not make enough. All they need to see is that there is enough money to support your fiance.

Her obligations as a co-sponsor would be to provide support if needed to your fiance. More than likely she won't have to do anything, but in the case that your fiance gets govt means tested benefits, such as food stamps, the govt could ask her to pay them back. If you don't apply for benefits, then she won't have to do anything. Her only obligations she would have would be to pay back any means tested benefits your fiance would receive.

You absolutely DO need police records and court documents for ANY and ALL of the petitioners crimes listed on page 3 of the I-129F....as well as proof of a relationship...a wedding invitation would seem useless as you don't know when you will be able to marry.

I highly recommend you seek a reputable LOCAL immigration attorney if you have any amount of criminal convictions.

Ah yes, you are right...but only if there are criminal convictions. If you answer no to question C part 2, then you do not need to include it. Some consulates require a police report for the interview, but you only need to include the reports in the petition if you have any convictions.

For the petition, proof of relationship is NOT required--however it is helpful to include it. You only need to prove you have met within the last 2 years.

For the I-129F petition, you don't need proof of a relationship--only that you have met in person within the last 2 years. Also any police records are not required for the petition at USCIS. Those would be required later at the embassy for the visa interview. Proof of relationship will also be needed for the interview and I think you can use a wedding invitation as proof, but you may need other forms of evidence as well.

To help you in the right direction, you should start reading the K-1 guide. Hopefully this will help you and if any more questions or doubts just ask!!

From what I understand, they want to see proof of current sustained income, so a letter from your employer should be able to show that, plus your pay stubs. I'm not sure how long you should work for, or what is best. If your income is less than the poverty level, then figure the difference and multiply by 3 and that is the amount you will need to have in a bank account. Example if you are short by $200, then you need to have $600 in the bank. You can use a combination of work and assets to show support.

It doesn't hurt to have a cosponsor just in case!!

There are 2 steps to go through in order to obtain your K-1 visa. The first step, the USC needs to file a petition on your behalf so that you can be eligible to FILE for the visa. Filing for the actual visa happens AFTER the approval of the I-129f petition. The petition has its own fee, and the visa has a different fee. Sure there is a lot of money involved in this whole process, but its the price we pay to bring our loved ones here so we can be together.

Ok I will try to answer your questions.

1: The address to use for your letters, like the cover letter and letters of intent, will be the Dallas Lockbox address. Using this address will be just fine.

2: The forms you need are the I-129f and the G-325A for both petitioner and beneficiary. Make sure you fill out both forms completely and especially answer the question about meeting within the last 2 years. Some people just write a little in the box on the form, others like myself write a litte more detailed and attach it as a supplement to the question. With the G-325A forms, you need to include a passport style photo of each the petitioner and beneficiary behind the corresponding forms. You also need to include proof of your US citizenship, proof of being legally free to marry (in case you were married before and are now divorced--may not even apply to your case), two letters of intent to marry, and finally PROOF of having met within the last 2 years. As far as making copies of your I-129f packet, it is advised to make an exact copy of everything you send to USCIS.

3: The interview will ALWAYS take place at the embassy near where the beneficiary lives. There may be a rare case where that doesn't happen, but I'm sure that 99% of the time it is the case.

4: You shouldn't need to translate any records for the interview, however for other processes you may need to have an English translation made. I know in Colombia it is not required to have documents translated to English for the interview. Other consulates may vary with their requirements.

The best advice to give you would be to read the K1 guide, and I think that it may help you a lot. Good luck in your journey!

When I file my K-1 There was couple forms that would not take date. It cut out some digits. Some times the box was smaller then it should be.
So when I was preparing papers for my fiancee. The one for interview. I used software to unlock pdf and then use pdf editor software to adjust boxes.

If you have same problem and would like to fit some info in form just google for software that unlock pdf and the one that can edit.


What forms would not take the date? If you couldn't get the date to fit, perhaps you put it in the wrong format. It needs to be how they want it otherwise it could be rejected...the same as for altering the forms.

When you file the petition, he has to be legally free and able to marry...meaning he has to be completely divorced. You will need to send a copy of the divorce decree stating that the marriage has ended. It doesn't matter if the divorce date is the same day that you file, just that the previous marriage has ended and he is legally free to marry. I wouldn't worry about the fact you have been seeing each other during the separation, and there is no need to attach the separation document. All they want to see is proof that the marriage has ended.

Ok you can provide support by your income OR your assets (or a combination of both). If you have no income, but have assets such as your inheritance you should be able to use it provided it is 3 times the poverty level for your household size. For a household size of 2, the poverty level would be $18,912. So you either need an annual income of $18,912 or assets equal to $56,736. The assets can be used to offset the income if you are below the poverty line, the difference multiplied by 3 is the assets you will need.

My packet contained:
I-129f form
G-325a form with passport size photo (2 forms, one for each of us)
copy of all pages of my passport
copy of my divorce decree
letters of intent to marry (2 letters, one for each of us)
proof of having met within the last 2 years (boarding passes, itineraries, passport stamps, photos, ticket stubs)

I also included evidence of our relationship, although it is NOT required but sometimes it helps.

All I-129f petitions are sent to the Dallas Lockbox. Based on your address in your petition, they will send it to the corresponding service center and you will receive an NOA1 with a receipt number stating which service center yours was sent to.

Also want to add that there are only 2 service centers that are processing I-129f petitions: California and Vermont. The Texas Service Center doesn't handle these petitions.

Sorry xP this is my first post, i'm not even sure if this is where i go to ask this type of information.

I've checked on the USCIS Fees page and to send in with my petition and all other documents I must have a check written for $340.00 USD...but nowhere does it say who to write the check out to. I looked on the forums here on VJ (Which has been such an awesome website o.O i'm incredibly happy i found it) and i saw someone said to write the check out to the U.S. Department of Homeland Security. Is this correct? Also, one other question. Is there another way of doing all this?? My fiance lives in Canada and i live in America, we want to live together here in America and have figured out that getting a fiance visa (k-1 visa) is the only way for her to come here so we can get married within the 90 day opening. Can we like get married in Canada or America if we just go to visit? not need to get a visa or anything, and then maybe go through another process that is more simpler and less expensive? not to mention the amount of time it takes to get through this process :/ any advice would be greatly appreciated. :) thank you everyone.

You don't file your petition with any service center. K1 applications are sent to a Lockbox in Dallas Texas and they assign the service center. Sending it to one of them directly will only delay your application.


:thumbs: Exactly. The only place you MUST file is the address located in the I-129f instructions, which is the Dallas Lockbox and there is another if you are using a courier service.
