Old Welsh saying. Point being is his fiancee could be paying a tutor for English, and even quit her job to stay home and learn it. This was my experience and I'm sure I'm not alone.

Red Flag must be there. From what you told us here, it seems to be OK. But there must be something more. Filing again without knowing the reason for refusal would not help. I know it's tough.
For god sake, if they refuse my wife visa I would fly and live there for 6 months and do DCF.


What if the petitioner has kids here in the states, you still think that would be a good idea? Most people with stable jobs and strong ties(Kids) back here in the states wouldn't do that. I love my now wife immensely and if we would of got denied I would of made a few more trips over there and do a Cr-1 like most of the Vjer's here are suggesting. Remember you have to be able to support you wife if you ever come back.

You say this because he wires his fiancee money each month? Maybe his fiancee quit work to study english or prepare for her interview, that's what my fiancee did, so I sent her money each month like he did, never a red flag for us.

My fiancee called me her husband after our engagement ceremony. I can almost bet his ceremony was like ours, basically the same as a Khmer wedding but with out the official wedding document. I don't buy a denial for calling him her husband or vice a versa. Some of our letters and emails were addressed that way, never a mention about it in the interview.

Hi all. We have our NOA1 and now waiting for our NOA2, but were wondering what would happen if we were to have a ceremony in my fiancee's home country before getting officially married in the US. According to South Korean law, having just a ceremony is not recognized as an official marriage in South Korea, and therefore the US wouldn't recognize it as an official marriage either, right? We wouldn't be signing any papers or anything.

Having a engagement ceremony is pretty common after filing the k1, it can be used as more evidence when you go to interview. Why would a CO think it's a marriage ceremony when you file a K1 there's no legal documents signed prior. I'd say go for it.

So i asked my Human Resource department for a employment letter and they said they cant do that and gave me theworknumber to verify my employment, i did that and was able to print out a page that verify my income but it doesnt show my annual income. i just got hire on november 19 and i need to show to them that i can support my fiance now but how can i do that when the work number website only verify my income for one month?? But i have a job offer letter when they hired me and it shows my annual and pay rate so can i use this to show proof im working since they wont allow to type me a emplyment letter??


You just have to be persistent with hr. I had issues with mine bothered them on a regular basis until I got it. I never used my pay stubs but if you could get at least a generic letter stating start date and employment statusalong with current pay stubs that could possibly work. Go to your immediate supervisor and ask them to write it, that might work as well. Make sure it's on Company letterhead. Good luck

I read that the child will not need a passport, but I also read that permission from the other parent is a K2 prerequisite. Gaining his permission might be difficult. She never married the father. He oppresses her at every opportunity, and even though he doesn't help provide for this child, he will likely obstruct my fiancée's desires in this matter.


The father will have to consent,my fiancee 1st husband passed away so I didn't have to deal with it.. As far as the passport not sure, my step kids were 13 and 15 when they arrived. Hopefully your fiancee can convince the father his child will get the best education and possibly set up a time later on to have his child visit him when he gets older. Is the father on the official Birth certificate? Might have a bearing on the consent if he's not.

It is an exciting time that you are in indeed! I can remember last Christmas wanting to be with my Rezq so bad and being certain that our paperwork would be completed by then. But trying to guess when the government will get their stuff done is like trying to determine where the wind will blow next. Our NOA2 was approved in November but it wasn't until March before they scheduled Rezq's interview and April before he was coming my way. If you're coming for just a brief visit between now and then like you're thinking, then I can't see any reason why you couldn't come just like any other tourist. As for the interview date, THEY are the ones that will decide when that is and it is like pens and needles waiting for them after you've received your packet and send it back in plus they never do anything very quickly. :bonk: Rezq got his package in December (a month after getting the NOA2) and returned it ASAP but they scheduled the interview clear out in March. Rezq kept in continual communication with the Embassy about the scheduling but it still took forever! My best advice for you is to use this time in between to get all your loose ends done so that once you get that interview, you can leave to be with your (L) immediately following. That is what my Rezq did and we were so happy because the process is incredibly long even when you're at the end! Rezq got his Visa on the 9th of April and was here in the States perminantly on the 21st. The Adjustment of Status is another long wait (we're still waiting for his work authorization & green card) but when you're together, time doesn't drag on like it does when you're apart! :dance:

We front loaded ours and didn't have a problem at all with getting it approved out the start. The only hiccup was during the interview and we got Admin Review BUT they passed us through before a week was up. It was rather smooth for us just took what felt like a very long time!

Yes, include as much as possible. The less you have for proof, the less chance it will be approved or not flagged. They don't want to just know about when you started your relationship they want to know it is still on going. It will look like a book by the time you are done but it is all necessary... especially with the tightened security.

A fiance visa is only usable by a fiance!! If you are married then you are no longer a fiance, therefore making your visa invalid. If you really want to marry first you will have to start the visa process over for a spousal visa.

That part was clear, what caused the slight confusion was the part that said "...any other dependents listed on your most recent Federal income tax return" I misunderstood originally that they had to be on my taxes, but I now understand that part to mean extra people claimed on your taxes in addition to your children. I understand now and will be claiming both kids as wholly dependant.

Hi, I have some doubts about whether or not I should list my 2 kids as dependents on the I-134 form. I did some investigation on my own, and the way I understand it is, as long as I am legally obligated to support them, then I have to put them down. My situation is, my kids live with my ex (she has custody) and I pay her child support every month. I do not claim them on my taxes. So am I correct in saying that I need to put them on this form? And if so, are they 'wholly dependent' or 'partially', since I don't have custody?

You don't need to do the stuff for the I-134 form yet, that will come at a later stage. So you don't need the tax return or payment stubs yet. You should have a declaration of how you met ( a supplement to question 18 of the I-129 form ). The birth certificate needs to be from the petitioner (to prove citizenship). Other than that I think you have everything. Good luck!!

I am not sure on this, but I think they go by the total amount of assets you have, meaning your salary and the assets you have in the bank. If your salary is not enough, then you would need to make sure you have enough other assets to make up the difference. So if you are only off by 192, then (192 * 3) 576 should be all you need in the bank to qualify without a cosponsor. However if you want to play it safe, I would suggest a cosponsor.

This is exactly the reason I am filing the K1 as well. And I think if you file the earliest one year from when you come here you should be ok. Keep in mind that the K-1 visa is valid for 6 months and then you have another 90 days after entry to the US to get married. My fiancee and I are not making any concrete plans until she has the visa in hand.

Yes that is all you need. For the letter of intent to marry, I typed it and had her sign it. She signed in black ink because she didn't have any blue pens. I don't think it really makes a difference how you write it, handwrite or type it, as long as they receive it. And for passport photos, make sure you get the right size (5 cm by 5 cm). I know in Colombia there are 2 different sizes for passport photos: The US size (5 by 5) and the Colombian size which is smaller. Good luck!

Yes you can do everything on your own, without the need for a lawyer. Also I wouldn't worry quite yet about what your fiancee will need for her interview, just focus on the I-129f petition for now. I know that can be nerve wracking in and of itself just making sure you have that petition just right. After you send the petition, then you can start thinking about the documents she will need for her interview. From what I understand it takes about 5 to 6 months to get approved so there is plenty of time to think of the things you need after you send the initial petition. Welcome to the long journey ahead of us!

YOU can apply for benefits, your fiance cannot. All the benefits you receive you should still be able to keep. I don't think it will hurt your case if you already are receiving them. They will be looking at the co-sponsor's information if you do not make enough. All they need to see is that there is enough money to support your fiance.
