Yea, things must have changed since my friend brought his wife over. His parents co sponsored for him for her to come over.

so even if we have his parents as co sponsor back ups, just in case...I'm assuming that won't work??
I've looked at the I-864 poverty guidelines...I have a daughter as well so pretty much I would be financially responsible for 4 people...which i believe is a bit over 28,000 for the poverty level...so if I make over that amount annually than I won't need any co sponsors, correct?

Currently right now I am living at home, but there is a high probability that I will be moving in with my in laws after the new year or possibly after tet. Our families are pretty traditional and since I'm pretty much their daughter in law (minus the marriage certificate) I have a fairly close relationship with them. Both parties are in agreement that since I'm daughter in law, its best I stay with my fiance's family. I will eventually be living with my fiance's parents prior to him coming over. That way his parents and I can assist one another in preparing for him and my stepdaughter's arrival to the US.

What type of questions would they be asking me?
Or is it rather they would be asking him my relationship with his parents?
Prior job I was averaging out anywhere between 25-28k annually however last year and this year I was out on FMLA for an ongoing 3 months period...in doing so my income dropped below the 21k mark....this year I believe including my 401k cash out my income would just roughly be at 21k....but in 2010 it was past 28k...once I get my masters and start teaching I will be averaging out at 43k a year as a first year teacher. Should I include that with the paperwork to show them that I am pursing a Master's to show what I am potentially able to receive?


As long as your making enough money lets say this year that what they go by. Give them employment letter with your start date,annual income and employment status and you will be fine. If you have assets you need 3000 dollars in assets for every 1,000 your short to use as income for the i-134.

You could file for k1 and have your engagement party on your second trip. Explain it in your timeline letter and by the time you go to interview your new evidence will show your engagement party along with more evidence of bonifide relationship like letters,phone records etc. I made 2 trips to Nam and wasn't there for her interview and she made home to me in 10 months. Nothing guaranteed it's the risk I took.

She will be able to finish up in the states. A lot of private insurance covers vaccines 100% just another reason to  wait till she gets here. Warning though when she arrives you will have to find a Civil Surgeon to update her I-693 vaccination paper work which she will bring over in a sealed envelope. There are a lot of crooked civil surgeons out there that will want to do a complete physical at a very exuberant price when she only needs the form updated and maybe a vaccination or two depending on her age. I called several ones that insisted complete physicals($600-$1200) which I knew was baloney. I found one that was honest and updated it and returned it to me sealed for a cost of $26 dollars. You should be able to get this information online from the courthouse, these are public record. By no means a denial of the visa, your fiancée will be made aware of it during the interview.

Correct me if I'm wrong. But I believe Only the Petitioner can do this. The Beneficiary has to unfortunatualy deal with past events. It is up to the Petitioner to gather Documents for the submital of a Petition / and /or Documents in the Event of an RFE.
Since the OP has not disclosed the seriousness of this Conviction. It is guess work. The serverity of the Crime is most important. Moral Turpitude, etc.


Your correct, After learning he was the beneficiary, my post offers no answers that's why I edited it. Personally I would hire an attorney that cut out the guess work if he needed to file a waiver or not. I hired an attorney not for my criminal conviction but for the peace of mind knowing my K1 would be done correctly. You can't put a price tag on love when you decide to petition your spouse from oversees.

Just wondering if anyone has any experiences or knows anyone who has regarding obtaining waivers regarding criminal ineligibility? My fiancee and I wish to apply for a K1 but I can foresee my one and only criminal conviction from 2 years ago being a problem. It was for assault occasioning bodily harm... though technically the uscis cimt consider assault to only be ineligible if there was intent to commit a crime, robbery or rape, or if the assault caused serious bodily harm.

my charge has nothing about intent to rape, rob, or commit a crime. OR do SERIOUS bodily harm.

I really am at a loss here, I need some advice and or stories other people have gone through, I didn't even instigate the altercation in the first place and now I'm stuck dealing with this cr*p as a result of it, missing the woman that I love deeply and it's breaking my heart :(

I had a a aggravated assault which is a serious misdemeanor on my record and addressed it on the I-129f with simple court records which I printed off the internet, never once got an RFE or denial. I am the petitioner, might be a different outcome if you are the beneficiary. Listen to the VJer's on here more versed on the law or contact an immigration lawyer.

No touches since they received our RFE, not a single one. To be honest, I have given up on finding "normal" processing times. I have seen people May and June filers at CSC getting approved, and VSC filers from July. There is no hope with what is "normal".

Honestly, no I don't think it is normal, but as I said I have given up hope on this almost. We may actually look at moving to the Cayman Islands instead, as this process is outrageous. Even both Senators office's here in Iowa say they go off the NOA1 date, but in talking with the USCIS customer service, they said RFE date. Point is that no one has any idea what is going on at USCIS or any of the servicing centers.

:) I think we are on the same page. I do agree that sometimes they get dismissed, but they don't always, just depends on the circumstances, and I think this whole USCIS is so broke that it wouldn't get dismissed.

I mispoke I should have said 15+ million POTENTIAL voters. Reference to the minimum number of estimates of people here illegally, that the government is trying to figure out who to get them here or to stay legally.

It has to be said that a single well worded, personal letter sent to your congressman or senator is worth 100 online petitions. Not wishing to put down the OP, the idea is admirable, I'm just saying that I've seen many online petitions come and go, and they've made little impact, much like email campaigns.

I also wrote to someone at the most widely read city newspaper this evening suggesting a serialized story on our situation. I proposed that they track myself and others through this process while investigating all that is going wrong. Whoever it was that said we need to get the media involved...I was already thinking along exactly those lines. If we all got our local papers involved, that would create enough of a stir that we could get ourselves picked up by television reports. That's where the real pressure is...Anybody else with me...? I am definately with you. Just talked with my Senators office and they told me that CSC said wait anohter 60 DAYS! That will put me at 7 months! Please people, sign the petition. Where are all the signatures of the members of this forum? I would think just on VJ are waiting more than 21 couples waiting for them to get approved finally. Not even to mention all those people they come and surf through this forum trying to find all kind of infomations but aren´t registered with VJ.

The more signatures we can collect the more they will have to open their ears and them to take actions concerning the problem of the eternal long waiting times for getting approved for a K-1 visa (especially with CSC).
What do we have to lose if we sign this petition? NOTHING! We actually only can win something! And if we won´t be the ones who really will be able to see any afflections anymore so maybe at least all those couples will, they still will have to go through this journey after we all might be approved yet. We have signed earlier today too. we will do all we can do to make those people waking up a bit and them to hopefully get some fire made under their butts because it´s not their lives that gets wasted on endelss waiting times, it´s our lives and our times we actually already could spend witn our fiance(e´) in a happy relationship or even marriage. The list is getting longer. I wrote my Congressman two weeks ago. USCIS keeps them in the dark also, and there isn't really anything they can do to "push" any of the cases along. Ok, so I might just be a regular US Citizen that was told to "wait in line" by USCIS. However, at this point I am extremely frustrated and tired. Regardless if I am approved soon or not (God, let's hope so), I wanted to start and do something about these long waits. It breaks my heart to know that based on locality (VSC versus CSC) your application could get approved in less than a month or take 6 months or longer.

I started a petition online, and with as many VJ'ers that are involved with this forumn and probably have friends as well in the same/similar situations. Yes, I know this is a simple start, but I am extremely hopeful and optomistic that eventually this petition could have thousands of signatures so that we can get USCIS to be accountable and to actually allow greet people with the "open arms, not long lines" that is spouted off at the political mouth.

I am doing something similar to call my fiancee. I purchase credit for a calling card so I can call her much cheaper than if I were to just use my cell phone. I can view my call history online as well, which is really nice. They also give me a local number so that I can direct dial, instead of calling an 800 number and entering a pin every time. They have a place online where it has her international number listed and the local number to use to call it. Along with the call history, I am printing a copy of this page and indicating that the local number shown (which is right next to her international number ) is the number that shows up on my cell phone bill. Providing proof that the local number is linked to the actual international number should be all you need.

The forms don't get sent anywhere, you need to print them out. The barcodes are generated based on the information that you type into the form, and it makes scanning it into their system a lot faster and easier. You don't have to worry, I think we probably filled out that form a dozen times before we got it right.

The only Original required is your signatures on the Forms. To send Originals in hopes of getting them back will posibly not happen and they are lost... Don't do that..
Attain Best Copy of Documents and sign and date in ink if needed. DO NOT SEND Original Documents.

You can send copies of originals with your I-129f petition. If you are sending your I-134 information to your fiance at the same time as you send your petition, you are sending it way too early. The information on the I-134 is time sensitive and needs to be recent information for the visa interview. The petition process will take on average about 5 months, in which case your I-134 would be too old. Do not even worry about the I-134 or the information required for it until you receive your NOA2.
