I have a few questions for the I-134. My father has offered to be our co-sponsor and makes well above the poverty guidelines for our household size. My mother (who is married to my father) also works but will not be listed as a co-sponsor. They file their taxes jointly.

Here are my questions:

1. Should my father list my mother as partially dependent on the I-134? Again, they both work and they file their taxes jointly.

2. Will there be any problems because they file jointly but only my father is the co-sponsor?

3. Because my father's income is higher than the poverty guidelines for our household size, does he need to list his bank savings, mortgage, life insurance, etc. on page 2 or can he just list his income?

4. If he just lists his income, are the paystubs and W-2s/ tax forms the only supplement documents he will need?

1. I would list her as wholly dependent, since she is residing in the house and will be counted in the household size.

2. There will be no problems.

3. If his income is sufficient there is no need to list other assets. You can leave these parts blank.

4. For proof of income, your father should have: copies of paystubs, employer letter on company letterhead, the last 3 years tax return transcripts.

Your father also will need to prove his status in the US by providing a copy of his birth certificate, copies of all pages of his passport, or copies of any document that will prove either his citizenship or permanent resident status.

You should go to the USCIS website to get all your forms. When you go do the forms page, it will tell you if they are still accepting outdated versions and/or which versions are still being accepted. As far as I know, the download links they have on their site will allow you to download the most current version available--even if it says its outdated. Using these forms should still be OK.

If you are already in the US you dont need a visa to get married. The purpose of the K-1 visa is to be able to enter the US with the intention to marry. You can marry no matter what visa you used to enter, however the problem comes when you adjust status.

For that question, you don't have to check either...you can leave it blank. In the space below you can write N/A K-1 VISA PROCESS.

Keep in mind that the I-134 is used for different visa types, not just K-1. For the K-1 it doesn't apply, for other visa types it will apply.

On my I-134 form, I did exactly that, I left the check boxes blank, and wrote N/A in the space below. No problems.

There is a bit of confusion on someone being partially dependent or wholly dependent. I am in the same situation, I have 2 sons which I pay child support for and who live with their mother. I put wholly dependent on my I-134. Not exactly sure if it matters if you put wholly or partially, because the CO will still count it as the same...they are your dependents and will be counted in the household size.

I also recommend you wait until you receive your NOA2 before completing this form and gathering all your necessary documentation. The reason is, you want everything to be dated as close to the interview as possible, and it could take months before you receive your NOA2. What you can do is find out everything you need to do so that you can be ready when you DO have your NOA2.

And also if your income is sufficient, you don't need to include other assets.

You are confusing the K-1 visa fee with the I-129f petition application fee. The K-1 visa is applied for AFTER the embassy receives an approved I-129f petition. That said, the fee for the I-129f is $340. Once your petition is approved, the next fee you pay will be the K-1 visa fee (which is $240).

And for your checklist:
No need for both birth certificate and US passport of petitioner...only 1 will be sufficient to prove citizenship.
Beneficiary does not need to include birth certificate, not sure what is NBI clearance but positive that is not needed either.
Proof of ongoing relationship isn't needed either, unless you are front loading your petition for the embassy once they receive your petition.

For proof of having met, pictures are only secondary evidence. You need to include as much primary evidence as you can, which includes boarding passes, passport stamps, any receipts that can prove you were there at that time.

Proof of ongoing relationship is only needed for when the embassy receives your approved I-129f packet. It is completely irrelevant to the USCIS processing of your petition. To get an approved I-129f, all you need is to prove you have met within the last 2 years, you are both free and willing to marry and the petitioner is a US citizen. Anything else is just fluff and will just be seen by the embassy when they receive it.

Not sure what your question is on #1. Passport photos are required on both copies of DS-156. Where did you see you needed 3 copies? And personally I would wait till you get your NOA2 so that your documentation is as recent as possible. Waiting for an NOA2 is unpredictable...it could come tomorrow, it may come in 2 months, you never know how long it will take.

It really depends on many factors. It depends how quickly the service center your petition is sent to is processing, depends how simple or difficult your particular case is, depends on the country of the beneficiary, and probably other variables I can't think of. You will get a better idea by researching the country and how long it typically takes after they receive an approved petition. For the most part for either service center you can expect a wait of at least 5 months.

In my case, I mailed the petition on July 3rd, and my fiancee picked up her visa on November 20. At the time CSC was moving very fast, and I had a simple case with no RFEs. Colombia allows you to make the interview date yourself after you pay the visa fee. A lot of times the wait isn't long. After the interview it only takes a few days after to pick up the visa.

My fiancee doesn't speak English, and we only communicate in Spanish. Our ability to communicate with each other was never a question at her interview. I understand that your case may be a bit more difficult than ours, considering Spanish is a relatively easy language to learn. With that said, I would go ahead and do the first 2 you suggested just to be on the safe side. You may need it or you may not. Also are you able to attend the interview? If so, then if there are any doubts to your ability to speak Mongolian, then the interviewer can ask you questions in Mongolian to see if you really do understand.

You need to have patience and wait. It is very possible that even if you did refile today that you still will not receive your visa until next year. While you are waiting to receive your petition back, you should read and understand the guides and instructions for this process. The instructions are very specific and you need to follow them otherwise you will be faced with more problems and delays. I don't mean to discourage you, but there is a lot of waiting involved after sending the initial petition. Just have patience and make sure you are doing everything right. Good luck!

I organized all my papers according to the cover letter. I used paper clips to keep similar items together. When my packet was ready to be mailed, I simply slid all the papers in a priority express mailer at the post office, and then mailed it.

You dont need to do anything fancy, just put the packet in an envelope and mail it. They will reorganize it how they want it.

I'm not sure if you are aware but K1 is a fiance visa, therefore you can't plan to be married. Now if you are planning on getting married to your now boyfriend you need to look into CR1 (marriage visa), Their is no long the K3 (CR1/IR1) route.


I must have misread the original post, but no where did I read that the OP was planning to get married in the DR...just that she was planning to get married. One of the main requirements of the K-1 fiance visa is being legally able and willing to marry within 90 days of arrival to the US. In other words, planning to get married (in the US of course) meets one of the basic requirements.

In short: If you plan to marry in the DR, you will need to file an I-130 petition (for a CR-1 spousal visa). If you plan to marry in the US, you will need to file an I-129f petition (for a K-1 fiance visa).

When I went to Colombia in May, we finished filling out the forms together, and she signed them. You can do all the work yourself, just ask your fiance for his information and then have him sign it. Remember he will have to sign the G-325a form and the letter of intent.

Yeah you might get an RFE for that, but if you have her correct date somewhere else, or in doing the background checks the adjudicator sees the mistake they make just make the correction. It is very good advice to triple check all of your forms for correct information, and after you are done, check it again. I almost made a similar mistake with my form, because I put the wrong year for my fiancee's birthday. I wrote she was born in 1879, luckily I caught the mistake but my fiancee got a laugh out of it.

Once the visa is issued you will have 6 months to enter the US with the visa. After you enter the US with the visa, your visa becomes void and you will have a new document, your I-94, which will give you 90 days to stay in the US to get married. So all in all you will have nearly 9 months to plan/get married after you are issued the visa.

My fiancee was issued her visa in November, and she will be coming to the US in February. We have not made any concrete plans yet for our wedding, we only talked about ideas and things we would like to do. We are going to finalize our wedding date soon, and start to make the arrangements for a simple ceremony. We plan to be married the first part of March. This is so far how we are doing it.

Note that the K-1 visa is applied for at the embassy stage AFTER your I-129f petition has been approved. The only thing you need to send now is your I-129f petition and $340 payment.

If the petitioner's income is sufficient there is no need to use a co-sponsor. The co-sponsor cannot augment the petitioner's income, they need to be able to provide support on their own based on their household size. In other words if the petitioner's income is short, the co-sponsor cannot just 'add' the amount they have in savings to help. They would have to fill out their own support form, and meet the poverty guidelines for their household size plus your fiance.

When I filled out the I-134 for my fiancee, I only included my income. I had my employment letters, paystubs, and last 3 year tax return transcripts. I also included a co-sponsor, who only included his income, employment letter, transcripts and paystubs. I included a co-sponsor as a 'just in case', because although my current income is over the 125% mark, my past income was not. At my fiancee's interview, as we gave them all the paperwork, they handed back my co-sponsor's information--they didn't need it.

If your co-sponsor has enough in income to support their family PLUS you, then you don't need to put any information down about their savings. You can't use their house if they are living in it because it would create a hardship. If their income is barely sufficient, or maybe even lacking, then including assets such as their savings will help.

If your fiance does not have a job now or will not be able to use his income as proof of support, he can use his assets instead like his savings. The problem with that is, he will need to have 3 times the poverty limit in savings for his household size. So he would need close to $60,000 in savings based on just you and him.
