Good Luck.......................when i visited while going through the process i took my NOA1 with me, which i'm glad about as the officer asked me how our marriage worked with me in the UK & Hubby in the US, & did we have plans........i said uh huh we are currently going through the immigration process, he asked did i have any paper work for this to show him, and i did :D ...................but i also took other ties back to UK to show i would be returning :thumbs:

Go to a lawyer or a judge . Someone that licensed to practice law . Bring someone that has know your fiancee since birth , that can state the date time location and names of both of her parents . And have it notorised , they have documents in vitanam that have a notory seal too . But this will only be excepted if there is no such record of your fiancee birth , its covered within the law to have this done ( in case of naturial disasters , like fire water ect. ). But you need to have a document stating that there is no such birth excist in their records . And the explaination from them why her birth doesnt excist .

It should take around the same time , it took for you too receive your both noa CSC . For you too receive the letter from NVC , it took us 8 days . In the letter from NVC it will say how long it will take NVC to process your paperwork there , and then it will be fowarded to the usembassy . After the Usembassy receives your paperwork , you will not know how long it will take them too send your fiancee or wife/husband recieve their k-packet from the usembassy . And if its fiacee visa k-1 expect to receive your letter from Usembassy saying you are ready to setup a visa interview at the embassy a good month after your fiancee , gets her/his k-packet . They dont use United States Postal Mail , cause its not dependable , they only used a guarente service . To send your documents , and for good reason .

Your son would be comming to the USA later than you , around 6 months . That question means , who will be acompanying your son at the time he arrives in USA . You need to show the current place you live in Philippines , along with Police Clearance of all the places you have lived for a total of 6 months . ( which means if you have lived at those places everyday for 6 months ) Since the age of 16 . Just don't forget your NBI ( National Berua of Investigation ) , this document is very important . The passport type photos have to be 2"*2" in size , non glossy ( which mean not sticky to the touch ). You must stand against a white background , looking right at the camera , and no shadow behind you ( you will have to have the same amount of lite on you as the camera ). thanks for the replies guys. DaniG, where do I get the apostille? Also What do you mean by the marriage licence saying that I will be changing my name. They never asked anything like that. I know they ask in Bulgaria, but they didn't ask us here. I am also thinking about doing it myself when I go back next year, or earlier. Just worried about the whole traveling thin and the name on the tickets, etc.


You can get an apostille only in the capital of your state, usually in the capitol building where the office of the Secretary of State is located. I think they do it by mail too. It is a page certifying that the document was indeed issued by the US authorities (and states the agency and person that issued/notarized it). You need this on your marriage certificate, otherwise they would not take it in Bulgaria.

The name change on the marriage license depends on the state where you got married. Some states allow you to change your name at the time of the marriage, while in other states (such as Massachusetts, I think) name change is a separate procedure from marriage because they decided it was discriminatory or something (that's what I've heard from Americans at least). Now, the thing is that Bulgarian law allows you to legally change your name only in two instances - when you get married and when you specifically petition the court stating a valid reason for the name change (+ adoptions). This is why if your US marriage certificate does not say that after the marriage your name will be Mrs. "Husband," in Bulgaria the clerk registering your marriage will refuse to change your name unless you go to court to do it.

I think there is an exception to this in cases when the country where you got married does not allow you to take your husband's last name at the time of the marriage (one of the Scandinavian countries was included, and they require you to present some kind of certificate either from the consulate of the country or the BG Ministry of Foreign Affairs, I don't remember) - then they can allow you to take his name when you register the marriage in Bulgaria. I don't know if they would do it for a state, however. If your marriage certificate does not state that you take your husband's name, it would be a difficult task to change it. But if they put it in the translation of the US marriage certificate anyway, that's all the BG officials would read - they will not even care to see the US certificate in most cases and will write your names exactly as they appear in the translation.

Also, the BG embassies do not make passports - they just forward the application to the Bulgarian authorities, who send your passport to the U.S. in several months (they are trying to make that faster with the new passports but it will still take at least 3 months to receive your passport).

Littlecrazyangel, yes, you are right in general. But the Bulgarian embassies would return you if you do not present to them the Bulgarian marriage certificate I described above without caring how many hours/days it took you to travel to the embassy (the reason is that they want to make sure your marriage was registered and your new name is in the BG system before they let you apply for a passport with the new name - stupid and burdensome, but go argue with them!). I have personally spoken about it with three Bulgarian consular officers and they all told me they have the same document requirements, which are also listed on their website, I believe. I need to change my passport urgently because mine is expiring and I would have just gone to the BG embassy instead of sending documents back and forth if it were possible; alas, it is not, they were adamant about it.

For other countries,the procedure is probably different and in most cases much easier.

For anyone getting married in the U.S. and wanting to change their name in their native country as well, I would recommend calling the embassy or the passport-issuing authorities before the wedding and informing themselves about the steps they need to take.

I just did that. You have to have one of your parents go to the municipality where your permanent address is and ask exactly what documents they require (BG public officials always know best and rarely follow the same standard, so in every municipality it can be slightly different). You can only change your name if your marriage certificate explicitly states that your name after the marriage will be different; otherwise you can do it only by hiring a lawyer and petitioning the court in BG.

Anyway, the documents I needed for my BG name change were:
  • marriage certificate with apostille (from state capitol) - my parents then had it translated in BG
  • hubby's birth certificate to show he is a US citizen (they need that for their database)
  • a copy of my passport because they wanted to see the visa with which I entered the US (no idea why)
  • power of attorney (pulnomoshtno), so that my parents could file all that in the municipality without me having to go back to BG - with apostille because it was notarized by a US notary. If you sign it in the BG embassy, you do not need an apostille, but the BG embassy was too far away for me and the apostille was much cheaper than what they charge.

When you (or your parents) bring all these, the municipality in BG issues a Bulgarian marriage certificate, which states that your name after the marriage will be [new name]. They do not return your original documents to you.

You go to the police in BG or to the closest BG embassy or consulate with this BG certificate (original, they do not accept copies) and now you can apply for a passport under your new name. They will not accept the US marriage certificate in place of the BG one (but you should bring it too, to show them how to spell your name in English, otherwise they will use the stupid conversion table)!take

There are a few different ways that you can be refused, and it's important to know how they did it.

Eveline is correct - even if he gets a visa, it is still the decision of the officer at the border whether he will be admitted. If he gets the visa and you want to be sure you get to see him, may I suggest having him fly into Canada. You could meet him there and spend some time together. He could then cross into the US via a land bridge. We find the border crossings there much different than at the airports.

If I remember correcty I had them attached (stapled) to the form.

Don't worry too much about that stuff, Frankfurt is a pretty relaxed consulate and they will tell you at the second window if there are things they want different with your paperwork. I think I went to the first window to pay, the second window to make sure all my documents were completed and in order and the third window was the actual "interview" which was basically a nice chat between my husband and the CO, with the occasional question for me :lol:


Thanks, I emailed them and they told me not to worry about attaching them just send them with the forms and they would attach them.

The forms were mailed to Frankfurt today.

I have a few questions Im not sure about. What if I sponored my daughters husband? But he hasnt been issued a visa or even a interview date yet. They are still waiting for their date. Im not sure how this sponoring thing works cause my daughter at that time did not have any tax returns at all just her employment letter. She does now have a 2005 tax return So how does this work? Am I the joint sponor the cosponor? Who marks this section about other previsouly sponored immigrants since we live together still?

Any help I would really appreciate Im new to this and its confusing I get double the work on this form I guess. Im kind of lost on this form and totally dont understand any of it. I just know I did the papers for my son in law. Thanks.

But they told me they mailed the form I-864 on this date of the letter I got today. But this is not the I-864 so whats wrong? Wheres the form? Im glad your husband had his visa approved and will be wtih you soon! But I dont think this process will go that fast for me! I know someone still waiting for a date since early January and the NVC now will not even answer their questions or anything really rude to her. Thanks for your help!

I have a question it just seems weird to me. I just paid my $70 fee for the AOS fee and returned my DS-3032. But today I recieved the next fee for $380.00. Shouldnt I receive the I-864 first? Then this? Im not sure but I dont think it makes sense! Did they forget to mail it to me?

I was just woundering if it might be ok with the National Visa Center or if anyone has done it before. But What Im trying to ask is when you mail forms and everything to them they want your case number on the upper right hand corner of everything. There is some things I dont want to write my case number on them cause I will use them later once we get them back (and I dont want every other place we use them at after this to see my immigration number or anything). So I was woundering would it be ok if I made some labels on my computer and just put them on instead?

They approved mine on February 27, 2006 but the National Visa Center didnt recieve it until March 6th, and then on March 8th they assigned my case number. Mine was sent originally to the Nebraska service center then transfered to California. Hope I gave you some help or a better idea atleast.

The RFE finally came in the mail today. So far we have recieved two RFE's for the DS-230. One of them was just cause we had to wait for the papers to arrive here from my husband. But what was wrong was we didnt send any copies of his passport being renewed and forgot to include from age 16 in addresses. So I hope we can get this turned in and CASE COMPLETE by July 1!
