They give the same information as London Embassy, and there isn't that ridiculous toll. You can also email London at londonconsular@state.gov. Put your LND case number in the subject line and keep it concise and they may or may not respond.

Definitely do come hang out in UK forum! You'll get lots of good information there if you ask for it.

The letter said we are in administrative processing and they need emails, letters, cards,photos, to be sure about our relationship. They returned passports, but kept birth certificates and I-134 form as well as the I129F file.

What does all this mean?


Give them what they ask for. Lots of people go through this and end up getting approved. It doesn't necessarily mean you'll be denied.

In Warsaw home page is writen they charge 8 $. But when I called, nothing was charged from me more then usual international call.

My RFE's have still not been received. Anyone else in this situation? It's been a month, and no confirmation yet.

I honestly can't imagine why this is happening. It's making me very sad :(

yup, me too.
we sent back both RFE's...one in early july, the other mid-july.
no updates on our case at all.

I received my NOA2 for K3 in the mail yesterday.
I haven't received any emails nor has the USCIS website been updated for my case since
July 3, when they notified by email and website update that they had sent the first IMBRA RFE.
No touches, no updates..................but in the mailbox yesterday, an I-797 (NOA2) for K3 approval date of July 28 :dance:



Same thing happened to me today. Website wasn't updated (last update was a touch on 7/31), but got the approval notice in the mail. Nice pleasant surprise! My timeline's updated if you're interested.

while i was getting my I-94 and such, the border officer told me that i had to get advance parole in order to leave the country.
is this true?
i told him that i was under the impression that this was not the case for K-3 visa's.
he was like, "no, no, no...all visa's need advance parole."
i swear to god i read on the uscis website that K-3 visa holders do not need to apply for advance parole.
i am a bit confused.
i am beginning to wonder how much do border officers really know??



Hello,

May be he thought that you have filed for the AOS but being on a K-3 status you can move out without the AP. The K-3 is good for 2 years to travel and work.

If a K-visa applicant requires a sponsor (most do, but some may have adequate financial resources of their own), the consular officer may ask for an I-134 from the proposed sponsor if the officer thinks it will be helpful. There is no absolute requirement that I-134 be provided, its use is at the discretion of the consular officer.

I'm surprised that someone at the consulate was able to tell you that I-134 is not going to be required in your case unless that person has seen your financial information and is also the person who will be processing your visa application.

For k-3 visa the NVC processes your case after USCIS , and sends the Petitioner a packet with the proper paper work . And checklist of what too do , and after the Usembassy receives the Paperwork from NVC , the Usembassy will send a packet too your forighn fiancee . And after the all the stuff is done NVC will setup the interview .

But in k1 visa , the NVC just sends the petitioner a piece of paper with your case number on it . And says a website , which you visit and follow the instructions . Like filling out the i-134 and sending it too your fiancee . And same in k1 as k3 , your fiancee will receive a packet from Usembassy after they receive your file . And gives her instructions too complete .

If your married allready and you file the I-134 instead of the I-864 what your supposed to file . Your visa can be denied , the I-134 is for non family based visa only . And the I-864 is only to be used for family based visa , and k3 and k4 visa is a family based visa . When k1 or k2 visa is a non family based visa . And your wrong in your post it says your visa is an non-immigrant visa , your visa if its a k3 is an immigrant visa . K3 visa means allready married , but no childreen .

If you are allready married , you dont file the I-134 Affidavit of Support . You need to file the I-864 Affidavit of Support instead , the I-134 Affidavit of support is only for if you are to be married to a non us citizen , or for other non family based visa . And the I-864 Affidavit of Support is for family based visa only .

The same rules apply for the I-134 Affidavit of Support and I-864 Affidavit of Support , so you should use both instruction on both . Cause soon You will be filling both of them .

The documents don't need to be in a specific order , it only needs to be organized in a way . That will make it easy for you , at the demand of the councel when they ask for it . (its not good to have them waiting along time , while you go through thousands of papers . Just to find the one paper they ask for). My fiancee use many folders , and she put all our Postal mail and other evidence of our relationship in one folder . All our money transfers in another folder . All the odd stuff in another folder (things you not sure to put them in which folder), all required documents in another folder , with a list for easy reference , of each thing you have and which folder it's in (just in case). And each folder she put in carry case , to make it easier to carry and protect from damage in case of rain , or accidental lost by slipping out of folders if you carry by hand . In each folder it's a good idea once you have it the way you like , go through each folder one at a time . And put it in order acourding to the date , or the order it happened . I hope this helps you , and good luck in your interview .

Counsel can extend your valitivity of your interview . But they will not let you resecudle your interview , once its secuduled which means you will have to let them know by calling them . Then after your interview date , you will have to call again when your ready for the interview . After you receive all documents . If you go too the interview , without all the documents you need . The counsel can deny your visa . My fiancee went too her interview , but she was able too prove our relationship , but there was a problem with my Fiancial Support documents . She didnt have all the documents needed to prove at the time of interview , that my annual income was above the Federal Proverty Guidelines , for 2008 . But what they seen on my check stubs , they were satisified with what they seen . And knew i could meet the requirement , so the counsel just put her visa on hold , untill i can send all the needed documents to show the embassy . And now my fiancee has her k1 visa in hand , and we will be together April 05, 2009 , so what im trying to say is . what ever you bring to Usembassy . The counsel will use that , if you dont have enough proff at the time of interview , they will not grant your visa . If you have more than enough proff they will grant you the visa .

Belovedbyme is right , you need your annual income at 125% above the federal proverty guidelines . Right now for houshold size of two , its $17,500.00 but on March 29, 2009 it changes too $18,212.00 . Which right now you would have to have an annual income , of $20,000.00 before taxes . But if you read in the I-134 , it says you can claim 3 most recent tax years which will help you alot if you were employed with full income in that time . And yes with I-134 a Co-sponsor will not help you much , she will be your wife . And they want too see you supporting her , not someone else helping .

The Instructions still for the I-134 still say it needs to be notorised , but there is no where on the I-134 to have it notorised . But i had ours notorised even though there was no room on the i-134 to have it done . And the court house wouldnt notorised it , but i showed the instructions to the notory of public where it says it needs to be notorised . And all the notory did is write signature with a line above it and date with line above it was sworn too me at with line above that and my commishion expires on with a line above that and filled in all of that . She then stamped the i-134 with the seal then i signed and dated it . I personally do not know if the usembassy would have a problem with it not being notorised , but i did'nt want to take the chance . And have to wait longer on administrative review . By sending the i-134 again too usembassy with it being notorised

You will have to wait for the letter from NVC first , once your letter arrives . It will instruct what the petitioner needs to do , then after the Usembassy recieves your file from the NVC . Your fiancee will recieve a K-Packet from Usembassy , that instructs her what she needs too do , after both of you complete both of your requirements . Then you can setup the interview in Usembassy , and if you pass the interview you will receive all the documents back at the time your fiancee gets her visa . And it will be in a sealed envelope , that says do not open can only be opened by immigration officer at port of entry . If you open the envelope , they will not let your fiancee enter the USA . This ensures the Department of Homeland Security , that no documents have been changed , or they are the originals from the embassy . Cause at the time of her arrival , it gets forward too DHS and she will be entered as legal entre into the USA .

That would be my read but I would caution anybody from jumping to conclusions on initial denials. Typically there are two types of "denials", the "show me more and maybe" and the "definitely not, sending petition back to USCIS". Without knowing the exact wording on the written notice we cannot predict which one of those these is but generally financial concerns are allowed to be addressed and the initial denial overcome.

I suspect a careful read of the notice will confirm that's the case. If so, what is needed is a co-sponsor. On the other hand, posssibly this is Manila where they don't always accept co-sponsors. We just don't have enough information to know which kind of "denial" this is yet.


Usembassy manila allows co-sponsors for sure , i was told this when they said i didnt meet the federal proverty guidelines . But the fact is , they only except what they see with their own eyes . We just had missing fiancial documents , thats all , she has her visa now , and april 3, 2009 she is leaving philippines and april 5, 2009 she will arive in usa . and in the blue piece of paper it will say you can have a co-sponsor to help you

Her Visa was not denied , what happened was her fiancee doesnt meet the federal proverty guidelines . And since he doesnt meet the requirement , she may become a public charge under the law . Same thing happened too us , and i still meet the federal proverty guidelines . But she had missing documents too prove support from me , she has her visa now and april 3, 2009 she is leaving philippines where our future together starts . So what she should of got was a blue piece of paper , that says you dont meet the federal proverty guidelines of $17,500.00 . To fix this you have a few options , get a co-sponsor or another part time job besides the one you allready have so you meet the requirement . And once you do send the documents too her so she can foward it too the usembassy in manila allong with her passport . And a photo copy of the letter , the counsel give her and your new I-134 , and harrass the Usembassy offten as you can . Ours took about a month and a half , for them too get too our documents we resubmitted too the cousel . And this puts you on whats called administrative review . ( i dont mean call the Usembassy puts you on Administrative Review , i mean if the counsel needs to review something after the visa applicant goes to his or her interview ). Its called Administrative Review , and its not nessasarally a bad thing . Its just a name , only bad thing is what your going through in waiting for the counsel decision . Good luck , and i wouldnt give up
