Canadaweird topic but: bringing christmas gifts to canada
just letting you all know that we had no problem at all.
i decided to chance it and wrap all the gifts.
the border officer didn't say a thing about it.
all he wanted to know was how much money we had in gifts and what was the most expensive gift.
he didn't say a word about them being wrapped up.
:)

Canadaweird topic but: bringing christmas gifts to canada
hi everyone,
i have a weird little question:
will i be able to bring wrapped christmas gifts into canada when driving from the USA?
i want to wrap all the gifts for my friends and family before we get there, but will there be a problem with that at the border?
just wondering if anyone can share their experiences.
have you ever been asked to unwrap gifts so they can see what is inside?
because that would be a huge pain in the #######.
i hope i'm not wasting my time by wrapping all these things.

US Citizenship General DiscussionQuestion Regarding the Exam
QUOTE (pars3221 @ Apr 2 2009, 04:11 PM) <{POST_SNAPBACK}>
Hi All,

Well the wife is started to study for the exam, but I had a quick question regarding how to study for the exam using the study guide

for example

2. What does the Constitution do?
? sets up the government
? defines the government
? protects basic rights of Americans

or

12. What is the “rule of law”?
? Everyone must follow the law.
? Leaders must obey the law.
? Government must obey the law.
? No one is above the law.

do you have to know all three answers or just one is sufficent?

sorry for the stupidt question, but rather be safe than sorry.

Thanks for your help

You are an american citizen , and you dont know those answers . Are you for real

US Citizenship General DiscussionN-400 - SEPTEMBER 2013 FILERS
We just received a letter from USCIS today. Asking for Form 1722 from IRS. I guess when we sent the N-400 our W-2 and copy of 1040 were not enough for them. I don't like to pay a tax professional to prepare our taxes when we can do it our self. I just got done requesting transcript of tax form for the last 3 years from IRS which will take 5 to 10 days to get in the mail. I just hope this is the right tax information USCIS needs at the interview. We are still in line for interview scheduling since October 14. We can't wait for all this to be over with the government it has been over 5 years with all the processes

Uh oh... was thinking - does my fiancee have to have a Social Security Number in the US before we can get married???

I believe it does vary from state to state. We were married in North Carolina and it is required. However, since I am Canadian and do not have a SSN the clerk's office had a standard affidavit that I signed and they notarized indicating that I was a non-resident and as such did not have a SSN. Problem solved! You should be able to find out from the office where you obtain your marriage license. Good luck.

A non american citizen cannot get a SSN , a fiancee of an american citizen does not make an american citizen . But marriage to an american citizen makes for an american citizen , ( a K-1 visa holder is an american citizen based upon the marriage of that american citizen ). Which means to apply for a SSN you must be married to the petitioner with a still valid k-1 visa within the 90 days . Maybe people should read the document for obtaining an SSN from SSA on visajourney or USCIS website .

Sounds kinda perverted huh? lol! smile.gif

During the course of your file being with them, it will sit in numerous piles and desks.... whenever it is handed off from one desk or another, or someone reviews it or handles your file in any way (by updating their system etc...), that is considered 'touched' where your file has been looked at, moved, reviewed etc.... sometimes you may never show a 'touched' during the course of your application, other times, as they shift duties internally, your file could be touched 100x!

Some people like to put hope on that or follow it, as they feel like they are getting progress, I wouldn't put too much emphasis on that, as I would normal time lines... like if it's been 5 months and you've heard nothing.. then it may warrant trying to follow up.

Hope that helps, as reading it over, it seems as cleqar as mud! HAHA!

What are the differences in these Affidavit of Support forms? I know my checklist says to complete the I-134, but I dont know how I got it in my head that I need to complete the I-864...

Depends on the type of visa that you filed . The I-864 Affidavit of Support is only for family based visa , and the I-134 Affidavit of Support is for non family based visa . Example if your allready married to a citizen of another country , you must only file the I-864 Affidavit of Support when you are asked to show your fiancial support from the government . But if you are not legally related to the person ( Marriage or family member ), then you only file the I-134 Affidavit of Support . Then if you do become related to the person due to marriage or other means , you must file the I-864 Affidavit of Support . When it's requested from the government to do so during the AOS .

So, I am being paranoid.

I confirmed with Montreal a few days ago that the NEW I-134 FORMS DO NOT NEED NOTARIZATION.

However, I am worried because on my checklist, it listed "Notarized copy of I-134" and I had checked the box that YES SIREE I have it! (When I did not wink.gif My fiance and I downloaded the new form and just used that.

BUT I was sent the old form in P3 and am worried that maybe they sent me the old form because they WANTED it notarized (IE, maybe I am a special case).

Ugh.......is it April 18th yet? wink.gif

ANyway, so I am debating just saying to hell with it and getting the OLD form notarized and having my fiance FedEX it to me.

How much does it cost and does it tpyically take weeks to get it done. It would be done in VA.

Thanks good.gif

(1) the new I-134 no longer needs to be notorized , but the old ones do ( but they are expired look at the top of the form you will see the expiration ), even if you use it in usembassy they will not except it ). From what i have read doing research is , if in anyway you fell you have not enough proff of being together . And time to remove the conditions of residence , following the 2 year after you are married . The best opition you have is , to have a family member or friend that you both know . To come with the both of you , to your local court house . And have your friend swear under oath , in writting that he know that the both of you have lived together and have been husband and wife since the time of your marriage . Then you have your friend or family member statements noterized , by a notory . Make one photo copy for your records , and send the original to uscis . With all your other paperwork . I hope i have helped in some way .

God Bless , both of you , and i hope you both have a very happy future together .

Removing Conditions on Residency General DiscussionStupid repeat question, probably
QUOTE (wheeler04 @ Mar 20 2009, 08:54 AM) <{POST_SNAPBACK}>
Sorry if this is a repeat, I just don't have time to exhaustively search forums, so I'd like to tap into the bored, public database of knowledge....

I seem to remember that when I filed my wife's I-485 back in 2007 that the time window to file the eventual I-751 was 180 days (6 months) before expiration of the GC.

But now I read it is 90 days (3 months)? Whatever, memory is fading in my early 30s....

The importance of THIS however, is that I'm not really optimistic a decision will be rendered within 3 months, even though it SHOULD basically be a formality.

So are a boatload of people walking around with expired temporary GCs while they wait for their I-751s to be approved? Or is there some kind of travel/waiver form like with the I-485 that you can submit - and SHOULD submit - so you can leave or get back into the country while you are waiting for the USCIS decision?

Thanks in advance, all...

That is only a limitation to file the proper forms , no need to worry the first adjustment of status is in 90 days after you arrive , then when the two years is over on your conditional residence you have 6 months up to that time to adjust your status again to get green card . You have nothing too worry about as long as you didnt past the 90 days to file adjustment of status , or the 6 months to adjust status again to get green card . ( as long as you filed the adjustment of status before your legal status expires , you are still good too go ).

US Citizenship General Discussioncollation with expired car insurance - ramifications for Citizenship

If you don't mind me saying you're looking for excuses to get out of almost everything in this situation. Are you asking VJ members to condone or help make excuses for you? You 'forgot' to renew insurance, you weren't following too close, you want to claim extreme hardship so you can avoid paying your fine. The facts are the facts...you didn't have insurance, the policeman noted 'no insurance' (which is true) on your ticket when you had the collision and frankly if you can pay car insurance you can pay a fine.

Really, my goodness...man-up (or woman-up which ever the case may be) and take care of your situation without trying ways to get out of it.

I don't think it's just about excuses or being a coward in some way because that's a quite significant fine for any family's budget. And it goes into the state budget, not to the person that was rear-ended. And people genuinely forget sometimes, that's why the banking industry makes so much money from late fees. That's why in some jurisdictions it's actually the unwritten policy to let you off on some offenses if you remedy the situation promptly (e.g. forgot to renew registration, headlight not working, etc.) If you choose not to use the loophole in that case, it's your loss only, like not using a tax deduction when you can cause manly men are in the high tax brackets. If that court's policy is to not let this particular offense go without a fine, then the judge will make sure you pay up no matter what you tell him (well, unless you have really compelling evidence that it wasn't your fault). I don't know if they would let you get away with having no insurance given that you caused an accident (I personally doubt it) but it wouldn't hurt to show the judge that you have renewed it, say you forgot to renew it and politely ask if he would be willing to give you a break this time. If they gave you several tickets, sometimes you can even strike a deal with the county attorney to plead guilty to some and get some withdrawn - call them and ask (good to do also if you want to be done with this fast so you can show immigration how it ended without having to wait over a month for your hearing).

Also, car insurance policies often have a grace period where they don't drop your insurance right away if you pay within so many days. Not sure if this is the case, but worth checking.

I sent mine in a flat-rate express mail envelope. The post office clerk said it couldn't get any faster than that (unless you went to FedEx) but priority would cost about twice as much. You can track it online and print a delivery confirmation for your records. With this option the package gets from IA to CSC in 1-2 days, which for me was good enough.

Removing Conditions on Residency General Discussionremoving conditions letter
The same thing happened to us. I filled out the online form for change of address as soon as we moved, and US hubby sent them a paper form and got a receipt from them acknowledging change of address. I have copies of both forms, so I am not worried. It must be something they send based on the info in your AoS petition, because the letter they sent was addressed to D. "Last name", and I never abbreviate my first name. I think it's a problem with their system, where they just fail to update all their data when you send in new info. It's common in large institutions, happened to me in college too - for 3 semesters after graduation, I kept getting letters from the Foreign Student Advisor telling me that I had violated the conditions of my student visa by not signing up for courses, and every semester I had to call and explain that 1) I have graduated, 2) I am a resident & 3) they are idiots.

I have a friend who sent all other kinds of evidence (including common child, financial, etc - her husband is in the military, so she had a ton of docs showing mingling of assets, joint residence and travel together) and she got an RFE specifically and only for the affidavits, which she thought were not important. I notarized ours, it's pretty easy to do in any bank, law office or bigger business and it's usually free.

Removing Conditions on Residency General DiscussionIs my I-751 Package Complete?

We have a joint bank account but differently numbered cards. I honestly thought that was standard. No?

Hmm... this is the first time I hear of a joint account where the cards don't have the same number. We have a lot of accounts (bank + stores like Home Depot, Lowes, JCPenney, etc.) and all our cards have matching numbers. On the AOS interview, the USCIS officer specifically asked to see our joint account cards and said he was looking for the same number on both cards, of which he made copies there. You might want to get a letter from the bank explaining that it's a joint account with cards numbered this & this and maybe open a couple of joint store credit cards just to be on the safe side if they RFE you or ask for that on the interview later. It's just my personal experience though, it would be good to hear from other VJ-ers as well on this.

In addition to more bank statements from various months within the two years, maybe add copies of debit/credit cards that show the same number for both of you. That's what they asked us to show at the AOS interview and luckily we had those with us, so this time around I sent a whole stack of bank statements + copies of all cards that we have in both names just to be on the safe side.

If you have joint title of any of the cars (or any other big purchase), you could send this as well, but it's not as important considering all the other stuff you are giving them.

Removing Conditions on Residency General DiscussionPlease correct me, but is this all I need to send in?

you need more then that.you need to show a bona fide marriage every thing togather jointy,as husband an wife.your joint banking credit cards, your insurance, filed joint taxes, your utility bills.your rent or least receipts, did you buy any thing on credit car, household goods, showing both names on the reciepts, any medical bills, child in school report card, your church dues receipts, a letter from two friends affidivit of support that you both are a loving happy married couple, cell phone bills, some junk mail at your address trips togather, some pictures with family and friends togather dates, wedding photos, copy of both driver license showing the same address.this is just some things you can use or put togather, tax transcripts are very good, any thing finicial.

Definitely add as many financial documents as possible - USCIS loves that. Even if you are a student and she doesn't work, you have expenses that you can show you've been paying jointly - joint accounts, copies of joint cards from stores, medical bills as above is a good one (I'm sure you've had them for the kid), even medical records that show you're listed as each other's emergency contact and as the kid's parents (call your doctor for a copy); any other records listing each other as emergency contacts; car insurance listing both or any other kind of insurance (life, health, renters); if your parents paid any of her expenses or vice versa (travel, med bills, rent, tuition, etc. - give them the bill & copy of payment) that's a pretty good sign of bona-fide marriage; any other documents that list your status as married.

Look at page 2 of the I-751 instructions and try to have as many documents as possible for each of the 5 categories listed - be creative: http://www.uscis.gov.../i-751instr.pdf

The following recent thread, among others, has a lot of good info listed concisely: http://www.visajourn...e-past-2-years/

Removing Conditions on Residency General DiscussionNeed help on the documents
The general consensus is that USCIS doesn't care about utility bills too much - they prefer the "real stuff" (bank statements, mortgage, insurance, 401k, etc.). The reasoning is that you have to pay for utilities married or not, but for example, few people would pay for their spouse's health insurance or put them on their 401(k) if it's not a real marriage. If you have joint utility bills, by all means send some, they're not going to hurt you. If you don't, send more of the other kinds of evidence. I only sent one utility bill from a couple of months after I first got my green card. Then my husband and I moved into our house and we didn't even bother to put the utilities in both names since the deed and the mortgage are joint.

They add a lot of other additional information to the letter that doesn't apply and can mislead people, but about 1/3 to 2/5 of the way down - it clearly states it is for biometrics. *** too early in the morning for a three hour drive, but oh well! *** I am glad that it came so quickly - filed on June 17th. US Embassy and Consulate DiscussionVaccinations required for K-1
The doctor lied, vaccinations don't expire in a matter of months. They expire in a matter of years, if ever. For instance, two MMR vaccinations (supposedly) ensure life-long immunity. Tetanus (Tdap) is every 5 years. (HPV is no longer required, but I believe it's life-long like MMR.)

US Embassy and Consulate DiscussionFiance got laid off from job before NOA2
JohnAnwesha, you're still waiting for your NOA2. According to Igor's list, there's a good 70 days between NOA2 and interview for India. With more than two and a half months (roughly), your fiancé should have enough time to find *something*. Apply to everything, use job agencies (including the unemployment office) and don't be too proud (take a job that's 'beneath' him, like the night stocking shift at Walmart, if that's what he can find) - as long as he makes at least $9.25/hr, he should meet the poverty guidelines.

For your petition, no matter what the category, he had to put up 3 years of tax
returns and presumably those showed enough income for you to complete your
visa approval without a sponsor.

FWIW, this is dependent upon the embassy. I don't know how many years of evidence India requires for the I-134, but Brazil only requires the most recent tax year's return. Rio doesn't want pay stubs, letter of employment, etc, just last year's (in this case, 2009) taxes & proof of citizenship/LPR for everyone who is filing a I-134.

US Embassy and Consulate DiscussionTo attend interview or not
It may not dispel them all - they will probably be concerned that you don't share a common language, because how can you have a strong, stable relationship if you can't communicate? Be prepared to answer (and how you intend to fix it -- you learning Spanish, her learning English, both) that regardless of whether or not you go. Going may very well tip it in your favor despite the lack of a common language.

US Embassy and Consulate DiscussionFiling tax returns without meeting the minimum income
Do you not want your money back? The tax tables are for the adjusted gross income (AGI), not your actual income. In 2008, the personal exemption was something like $3000, so your AGI was $0, and you're entitled to get a full refund. Granted, it's $37, but that's a six pack and a pizza, or whatever floats your boat.

US Embassy and Consulate Discussionproblems calling DOS
If they still have 1/haiti, 2/everything else as the initial menu, hit 3 right away for an operator. I kept getting a circle of busy-ness (not even connecting to an operator) until someone in October CSC mentioned getting through with a mishit someplace in the menu when they had the same problem.

US Embassy and Consulate DiscussionPolice Certificate From Petitioner

Thank you... Do I need to report any traffic violations or parking tickets?

Typically, they're not a big deal UNLESS you were charged with a greater crime (such as a DUI) or got your license suspended/revoked.

I did not list mine (and I've had quite a few parking tickets & a small handful of moving violations when I was first learning how to drive), and I didn't hear anything from USCIS for not including them.
