The issue at hand isn't that she had a gun permit...it's that she made a false claim to citizenship which is very bad, and something you can't take back. I would suggest seeking advice from a good immigration attorney.

From what I see, looks like the only problem area would be around Birmingham. If you take I-22 into Birmingham you might be able to avoid most of the mountains, as opposed to if you took I-65. Either route you take you should be pretty safe on the interstate.

You send your paperwork where the instructions tell you to send it. For the I-129f petition, it is the Dallas Lockbox. From there it is routed to either California or Vermont depending on where you live.

We have our date, and most of our paperwork has been completed. He's scheduling the medical soon and will be getting a massive amount of photos taken soon (there are about 12 between the K1 and AOS process!), and we have to get our travel plans fleshed out.

They emailed us Friday saying we should get a date on Monday or Tuesday. Either way, it's one of the best birthday presents I could have, topped only by getting the visa approved! In any case, since I'm flying down for the interview, we've started looking at hotels near the consulate (reviews, estimated prices, blahblah), and I've been looking at things to do in Rio as we're going to have two fully free days.

In any case, Carolina, when are you moving -- do you plan on coming before the snow melts?

Rio's got our petition now, and thanks to advice up-thread, we've emailed them with our NVC case# and names/DOB to try to get the interview scheduled a little early. :)

I have to update the I-134 with my '09 taxes, but I think we've got the rest of the forms done already, and L is going to order his birth certificate (and police certificates) about three weeks before the interview, so we should be able to use them for registering our marriage with the Brazilian consulate in August. He's calling the doctor to schedule the medical appointment after we have the interview date. In short: we are almost done! :dancing:

She might be able to get a non-certified copy faxed to her by Friday, and she can fax that to you. Depends on where she was born and how busy the records office is.

When I visited L for the holidays, I brought him I-134 with my 2008 tax returns and a photocopy of my passport [required supplements to the I-134], as well as originals for our 'proof of having met / proof of relationship' (though we're adding to that portion of things). I don't know if I should have brought more, though. When I fly down to visit him / go to the interview, I'm bringing my 2009 taxes and some other things to add ti the 'proof of relationship' crapola.

L and I talked earlier this week about where our petition is (currently awaiting NOA2, though it should be here in the next week or two if the activity on Igor's list is any indication, though VJ's timeline thinks it could be as late as Valentine's Day), and with Rio typically scheduling about 2.5 mo after NOA2, that would put the interview late April/early May. And for whatever it's worth, we were planning on having him leave mid-July & getting married mid-August, after I go back on educational leave but before my last term of school starts. It's about three months after the interview, which should be plenty of time for "organizing the wedding" (especially as small of one as we are planning).

Soooo, I'll be coming down for a week in May, for the interview (which means we'll have to reschedule, but that's ok).I would much rather take an extra trip to Brazil, see Rio (which I've never been to), and have the visa approved, than not come and regret having to go through the AP process or worse, trying to figure out how to get married in Brazil and then doing the immigration dance *again* because they didn't think we had enough of a bonafide relationship for the K1. Even if I can't go in, I hope that the IO would consider that to be a good sign of a bonafide relationship.


ImWaiting - We'll definitely be doing some preparation for questions before we go. We were going to do that anyway, mostly because I've moved around so much that he'll need the practice.

Our evidence collection to date (which goes through our petition right now) has a handful of emails and screenshots of the sheer amount of chat lots (irc/msn/gtalk/skype) with some samples, and the hotel records, random receipts, my passport stamps, and some photos from my other trips. For the emails/chats, we have excerpts from the beginning of our friendship, the beginning of our actual relationship, through when we decided to get married (including some chat from when we thought my antibiotics killed the morning after pill and I might have been pregnant last June, which was what made us really start thinking about marriage in more than a 'maybe someday' sense). We really don't have much as far as phone calls go because we use VOIP through gtalk, and there's basically no way to access those records.

As far as what we were going to add, beyond some updated logs... our landlord for our (short-term) flat here in Recife is going to write a letter stating that while I am not on the lease, I was residing with L & we'll have that with the lease and more passport stamps/photos/etc and a copy of the money transfer for my share of the rent. I'll add a print off of the wedding plans (things like flower selection, the really short guest list, location, etc) to the folder, along with some of the engagement ring stuff.

As far as photos go... To be honest, proving I met his family wasn't even a thought in our minds the other times I met his family as we weren't (at the time) planning on immigrating, and this time, I was so tired after a long, uncomfortable flight that was complicated by missing baggage that I really don't know if they took any photos (but know I didn't because my camera was in my missing bags). We do have a screenshot of the Christmas Skype video call of us together (in Brazil) with MY family (as well as a few gtalk video calls with me & my sister on one end and him on the other), which is the closest he'll come to meet them before he moves since he can't get a tourist visa. And I suppose if we had a birth control!fail incident, we may have a sonogram to toss in there. But neither of us are really photo-taking people.

With the problems Rodrigo has had (linky), I'm concerned about our interview -- we're in a similar situation with older woman/younger man with the man being the Brazilian beneficiary. L is a fidgety guy and gets more so when he's nervous.

I'm wondering if it'd be beneficial for me to be at the interview - money's not really an issue (and my professors have been good about me rescheduling exams/quizzes due to me traveling). With Rio scheduling about 2-2.5 mo after NOA2 and me being (estimated) a month from NOA2, it'll be riiiiiight around spring break (when I was considering a visit anyway), and in the low season (or at least, what is the low season in Salvador!), so fare/hotel should be almost reasonable.

Thoughts?

(ETA: D: I'm still on US time after a week here! Recife's been fabulous, though, so.. whatever.)

Do they? Haha, I might actually understand them - the disappearing "r" is one of the things I find hardest about listening to/speaking Portuguese.

Also? The Embassy will *definitely* be closed on Thursday - Thanksgiving is a federal holiday. I don't know if it will be open for interviews on Friday, because usually people take the Friday after Thanksgiving off (a personal day if the company doesn't give it as a holiday).

Notarizing is pretty much useless in determining the legitimacy of the return, so.. yeah.

A side note, for anyone who runs into this topic while searching: this DOES vary by consulate. While USCIS is happy with the letters of intent sent with the 129F petition, some consulates (like UK/London) require more recently dated letter of intent. Other consulates (like Brazil/Rio) have an explicit form that needs to be filled out by the petitioner. When in doubt, always double check your consulate's requirements or contact them for clarification.

1) Yes. Spouses are eligible after 3 years of permanent residency. This is not precisely 3 years after marriage, more like, 3 years + whatever time it takes for you to file for the adjustment of status (AOS, I-485) and for it to be processed. (You will still need to extend his green card about 20 months after his green card is approved, though.)

2) Yes, you can file for permanent residency for Canada from the US. link from CIC

To me, it sounds like she was using you for the green card. Granted, I don't know what else was going on, but the timing is suspicious, and I suspect the fact that she said she was going to divorce you before the conditional green card was actually approved (between denial and the hearing) is something that, if USCIS had known, they would not have approved of it.

Derek, Did you not say your current income is 200% above the poverty? You have no worries now. Now if if you loose your job right before the AOS then you might have to worry because you will not be able to produce an employment letter. Right now you have to be strong and confident for your fiancee. Instant message guys like pushbrk and jimvaphuong they are very educated on the visa process and will give accurate and to the point advice.

Never heard you had to be gainfully employed for 1 year. Produce an employment letter from your employer who your currently employed with forget about 2012. They are concerned about income now. One year i did not make enough for the poverty guidelines out of the 3 yrs of tax transcripts I submitted never once questioned about it.

They usually ask for the last 3 years of Taxes. Don't worry about the amounts. As long as the employer letter shows that your current income meets the 125% don't worry. When it comes to AOS(864) if your still employed once again the same evidence, 3 yrs. tax transcripts, employment letter.

Went to the mailbox this morning, and found my Xpresspost stuffed in there good. Tried to get it out and it ripped. What fell out? My Visa! Yay!!!

Surprising that I got no email notification, and didn't even have to sign for anything...but overall just relieved that it finally came, and didn't even need to call a congressman! To recap, my interview was in the first week of January where I was denied, saying I needed more proof of establishing domicile, and after gathering more evidence, sending it to MTL on Feb 17, almost 8 weeks later I got my packet. Lots to think about and plan this weekend...can't believe its finally here and official!



Hold up! LOL....does it ALWAYS take 8 weeks to get your visa mailed back to you after you've been approved at the interview in MTL!?...but congrats btw

We sent ours back the 18th of January, It was logged February 3rd. We got our interview date assigned on March 17th for May 19th. As it stands they seem to assign interviews every two months or so. Therefore it makes sense that the next ones assigned should be in a month (May 14-21).



So I should have caught that booking period then...May 14-21ish....

Most of us with interviews in May sent our P3s back in January/February. It's unlikely that you'll have a May/June Interview, but you never know!!! That's why they say not to make any real specific and finite plans (like booking things, etc) until you have the visa. :( I hope you get it your wish, though. :)
