If you get an RFE for something you don't have, you could always send a letter of explanation why you don't have it and/or affidavit from the in-laws explaining that you live with them and they pay utilities. By the way, for credit cards, are you sure you really have none - not even store ones from places like JCPenney, Costco, Kohls, etc.? I guess it's not impossible, albeit rare, but even then you are still showing commingling of finances because you have joint checking accounts. If you don't feel your evidence is strong, you could also get more affidavits from friends and other family members - most people send a couple anyways.

ok!!beside the 2 bank account we have ,the 6 years tax return as married ,debitcards,check books ,life insurance ,att family plan,pictures wit friends this and that and our lawyer ,what else we can use as ammo to winn this battle !! is it scary going to court ,are the judges generous,the time frame of us beeing merried for 6 years what else we can do or think off!!! any advise please!!


Goce, your attorney would be the best person to ask this question. It sounds like you have enough documents to show bona fide relationship, and I don't know if the judge would care to see more paperwork than that (and if they review USCIS's decision for abuse of discretion only, they won't). There are always more things you could show - rental agreement/house deed, affidavits from family/friends, health insurance, medical records that mention the spouse as emergency contact or as someone who visited while the other one was hospitalized, greeting cards addressed to both of you (or cards from her family to their wonderful son-in-law), any document that lists both of you as married, even facebook pictures of the two of you or statuses with comments from friends that show people see you as a couple, the list is endless... The question is, do you need all this stuff?

I think this might be actually BETTER as now it's not in the hand of the (hopefully NOT) same IO dealing with your case. Sometimes immigration judge is better when it comes judgement as long as you have your stuff together.

I agree that it's better to deal with a judge - at least he/she would not act like a bully and will actually apply the law, it's his/her job to be impartial. No IO will dare yell at you or your wife in front of a judge. Plus you have the attorney with you to make sure everything is presented clearly to the judge. Keep your hopes and your cool, all this nightmare would soon be behind you.

Goce, you asked about similar case decisions but in order to find that, we would have to know the exact reasons given for your denial by USCIS and the facts (or what USCIS chaims are the facts) supporting these reasons. The whole story is so unbelievable that I still don't understand why they denied you, except because they can. Anyway, I am sure your attorney is familiar with case law and knows what to say to the judge.

Your best bet might be to speak directly to someone from the lending institution and explain that you are in the process of renewing your expired card, which usually takes several months and ask what document they would accept as proof - copy of expired card, copy of extension letter or USCIS stamp in passport (you could get that at an Infopass). Sometimes they just have to check a box in their system and need some kind of document to basically cover their ####, so they are happy to get anything that fulfills the requirements somehow, especially when they are given options and are allowed to pick which one they want themselves.

It should work out, but it does seem that different lenders have different procedures and requirements, and it might be worth it to shop around for the right bank if a particular one is giving you more trouble than you can handle. A friend of mine does not even have a GC (she is on H1B, single lady) but was able to buy a house in 2009 and refinance it last year without any issues - just talked to as many banks as she had time to contact. On the other end of the spectrum, I've received a rejection from a bank on a credit card application stating that the reason they wouldn't approve was that I'm not a US citizen, period, even though I had had a checking account with them for several years (wouldn't even let me open a prepaid CC account) - well, they lost a client really fast and another bank gave me a CC with an 8K limit within a few months. We bought our house 6 months after our marriage, so we had a similar issue but mostly because of lack of credit history for me - the mortgage is technically under my US hubby's name, but they listed me as guarantor of the mortgage, putting my name on all mortgage documents and on the deed, so USCIS got plenty of paperwork for ROC.

For the debit cards with different numbers, you could get a letter from the bank stating they are for the same account. Or alternatively send a voided check instead that shows that both names are on the account. If your bank statements already list the debit cards on the account, you could just write a short explanation note pointing that out and include copies of the cards. You have a good list otherwise :)

Card showed up in the mail today :dance: I'm so happy they approved it, my husband's wallet got stolen last weekend and we had to cancel all of our bank accounts, so it would have been pretty bad timing for an RFE or interview.

They received our package on March 1 (mailed Feb 28). This is the date of my NOA as well but I did not receive the NOA in the mail until March 8. The check was not cashed until March 5. You could contact USPS or whoever you used for sending the package for more info and proof of when it was delivered.

Barely made it into February filers but here I am. Today is 90 days before my GC expiration, so I sat down, assembled the package to USCIS and it's going in the mail tomorrow. Whew... it was so much easier to do than adjusting status (of course, I adjusted status 3 times before I married and became permanent resident, so I shouldn't complain)! It's nice to see that some of you are already done with biometrics, I hope it goes smooth and fast for all of us Posted Image

That's EXACTLY my situation. My wife (USC) has a short credit history. When we went to get a loan for a house, which eventually will be our parents' retirement home, the loan officer goes "if you are putting both of your names on the loan, chances are it's going to be EXTREMELY difficult. However if it's just under my name it'll be a breeze."

When I submitted my package, which end up with a RFE, we simply didn't include the loan. Title-wise my wife actually decided to do a quit-deed as the loan officer told us it'll be much MUCH easier to transfer the title to our parents down the road as a single sole property owner than co-joint.

Sometimes it's funny how a born USC has less than an immigrant... I guess that's how the topic of bring back the economy got started.


That was our case too, I had no credit history whatsoever, so it was not even a question that the mortgage would be for my husband only (he is the USC). But because we are married, I had to sign tons of paperwork for the house, including signing the mortgage contract countless times as a guarantor - that's what I sent with my I-751 package. The realtor was supposed to then get the deed in both of our names but goofed up and did it just in my husband's as a single person. We then called the bank (BOA) to check if they were okay with us fixing that, they said they didn't care (some banks require notification or approval by the bank) and we did a quit claim deed to own the house jointly. Btw, part of the paperwork for purchasing the house by hubby was some sort of gift acknowledgment document, where I gifted whatever funds I contributed towards the downpayment to hubby because the origin of all funds had to be shown for the purposes of the mortgage application - I didn't send that to USCIS, but if you have something similar, it could be included too. I could have also sent proof that I made payments towards hubby's mortgage, which we both consider joint since we own the house jointly.

2 days before i submitted my removal of conditions on my wife's behalf, our place was robbed!! they took something that had all my wife papers inside including SS card, foreign Passport, and green card. i just receive the NOA for the biometrics what can we do to complete this because she has no green card or passport or ss card. The only ID she has is a learners permit. the biometrics requires the green card. what are my options now.



Hi Phil,
This is what you need to do. You need to first contact the USCIS and report that the greencard has been stolen. Explain your situation to them and I am sure they will issue a new greencard. I would suggest you do this as quickly as possible. There is also forms online to request a new one at: USCIS GREEN CARD REPLACEMENT. You can also contact the Social Security office and request a replacement card. I would first call them, though, and let them know what is happening and they can probably give you better advice than this. Prayers sent up in y'alls behalf.

He cannot lose his UK citizenship unless he takes positive legal action to do such. The US citizenship oath does not constitute positive legal action to renounce former citizenship, even though it includes a statement about that.

If you move to the UK while he is a permanent resident, he can lose that. He cannot lose his UK citizenship simply by becoming a US citizen. The US doesn't recognize dual citizenship - this means the US doesn't care if its citizens also claim other citizenship. It does not mean dual citizenship is illegal.

I was expecting hubby's approval in another couple weeks, judging by other recent CSC timelines. It looks like we did get scheduled for biometrics pretty quickly, which probably helped. Anyway, I definitely expect to see everyone else here rolling in in the next few weeks.

BTW, received mailed notice today that has 7/24 as decision date.
