Hi! I sent iour Fiance k-1 visa package today ( I am American Citizen, he is Pakistani, living in Abu Dhabi) for myself and my fiance....after reading all of this...I feel like I may have left some things off...when I actually thought I sent too much. here is what I sent...

I-129F
325A for us both, signed by both with 2 passport style photos (white background)
proof of financial support - not sure of the form number
copy of pay stubs
both letters of intent to marry, signed
our "story"
letters of support from our familes
email from when we first met
my divorce docs from when I was 18
my top sec. sec clear. through my job at state dpt
my birth cert
my pass port - all pages
my flight itin, from when I traveled
our hotel reciepts
pictures of us, rings, my wedding gown and our engagement announcement
and of course the MONEY!
OMG! what more could the need? LOL


There is a bit of stuff not needed: proof of financial support, copy of paystubs, your top sec. sec clear. through your job (not sure what this is to prove), only need either 1) copy of birth certificate OR 2) copy of all pages of passport (to prove your citizenship)

Other stuff included like your "story", letters of support, emails, etc. are all good for proof of relationship and may be good for front loading your petition. The USCIS doesn't care about it though, it would mainly be for when the embassy receives the approved petition.

You said you included flight itineraries and pictures, but that is secondary evidence of proof of meeting. Did you include the passport stamps (assume maybe that is why you included all pages of your passport?) and actual copies of your boarding passes?

The petition packet itself doesn't need to be large at all, you are just proving: you met within 2 years, you both are legally free and willing/able to marry, and that you are a US citizen.

Did you have your wife sign her name over the lines, I mean, if the page is in excel spreadsheet form, did you just have her sign in one of the boxes towards the bottom?


I made the format in excel, but I copied the chart into a word document, and at the bottom I typed her name (like in a letter) and my fiancee (not wife) signed and dated it underneath. At the bottom of the page it just looked like:

Nancy XXXX XXXXX (beneficiary)

(her signature and date)

For the letter of intent, what you have is fine. It is not necessary to say how long you have been together, all they want is to know that you are intending to get married.

If your income is $55,000 and your household size is just 2 (you and your fiance), then you have more than enough income and you do not need to put down other assets. As long as your income is more than 125% of the poverty guidelines for your household size, you are good to just put your income.

First of all you should start collecting all the supporting evidence for your I-134, in case some of the stuff like employment letters take a while. I would suggest to find out what is required for the interview, and then try to make sure you and your fiancee both have everything in order. The DS-156 is a non immigrant visa application (I think it is a general form for all non immigrant visas) and the DS-156K is a specific form for fiance visas. Your fiance will need to fill out both of these, and depending on the requirements of your embassy you may need more than 1 copy. Your fiance will not receive the forms from the embassy, the forms are filled out online and printed from here. The new letter of intent you will send your fiance will serve as proof of your engagement and your commitment to marry.

Hi! black and white photocopies will do both from your passport and birth certificate. Yes you need to send the originals receipts, hotel tickets, etc. but you dont need to send ur original passport just a photocopy of it with all the stamped pages when you last visited her. Hope that helps :)


Not true about sending the original receipts. You can send copies of all of your proof (ticket stubs, boarding passes, etc.) with the I-129f petition. However, you may need to send originals if they ask to see them.

OMG take everything out of the sleeves, and the binder. You will cause more work for the adjudicator and thus add more processing time to your case. They need to be able to organize it how they want it, and quickly. I only used paper clips to keep like items together, and I put all my paperwork inside a Priority Mail envelope at the post office and I mailed it the the Dallas Lockbox.

I had the same question in my mind but I think it's the attachment like if you have to add a page to answer one of the questions on the form that you have to print your name at the top and sign and date at the bottom. It doesn't make sense they would want, for example, 100 pages of phone records signed. But let's see what others say about this.


You don't need to sign the pages of evidence, just the supplemental pages.

When you say K-1 application, you are talking about the I-129f petition? If you are working on your I-129f petition, anything not in English needs to be translated for the USCIS. With that said, they don't need proof of your relationship, just proof of your meeting. If you include proof of your relationship in Spanish, they may ignore it and leave it for the embassy stage. If you are preparing proof of relationship for the interview, then I imagine you can leave it in Spanish. In Colombia, the documents can be in English or Spanish. A lot of my proof is Spanish only since my fiancee does not speak English.

For the petition itself, it does not matter if you are employed. The address they ask for is one you should use that you would receive your notifications from USCIS. You can use your parent's address, or whatever address you feel is better that you would be able to receive your notifications. First step, read the guides to help you understand the process better. There are actually different 'stages' of the process. The first step is to file your petition for alien fiance, the form I-129f. Only you can fill this out, not your parents. The part where financial support comes in, is during the interview stage. Your unemployment is still no issue as you can use a co-sponsor (provided Brazil allows co-sponsors). This is where you can use help from someone else, such as your parents as you indicated. The income of your fiance will not even be considered unless possible that income would continue when he is here in the US.

Wow your process has been extremely FAST!!!!!! you guys have the interview on November??? That is only 4 months after you sent the package??? I am starting on this process and I am sending it tomorrow. Did you hire an attorney or did you guys do it on your own?


Our process went fast in part due to how fast the California service center processed our petition. Also I'd like to believe its because we had everything in order and they didn't need any additional information from us. And definitely did NOT hire an attorney. This process is so simple, and was designed to be so, that hiring someone else to do our paperwork would have only delayed our case. We did everything ourselves.

They are looking for gross annual income. The employer letter should also state your gross annual salary. As far as needing the last 3 years tax returns for the I-134, this is dependent on the consulate you are going through. Some may require only last years, some may require all 3. For the consulate my fiancee is going through, I originally thought they needed just last year's (2011), but they specifically ask for the year 2010. So now I am bringing all 3 years to be safe.

I'm not sure how the embassy in Chile will want it, but I was advised by someone that went through recently at the embassy in Colombia to just glue the photo to the form, not to use staples.

You can put NONE for address, no need to put deceased. My fiancee doesn't know anything about her father, so I have to write UNKNOWN on all of those lines.

For spouse, you would write NONE (since he does not have a spouse).

For the educational question, we went all the way back to her primary school. Not sure if they need that far back or not, and actually I am curious to know the answer to this too.

To answer your first question, a lawyer will not make the process move faster. If anything it will take longer, because you have an extra step--sending the information to your lawyer to have them send it. Once the petition is sent, you will be playing the waiting game like the rest of us, most of whom have not used a lawyer. Some wait times are around 5 months to receive an approval, some get lucky and get approved quickly while others take longer than 6 months.
