That stamp is not enough for a K1 holder to be employable. She needs the EAD.

The EAD stamp that JFK gives is sufficient according to the SSA agent that processed L's SSN application. (L doesn't have one, but I was curious.) The EAD is also sufficient.

In either case, the eligibility expires 90 days after POE, unless you have married and gotten your EAD from the AOS. So, if you're planning on getting married and AOS the first month, you'll have no problems transitioning, though you'll have to update your information with your employer.

Unless you're going to magically get a large raise, you're going to need to get a co-sponsor, a new job that pays over $23k-24k (the 2010 limits will be posted in mid-Feb), or a second job to make up the difference.

I wouldn't be surprised if the embassy won't approve a K1 when the evidence of support doesn't meet the 125% guideline and require that you get a co-sponsor, if not a new interview (and likely, new fee).

Joanne, you're exactly right. The important question is when the NOA1 was issued. If the "Received Date" on the NOA1 matches the date they sent it, more or less, and is within 2 years of their meeting, everything is fine. If it is not, immediate action needs to be taken before a USCIS adjudicator gets to the file and compares the dates.

With the 19/11 check cashing, they can prove that even if the NOA1 was issued in February, USCIS had it at such a time that they HAD met in the two years prior to receipt. USCIS can't cash the check if they haven't received it!

Uh, it looks like you were approved already? Your sig timeline has an NOA1 in November, which means the second one was probably an approval/denial. In any case, I believe as long as it was 2 years before NOA1, you're good to go.

Some consulates use "packet 3" as a way to get all the biographical/financial information before the interview. It varies by consulate, but roughly corresponds to the forms DS-230 (pt 1), DS-156/157 (or DS-160 if you're in an area that uses it), DS-156K, and DS-2000 or DS-2001 or I-134 (affidavit of support). Some may also require the medical to be complete before scheduling the interview, or to receive the police certificates as well.

Other consulates don't require receipt of this information prior to the interview. Like Guatemala, Brazil also does not require "packet 3" before scheduling the interview, and instead will mail you the requirements with your interview date. "Packet 4" is basically a checklist of the documentation you need to complete and things you need to obtain/do for the interview, if you have not yet done them -- the forms listed above, the medical exam, police clearances, birth certificate, the fee, passport photos, etc, along with any evidence of ongoing relationship that you wish to bring.

it's not the fact that you guys got approved and we didnt that makes me mad, it's that they are now moving on to november if they havent even looked at our files.

If they had started adjudicating them and something was causing delays, I can understand that they are not going to hold up everybody to sort it out right away... but I just don't understand how they decide which ones are going to sit and wait while others who filed after us get processed.

Have you thought about contacting your congressman to find out what's going on? If it hasn't been touched yet, I would be concerned at this point. But look on the bright side: Canada should be an easy trip once it's through USCIS - not like the higher fraud countries, where you're most likely to go into AP regardless of your evidence/etc.

For whatever it's worth, we went ahead and went with the CS transcription - ultimately, we decided it was better to spend a little money and ensure we wouldn't get a RFE for not filing the correct form, as RFEs put a pause in your AP and EAD as well as your AOS.

L's AOS/EAD/AP was just transferred to CSC, so no interview for us! Someone in the Aug '10 filers thread mentioned that people who apply for all three (as opposed to those that apply for AOS/EAD or AOS/AP or just AOS) tend to get transferred and have no interview. I don't know if that's a good thing or not (I suppose it depends on whether or not you want to sit back and wait for everything or want a particular time that you'll get the green card). I'm just glad we don't need to interview - we live over 100mi from the nearest USCIS office and after driving from AZ to NC to here, L doesn't want to drive aaaaaanywhere.

That's not going to be enough time. I'm flat out going to say that. I frequently fly out of O'Hare, and an hour is just enough time in O'Hare for domestic layovers if you've got a concourse change, as planes are frequently late (or if on time, have to sit on the concourse, waiting for a gate to open up) and there's no trams/etc to help you get where you're going faster. International to domestic typically involves a terminal change at O'Hare, in addition to the time at immigration and customs.

Miami's not as busy as O'Hare for international flights, and L took about an hour and a half between waiting for his baggage, going through initial immigration screening, and going through secondary immigration control. He got the fast track through security, because we used my frequent flier miles to buy his tickets and first class was cheaper than security, and it still took about 15 minutes with TSA.

And if you read the O'Hare POE reviews, many of them talk about taking an hour and a half or more at immigration - on top of the 30-60 minutes you'll spend waiting for your baggage.


Maybe if he didn't have the secondary screening because of the K1, it'd be sufficient time...

Yay lilac!

We're still waiting for our NOA1. It's been a week, and no joy on the texts/emails. I won't start pestering anyone for another week or two.

Did anyone have Chicago at the POE? My man is trying to decide between two flight that both have his POE in Chicago. One has a much shorter layover and gets him here to Colorado much sooner. The other is a much longer layover and he gets here very late. I'm just wondering if he needs the extra time to go through the POE process or not. He'll be flying 2 days after christmas, and we're not sure if that will make the immigration line a lot shorter, or a lot longer because it's close to the holidays. Would love any info you all have!


Figure you'll need at least 2 hours at immigration, plus whatever time it takes to get the baggage, plus time to go through security again, plus time to get to the gate (as there are no trams or automated walkways in O'Hare) -- travel around the holidays is so variable, and (as a frequent Chicago flyer) when Chicago gets busy, it gets *busy*. I would say that 4 hours is a minimum, and 5-6 hours may be better if he's not flying priority class (which gets faster security time). O'Hare is pretty ####### about the TSA list (must be in the ziplock, must be under the size to fit in the ziplock, etc) - Miami's not nearly as #######. It's MUCH better for him to get in late and tired and not having missed a flight than having insufficient time and having to reschedule the flights and possibly stay overnight (flying standby succccccks) and what not.

We filed our AOS this past weekend (after getting married just over a week ago) - pretty much the day after our honeymoon. :lol: I really hope we'll get to forego the interview stage -- my state only has one USCIS center, and we live about three hours away from it. It's a huge inconvenience, and as far as I can tell, they prefer to send the K1 AOSes to CSC to be processed. (Of course: sample size 1...)

I'm sorry about the SSN snafu - you'd better get that cleared up soon, you've got about a month before he can't get one. You don't need a SSN for the wedding or the AOS, so don't stress too much; at the end of the day, it DOES save you the effort of having to go to the SSA twice.

It's been really nice having L here, and we've gotten in a sort of routine. I'm picking up enough Portuguese that L keeps laughing when he's on video chat with his family and I'll pipe up about what they're talking about (in English - it's a vast improvement from when I met them last year and barely understood). I would keep calling around - and really, if they charge as much as they did abroad, I'd call even as far as an hour or two away, because four hours of gas is cheaper than the extra $100+!

FWIW, there are probably civil surgeons with UMich's med school. Unlike other civil surgeons, being that they're employed by the state, they're required to not run a profit at the hospital and the clinics. When I was looking for a civil surgeon here, one of my really good friends (who coincidentally just finished his coursework at UMich) suggested the state-run university clinics that are approved are a good place to go because they won't overcharge and usually they're willing to listen - if you can show them where it says that a full physical is not needed, they will typically not force you to get it. Especially since this service is one that insurance isn't good for.

I think we're going to use L's Brazilian driver's license (only in Portuguese) with his Inter-American Driving Permit (which I believe is in English, French, Portuguese, and Spanish) as the second form of ID. I think if they accept school IDs, they won't have a problem with that.

Citizenship or immigration status: We can accept only certain documents as proof of U.S. citizenship. These include a U.S. birth certificate, U.S. consular report of birth, U.S. passport, Certificate of Naturalization or Certificate of Citizenship. If you are not a U.S. citizen, Social Security will ask to see your current U.S. immigration documents. Acceptable documents include your:

Form I-551 (includes machine-readable immigrant visa with your unexpired foreign passport);
I-94 with your unexpired foreign passport; or
Work permit card from the Department of Homeland Security (I-766 or I-688B).
International students must present further documentation. For more information, see International Students And Social Security Numbers (Publication No. 05-10181).

Age: You must present your birth certificate if you have it or can easily obtain it. If not, we can consider other documents, such as your passport to prove age.

Identity: We can accept only certain documents as proof of identity. An acceptable document must be current (not expired) and show your name, identifying information and preferably a recent photograph. Social Security will ask to see a U.S. driver?s license, state-issued nondriver identification card or U.S. passport as proof of identity. If you do not have the specific documents we ask for, we will ask to see other documents including:

Employee ID card;
School ID card;
Health insurance card (not a Medicare card);
U.S. military ID card;
Adoption decree;
Life insurance policy; or
Marriage document (only in name change situations).

All documents must be either originals or copies certified by the issuing agency. We cannot accept photocopies or notarized copies of documents.We may use one document for two purposes. For example, we may use your U.S. passport as proof of both citizenship and identity. Or, we may use your U.S. birth certificate as proof of age and citizenship. However, you must provide at least two separate documents.


While the passport does fill age / identity / citzenship and the I94 the immigration requirement, I don't think they're considered separate documents.

I'm posting even though my fiancee is from Vietnam. I send money from time to time to her, she has never asked me for a dime, only one time she asked for a computer so we could see each other on skype. She knows the United States is expensive and money doesn't grow on tree's. We both agree we'll send money back to her parents, more like 100 dollars to 200 dollars a month, which will help her family a lot. They make a good living over there (Farmers) very simple people who don't spend there money foolishly. So my advice is send what you can afford. I feel lucky my future in laws ask nothing of me.

We xoomed money to my wifes father last trip (2011). We were in N. Samar and I couldn't find an ATM that worked. I also had a terrible time finding a place to exchange my nice crisp newer $100 bills. We drove around half the day before we finally found a place. We ended up exchanging a $1000 when we finally found one. That made me nervous too, riding 30 miles back to her folks house in a tricycle at night with 43,000 pesos in my pocket. Evidently there are night time highway robberies taking place around there these days.


I walked around with 2,000,000 dong in my pocket , no worries in Vietnam. 100 dollars U.S lol.

No AtM's in my wife village, I always concealed several grand in a money pouch around my waist, then fiancee would lock it up at the house. Just thought I'd share.

I have seen the same. My buddy had to borrow for everything except the I129. Her flight and then her AOS as well due to his financial situation. I am saving 3k for just the process for my fiancee. That should cover most situations even extra days stay in Manila for Medical if needed.
Yes it is crazy in this day and age for many wanting to go this route....


If I remember right you have to pay for each persons visa at 350 a crack. Your medical over there was much higher than what I paid. The medical exam fee is US$213.35 for adults (15 years and older) and US$185.35 for children (under 15 years of age). Airplanes flights one way cost me about 2200 bucks to get them over here. I'm estimating I spent with all my trips and visa's, greencards around $20,000. Was it worth it ? Hell Yea! She's a good woman and her kids are a great edition to my 3 boys i have now.

My fiance and I are only approaching the BPI phase, I hadn t even thought of the AOS phase 1070,Plus 2 Kids? We both knew up front we would have fees and fees and then a few more fees, were pretty much on the same page with the cash end of the process, but reading this post wonder how many people dont know or dont care to know it takes some income and planning to make this a seemless, somewhwat stressless Journey, The hurry up and wait is hard enough without adding onto it mutual mystification in regards to fees and unknowns of resources once your here together, just my 2 cents.


I did the the K1, and K2, fro 2 kids. Anyone that marries overseas knows that its costly and can be painful due to the distance and the uncertainty. If any of your fiancees children are under 14 at the time of Aos the fee is a flat $635. My total was$2775,note write a separate check for each app. I listen to so many post of people unprepared and lack income and relying on sponsors, some people just shouldn't do it. My 1.5 cents, anyway good luck!

the only fee that will be due for AOS will be $1,705.00 that is for the K1 and K2, there is no fee for the EAD or AP if filed together with AOS. Wait 2 weeks and you will be able to get both a SS number in their maden name only, you will have to file the AOS after marriage to get the SS number in the married name.


Do not write one check for 2 applications, I received an RFE for that. Attach check to each application. Don't worry about the ssi number her name change will be legal with the marriage. Apply the EAD with your I-485 it's free, the EAD will come first before the GC and then get the ssi card so she's legal to work. Yes, put your wife and her daughter on Health insurance, utilities bill, your bank account. your wifes GC fee is $1070 and if her daughter is under 14 years old it's $635. Good luck.

PhilippinesHow much do you send to your wife's family monthly ?
My wife is from Vietnam. We send about 200 to 300 month. Major holidays we send several hundred on up to about 1500. We will also pay for our nieces and nephews weddings. As long as our bills get paid we will keep sending.

Get used to it, thats Asian way. None of my wifes family are dead beats, there hard working people. I'm blessed that we can help.

Your right! He needs to deal! My wife asian also and she is the complete opposite . I admire his desire to stay married but another year from now he will have a change of heart. Sounds like she makes no time for him or really care to. I feel so blessed I don't have to deal with a woman like this. Good luck!

Not normal at all. I have 3 kids with my ex wife and talk strictly about children and that's not very often since I've had physical custody of my kids since 1999. As far as insurances policies I definitively would of never kept up on any of the coverage's on her , she might of grabbed a sum of his 401 k but you usually pay up at the time of the divorce. This guy still has some type of feeling for this woman. Sounds like a your putting your foot down but he's not taking you seriously. Follow through on them , do you have friends you can stay with or confide in? Go to counseling to help your relationship. Best of Luck.

Yes using the I-864 actually helps for a co-sponsor with the K-1 visa. A few months back there were like 3 or 4 that used co-sponsors with the K-1 and were approved.


Wasn't aware a K1 uses an 864 until you do the AOS?
