Ok I am sure this is somewhere but I cant seem to find the answer I am looking for.  I am a person of short words, I got the explaination of how we met in person into the box on the form. Read like this:

 

"We originally met online, we visited with chat and video calls. Kenny invited me to visit him ofr his birthday, 04/21/2013 but was unable to make it. Instead I arrived in Johannesburg, South Africa on 5/31/2013. We spent 6 days exploring the city and getting to know each other even better. While I was there Kenny proposed marriage, which I accepted. I left for USA 6/6/2013."

 

Is that good enough? they just want to know when and how not an account of everything we did, right?

 

Thanks everyone, I am confident of everything else but this and it scares me to mail it off because of that one.

 

We met on 5/31/2013 in Johannesburg, South Africa. 

 

This is all you need to put.  You don't need a lot of details, just simple and to the point.

My fiance worked in the same company since 2001, but he didn't work 5 months in 2012 and 5 months in 2011 when he was visiting me , In employer letter should I state those periods, or not since the encome is pretty enoght.

 

All you need is CURRENT income...the past is irrelevant for the employer letter.  So if your fiance is paid salary, put the annual salary amount down.  If your fiance is paid by the hour, put the amount of hours per week he will be working * the hourly rate * 52.

For annual income, you should put down what is on the employer's letter...not what is on the tax return.  The I-134 needs to reflect current income, which is what should be on your employer letter.

The I-134 will probably vary by consulate, so I can only give you my experience with Colombia.  I sent in with my I-134 my last 3 years tax return transcripts, all were under the poverty level.  I also submitted employment letters, and paystubs from 2 full time jobs that proved my income was over the poverty level.  They accepted my I-134 without co-sponsor and approved the visa.

To answer your question about whether your friend can sponsor his wife and your fiancee, the short answer is yes IF his income is sufficient.  On the affidavit of support he has to include every member of his household, any children he has regardless of custody or whether they live with him, and every person he sponsors.

 

So from what details you gave, he is a household of 3 currently (himself, his wife and baby).  If he supports your fiancee as well, he will be a household of 4 (himself, his wife, his baby, your fiancee).  His income of $36,000 is sufficient and well above the poverty line of $29,437 for a household size of 4.

I would fully expect an RFE in your case.  You did not send any concrete PRIMARY evidence of having met in the last 2 years.  Photos and airline tickets are not primary evidence.  Airline tickets merely show that you bought and paid for a ticket...not that you actually flew.  The actual boarding passes show that you were on that plane and went to see your fiance.  Don't do anything now, just wait for the RFE.

You have to claim your children no matter what. Does not matter if they receive support from you currently. Does not matter if you claim them on taxes.

Incorrect. The children are considered dependents for both the I-134 AND I-864. The decree is irrelevant to dependent issue. If (god forbid) something happens to the mother, the children would be dependent on him given their age. Until they would no longer be dependent on him (by reaching the age of majority in their state) then they children ARE considered dependents.


:thumbs: This is the best explanation to explain why you need to claim your children regardless of whether they live with you or if you pay child support. Because you will be responsible for their care if something happens to the mother. So yes you need to claim them.

You can pay me 200 dollars for checking the i's and t's and I'll do a better and more efficient job than a lawyer.

1 - search VJ for words like red flag and your country, or look at embassy reviews from your embassy. This is to understand what exactly a lawyer can't prepare you for unless he/she asks those specific questions. Things you might not consider possible bumps could easily turn out to be one - or on the contrary; it may help you calm down.

2 - A lawyer can't provide a guarentee that the petition will be approved. Not only that, but he/she can't always help on the other side of the pond(non-USC gathering documents).

3 - A good immigration attourney won't only charge you 1000 dollars unless they're just out to make easy money because there really isn't anything stopping you from doing it yourself. In such case, the only thing the lawyer does is put it in an envelope after YOU submitted all documents to the lawyer. Some on VJ got "a good deal" with a lawyer but found out later on that they couldn't just ask the lawyer questions through mail/phone/in person more than twice unless they wanted to be charged extra. Too bad when the first question was "any news yet".

If you decide to hire a lawyer, make sure you have a copy of the i129f petition that they submitted, a copy of NOA1 and NOA2 and any other correspondence to/from USCIS.

And if you're really, really bad at paperwork, paying a lawyer is an expensive way to never learn how to submit paperwork. You'll have embassy, later on AOS, then ROC and then citizenship(if so) and lawyering up each time will cost you the down payment of a house, basically.


I was able to do the AOS without a lawyer . I too hired one for my K1 and K2. I say the latter part of your statement is untrue unless the petitioner lacks a basic understanding of English.

It was worth the 2000 dollars I paid. I didn't have time because of work. Another thing was her English was very poor and her country's language was not her primary language so they brushed her up on her Vietnamese and English a month prior to interview, So people can have their opinions of not hiring an attorney and if you don't and not well prepared it could be a very long time before your loved one is with you.

I have a friend who wants to do a K1 to a Philippine woman after his first trip and the only trip he wants to make. Here's another red flag is he did a K1 on a Ukraine lady who he brought over in early 2012, never married her and she went back to Ukraine within 30 days. I see a lot problems if he files, give me your opinions on what to do.

He needs to find work soon that can satisfies 125% poverty guidelines. The previous year of no work shouldn't effect the process as long as he is working now and has a letter of employment he can provide in packet 4 at the time of your interview.

You might have better luck with the Cr1 with a co sponsor, go back and get married. Some countries do not allow the k1 to have a co sponsor( It states they do but routinely denied in countries like Vietnam). Best of luck.

Very sorry to hear your misfortune. I knew I couldn't do the paperwork alone so I hired a Lawyer,just not good at that kind of stuff. I'd say if your fiancee saw Pink that was a good sign. I hope your interview is soon. Make sure she knows everything about you and looks the interviewer in the eyes with appropriate smiles during the conversation. She needs to answer with confidence. Hello everyone.. i just need to vent!

My Fiance had her interview on Nov 23rd... we were so sure that it was going to be a good day and she would get approved. but here is what happened...

I thought I followed the instructions carefully and read the following.. "DS-160: Online Nonimmigrant Visa Application (for all nonimmigrant categories except K applications)"
So we filled out the "DS-156K: Nonimmigrant Fiancé(e) Visa Application" to turn in.

My Fiancé arrived at the interview at 8:40am her interview wasn't until 9:30am They gave her a number to wait.
After they called her to go to door 14, The Consulate officer a Vietnamese lady asked for the paper work my fiancé brought with her. Then she looked through the contents and made notes on the pink paper. Then asked where is the DS-156 form? My fiancé told her "I though we need to turn in the form DS-156k." The Consulate officer said you need to print 2 pages of DS-156 and she wrote it down and asked her to go to print and return in around 40mins.
When she came back to give her the form the Consulate officer said it is the wrong form. And to go to see the lady outside to ask her for another interview date. My Fiancé asked her "Why? Why not today?"

Consulate officer said... "we work only mornings."

Then my Fiancé went out to see the lady to make another appointment but she was not there. She waited 20 mins but nobody showed up. She went back to the Consulate officer, and was told to come back at 1:00pm to see her then. After returning back at 1pm my fiancé was told that she would receive a letter in the mail for another interview date.

We were so disappointed..

We were really hoping She would be here with me for Christmas and were planning to get married on New Years Eve! :(

Unless it has changed since I brought my fiancee(2011) Vietnam does not allow co-sponsor. It might say so on consulate web site but highly doubtful. You should consult Marc Ellis,he's an immigration attorney in HCM . He's one of the best and very happy I used his services.

Why bother with a lawyer when you will be doing all the work anyways? Unless your case is complicated, to me its a waste of money. You will already be spending a lot on form fees and what not. All a lawyer will do, is tell you the information you need to gather for your petition. That information is already conveniently provided here in the guides. Take a look at the guides, ask questions on this site. Like its been said, this site is a wealth of information, not only in the guides, but through the people that have already been through this process.

For copies of the cell phone bill, we just included the pages that included the numbers called and the texts sent/received. I highlighted all places where we called each oter and also where we sent each other texts. And I think we sent 3 months worth. We didn't send any copies of emails because it was all in Spanish.

I actually used a few paperclips in my package. I kept similar items together by paperclip, and just had them in order based on the cover letter. I think as long as you have everything in order, you won't need labeled tabs. I never used them. My package altogether was maybe 40 pages.

For passport pages, what I did was copied several pages to fit on one piece of paper, so all pages of my passport fit on 3 pages. I printed all pages of my passport to prove my citizenship, but then for my evidence of meeting I only printed the pages with the passport stamps and my bio page. So you should be OK with just printing your bio page and the pages that have your passport stamps.

I only included a little evidence of our ongoing relationship, but I didn't include much at all. We are presenting our evidence of relationship, if its asked for, at our interview next month.

Most consulates will use the 125% guidelines because, although the K-1 visa is a non-immigrant visa, there is immigrant intent and they know the intending immigrant will be filing I-864 which requires 125%. You have to understand that the I-134 form is used for other non-immigrant visas as well, which will not have immigrant intent and in THOSE cases they will require only 100%, but not for a K-1 visa.

Couldn't have said it better. YOU are responsible for the RFE, YOU are responsible for whatever evidence they receive in response to the RFE and if it isn't good enough YOU are the one to face the consequences. You need to do what is best for you, and get rid of that lawyer who doesn't seem to have your interests in mind. I recommend sending as much evidence as you can INCLUDING photos, to satisfy the requirements of the RFE.

We know someone who also included a marriage contract and was approved anyway. It just states that we are each financially responsible for any children born in the marriage, anything obtained prior to the marriage will remain in the possession of the individual parties, any children are free to choose their own religion, etc. If it could harm our chances, i won't include it but we DO know couples who have done this with no problem. In what ways could it harm the petition getting approved?


It could harm the petition being approved if they suspect you are already married.

You only need to prove 3 things in your package: you are a US citizen, you and your fiance are legally free and willing to marry, you have met in person within the last 2 years. That is it. Depending on how hard your consulate is, you may want to include a little or a lot of proof of your relationship. The packet I sent was less than 40 pages.

For the embassy stage I'm not sure cover letters are needed, but I can't speak for the embassy in France. In Colombia, when you arrive to the embassy, they give you a sheet that tells you the proper order the items are supposed to be in, no cover letter needed.

One passport style photo of each is sufficient. I made copies of my boarding passes, passport stamps, itineraries and such, and included them at the end of my package to show proof of meeting. I included maybe less than 10 photos altogether, and I had them in ziplock bags stapled to a sheet of paper. For the passport photos, I put each in a ziplock bag stapled to a piece of paper behind the G-325A form. On the bag I wrote: Passport syle photo of xxxxx. For the photos to show proof of meeting (I had 2 sets), I wrote : Photos from March 2012 and Photos from May 2012. I don't think it was necessary but I liked to keep it organized. And my package was MAYBE 30 pages if that. It was really short! I didn't have any problems with my petition.
