Hello Everyone!

I have filed the appropriate paperwork for the K1 visa with Nebraska (my processing center), about a week ago and they have received it. My questions are this:

1. Can she come her on her current tourist visa as long as she leaves b4 it expires or is that a no no since we have applied for the k1?

2. Can anyone please give me the names of hotels in Kingston so I can prepare once all the paperwork is there, filled out, etc and they give us an interview date?

I am seriously considering marrying my Fiancee and applying for a k3 instead fo the k1 to speed up processing times.
Do all K3's apply through the National Benefits Center?

The reason I ask is that they show a processing of the 129f's as January 25, 2006, which is much faster than if I do the k1 through nebraska, which is still processing decembers.

Any thoughts on anyone? I just want to be with my future wife sooner rather than later. Thanks.

My Fiancee recently found out her landlord has sold the house, so she will be moving in the next 30 days. My question is that I recently (march 23rd) submitted our k1 application? The problem is, unlike in the US, the Cayman islands is somewhat chaotic with mail, not to mention the Counsulate is in Jamacia. Can we have this mail forwarded to me? Or how do we go about changing the address so the application is actually received? I don't want this to be even a day delay. Thanks.

1) You can have some sort of celebration but make sure that its by no means legal .... I gather it must be for personal reasons on why you want to have this ceremony now rather than wait till your K-1 approval ??

2) I think since you are like 3 months in that process already it would be counter productive to get married and have to start the whole process over again ... IMHO this would probably add even more delays to cancel the K-1 and then apply for a K-3 ...

3) Who knows but starting all over with a K-3 would be even longer ... Atleast your in the que right now .... Imagine if you were to refill and start at the bottom again ...



1. Yes for personal reason, we are struggling with having it now (not legal, but a ceremony), versus waiting until after the baby is born.

2) Yes, I definatley don't wnat to start over, but in 2 months I think she will be showing quite well, we think it is twins (runs in her family).

Question: If we wait, and then go through the whole K1 process, I know we have to get married in 90 days, but would a civil ceremony suffice for that or will there be lots of questions?

My fiancee (Caymanian) and myself (USC) submitted our paperwork on April 4th (they received it on this day). Our I129F case of course was transferred from NSC to CSC now.

Fiancee came for a visa on a waiver on May 28th. Figured we would be able to hang out and wait out the processing times. Well, in this short course, we found out we are pregnant a few weeks on June 20th.

My questions are these:

1) Can we go ahead and have a marriage cermony, without the legal paperwork, so as not to cause problems with our application?

2) Should we just go ahead and hire a lawyer, get married and then file other paperowork, since this would be considered "spur of the moment" marriage?

3) How much longer until this hell ends and we actually get moving on the paperwork in CSC? It is pushing 90 days.

"There is a backlog of I-129F applications and therefore they are shipped to another service center for adjudication. It should not delay your case and actually will push it along. I understand your frustration and while yes it would have been legitimate for her to come for a visit getting a visitors visa for her might have been difficult. Please remember when they give you the time frame of 80 - 110 days on the notice of action they are not referring to actual days but business days."

I also received this notice (I live in Iowa). So does anyone know what the heck is going on. I tried calling, but of course the USCIS system is so fun to manuever, after about 30 minutes of punching buttons, trying to get to someone life, I was hung up on.

If it makes you feel any better, which it wont' I submitted ours on April 4th to NSC, and now it was transferred to CSC. My Congressman basically said, we get put to the back of the line and go with the CSC timeline now.

"We had submitted to NSC originally as asked on April 4th, 2006, which was 61 business days ago. That is 96 business days, and almost 133 days, or close to 4.5 months before even the first real action on the case?"

The better thing yet, is that my fiancee is pregnant now (she came on a tourist visa for 2 months, we figured that it wouldn't take longer than that to get some action done), and now she will have to go back home. Way to go government, way to care about the citizens. It would have been quicker to just get married when I was down there and file a I-130 OR just to have had a "spur of the moment" wedding here. This is not a good situation, no wonder people migrate here illegally, those that follow the rules are fools, unfortunately I was taught to do things right. I dont' think we should count on ANY timelines as they are just flips of the coin.

The Federal Government needs to clean up their act, with today's ability to find information, it is absolutely ridiculous that we all sit here and wait, while our paperwork just sits and waits to be looked at and/or entered into the system several months later.

Anyone up for starting a petition of some sort to get noticed? We are all in the same boat and I am sure there are tens of thousands more like us, maybe a little rattle as the mexican people did would get SOMEONE's attention. Form letters to George Bush possibly? I am at my wits end with the waiting and now my baby will have to be born outside the country, which I wonder how long it will take him/her to get in since the wait was out of my control and my paperwork will be outdated by then.

The last update to the CSC processing times was June 20th! I realize that they dont' update it every day, or even every week for the that matter, but does anyone know when the will actually update it? It would seem easy to program that they have so many cases, along with processing times, they (the government I know I know) should be able to keep this up to date, Good Lord at least once a week. Anyone know?

I was told it was business days by my Congressman. That being said it was suppose to be between 80-120 days for me, and I am at day 100, and business day 73.

I don't think the people working even at the centers know, and i would love to know the percentage of people who fall outside of the "projected" dates.

My fiancee was able to come on a visa waiver, as the POE officer let her into the country to visit me after we sent off our I-129F form in April. As we sit here and wait though I have a question.

Her I-94 form says she can stay for 6 months, and her waive is good for 1 year and 1 entry into the US from Grand Cayman.

Question: If she doesn't take the original flight back is she ok to stay AS LONG as she doesn't go over the I-94 date? OR will she have problems with the fiancee visa since she isn't taking the original flight back?

The reason I ask is that I don't want there to be any problems with our fianee visa application, and am hopeful that it will get approved in August (Her original return date was July 30th on the ticket). To change the ticket to an "open" ticket is much more costly than just buying a new one. Thank you.

109 DAYS
78 BUSINESS DAYS

I beleive the original said between 80-120 days! When do I start ranting to them or when (if there is a when) should I expect to hear anything else?

I am sure I am not the only one feeling this way, but I am VERY happy for those of you that got approved. That being said, which way is the approval line flowing. I have seen people with cases after OURS by a month getting approved at CSC, while others waiting even before our case aren't getting approved.

What is the order in this chaos?

Also, CSC has some brilliant people working there. See the response I got below. I am sick and tired, and tired and sick of all this Immigration BS. I am ready just to move, at least there you get approved in 30 days and immdiate work permit. I hate winters anyway here in Iowa.

You can have the religious ceremony, that IS legal. Just make sure that when talking with family and really close friends you recognize it as such. A religious ceremony is OK, just don't sign the paperwork. If it is brought up in the interview, be honest, let them know you had a RELIGIOUS ceremony and were planning on legally getting married at a later date. I really don't think you will be denied the fiancee visa. While I am sure there is a certain level of risk, you can mitigate that risk by having it as a religious ceremony without having to change everything. Moreover, if asked you can also say that (truthfully) you thought that 6 months as fair, as it gave several more months than the average for the visa. I feel sad when the USCIS has held everyone back because they are inadequate.

Actually when I called the lady was very nice, albeit she was very unhelpful in answering my questions.

With any Customer Service keep in mind that agents have little if no power to do anything anywhere, whether it is USCIS or eBay.

So from what I posted originally and from what I read no one is being rude with USCIS, but we are all sitting here without any help from anyone. Personally I find that REALLY amazing since immigration reform is a large topic these days and they are talking about trying to get 12-15 million people somehow into a legal status. You would think the Senators would have more of an open ear.

I am so frustrated right now, I feel like just leaving the US for another place.

Just got off the phone with a USCIS representative, and basically she said that they are using the RFE dates as the start of the process, NOT the NOA 1 date.

So that basicaly means we submitted in April, waited 2 months for our transfer to CSC, then another month for the RFE (IMBRA), and now our days actually start from that day. 90 days of waiting=No Progress.

We should all just expect this process to take 9 months!

I have come to the conclusion that the NOA1 date and the RFE date make NO DIFFERENCE in approvals. I have now seen people with RFE dates of when they sent things back two weeks later than I, and I still have no approval.

Conclusion: Nothing but the wind matters at CSC and customer service is just talking when they say they base it on the RFE date now.

Total Time from Application Receipt:

Days: 36
Business Days: 27

They weren't very concerned with my travel costs. :)

I was hoping:
1. Since she has been sick, and could be at risk, that the doctors note about traveling would help.
2. Since Cayman Embassy is not in Cayman, but in Jamacia, that that would be undue hardship, as she will need to get a waiver to even travel there.

Has anyone asked to be intereviewed at a local office, versus flying off to another country, or is this even possible?

The reason I ask is that my fiancee is from Grand Cayman, but the embassy is in Jamacia. This would mean that we have to spend a full week from BOTH of our home countries in a hotel, and both fly there causing undue financial expenses in my opinion. Plus she is pregnant, and that would be one more risk for her. She is three months and been hospitalized twice already.

Anyone had any experience or thoughts on how we might be able to do this locally, either here or in the cayman islands?

So here is some humor to vent some of my anger.

I talked with three different reps at USCIS, one was even a supervisor that I waited on hold for two hours to talk with. Well, turns out that NO ONE there knows that Mr. Gonzalez is the USCIS director or ANY of the following.

1. All NSC I-129F petitions have been transferred to California
2. What IMBRA is or that they had to sent out 10,000+ IMBRA forms.
3. The IMBRA law was signed on January 5th by Bush.
4. The IMBRA law went into effect on March 6th.
5. June 15th was the first day the NEW form was avaiable on the internet at USCIS.Gov
6. What the "Backlog Elimination Plan" is that Bush set forth in 2001.
7. That we are to have open arms and not long lines for immigrating (Bush's Statement)
8. The USCIS goal is to have all processing done in 6 months or less by end of FY2006.
9. NOA=Notice of Action

Now, with all that being said, shouldn't the people who answer the phones and at least be given a memo on who the USCIS Director is for Godsakes!

Oh, and one other thing. I learned NOTHING new when talking with any of them or the supervisor. No one should waste their time talking with them, if anything it makes you feel worse that they don't know anything about anything, therefore your processing may or may not take place.

Oh let me add this in...this is why I am frustrated:

I agree just have a cosponor just to be safe. Just incase I read sometimes they dont even look at your affidavit of support. Maybe its cause the K visa affidavit of support I-134 isnt law abiding from what I read. I dont know but maybe.
