I'm sorry but I think you still haven't quite understood the question. Kamhoe is talking about receiving the Green Card after you enter on an immigrant visa such as a spouse visa. At that point the application is complete and approved so there will be no mistakes or RFEs - they just need to produce and mail out the card. I did my POE last Sunday at Atlanta and they told me three to six weeks.


My experience is with K1, possibly the Cr1 is different and you started the Aos abroad? If thats the case then I apoligize for any misgivings. I had to marry first within 90 days then start my Aos.

I am not asking about the process of applying green card and the time to wait for the interview. I am asking about the time to wait for the green card in mail after someone has entered the United States on an immigrant visa.


Thats how long it could take,depends on your app and if you have no mistakes or Rfe's. Granted some people have received them in 4 to 6 weeks. There is a web site you can check your status after you recieve the first letter.

After I found out I was approved off the web site it took approximately 2 weeks.

Depends on how fast you apply for AOS, it could take 3 months to 6 months if you have no RFe's or interview after Biometrics. Good luck getting a SSI card, even though she is eligble most offices dont know the law and I stopped trying after about the 5th time, irrelevant to have one it doesn't make you legal to work. I was able to get my now wife on my health insurance with out one and waited till after the greencard to get it. When you do the Aos,apply for the temporary work visa(EAD) that will come before greecard and is free if file at the same time.

The above post is spot on. Why didn't you do your homework before you filed or while you were dating to see what kind of income you would of needed. Maybe get a better job or even two jobs to cover the income part of your visa process. I knew I would have to be 125% above the poverty level for a family of 6. No way in hell would I've got involved with my now wife if I couldn't sponsor her. Sorry to sound judgmental but it strikes a nerve when you get this far in the process and the petitioner doesn't have the income requirements. By the looks of your timeline you had almost 4 years to get it figured out.

I hope it all works out in the end and you can get your husband over here, hopefully he can land a good job. Best wishes.

I pay around $350 to $400 dollars a month to buy minutes on my calling card, not counting $175 a month for my cell phone plan. We talk close to 5,000 minutes. We also chat on Video Skype. I don't mind because her english has improved alot since we started talking more.

I'm not complaining about the money or working 2 jobs, I now make way over the amount needed for my case, that was a concern to me at one time.

I just wanna know how people can afford it and not worry about where the money comes from,yada yada yada. Granted I'm going through a difficult Consulate but so many worries how to prove a legitimate relationship, I would find it much harder to prove under those circumstances.

I understand there is co sponsoring but how are these people affording trips to see the beneficiaries and pay for the visa process. I work 2 jobs, make decent money find it real hard to save the money and get the time off to see my loved one. I have every little receipt or money trail to prove its my money. Explain to me how you do it, I want in on it.

My fiancée received the first letter Aug 23 from U.S consulate HCM, my lawyer sent out the 230"s Sept 17. I emailed the Consulate 3 weeks ago and they received my lawyers paperwork, so now we wait for the second letter. One of our fellow VJ's members will tutor her English until she receives her interview, she leaves for HCM next week. So I will continue to email the Consulate once a week till we get the the last letter. Good luck

I am working on the I-864 and I am not really sure what documents to send. I have never worked in the US, so I don't have a W-2. Can I just send a copy of my tax return? Should I just send it from one year?

Also, my income is below the poverty level, so I will have a joint sponsor. Even with my assets I am nowhere close to the required income requirement. Should I even bother claiming any assets, then?

You have to apply for the I-130 and I-129F. Which cannot be filed when that foreign fiancée/spouse is in the USA. They consider that as marriage fraud. And the non-American citizen will be deported. If you are here in the USA as a tourist you cannot marry an American citizen. Also if your here as a student you cannot marry an American citizen. That's what the K-Visa is for so you can stay legally with all the benefits of being married and your not a tourist or a student. The government considers this as marriage fraud. You will have a hard time proving why you both want to get married (government will think you only want to be married to come to USA and live here). If you violate your status of being in the USA. You will be banned from re-entry for 10 years or life.

When you petition is aproved by uscis . it automatically gets sent to the local nvc closest to your place of residence . once nvc have processed your paperwork nvc will send all the required paperwork to you just follow their instruction . And they will send the k packet to your fiancee .

You dont need a special letter from the USCIS or NVC or Usembassy to take the medical exam . You just need the noa#1 and the aproval notice from USCIS , allso the letter from NVC that your file has been fowarded to the usembassy . After the time has passed that says in the letter from nvc , start your medical exam , you will have a case number assigned to you starts with MNLthen the year NVC received your file from USCIS then a number . And the Saint Lukes Medical Center will find the information there , using the Case Number . You just need it from the 3 USCIS NVC and Usembassy (wonce the Usembassy recieves your file from NVC , they will let you take the medical exam . Without any problems , if you are awaiting your letter from Usembassy expect to wait 2 and a half months for that letter to arrive . (All you have to do is wait up to the point that Usembassy recieves your file), if you can show that now (you can allready take the medical exam).

You would have too meet the Federal Proverty Guidelines , for your current household size plus 1 for the person you are sponsoring . And you need to be an american citizen first before you can petition him or her . And for the arrival of your Green Card im not sure , maybe contact USCIS ?.

You have to wait untill you information is fowarded to the Department of Homeland Security from you POE . So they can enter it into the SAVE-AVSAP System . Which will then show , you legally entered the USA under your visa , this can take any amount of time . Then checkin too the SSA , and apply for a SSN (make sure you tell them your not asking for employment verification , and you need no EAD , your card must say Not Valid for Work without INS Authorization ). They can check , the status on the computer in the SSA . If you entered into the USA using your Maiden Name , you must apply first for your SSN with that Maiden Name . Then wait untill you get your SSC in the mail (SSA will tell you how long it should take for you too receive your SSC in the mail), if you are allready married before you recieve your card . Go back too the SSA , and do your legal name change .

You need to be patient , you are looking at about 2 years since your married ( being apart ), and if its a k1 not yet married about 1 year ( being apart ). If you dont have patients , then this visa is not for you .

Thats not what it says to me , if you break down each word , and define it it says from what you wrote . (1) Applicants who have previously been deported (2) or removed at government expense ( from the united states )

So if you have left , in the time they tell you . That is still deportation , so from what you said after that as follows .( need to fill out a I-212 ), so in my opinion you must still fill out the I-212 . And submite it too the proper place , so its filed

The other posters are right , but allso if you have no employment that can effect you getting a visa .(They want too see one of the spouses having employment ). And allso some Usembassy do not except co-sponsors , you should look into this to make sure , cause your time doesnt say where your finacee or spouse is from .

Hello all, I am having the same problem. The NVC stated they have sent my package on January 4th. I have selected track by reference and typed EXP 04 JAN 2010A with the dates before and after and even tried 03801 as the origin postal code but with no luck. It says no shipments found. Anyone having any luck for 2010?


Check on the 6th or 7th. One of those days had 2 pages of packages picked up. Unfortunately none to Frankfurt.

I have tried the date NVC told me. There are no shipments to Frankfurt so far in 2010. I did however find one on December 30 or 31, 2009.
Could this be mine? It seems possible with the holidays and such. I guess I should try emailing to the consulate and see if they received it yet.

It's not working for me either. I called the NVC and was told that it was forwarded to the Embassy in Mexico on Dec 24. So I on the Ref # I put in 24DEC2009a as well as the original zip which like you said is 03801. But it still says "no shipments found. Please revise criteria and resubmit."
Am I missing something???

NVC doesn't get involved with DCF filings. It's all done in Jamaica. An address, bank account and maybe a driver license is all the domicile you're likely to need. Restarting AOS is not an option because you are outside the USA and would need to commit visa fraud to enter the USA to complete AOS. DCF, IR1 visa is the path. Once you have the visa in hand, she has six months to use it, so plenty of flexibility.

Don't confuse domicile and sponsorship. Sounds like you WILL need a joint sponsor or a new job in the USA. I didn't notice you indicating your wife's citizenship but Jamaica certainly isn't part of the VWP.


No I was just saying it is too bad the US is not that efficient, hence why we are going the IR1 route. We live in the Cayman Islands, she is not from Jamaica.

The embassy in Jamaica doesn't do DCF filings though, so that won't be better. They did however state they receive I-130 forms, so I was thinking it might be easier to send it to the Chicago Lockbox to be faster, which I still am not sure of at this point.

Not sure if the domicile thing will be an issue, as we have enough money in our savings account to suffice, and the money I am making here should show that I can support her fine without having anything in the States at this time (as I am on contract here).

Does Jamaica do DCF, as I was told (by them) they do not?

Honestly, filing directly with the consulate will be faster and less hassle (although you may need a stonger domicile in the US than your mother's house - a job for example. Montreal is really strict on domicile however Kingston may not be) but if you are not looking to move for a year or so, perhaps you can wait.

Yes she can travel on the VWP however, no guarentees that she'll be admitted so you should bring strong ties to your home country when applying for admittance

I was thinking it wouldn't be faster, as the consulate would have to process it then send it off to the NVC. As opposed to the other way around. I would think the NVC processed ones would be faster, and it would be a matter of the embassy just receiving it and holding the interview. The domicile thing is tough, as if I am currently working overseas, that is hard to prove, but I may just have a sponsor form sent just in case. The really dumb part about all of this is that we went through AOS in the states, and ONLY the interview was left (they had taken biometrics, etc), and we left two weeks (didn't know it at the time) before the interview. We did send a letter when we left letting them know we were withdrawing it, and the reason, and received a letter back from them as well. It would seem logical if we could just restart it, and update any information, but government doesn't run efficiently like that. :( That was three years ago, so obviously we stayed married.

Is that the consensus though to file it through the embassy directly?

I (USC) am living outside the US currently with my wife of 3 years and our two sons. (married in the US)

We have no immediate rush (IE, we probably could wait a year, maybe a bit longer) to move back to the US as I have a good job that is secure until at least this December (end).

Our local embassy is in Kingston Jamaica.

Should we file with the Chicago Lockbox as I have a US Domicile (mom's house), or should we file with the embassy in Kingston to have our applications processed quicker?

Please advise, as I am lost on this one.

Also, since we live in a visa waiver country, I understand (from some Canadian answers) that she could travel back to the US while the I-130 is processing. I know there is always a risk she could get turned away, but we have a mortgage here, I am on contract work, we have anything they would want to prove "ties", but I just wanted to ask if it was illegal. It would seem to me (logically) that if we filed an I-130, that shows our intent to do it the legal and proper way, so not to sneak into the country with her, but I know sometimes (although it appears small) people have issues with the POE. We have never had that issue and we have traveled back 4 times a year or so since we moved out of the US.

It has been a while since I have been on VJ, and I think I have confused myself.

My wife and I have our interview at the Jamacian Embassy coming up in September. My question is this: If we get approval (we filed as an IR), will her passport be stamped the same day or will we have to wait for her visa to be mailed to us.

We are living overseas in the Cayman Islands, this is our local (not on the same island) embassy. It would seem odd that she would leave her passport as that is the only one she has, and she wouldn't be able to come back into the Cayman Islands without it. It seems logical they would stamp her passport if approved.

Can someone please tell me what the process is going to be if approved?

Ok, so let me see if I have the K1 process down for Grand Cayman.

1. I (the USC) apply for the K1 visa, then USCIS forwards it on to the counsulate of that country. (Lucky me, Grand Cayman's is in Kingston Jamacia :( ))

2. Once Kingston Receives it, then they send out a packet (I understand Jamacia's is one) to my fiancee.

3. My fiancee fills that out completely. (I will probably have her make copies just in case any mistakes happen). Once filled out she can either mail it or go in person.
-----I have a question here. Should we fill out the packet first and then phsyically take it to Kingston and will they then giver her the "k" status immediately, allowing her to come back to the US with me.
---OR as soon as I get the I-797 form, can we go to Jamacia, get the packet, fill it out in our hotel room, and then turn it in, AND will she get the K status immediately and be able to come back with me?

What would one suggest? Thank you, any help is GREATLY appreciated.

-----I have a question here. Should we fill out the packet first and then phsyically take it to Kingston and will they then giver her the "k" status immediately, allowing her to come back to the US with me.
---OR as soon as I get the I-797 form, can we go to Jamacia, get the packet, fill it out in our hotel room, and then turn it in, AND will she get the K status immediately and be able to come back with me?

What would one suggest? Thank you, any help is GREATLY appreciated.

Ok, here is the problem.

II know there are several different ways to bring a fiancee/gf to teh states. I am a US citizen, and I am told to go through the K1 process. This is the problem. MY fiancee is from Grand Cayman, which doesn't have a Counsulate (you have to travel to Jamacia to get anything). So if I file the K1, then she would have to travel to Kingston (not such a safe place) TWICE. One for the paperwok, and then another for our interview. So I have been told (by an attorney) to NOT plan the marriage, bring her here to the US to see if she likes it, if she does, have a spur of the moment wedding. My question is this:

If I, a US Citizen, marry a foreigner on "spur of the moment" then will it be a problem if her i-94 expires before we file the I30/I485 paper work together?

So the scenario would go something like this. She comes here for a visit to see if she likes the US. Then I decide that I really do want her to stay so we decide to get married. Her I94 expires is valid for one week (her intended stay), and then we get married after 60 days, and file paperwork the next day (day 61). Her i94 would be 54 days expired when we file the I30/I485 paperwork.

Is this a problem? I have no idea how long they typically grand the i94? Any advice would be helpful. Thank you.

What are the exact forms I need to file a K1 Fiancee Visa?

We have filled out the G325A and I-29F. Are these all we need to start the ball rolling, or are there others that need to go along with these forms? Should they be sent together? Thank you. All so confusing right now.

BTW: Thank you to all who helped me with my first decision on getting married here or not. We are taking the high road and not going to have a "spur of the moment" wedding, but rather go through the process.

Hello Everyone!

I have filed the appropriate paperwork for the K1 visa with Nebraska (my processing center), about a week ago and they have received it. My questions are this:

1. Can she come her on her current tourist visa as long as she leaves b4 it expires or is that a no no since we have applied for the k1?

2. Can anyone please give me the names of hotels in Kingston so I can prepare once all the paperwork is there, filled out, etc and they give us an interview date?
