K-1 Fiance(e) Visa Process & ProceduresDenial of K-1.
QUOTE (LuckyHelen @ May 21 2009, 05:12 AM) <{POST_SNAPBACK}>
CODE
I am from Ukraine. I got denial of the visa of K-1 the day before yesterday at interview.
Explanations: my fiance petitioned on the former wife 7 years back, they officially divorced in January, 2009. And our relations began in February the last year. His former wife lives to one address with him, it did not please a consul and he drew conclusion, that they live together. Yes, one address, but there are a few apartments in this house, and they live in different apartments. This house is my fiance ownness. They did not divorce because they do not need it it was, but every lived by own life a long ago, and she has already other man which going to get married her. I was not able it to explain it. A consul said that his wife is not American, began to ask me as they met, I did not have been able to answer, I did not know, and  I said that he met her with his friend, but he said that they met also as I with him in Internet. Probably, he thinks that I want to leave to America and paid the fiance of money. It is not truth.

What can we do - to try it to explain and how? Or to conclude marriage in Ukraine and do the visa of K-3?

If your fiance was officially divorced in January 2009, when did you file the petition for the visa? Just to be clear, as you don't have a timeline, you filed the petition after your fiance's divorce was final, yes? I do recall seeing cases where that detail has slipped through USCIS. That would be a legitimate reason for denial.

I think carlawalla gives good advice, have your fiance talk to the embassy and if you have issues getting them to listen, get a congressman or senator involved in your case.

United KingdomCheap hotels close to Medical London.
Thanks for all the great suggestions!

I think Jon's going to stick with the Marble Arch...it looks to be close enough to both.

One less thing to worry about!

United KingdomCheap hotels close to Medical London.
Hi all!

I'm starting the prep for my impending medical and interview, and would appreciate some advice on really cheap hotels(not hostels please:) that are close to both the doctors rooms in knightsbridge and the embassy. I've tried looking up hotels around the embassy, that was succesful(though the more the merrier!), but as for the medical place.....They were all a bit expensive! So if you have any suggestions, I'd love to hear from you!

Many thanks
Jon

United Kingdompacket 3.....regular royal mail?
Can anyone help.

Does the London Embassy send up packet 3 via standard royal mail? Or do they use some other courier?

Thanks Jon.

i would be more worried about AP because he is a UK citizen rather than a former SA citizen.. smile.gif

Well, if you ask him he's South African wink.gif

But, from what it sounds like there are many many more variables to consider other than just country of birth and we'll just cross our fingers!

Thanks!

Do you guys think being born in a different country but still a British citizen makes you more likely to be put into AP?

I'm trying to ascertain our chances of being totally heartbroken after the interview. Jon was born in South Africa, not really a high-risk country but.....

hi.

im not frantic. just curious.

i am so torn between answering question 11 (on the I-134) with

a. [do not intend] n/a (k-1 visa process for permanent residence)

and

b. [do intend] i intend to support my fiance in whatever way is needed, including providing room and board, for an indefinite period of time so that he does not become a public charge.

advice?

We haven't had this given the stamp of approval yet, but I went with

"I intend to marry and live with the recipient in the manner of husband and wife, sharing with him my home, food, money, and belongings"

I looked at that N/A answer given in the guides and felt it was inadequate...although its probably perfectly adequate.

London is a bit better with Current and Future income evidence.

I would have an extra I-134 from a co-sponsor handy just in case.

That is what we thought would be best too. We have Krysti's parents as a co-sponser, only we may not have their 2008 tax returns in time, we have the last 2-3 years though. Hope this isn't going to be a problem.

Thanks for the reply!

Hi! So Jon and I are getting ready for his interview and we're working on the I134

I've been in school/traveling and last year did not make above the poverty line (my 2008 taxes reflect that!). But I've had a job since October that is pays well above the poverty line and have pay stubs/employer letter as evidence. Has anyone had experience with London and know if they will accept this?

United Kingdommedical reports
QUOTE (Nich-Nick @ Apr 14 2009, 07:25 AM) <{POST_SNAPBACK}>
They just need your immunization record so they can put it on the forms. You would be wise to complete all immunizations in the UK if possible so they can show you are complete on the DS3025 form. If you are lacking something like MMR, you can pay them to do it there or go back to you NHS doctor and get the shot maybe free. Nick was lacking Tdap and wanted to do it at NHS so Knightsbridge held his results until they got a fax from his NHS office. Then they put that on the DS3025, sent him a copy, and forwarded the file to the Embassy. In hindsight, he wishes he had just paid Knightsbridge because at first his NHS doc said they had limited suppy of the vaccine and they were reserving it for babies. So he thought he would be taking another day off work to go back to London to get the shot at Knightsbridge after all. The reason to try to complete everything in the UK is that a complete DS3025 seems to be working for AOS submission. Otherwise you have to get an I-693 form (immunization part) done in the US by a Civil Surgeon and that will involve more hassle and money to pay for that service.

The only medical information needed would be if you have a continuing illness that is serious enough to require explanation of your treatment and that you have it cured or under control with medication....like depression, diabetes, heart disease for example. A tip: if you took Prozac years ago for a month because your dog died, don't even mention that. They can make you undergo all kinds of psychiatric evealuation to prove you don't have a mental illness. So if you were temporarily sad and got over it with short term meds, just don't bring that up. Their question on the medical history form is more about long-term depression or mental illness.

Thanks! That settles my mind! I phoned the Knightsbridge doctors to confirm my appointment and they told me what to bring. They didn't even mention medical records, so as usual I have nothing to worry about! Thanks for the advice on the vaccine shots, I'll do all the ones I need done tomorrow at the medical, saves time and trouble!

Thanks again!!

United Kingdommedical reports
Hi there.

With regards to the medical report that you should take to your medical, what exactly is it supposed to contain? I got a letter from my GP back in SA, it states visits I made, dates and what it was for(Illnesses), nothing more or less, my doctors rooms only provided info back to 2001, I have only ever had 1 semi serious condition, that being pneumonia, which was cleared up quickly with anti-biotics, other than that the usual, colds, flu, ear infection, tummy bug....just the norms! Is this what they are after? I hope so as I have my medical tomorrow, and I'm a little stressed that this won't be sufficient! To get another more detailed copy would take a week or 2 to get, with the inter-continental postal stuff!

Thanks for any input!
Jon.

United Kingdomwaiting on interview date!
Does anyone know what they actually DO with the packet 3 papers? Are the more checks performed or do they simply ensure they're filled out and correspond with the info sent from USCIS/NVC?

This is more curiosity than anything else. It seems the more I try to understand this process the more vague and undiscribable it gets.

I wouldn't worry too much. Easier said than done, I know. It seems like it takes forever, but the time will go by very quickly! yes.gif
When we were waiting for packet 4, I think the people at the DOS thought I was crazy I would call so much (actually, they were really nice and understanding). blush.gif

Ah, the Hawkeyes! They're my adopted team!!! Krysti is from Iowa too! Been trying to convince her that cricket is a fantastic sport, she says she'll go watch a game when we go visit back home in South Africa....got to make sure it's not a 5 day game!!
Anyway, we both phone the DOS everyday, and Yes sometimes(like today.) more than once! They are very friendly and as helpful as they can possibly be! Much better than the USCIS, because I can actually talk to them!

I do know this will eventually end, it just doesn't seem like it will sometimes!

I had to wait a few weeks, I would keep calling DOS

however it also depends on what date you put for leaving the UK, if you put a date that is far off you tend to wait a bit longer than those who had a earlier planned leave date

Hope you hear soon

Thanks!

I think that was it, i put down our wedding day, the 11th July but not a date for travel! Which is what I'm kicking myself about now!! Krysti says we should email them to ask for an earlier date if possible as all her family are gathering for Memorial day and it would be great if I could be there. Does anyone know if that is advisable, and if they would actually take this into consideration?

thanks Jon

United Kingdomwaiting on interview date!
Hi all!

Just curious to know if anyone knows what the usual wait for an interview date is between packet3 being sent and the actual date of the interview. We sent ours off on the 30th march and still nothing, that's 4 weeks tomorrow! Is that normal or should we start getting concerned? We phone the DOS everyday, and we know they have all our documents and my medical report too. I suppose the impatience has a lot do do with the fact we have been waiting for almost 9 months now, since we received our NOA1! We are a little pissed I suppose at just how ridiculously unfair this system is! This definitely isn't a 1st come 1st serve system at all!

Right, a bit of venting always seems to make me feel just that much better! Thanks for reading and any comments are much appreciated!

Thanks Jon.

QUOTE (krystiandjon @ May 7 2009, 12:47 PM) <{POST_SNAPBACK}>
I sent off my packet 3 what seems like eons ago(5 weeks) and still no interview date set. Anyway we have been contacting the DOS pretty much everyday in the hopes that they have scheduled us one.....Alas NO! We do know that they have all our documents-DS230, DS156, DS156k and DS157, but the DOS can't tell and don't seem to even know(about such forms!) if they received our IV-15 form(the check list for the interview). Now this stresses me out because if they've misplaced that or lost it, then they won't start processing till they receive it. I'm sure they probably wouldn't even bother checking with me either! So my question is, who do I call to verify that they have it? Is calling the extortionate Embassy line the only option?

Thanks for any replies to my probable paranoid beliefs, but I've seen a few number of blunders that the Embassy and USCIS are responsible for.....I just want to get this done ASAP.

Cheers Jon.

I contacted the Embassy yesterday on their extortionate line, I was told that they had processed the DS-230, but that was all. She did say it had been longer than 4 weeks(I know!! Almost 6!!!) and that is longer than the norm, so i should email them with my queries and to ask for a quicker interview date(wedding is set for 11th July, we also have family members wanting to start travel plans from SA!) So I got the email code and proceeded to email them. So hopefully something will be done by next week! This whole process for us just seems to be an uphill struggle, I just wish something in it would be easy! Maybe the interview and POE will be a breeze!!

Anyone else have problems this part of the journey? How did you deal with it? We will get the Senator involved very shortly, time for being patient is well over!!

We put a wedding date of July 11, but for travel date we put "immediately upon receipt of visa" or something like that. We're starting to regret not just making up some day to travel! Jon's calling the embassy tomorrow to see whats really going on.

United KingdomPlan B anyone? (K1)
Plan B for us is definitely moving to South Africa, getting married, and later applying DCF. Its not the best financial decision or a good career move for either of us, but after waiting this long, neither of us can imagine waiting on a K3 or CR1 apart.

On another note, Bob and Patricia, I believe in the power of positive thoughts! But, its always healthy and reassuring to have a plan B wink.gif

United KingdomA quick food recommendation
QUOTE (mr and mrs @ Apr 16 2009, 09:50 PM) <{POST_SNAPBACK}>
my year in glasgow was a sad year for the part of my heart that is in love with mexican food. we did make do. we learned to make a lot of things at home. jamie makes very good beans now. yum! and i am now able to make a pretty decent salsa (and i grow the ingredients in my garden!) and, though we did not discover it soon enough, we did visit the mexican grocery/deli on the great western road several times.

we had a particulary bad meal in stirling, but it was entertaining. i asked for hot sauce when our meal came and the waitress was puzzled. she returned after a minute with the kitchen's mini-vat of hot sauce and deposited it at the table. <3 (it wasnt really hot. just red.)

and damian, are you posting these recommendations as you discover them? is this a meal by meal account of your days in the us? did you have a reuben for lunch and a steak with a-1 sauce for dinner? : D

I've been to that terrible Mexican place in Stirling....how interesting was their rice?

Theres a pretty good Mexican place in Edinburgh on Coxburn(sp?) St. Although I'm with you all that American does Mexican food well!

Oh, and root beer! (Jon can't get enough!)
