For the K3 you must go through the embassy in the country in which you married. So, unfortunately, for the K3 Australia it will be. However, I am under the impression that the I130 (CR1/IR1) does not have the same regulations and you are able to interview etc in London.

As you have stated you are the main breadwinner, the I130 would be better in this respect too, as you would not be authorised to work for roughly 3 months from entering the US on a K3 and filing for adjustment of status.

The difference in processing times between the IR1 and the K3 is only a couple of months at present.

I have to agree with this post. The first step alone would take 2-3 months at the absolute best of times, then you would need to add another week for the NVC and then whatever time to schedule the interview at the consulate/embassy. Lawyers seem to know a bit about the general process but they do not seem to keep up to date with changes or delays. I wonder if your lawyer is still telling potential customers that it will take 2-3 months?

Unfortunately, USCIS can take up to 6 months to process their step (in fact, they state this) so to go into this process hoping for the best possible outsome (2-3 months total) was setting yourself up for a fall and was very unfair of your lawyer to raise your hopes to that level. I went into this process hoping for a 6 months turn-around but after finding this site, I soon changed that estimate to 10 months and so far it is looking like the 10 months will ring true.

I may be wrong but it seems that things were done in PNG to try to circum-navigate the divorce rules in the Philippines and time ran out sad.gif I am sorry for all the troubles you and your spouse are going through but I think what you really need at this time is not just an immigration lawyer but a lawyer that understands marriage laws in your spouses country sad.gif

I think this whole process makes people pessimistic, so you're not alone in that Pkwel. If doesn't take long to realise that USCIS can let you down at any moment, and I think accepting that scenario is the only way to stay sane and get through each day. It is too much heartache and emotion to remain optimistic in this process.

Looking at your timeline, I think you're slightly too far ahead of the current cases being processed. It may be coincidence, but on some signatures it does look like an extra touch happens after an RFE trick. I'm not a fan of the RFE trick because you can never be sure exactly which touches are caused by it and they are "false touches" because they are caused by us and not by people adjucating the files.

That it is sad.gif In hindsight, I wish we had decided for Josh to come to the UK... he could have been here within 2 months tops. But the best future we can have as a couple would be in the US, so we're sticking it out.

Instead of the quick time it takes to immigrate to other countries, everyone going through this process is suffering by being away from their spouse for ridiculous amounts of time. One day this journey will be over and we can all look back and feel proud of what we overcame to be with the person we love. It is something we have to endure but the rewards are worth it smile.gif

As you have already paid the bill for the I130 at the NVC I doubt USCIS are in a position to recall it. Paying the bill has proven that you wish to persue it. However, I don't think just that would stop the I129F petition from continuing. You may want to call the USCIS and ask how you can stop the I129F from continuing on.

In past times, people have had both petitions in the race and have used the quicker K3 to secure an interview at their embassy and, if they were lucky enough to have their I130 on site by the interview, asked to be interviewed for the CR1/IR1 visa instead.

They pair the petitions together and, because you filed the I129F, USCIS assumes that it's the I129F you wish to persue (someone who wanted an immigrant visa straight away would never file an I129F)... Therefore they hold the I130 for adjustment of status in the US. Getting an I130 sent on to the NVC when there is a valid I129F is a very rare thing these days. There have been people who have clearly written on their I130 that they wanted consular processing and have still been ignored and kept for adjustment of status sad.gif

I am really confused why your lawyer (who knew you wanted everything to be handled in the UK) would even suggest, let alone implement, an I129F petition for your husband wacko.gif

As I mentioned in an earlier post, to get the ball rolling again submit the form they mention on the NOA2 (I-824). It will probably take about 6 months for USCIS to action it (as always) but it will result in your I130 being sent to NVC.

If the I-130 was not sent on to the NVC then you are not following the immigrant visa route , you are only following the K3 sad.gif To get the ball rolling on the I-130 again, you or your lawyer would have to submit an I-824. it does take many months for USCIS to action one of these forms though sad.gif

This is the standard wording for when both the I130 and I129F are approved. It means they are keeping your I130 at the service centre until your wife is ready to adjust status from within the US.

Only your I129F will continue it's journey to the NVC.

Not wrong, Andreydy. The procedure was first deviated from when the CSC had printing issues (in April) which stopped them from sending out NOA1s for many many months. A few of us (including myself) got copies of our cashed cheques and submitted the I129F with a copy of the cheque as proof (USCIS write the petition number on the back). The procedure again changed when people became confused about which fee to include with their forms so, again, decided to send them together to alleviate any queries.

I'm not sure whether USCIS has ever officially stated that this is acceptable (anyone able to provide a link?), however, many people on this forum have submitted them together and received both NOA1s without any issue smile.gif

James' shortcuts are meant to be able to reduce the time at NVC by a few months (because you can pro-actively create some of the forms they will send you and send them back before you even receive the forms from the NVC).

As Credzba said, the main question you need to answer is: "When you entered the US using the VWP, did you intend to marry and stay?". And if you did not intend to stay permanently on the entry, can you PROVE that you intended to leave (return ticket, job back in Germany etc etc)? The answer to that will determine whether you can stay in the US and adjust status or have to return to Germany.

Yes, you can apply for the I130 alone. If you have a look at the timelines, it will give you a rough guide to how long the process will take for Germany. I am from the UK and mine will take over 10 months for an I129F, an I130 would take close to a year.

Yes, you can visit your husband using the VWP during the process. HOWEVER (and it is a big however) you must be prepared to show strong ties to Germany should you be asked by the officer at the point of entry. They can, and will, turn you straight around back around and refuse entry if they believe on any visit that you intend to stay permanently. The burden of proof is on you to prove that you will leave at the end of your visit. Being in a VWP country is a positive thing in this journey because, if you were to apply at an embassy for a proper tourist visa, you would likely be denied outright because having a spouse in the US is generally seen to outweigh any evidence that can be shown.

Yes, some of the petitioners on here have spent part of the process outside the US. Some of them seemed to have lawyers handling all the paperwork for them though.

Considering you don't want to be separated for any long period of time... How long does it take to get a residency permit (not sure of the exact term) for Germany? What you could do is apply for your husbands residency, have him live in Germany with you for long enough to meet the Direct Consular Filing criteria (most countries are 6 months, but you would have to check this for Germany), then you can both file directly with the US embassy in Germany and live in Germany together while the paperwork is going through. There are certain criteria that your husband needs to meet to file for you in this way (like maintaining a domicile in the US) but I am not very clued up on the DCF process, so I would suggest you check out that forum to see how it would work for you.

we're submitting our money order copy, both front and back and the online case number form

i still can't believe they're charging $455 for K1 petition


Bare in mind, that the people applying for the K3 visa have to pay for the I130 ($355). Which is still cheaper than K1, but it is certainly NOT free (K1 requires no other petition to be filed). The I130 and I129F (K3) used to have two separate costs, they merged them into one cost and applied it to the I130 only. It works out to roughly the same price as pre-"price change".
