The guides are very helpful in what to expect for both the I130 & I129F routes. If you are indeed going for the I130 you may want to search for the shortcuts (James's Shortcuts, if I remember correctly) that can knock quite a bit of time off the I130 wait at NVC smile.gif

I know that statement sounds strange (as we all know we are not in the States at this time) but it is actually the wording on the official NOA2 for when they are holding the I130 for AOS. So you really should ask your wife to check the NOA2s wording smile.gif

Sorry if this has been asked before Torito, but what did your NOA2 for the I130 say? It looks as if both of your petitions were approved on the same day (which generally means that your I130 will be held for AOS and only the I129F will continue on). Did the NOA2 mention that your spouse was in the US? If it did, then you are going the K3 route and would have to send off a form to kick-start your I130 again.
KevFabi had only their I130 approved at this time which is how they are continuing with the CR1 smile.gif

After approval we may be waiting up to 6 weeks in the mail room to be sent to the NVC (I'm really really hoping it's shorter than that). If you are going with the I129F then the petition will come and go through NVC within 1-2 weeks of their receiving it, with no interaction needed from you.

It will then be shipped to the embassy. It is this stage that you require your affidavit of support (for a K3 it is generally the I-134 but it can vary by embassy, so you should check with them and be sure).

At this point, I have my vaccination records ready, my criminal record (lack of!) applied for and should get it back within the next 20 days (ish). My mother in law is in the process of sending off for the tax transcripts she'll need for the affidavit of support, as is Josh. I already have a folder of bits and peices that I am putting together as my evidence so I'm trying to be as organised as possible for when the interview time comes.

But even with all that, it is a waiting game until it hits the embassy and they start work on the petition whistling.gif

We're going to wait at least 30 days before we start chasing the NVC, anything sooner than that and we'll just end up stressing ourselves out each time we hear it hasn't been received.

No appointment yet, because I've been holding off for a few days to send the checklist in. I am going to mail it today and then enquire around the middle of next week to see if I have an interview date smile.gif

Once the NVC receives your petition it is a nice smooth, organised ride to the finish smile.gif It's just getting out of USCISs mailroom that's the hard part smile.gif

This is so true YGandMAT. How quickly you get through that stage really is all about luck. It depends on whether you're unlucky enough to be first in the new box or lucky enough to be the last in the old box.

K1 and K3 are processed at roughly the same speed. The only problems in the past were that the person filing the K3 had to wait for the I130 number before sending off their I129F (could result in a few weeks extra delay before filing, the K1 had no such delay). Now that you are able to send off both forms together, that extra wait has disappeared.

USCIS quotes 6 months processing-time on both and they really seem to be sticking to that timeframe right now (no longer are we seeing 3-6 month approvals that have happened in the past).

There has been a complete slow down of K3 processing lately but we are hoping that slump is over (the approvals are re-starting!! kicking.gif )

Being married for a short amount of time shouldn't make a difference to the K3 application. Many couples on here decide to get married just before filing (we were married at the end of Feb and filed in mid-April but had known each other since 2005).

One thing that you may want to look into is only applying for the CR1. The CR1 is not only cheaper, but results in a green card (no adjustment of status needed) and enables your partner to work as soon as they enter the US (no need to wait 3 months+ for an employment authorisation document).

The K3 visa may only save you 2 months on the processing time, if that extra time together is important to you then go ahead and file the K3 smile.gif It is worth it to us and it will enable me to get used to living in that environment at my leisure, rather than in the throws of finding a job etc smile.gif

I know from reading medical experiences of others that height and weight are taken. Is weight purely for personal statistics or does it play a part in the medical itself? The reason that I am asking is because I am a very overweight woman and, while I have no diseases and no mental illnesses other than a depression episode a year ago (no self harm involved but that added to my weight), I do worry that weight might be taken as a factor.

If I am otherwise healthy, should I be worried?

Just as a side note, I have been trying to diet since returning to my normal self but I lack the motivation that I had prior to being ill so dieting is not progressing well.

Thanks for the responses :) I will try the doctors surgery again to see if I can get a more helpful person. I still don't understand why they wouldn't re-do the tetanus, as when you get cut within the 10 years they sometimes like to give you a new one anyway. I'll also try to get the MMR done alongside that too. I'm just not holding my breath after the annoyance of the last appointment.

The problem is, in the doctors surgery I attend, it's always the nurses that give injections so I don't have much (if any) chance of actually seeing a doctor for it.

I am currently in the K3 process and it has not yet been approved. But, being rather organised, I decided to go about getting things I knew I could before hand. One of which is my medical record. Here's where the fun begins...

I booked an appointment at my local doctors surgery to have a tetanus injection because I wasn't sure of the last time I had had one (and couldn't remember having one in at least the last 10 years). It turned out that my last tetanus jab was given in 2001 at a local emergency room, due to cutting my leg on glass (can't figure out how that one slipped my mind). The Surgery have a record of the jab but no brand etc and, as the nurse who saw me at my appointment didn't administer a new vaccine (she wouldn't as it was within 10 years of the last one), she said she couldn't sign to say I was up-to-date with my Tetanus vaccinations. Even though it is clearly on my medical record that I did, indeed, have one 6 years ago. She did say that I could contact the local child health clinic to obtain my school and pre-school record of jabs.

So today I phoned the Child Health Clinic and asked about obtaining a record of the jabs I'd had at school/pre-school... they have no record of my having the rubella injection in middle school (or of me even having attended a middle school) and no record of my having the BCG (I think this is not even necessary for the visa) in my secodary school.

So, all-in-all, I have failed in both attempts to get ANYTHING that can prove I have had the required injections.... Anyone know what I could try next? I'm not looking forward to the fees associated with having them done during the medical :( Especially as I have already had all of them.

There is no set number of questions you have to be asked in your interview. The officer should ask as many as it takes to be sure that everything is valid. Some interviewers are probably more thorough than others. Unfortunately, though, the mood your interviewer was in could also affect it. Although I'd hope (s)he wasn't taking out her bad day on you.

Forgot to say, the details for the medical (i.e who the doctor is, where they are located) are contained in packet 3 but you have to organise the medical yourself. The embassy do not schedule that for you.

The London interviews are scheduled after the embassy has received back the checklist to say you have everything ready. This does vary by embassy though (some embassy's do not use packet 4 "interview packet").

I sent off my DS forms yesterday (as they state they need them back immediately) and will be sending my checklist at the end of the week (Josh hasn't got his tax transcripts yet but it shouldn't cause me too much of an issue considering London have a 2-3 month wait for interview). It will be a nice Christmas present if I have my interview date by then, but I think we are cutting it close to get a letter back in the next 2.5 weeks wacko.gif

Yes, that's correct. Once you speak to a human at the NVC they will give you a new case number starting with 3 letters that represent the consulate/embassy you will be interviewing at. You can then use this new case number to contact the embassy to see whether they have received it or not.

I have not heard about this for K3, the printing and cutting out of barcodes sounds like something from James shortcuts for the I130, at the NVC stage. However, after receiving my packet 3, there is nothing in there that I couldn't have done online first (filling in and printing DS-230 part 1 and DS-156) the only other things the packet contained were the checklist to send back to the embassy to say I have everything ready and the information for where to go for the medical.

Yes, they are compulsory. Yes, you can have the police certificate done early (it is generally valid for at least 6 months, but this varies by country). For the medical, you can theoretically book the medical as soon as you are given the new case number from the NVC, as long as you know who the official medical practitioner is who would have to carry out the exam. You may want to check with your regional forum to ask a more specific audience.

Did they only have an email address for you?

That does seem strange. I was under the impression that, as soon as the petition reaches the embassy, the foreign spouse becomes the petitioner (sorry if that is the incorrect terminology) instead of the beneficiary (at least that is how it works for London). I will become the beneficiary again when we apply for adjustment of status.

Bare in mind that the USCIS site always calls the I129F a fiance(e) petition, even if you used it to apply for a spouse. Did you fill in these forms for your spouse or did you fill in the form for your fiance? Did you also file an I130?

To use a quote I had seen on this site before "a marriage, is a marriage, is a marriage"... if the country you were married in classes the marriage as legal then the US will also class it as such. However, once you were married it was up to you to proactively tell the relevant entity's that you became married (social security office etc). The country the marriage took place in would not do this for you.

I definitely learned patience after the K3 nightmare we both had back in '07, YG and MAT ;) It's kinda sad that I don't see any other names that went along that journey with us :( For removal of conditions I am not stressing it. It doesn't have the hardship and emotional stress of being away from my husband so compared to the K3, this feels like a breeze :)

· Bank statements covering the last 12 months, or a statement from an officer of the bank or other financial institution in which the sponsor has deposits, including deposit/withdrawal history for the last 12 months, and current balance;



· Evidence of ownership and value of stocks, bonds, and certificates of deposit, and dates acquired;



· Evidence of ownership and value of other personal property and dates acquired; and



· Evidence of ownership and value of any real estate and dates acquired.



(cool.gif Amount of assets required. In order to qualify using assets, the total net value of all assets must generally equal at least five times the difference between the sponsor’s total household income and the minimum income requirement for the current year.





Example for a household size of 4 :
125 percent of 2006 Poverty Guidelines $25,000
Sponsor's income $19,500
Difference $5,500
Multiply by 5 x 5
Minimum Required Net Value of Assets $27,500



There are two exceptions, however:



· If the adjustment of status applicant intends to immigrate as a spouse of a U.S. citizen or as the child of a U.S. citizen who will not become a citizen under section 320 of the Child Citizenship Act of 2000 because the child has already reached his or her 18th birthday, the “significant assets” requirement will be satisfied if the assets equal three times, rather than five times, the difference between the applicable income threshold and the actual household income.

Unfortunately I can't help with how the congressman would react to your request (whether good or bad). But the way I see it, is that you can only try. If the congressman turns around and says (s)he won't help, then you have lost nothing because you are in the same predicament that you are in now. If they turn around and say they will help, then you have gained.

As you don't have a timeline, I'm unsure how long you have been waiting for your approval. One point to bare in mind, is that I don't think congressman can do much if the case is within the USCIS processing times.

As you can see from my signature we sent off the I130 form to the CSC back in April (just when the printing issues started to occur). Up to this date we have never received an NOA1 letter for it, although we do have the receipt number.

Each time my husband has phoned up the USCIS line to request a copy of the NOA1 to be sent to us, he is basically fobbed off with the excuse that the form is irrelevant and we don't need it (why do they send them out in the first place then?!). It is incredibly annoying for me (because I'm usually on skype listening to my hubby's side of the conversation while he talks to the USCIS representative) to hear him come away with nothing each time he puts the phone down. He is not as forceful as I am and I can't help but think that if it was me phoning them that I might be able to persuade them to send a copy (other people in the forum have sucessfully requested copies when originals have gone astray in the mail!). So far we have nothing, other than a number, to prove that we are even applying for the I130 and it's so frustrating.


To give a bit of reasoning to our receipt requirement. Not only is it obvious proof that we are applying for a visa, but I am a collector/horder and I like to keep "keepsakes" which relate to big and small things in my life, of which the final visa counts as one of the biggest (because it will finally allow me to be with my husband permanently). I would really like to have the receipt not just as proof of the process but as part of the "big picture" to look back on and see what we have gone through as a couple. I really don't think we are being unrealistic in wanting a copy of a form which should be sent anyway.

So what are we doing wrong? Why do the people on the misinformation line continually rebute our efforts to get a copy of the receipt? Is it THAT difficult to send a form that they have failed to send? Is it not, afterall, part of their process to send an initial receipt to prove they have the application?

I have 2 questions:

1) Is anyone here still waiting for their NOA1 (specifically from the California SC - printer problems and whatnot)? According to the USCIS site, our NOA1 should have been mailed on the 04/27. We chased it a month later and were told to wait a further month. Today is the day we chase again. I'd just like to know we're not alone in this.

2) Is it unusual for an I130 with an NOA1 date of 04/27 not to have been touched by now?
I'm getting slightly worried that we have already have our I129F NOA1 and that has already been transferred from Chicago to California and is currently pending. It's going from one extreme to the other, no movement on one and lots of movement on the other.

My situation is not the same as yours, as I am the beneficiary, but I do understand what you are going through. I have been in limbo since mid-April when we filed our paperwork, knowing that at some point I will be leaving everything here behind me.

I want to be with my spouse, so am living in a place I don't want to be, am working 40+ hours a week at a job I don't want to do... I have to re-motivate myself each and every day to continue things as normal. If there was a definitive end-date to this process, I would find this easier to deal with but instead we have to keep pushing ourselves to maintain some normalcy for however long it takes sad.gif

All I can say is hang in there and when things seem tough, try to remember the reason you are doing this. You want to be together with your spouse and they are worth every moment of this process smile.gif

Honestly, I have no idea but someone surmised that they send a truckload at a time (and considering how many petitions USCIS say they process, filling that truck shouldn't take long at all). I'm just hoping that we aren't going to be waiting as long as the April filers did.

I need to claw back some time on my journey so I'd love to kick-start the next step, while trying to remain optimistic for my February estimate whistling.gif

I was trying to remember back to when I first came on this board and I don't remember seeing filing both petitions together being mentioned very often. It seemed to be mentioned more around the time the fees changed, so that people weren't confused with which amount to send with their petitions. So the July/August filers might be a better group to ask smile.gif

Receiving no touches is not a bad sign, some petitions don't get touched until close to their approval dates, some don't even get touched at all. There is no need to worry. They're still working on early May petitions, so you are probably still 3 or so weeks away from approval, going by the current approval rate. Keep your hopes up smile.gif
