Had a nice surprise when I logged into the USCIS site today...

After no movement on the I130 since it was first received in mid-April and no movement on I129F since the end of May... both of our petitions have now been touched (08/20/07). We have not contacted USCIS for a while, so this touch is not caused by any queries we have raised smile.gif

While I'm am thinking it is a "pairing up" of the files and not getting my hopes up about an approval being anytime soon, I am happy that it means they haven't completely forgotten our petitions kicking.gif

I just want to let you all know that I finally got a touch on my I-130 today. I sent my I -130 in mid April. CSC has that they received it on the 24th of April. It is 125 days since I sent it so.....I will keep yall posted.


That's very similar to my I130... lets hope it means they're looking at approving some April ones :)

Very slow... even the March filers thread is not seeing much movement. Looks like they're still processing claims from mid Feb to 1st week of March, so it'll be at least a month before we start to see some nice approvals in this thread :(

Well, my hubby phoned the call centre to chase up our missing I130 NOA1 (NOA1 should have been sent on the 27th April, according to the last update on the USCIS site).

Apparently the person on the phone was very unhelpful and said that they could send it out at any point within the 6 months and were not under any obligation to provide it by a specific point within the 6 months (i.e the 30 days you are meant to contact them after, if not received).

Also they said that the NOA1 was 'unimportant' as it is only a sign that they had received the inital petition. When pressed about the importance of the I797 (I think it is) it was pretty much the same response. Is the I797 the same as the NOA1 or are they two completely different things? I'm not quite clear on that.

I'm just glad that we didn't hold out until we received the NOA1 to send in the I129F, who knows how long we would be waiting if we had :(

They are silent about the K-3 filers if then can use the online printout for the I-129F. I would assume based on the language in the notice and given the situation at hand that they will accept the I-129F without the original NOA1.


My husband submitted my I129F with only a copy of the money order and a 'blue form' which the Diocese told him to complete. I'm unsure what exactly was on the blue form but the receipt number on the money order should be enough to prove it has been submitted.

Btw, the problem with the links is that this message board shrinks them (replacing important letters with ...) If you change the URL name to something smaller, it won't affect quoted text :)

I130 NOA1 - still not received :crying: Is this unusual? We chased is after 1 month and were told to wait until the end of 2 months before chasing it again :(

Both forms are now being processed in Chicago, hope that's a good thing rather than a bad thing (but after being told they are not the fastest at even sending out receipts, I do worry).

From our experience, a lawyer is not necessary. For this process, I believe if you want something done right you'll do it yourself. I'd rather go through everything with a fine-toothed-comb and treat my case as unique, than let a lawyer deal with my paperwork in amongst all his current workload.

Our petition was submitted with only a marriage certificate as proof of our marriage/relationship. We were advised on what to include by a local diocese and it may be that they were not aware that we should include more. We were approved on the 25th October with no RFE.

Maybe they will become more strict on this point when they are less backlogged.

Was your wife given any sheets of paper after the interview? If she wasn't, then that is a good sign. Some embassy's do not tell the applicant whether they are approved or not on the day. 4-5 weeks is a long time but it may be normal for your embassy. You might want to check the regional forum for the embassy and ask if this is a normal response to the interview.

Amoro, your wife needs to send the affidavit of support to you for the interview, along with it's supporting evidence (tax transcripts, pay stubs etc). As far as I know, the embassy will not need to see it prior to your interview, unless your embassy follows a different procedure to the UK. You can apply for your police certificate at any time (they are generally valid for either 6 or 12 months) and you would apply for them as you would if an employer wanted a copy. Could you also create a timeline for your profile so that it can help others smile.gif

Deb, it is a good feeling when you speak to someone at USCIS that actually seems to have human emotions. I hope that she is able to find out exactly what is holding up your petition and speed it along on the correct path.

Urge... it is horrible that the embassy suddenly changed from a 3 week to a 3 month interview wait, especially as they took so long to give you the date for it sad.gif But it is good that you are no longer waiting in limbo and the days will pass by. Wintime's suggestion of going to see your wife early and making an extended holiday of the interview is a good one. I have no intentions of leaving this thread until we are all approved tongue.gif So you're stuck with me tongue.gif Gogo has a meeting at the local office coming up later in the month and will hopefully get some news at that point.

Amoro,

The $1010 is the fee for Adjustment of Status & Employment Authorisation which you will have to apply for when you arrive in the US (after the K3 in granted). It is the process that will get you your green card.

The NVC only has an active role in the I130 process (where it can stay there for 4-6 months), the I129F is only there for a few days.

If your I129F NOA2 states that it is being forwarded to the NVC, then the NVC needs nothing from you. All you need to do is compile all the necessary paperwork for the embassy (birth certificate, police record, marriage certificate, proof of relationship etc) and pay a $131 fee at the interview.

With Urge MIA at the moment (here's hoping he's ok and will let us know soon), I have gone through the posts since his last chart and created an update to let us all know where we are.

If I'm missing anyone is it probably because they have either posted their updates in other threads or filed in July or onwards.

NOTE: You may need to enlarge the chart twice because it wasn't playing nice when I tried to upload it (clicking "full size" only makes the chart about 85% of total size and, therefore, appears blurry until it is enlarged again - anyone know how to fix that?? wacko.gif )

However, the lady did say something about taking a couple of days to be 100% approved (after they do a few last things) but I had all the paperwork that they required, paid for the visa and also paid for the delivery of my passport back to me. No RFE, nothing missing and it was so much easier than I imagined.

People really are right when they say it is an anti-climax for the UK interview. All being well, I will have my passport back with the visa in it within 5 working days biggrin.gif

Where abouts are you? I'll be heading to Iowa, which is currently 29F (or -1.5C to me). It was down to -13C at one point in the last week or so and I have no idea how I'll cope with that helpsmilie.gif England is fairly mild and doesn't have huge changes in temperature so both the hot weather and cold weather will be a lot more extreme than I am used to.

I've pretty much managed to avoid both extremes until now (visiting only in February/March and September/October) but last September I felt like I was melting when we were out and about for my brother-in-laws wedding. I think this coming summer/winter will be quite a trial for me. Josh'll need to be there with the ice cold drinks or cocoa wink.gif

Also I got through the fax a weired form numbered DS-2001 titled
"Notification of Applicant Readiness"

Please help helpsmilie.gif if you got any of the above wording or different please post, and if you got the last form.


I would have a guess that you might have received the CR1/IR1 interview packet, but this could just be wording specific to your embassy. Hopefully someone else can shed a bit of light on it.
