Removing Conditions on Residency General DiscussionTax returns
Hi,

Has anyone not included tax returns and gotten approved and/or not received an RFE? We filed separately for 2010 for a reason, so we didn't include that in our application. We have other convincing evidence of a bonafide marriage, so we didn't feel it necessary to include the return:

Copy of water bill with both names
Copy of joint credit card accounts
Copy of joint checking account
Copy of joint stock account
Copy of automobile insurance coverage with both names
Copy of vaccination certificate for pet dog with both names
Copy of Life insurance policy naming me as beneficiary
Copy of Guardian Life insurance with both names as insureds
Copy of Group Term Life and Accidental Death coverage naming hubby as beneficiary
Copy of Automobile title with both names
Copy of Notice of Transfer of Rights of house with both names on it
Copy of Home owner’s title insurance addressed to both names
Copy of Property tax information addressed to both names
Picture of the two of us with family and friends (2010-2011)
Copies of holiday cards addressed to both
Notarized affidavits from family and friends

I guess in the end if we get an RFE for it, we'll have to send it with an explanation of why we filed separately, but really if you read the instructions, it does say "including" meaning, "not required".

Just wanted to see other people's experience.

I did get a notice of approval, but it didn't say that it was I-797C.

On another note, yesterday, I got an e-mail notification/text:

On June 19, 2012, we mailed the new card directly to the address we have on file. You should receive your new card within 30 days. If you do not, or if you move before you get it, call customer service at 1-800-375-5283.

I just wanted to say that we were approved without submitting tax returns because we had plenty of other evidence to show that we had joint assets. I was worried that we would get an RFE, but luckily, we didn't. :thumbs:

Hello all, I am in the process of sending in my I-751 form and documents. My conditional GC expires on Jan 13, 2012. I have a lot of documents that I am going to send. My question is, do I put everything in one big envelope with the check (filing fee)? or do I separate the check from all the documents? Thanks everyone.


Hi,

Use a paperclip to attach the check to the first page of your application (the cover letter if you have one). Since the application is going to be big, I suggest putting everything in a big envelope.

Hello every one,

First time poster here, I'm in the process of filling out the I-751 form for my wife and I'm collecting all the data for proof of marriage and have some questions. First her conditional 2-year visa expires 3/04/12, I'm going to submit the package first thing tomorrow (Dec 05) since the USPS is closed today (Sunday), my wife gave birth to our first child 2-weeks ago so I kind of lost track of time, will I still be within a safe window submit everything for tomorrow? Second I read somewhere that some people are submitting passport style photos in the package as well, is this necessary or just personal preference? Lastly, my wife still has her maiden name, I failed to change it on the earlier documentation, on the I-751 form under Part 1 for the line Family Name (Last Name), I entered my last name. Then under Part 3 for the line Other Names Used (including maiden name), I entered my wife's maiden last name. Do you think USCIS will see this and understand I want my wife to have my last name and put that on her CG? Or should I reverse everything? Thanks in advance for the help!!

Abe,

1. I believe as long as you submit on or a couple of days after your 90 day window, you will be fine.
2. The I-751 instructions do not require passport style photos, so I think it may just be a personal preference.
3. I will defer the question about the last names to another poster, as I'm not sure.

When does the time clock start for the N-400 Naturalization process as far as number of years in the United States? Does the 3 more years start after they approve our I-751? or is it total 5 years in the US that make you eligible to file the N-400? July 2012 my wife will have been in the US for 3 years now. Thanks.


It begins from the approval date of your 2 year Green card. The earliest date that you can file for N-400 is 90 days before your 3 year anniversary of your permanent residence.

Don't worry about it. We sent ours on May 13, and didn't get our hard copy NOA1 until May 23. However, the receipt date was May 18. So it does take a while. Of course, you may or may not get it quicker than we did, as you filed at CSC. Good luck!

Hi Everyone,

Just wondering if any of you had issues with this:

My fiance will be moving from Stony Brook, New York to Indianapolis in July, which means our service center would change from VSC to CSC. Now given what everyone is going through, we're likely not going to get our NOA2 before then, so our case would probably go to CSC. Does anyone know if this will put us at the end of the pack?

It's easier for us Canadian folks as we don't have to apply for a visitor's visa, but it does provide more of a scare when actually going through Customs as you never know if or when you'll be turned back. (I have been, once. It wasn't fun.)

I just crossed the border last week (through the airport POE). The customs officer just asked where I was going. I said for a 5-day vacation in Oregon. Then he asked when was the last time I entered and I said in May. And he let me through. So just give them what they need. Don't make things that complicated. Hope that helps.

Just have a question, I just looked at an example Packet 3. It doesn't say anywhere on it that we need 3 years of tax returns and W2's. It says they need it for the most recent taxation year. Also, not sure where it says pay stubs. If we are to bring it, can anyone please tell me where it says that? That would certainly save a lot of work for my fiance because though it will be easy to find his most recent tax return, W2, he'll have to go digging for the other two years.

Any help will be appreciated!

Quick question, was your "touch" the NOA2?

My fiance changed his address online on July 28. Before this, our case was never entered onto the system. On July 29, we got entered into the system, and then was touched again on July 30. Just wondering if this could be the NOA2 or the change in address. Thanks.

Yes, I called but not much information given.

It is an international phone call.


I know that you can reach USCIS using Skype, but they don't tell you much unless you are the petitioner, I guess.

Wouldn't be a bad idea to call them - to be certain the system got updated - also not a bad idea to make sure he puts his name on the inside of the mailbox (like on the inside of the lid or similar) so the mail carrier will for sure know he's living there.


I would have to get Roland to call as I am the beneficiary. Are beneficiaries able to call the NSCS, or do they only allow petitioners to do that? It's just that Roland seems to think that we're ok, but I'd like to be positive. Thanks.
