You can send in your I129 but if you marked on the form that you are divorced, they'll definately will want to see that divorce decree at some point. You'll get an RFE asking for it. I would not recomend sending it in until you get it. You'll risk not getting it on time and risk the case being cancelled and losing that $455. As for your housing situation, I don't think that it matters as long as they have an address to send you communication such as an RFE or NOA. If your address changes while the petition is ongoing, you can call them to have it updated.


Please don't give WRONG information that could jeopardize someones chances of receiving a visa...you may feel good about trying to make someone FEEL better but in the END you could cause BIG PROBLEMS FOR THE OP crying.gif if they listen to your incorrect information headbonk.gif

I just got word today from my Ecuadorian fiance that his visa was issued. I looked at this site many times for advice, inspiration, and sometimes to contemplate the worst. So I thought I should post a description of our visa journey to help others.

I mailed in our initial visa application in June of 2008, and received a notice of receipt at the end of July 2008. We got the approval from the USCIS at the end of November, and a month later we got the K-1 visa informaton packet from the US embassy in Guayaquil . It took us awhile to compile all the needed information for the interview, because our immigration lawyer never told us that we would have to re-submit all the same material again- photos, copies of emails, etc. Please note this- this info. is not passed on by the USCIS to the local embassy. Once we were ready, and called the Visa Center in Ecuador, the interview was scheduled for a week later, on February 4th, 2009. My fiance had copies of 4 years of email communication, a copy of my passport which showed 6 visits to him over the 4 years, copies of my flight itineraries, a couple of snail mail letters, and only 3 photos. One thing he did not bring was his police record. We thought that since he was never arrested, he had no record to bring. We didn't realize that he needed a form from his city police stating this fact. Maybe a little dense on our part, but again, the lawyer never clarified this.

The interview was short- he said they asked very few questions. At the closure, they gave him a letter stating that he needed to send them his police record, a notarized copy of his passport, my actual passport, and more photos, through DHL. We had no more pictures of us together, but I created a photo essay of my travels there, and kind of laid out a pictoral love story with photos of me with his family and in his community. I was surprised that they would want my actual passport, and called the Visa center to clarify, and indeed they did. Again, there was a delay as we compiled this info, and he mailed it through DHL on March 10th, 2009. At that time, they had him pay the return fee, and said he would get a response back in 8-15 days. Two weeks later, he had word that a response was waiting for him. He traveled 4 hours to the DHL office today- and the visa was waiting for him. So in total, the complete process from beginning to end was about 9 months, though part of that delay was our own doing.

In retrospect, I don't feel that the lawyer was necessary for this process- I feel like it was $700 of wasted money. As long as you diligently fill out the forms and follow the instructions, it is mostly self-explanatory- especially if you utilize the experience and advice on sites like this, and don't make little oversights like we did.

NVC does not update K1's via the phone system you must punch 1 and then 5 to speak to a live person for any information about their receipt and forwarding of you petition to the designated consulate.

You should probably ask this in the region specific to you filing. In the Philippines it can take anywhere from 3days to months after interview to get the actual visa a allowed to leave country.

Can you get travel money cards in the US? The UK versions you load the money you need (or transfer onto while overseas) onto the card and then the card doesn't charge fees or refunds them and it doesn't charge conversion fees either. You might look into that. That is the most fee-free way I can think of using a card abroad.

Good advice. That is part of what is frustrating - waiting and I had heard some Consulate officials asked when the wedding date is - well, how can I schedule anything without knowing for sure he's coming and when? So I advised my fiance' not even to send stuff ahead until the Visa is in hand because I'd hate him to have to do without stuff like his bikes that he uses almost everyday and then have delays put in the way. :thumbs:

NBI is valid for 1 year, but do I need to get a new one, just in case it will be more than 6 months during the interview same as the BC?

Look here for the most accurate info...it's the Manila US Embassy website this page shows all you need for interview stage of visa process. Below I pulled from this page the info on Evidence of Support

n. EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.

What you hear from people is either...their experience, something someone told them, something they read or THOUGHT they read. Many people say Manila will not use a co-sponsor when it comes to a K1 and many people say they will. Your best bet is to read the info on their website and email or call them personally and ASK them and see what they tell YOU.

And as for what the immigration office told you about the 1-134, I would disregard it because it's wrong...Adjustment of Status uses the 1-864, similiar to the I-134 but has more ramifications when it come to binding in court. yes.gif

Just bring employment letter stating how long they been there, annual salary if thats the case and bring all paystubs for whole time there. You should be fine as long as you meet the guidelines.
