Does this mean that the application has now gone to NVC? I got the same exact NOA2 last week and it doesn't say NVC on there so I'm not sure where my application is now. The consulate it stated doesnt know anything.

K-1 Fiance(e) Visa Process & ProceduresBarcode on DS156
Hey Lai from what I've read I don't think you can write anything because the document has to be electronically filled. I had no exact date so I just estimated a random date for the next month.

Thanks everyone else for the reply! Very helpful. Shakgill if you get to your interview before me can you let me know how much you end up paying for the fee in rupees so I can let my fiancé know to take some amount with him? It would be nice if I could just pay online now so he doesn't have to go through the hassle later.

Thanks for the input. I'm going to fill out the form myself then.

As for generating two copies for the DS156 forms, do i have to do it both times through the website and get 2 separate barcodes for each copy? Or I just do it once and use a copier to make an additional copy?

K-1 Fiance(e) Visa Process & ProceduresBarcode on DS156
Hi,

I've been perusing through some of the topics here about the barcode but i had one specific question about the barcode on the DS156 form. My lawyer is preparing my K1 visa form and their staff said since they don't submit it through the website there is no barcode, and that I will have to send the forms to my fiance in his country and he will submit it to the embassy in Pakistan and pay them the fee. Does he pay with the forms now that he submits with his Packet 3.5 or does he wait until he goes to the interview to pay the fee for the form?

Thanks!

The packet was sent and delivered the next day. We sent it by courier to the Islamabad embassy. They received it on December 7th. How long until we hear about an interview date? And do you guys know how they contact us back for the interview? Via email, phone or regular mail??

Thanks for any and all help guys!!

Surprising enough my fiance got an email the next day! We submitted Dec 6 or 7, and got a response the next day in an email listing his interview for next month.

For someone who may have had TB, the "scars" can stay on your X-ray, in fact even pneumonia can leave that. As long as you took the treatment, and can provide proof you took treatment from your doctor and have no symptoms currently that should not be a problem at all.

K-1 Fiance(e) Visa Process & ProceduresIslamabad Long March

To all the fellow Pakistani VJ'ers out there who have visa interviews this week at the Islamabad Embassy, what is your reaction to this long march. Specially since interviews scheduled for today and tomorrow have been cancelled. My Fiancee's interview is scheduled for this Friday and I really really wish that this march gets over before then. Please pray for us and the other VJ'ers in the same boat. Thanks You All and Good Luck on this arduous and trying journey to be with your loved one...

Have any of those people who were to have interviews this week gotten any emails about rescheduling of interviews? My fiance has his on Eid but now Eid is on 25 instead of 24th it seems and the embassy may be closed. I'm wondering how people get notified when interviews get cancelled.

K-1 Fiance(e) Visa Process & ProceduresGathering documentation for NVC

Ah that is a bit clearer thank you, didnt spot that one.

Still, for example the affidavit of support, which seems to be the main form i will need. My fiance and her family (her co-sponser) want to fill in the form and get the details/backup now. But considering we only got NOA1 in December, would this information be considered to old when we submit it (hopefully in June/July)? I guess thats what im trying to say..

Assuming this may also be the case for some of the other documents like proof of vaccinations or the like..

I started gathering all my info for my fiance, as far as affidavit of support, after he got the NOA2. You have ways to go from NOA2 til medical and interview date. At that time I also sent him photos, my phone bill copies, my pay slips, IRS tax reports for past few years etc for him to have. As for vaccinations he didnt need any but sounds like for K1 you dont need vaccinations. They will decide all this anyway when you go for the medical exam after they send you information about your interview date.

K-1 Fiance(e) Visa Process & ProceduresDifferent name/birthdate used to work in another country

My fiancee lives in Cambodia but last year worked in Thailand. When she went to Thailand to work the people who helped her used a different last name and birthdate for her (god only knows why) and I just found out after filing the I-129F in July. Will this cause an issue and if so what can I do now. She will have to get a police record from Thailand because she was there for a year and that will have this other name used and the wrong birthdate. What should we do?

One more question:

We have boarding passes (the e-mail PDF printout of them) for our trip to Paris together, but they are with the airline Vueling and are all in Spanish. They are clearly boarding passes, but I don't want to risk getting an RFE for something so silly- has anyone run across this problem as well? Do I need to have them translated?

K-1 Fiance(e) Visa Process & ProceduresFiling I-129F while living abroad

Hi! Welcome to the forum! My husband and I just filed the I-130 and stated our address in Spain as our address, and then his parents' address as our intended address. We didn't include a cover letter. If you want to receive your stuff there then you should probably put your parents address as your address and then explain in cover letter that you live with you fiancé in Spain but will be moving back in June. I personally would not care about receiving the hard copy of anything and just list my Spanish address as my address, with the hopes of that maybe expediting the approval. It's cool to see other people filing from Spain. Hope we both get approved fast! :)

Thanks everyone for your input!

Yes, LucidSofia, it's nice to see other people from Spain on here, as well! I don't think there are that many of us. :) Suerte!

K-1 Fiance(e) Visa Process & ProceduresFiling I-129F while living abroad

I'm gonna tell you what we did.. my fiance has dual citizenship, american and irish. For the last 11 years he has been living in Europe. When we filled our I-129f he was still in Europe, but he returned to the US a month after we filled our petition. On the i-129f form, part A he wrote the address where he will be living in the US at his moms address, he didnt write the foreign address. it worked perfectly, cause we got the NOA1 hardcopy at the US address. He also explained on a different sheet (on the same sheet that he explained how we met)that he has been living abroad and he'll be returning in the States shortly after we filled.
There is a big possibility that you wont get the hardcopy abroad if you write that address.
Maybe other people more experienced can help you, i just wanted to share our story since it's so similar.

Thanks for your reply! Yes, our situation is very similar to yours.

I'm guessing your fiance also wrote that his current address was the U.S. address on the G-235A, as well?

K-1 Fiance(e) Visa Process & ProceduresFiling I-129F while living abroad
Hello everyone!

I'm a U.S. citizen currently living in Spain working as a English Language and Culture Assistant on a student visa. My fiance and I are just about finished gathering all of the documents needed to mail the I-129F package from here in Spain.

I'm leaving Spain on June 6 before my student visa expires. Since my fiance and I currently live together, we've listed both of our addresses as our current address here in Spain in Part A of I-129F.

When I leave Spain to go back to the States in June, I will be living with my parents until I'm able to find a job and apartment at which point I'll submit a change of address. (I've also listed that my fiance's "intended address" is my parents' address in the U.S.).

My questions: Do I need to explain somewhere in the packet (cover letter, for example) that I'm moving back permanently to the States in June?

Is it OK to list my address here in Spain? I'm aware that I need to have a stable mailing address in the States and I would like all of the documentation to be sent to my parents' address. Do I also need to note this? If so, where/how specifically?

Any help is much appreciated!

K-1 Fiance(e) Visa Process & ProceduresFiling a k1 visa while living abroad

I was in a similar situation- I was living in Spain with my fiancé until recently.

What I did was this:

- On Form I-129F, I wrote in my U.S. address where I wanted things mailed (my parent's address and where I'm living now temporarily). (This is the form where you should write in the mailing addresses both for yourself and for your fiancé(e).

- On G-325A, I listed my present address in SPAIN to clearly demonstrate that I was living in Spain at the time of filing at the same address as my Spanish fiancé.

- I added a "Supplement" sheet to I-129F to explain the differences in addresses. I listed and wrote out both my "mailing address" in the US and then my "physical address" in Spain and also stated when I was moving back to the States.

If I'm not mistaken, I believe on I-129F you MUST list a US address- the NOA1 and NOA2 have to be sent to a US address.

I had absolutely no problems with this- we've now gotten our NOA2 and we're waiting on everything to be sent to the Embassy in Madrid.

Best of luck!

K-1 Fiance(e) Visa Process & ProceduresHow to pay for I-129F while living abroad?

I was also living abroad (Spain) when I had to file the I-129F. The US Embassy in Madrid also had no answer- they just kept repeating the instructions and saying the money had to be drawn on a US bank.

I sent the entire packet to my mom and had her include a check (I then quick-paid her through my Chase bank account) and she re-mailed the entire packet to the Dallas Lockbox. I think that's the easiest way to do it, as well.

OR you can have someone mail you a check or money order to your flat in the UK and then you mail the packet to the Dallas Lockbox from the UK.

***One thing I would check into with mailing the packet (or anything) from abroad is whether or not you can track the package internationally. For example from the Spanish post office, we would only be able to track the packet throughout SPAIN and see when it left the country, but once it was in the US, we would have had no idea where it was and whether or not it reached the Dallas Lockbox.

It might be different if you use DHL or another courier service though- something to check into. In Spain it was much more expensive to send it via another courier service, so that's why we opted for the just the regular mail service.

When we sent it my mom, she of course told us when it reached her, but if it had gotten lost, we wouldn't have known where it was (another solid reason to make several copies of the entire I-129F packet!!!). When she took it to the US post office to mail, she paid for the tracking and we could see where it was and when it reached the Dallas Lockbox.

Good luck! :)

Except the SSA is not the agency that has the authority to make that determination. That authority resides with the USCIS.

The back of Benny's I-94 gave him a 90 day work authorization, which was valid through Dec 15th or so. We were busy moving organizing and wedding planning so we couldn't get the SSN done then.

The "K-1" symbol on your immigration document means you are the fiancé(e) of a U.S. citizen and are authorized to work.

To Apply for a Social Security Number --

Download the form from the following Internet address to apply for a Social Security card: http://www.socialsec...nline/ss-5.html

or visit any Social Security office to apply for a number and provide original documents showing your age, identity, and lawful alien status (including your permission to work in the U.S.).

Age: We prefer to see your birth certificate. However, we can accept other documents at least one year old, such as your passport.

Show evidence of your identity. The lists of acceptable documents as evidence of identity are now based on three factors: (1) the applicant's age, (2) the applicant's citizenship/alien status, and (3) the relative probative value of documents. Documents are listed as primary or secondary documents. See reference RM 00203.200E in our Program Operations Manual System at http://policy.ssa.go...x/0100203200#E4 for these priority lists of documents.

Alien Status: We need to see the document issued to you by the Department of Homeland Security (DHS) when you arrived in the United States, the I-94 showing "K-1," or an employment authorization card issued to you by DHS. The document must be unexpired.

All documents must be either originals or copies certified by the issuing agency. We cannot accept photocopies or notarized copies as evidence because we cannot verify their authenticity. The custodian of the record must certify any copies.

We must verify your documents with DHS before we issue a replacement SSN card. Most of the time, we can quickly verify your documents online with DHS. If DHS can't verify your documents online, it may take longer to issue a card. We are working closely with DHS to minimize delays.

The acceptability of a document must be evaluated on a case-by-case basis, taking into consideration the applicant's situation and exploring what evidence is available for the person.

We suggest that individuals with K-1 status apply for a corrected replacement SSN after marriage to update the SSN record to reflect the married name.

Form SS-5, Application for a Social Security Card, is the appropriate form to request an original SSN.

You can access Form SS-5 on our Web site at the following Internet address:

http://www.socialsec...nline/ss-5.html

To read and print Form SS-5 at a personal computer, you will need a copy of the Adobe Acrobat Reader software. This software is available free of charge from Adobe's Internet server on their Web site at the address below:

http://www.adobe.com...t/readstep.html

Complete the Form SS-5 and take it, along with the required identifying documents, to the nearest Social Security office. Individuals age 12 and over must apply in person at a Social Security office.

You can obtain the address and directions to the nearest Social Security office from the Social Security Office Locator, available on the Internet at the following Web page:

http://www.socialsecurity.gov/locator

You can also request Form SS-5 by calling our toll-free number, 1-800-772-1213.

Our 800-number telephones generally are less busy during the early morning from 7:00 A.M. to 9:00 A.M. and in the late afternoon and evening from 5:00 P.M. to 7:00 P.M. We encourage people to call during these times to avoid busy signals and extended wait times. Our busiest times are during the first week of the month and on Mondays and Tuesdays throughout the month. Some services are available 24 hours a day through the 800 number automated menu.

SO...I think I've come to a serious halt on our visa case. We are already approved for a I-129f visa, but since I did all the paperwork myself and didn't realize until just a few weeks ago that Thailand seems to be the one and only consulate not accepting co-sponsorship for I-134, I really think we've lost this battle. Of course I'll have him try anyway with my father as a co-sponsor, but I'm not hearing anything positive about this issue - PERIOD.

So whats next then? Do I really have to pay another 500 and refile? Or go to Thailand and marry him and come home and do it all over? Or can I just switch consulates since he's really from Cameroon just residing in Thailand so pretty much already has clearance there too? (ha, fat chance, ya i'm fishing!!!)...I really don't know what to do to save myself some time. My son is already 1 and a half months old, and still has yet to see his father. =( Makes me super sad. Can I use him maybe? We can always establish paternity, does that help?....Eeeeerg. I could cry. Any suggestions would be cool...Thx

There are posts today on V J about the percentage of visas connected to V J. No matter what numbers are used they still only represent a small percentage. The embassy in BKK told me they see about 700 cases per month. Keep this in mind when you read these posts. I dont know what percent are K 1 types.
I helped two friends with their K 1 visas. Each of them required a co-sponsor. They were both approved in BKK & are here in the USA now. There have been many cases reported here on V J where a co-sponsor wasnt allowed.
You will not know what the outcome will be on your case until you submit all the docs & he walks up to the window on the given day. It seems you have paid the fees & waited all this time so why not submit the co-sponsor & see what takes place?

Yes, it was a real attorney. I found her on the State Bar of Georgia's website.

I'm wondering, why do people use an attorney for this anyway. What exactly do they do?

Take your money and transcribe all the info you gather to the forms, avoid your calls and tell you it's gonna be a bit longer on occassion.

QUOTE (Brian.Mitchell @ Sep 30 2009, 10:16 AM) <{POST_SNAPBACK}>
My Fiance Kati and have been navigating this "Waiting Game" for the last 3 months. I just registered for the site yesterday and I now feel a new surge of hope that we are not going to be waiting until November to get our NOA2. This has been the most intense 3 months of my life. The waiting has been really good for our relationship because we get to talk so much and learn so much more about each other. (THANK GOD FOR VONAGE) I guess it has just been hard not to be able to go on dates and all of the other stuff normally associated with being together.

One thing that I am starting to wonder is this though... We did the I-129F, got the NOA1, and now are waiting for the NOA2... What can we do right now to help us out when we get to the interview stage? I have read a little about doing the AOS and other forms (I really feel like a Novice right now) that other people do. Can anyone give us some things that we can start to do while we are doing all of this waiting? Also, can anyone link any helpful articles or suggestions for us. And one last question is how do people get the detailed timelines at the bottom of their posts??? Is this just something that people make them selves or is there another section of the site I haven't found? Thank you so much in advance....

Your best bet is to start preparing the paperwork for the interview stage in Finland, i'm not really up on what they require but check their website to see what they need from you.

Well I am sorry to hear about your troubles, but if you wanna be vindictive. Do NOT cancel the petition let it die its own natural death and NOBODY can file for here for a long period of time smile.gif

I like your thinking!!!! devil.gif good.gif

---------------------------------------------------------------

Sorry, but this thinking is an irrational position and not based in fact. You can't "cancel" a petition once it has been approved by the USCIS. You can withdraw your affidavit of support and give the USCIS info on any misleading or deceit on behalf of your beneficiary. That way, she will have questions to answer at her next embassy interview. devil.gif

This being the Phillipines consulate and her still having an open petition with a USC will raise a Big Ole' Red Flag and deservedly so...there has been no affidavit of support filed yet so there is not one to withdraw. Are you making this up?

It is important for the petitioner to notify in writing the USCIS, NVC, USEM of exactly what happened so the man's slate is cleared in case he wants to file another petition. You don't just do nothing and end up screwing yourself.

Where did you read this info and can you give me a link that says this is the procedure, how will you screw yourself? No real reason to notify USCIS at all, there is no slate to clean he will still have to file a waiver if he files again in the next 2 years...so there is NO NEED at all to clear his name now.

It is always better to notify and put into the official record what happened to a "failed" petition. This way you "Close the loop."
This is sound advice. If you let apathy and laziness to set in and just do nothing, it can come back to bite you. As the petitioner, why would you not document and notify the USCIS/NVC/USEM? Most men will petition another foreign woman if the last petition failed. It looks really nice in the next petition to have this failed case documented. Ultimately, it will be revisited at the Embassy interview, and there is a question on the I-134 Affidavit of support if the petitioner has ever made a petition or Affidavit of support previously. BOTTOM LINE: It's always better to document what happened. It makes your life easier in the future. Cheers and good luck.

All subjective conjecture....I will wait for your link to REAL documented information as to your thinking, and i'm thinking I will be waiting for a long time.

This is twisted reasoning. .

Of course it's twisted, hence the word vindictive.

I like your thinking!!!! devil.gif good.gif

Hello every one, This would be Tom without Judy on this post. I have sad news,
Judy has decided not to go to the interview. This comes as a shock to me, but to some of you saw this coming.
Her reason is simple, One of her past boyfriends came back. And to keep it short. Money was involved.
She still wants to be friends. I still do talk to her.
But she is telling me now that I have to wait 2 years before I can file another Petition for someone else.
And for her it's 6 months for someone to file a petition on her behalf......IS THIS TRUE?

My orignal posts were under the name of Hoping2..

Tom

I would like to add: She was using the 2 year wait period to rub in my face, that all she had to wait was 6 months.
And this other relationship with her past boyfriend had been going on since last June. Hiding it from me. I also was sending her money to help with her support all this time.
I have not cancelled the petition for her as I still have hope for her. But now after finding out about her past boyfriend.
I think it is best to cancel the petiton. But she is still trying to hang onto me. Maybe in case her past boyfriend doesn't show..
I feel used over this and will be more cautious in the future.

Well I am sorry to hear about your troubles, but if you wanna be vindictive. Do NOT cancel the petition let it die its own natural death and NOBODY can file for here for a long period of time smile.gif

Hi guys, I was interested in knowing what happens during the "Initial Review" phase as well as the "Post Decision Activity" phase (that is at the NVC) of the USCIS.
Thanks a lot for all your answers in advance.

"Initial Review" - During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

"Post Decision Activity" - For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.
