Same thing happened to the early december filers at CSC. And they skipped over us to the late december filers, but they got to us eventually. It all seems to go very fast once CSC is finished with the case! They will get to you and probably sooner than you think!

There is plenty of badly written english on here. Hopefully those people speak it better than they write it. Also, I think when people are upset or angry the don't check what they've written or think clearly when they write and they come across as ignorant or as second language speakers. But I do agree that, as in every other country with immigrants, there are many people who will try to bring all their relatives plus the rest of their village once they're granted residency :P . It's inescapable wherever you go.

Curious as to why you didn't apply for your green card in your married name.

It looks like you have 2 choices:
1. Retain your maiden name as your only legal name and don't change SSN or GC. Everything that you then do such as driver licence and bank accounts will then be in this name.
2. Pay the fee to change the name on your GC to your husband's name, this is now your legal name, and then change it on your SSN when you receive the new GC. You will then use your GC with your new name to do the above.

Not everyone uses their husband's name and that's legal. As you stated, the only way to get a replacement GC for free is if there is an administrative error (I know, they spelled my last name wrong, admin error).

Our case was completed February 23, 2006 and our interview date is march 28, 2006.

How did he receive notification, Jamaica mail? My wife's case was completed and sent to Kingston on the same day.

I had hubby email me the DS-3032 Choice of Agent, signed it and mailed it off in a package I was already sending to him via Fedex so he could mail from the US. If you hava a look HERE there is an example of emailing the NVC in place of sending the DS-3032. It seems to be working for members doing it this way. NVC usually confirms within a couple of days.


NVC will accept an e-mail from the beneficiary in place of a DS-3032. Quite convinient.

Meauxna has written in detail somewhere how they proceede once they receive the petition...i don't remember where that thread is on VJ...Also, Capt Ewok, has refered a thread of comparing the Timelines..in my other thread on here...that gives a good idea...usually around 5-6 months for NOA2 for the longest time waiting...


Heina, i have never read on here of I-130 been approved in 3 years...maybe in exceptional situations...can you tell more about that couple? what was their case? Thanks...

Things were much slower years ago, our I-130 took 15 months. Though processing time estimates 4 months into the process did show it would take 2 years. The wait can be unnerving, but have some patience it will come.

My fiance will be flying into JFK from London in hopes of getting his EAD. Problem is, there aren't any flights at the right time for him to get form JFK to Indy. Can someone please tell us how long it usually takes to get through immigration at JFK?

And how long does it take to get from JFK to LGA, cuz there are plenty of flights from there to Indy. He would be going between airports at around 6:30 or 7 in the evening I would guess (his flight from London arrives in at 4:10.)

Any suggestions would be great!

I agree- no need for a lawyer at all if you've got a straightforward case. Just make sure you READ all the directions for all of the forms a good two or three times. Highlight things. Read them again. Follow the guides on here, ask any questions (even if it seems like there should be an obvious answer), and you will do just fine

Hi- when my fiance went through JFK today the immigration lady told him he must be in the country 24 hours before getting married. we are thinking about going to the clerks office tomorrow to get a marriage license so we can get him on my insurance straightaway.

Do he need to be here a full 24 hours before we get married? has anyone done this and had trouble?

don't give up, don't ever give up!! I know it is easy to lose focus, and to lose heart. I'm looking at your time line now and things sure are dragging out for you. have you contacted the CSC or checked their processing timeline lately? That might give you some idea where things are.

Keep your head up though and remember what matters here and why you are doing this. You obviously love your fiance very very much, and in the end it'll all be worth it, and days like this just a distant memory.

Think of how much goodness awaits you! :)

As stated previous, the man has moved on to another target now and has shown no more interest in this marriage. Not only is he wasting her time it seems as if he has stopped all communication with her. Is this true... if so still hope for a Visa under such circumstances will lead you to much more heartache and sadness. Simple because it does not seem possible. I am sorry to agree with everyone else but gaining a Visa from trail of lies seem hopeless. I advise you to prepare yourself for a fresh start. I wish you the best on your next journey. Response
The determination of when to file should be made by the taxpayer based on all of the facts and circumstances of
their case. The taxpayer for example could have a large refund amount that would not be available to them if
they waited to file just to get an additional $600-1200 on their refund.
The taxpayer could file now and amend the return once the spouse has a valid SSN to claim the recovery rebate
credit.

You can only file head of household if you have children; spouses don't count as a dependent.

If you plan to use a tax service you can call the office nearest you to have them find out where there's a preparer that specializes in international returns. I don't think anyone that isn't trained would be comfortable to do these types of returns alone. This is my third year doing taxes for a service and I'm not comfortable with mine so once everything's all set I plan to ask one of the ones I know to review my return.

That is the logic...you think the government and this process is logical, and You believe.
This is wishful thinking on your part and has nothing to do with actual knowledge. Could you possibly cite some sources for your information that you are stating as fact.

Sorry but I think this persons future deserves a little more than someones belief that this process we all go through is in any way logical.

The only thing you have to consider is this "are you willing to risk your future if you get caught". Misrepresentation by accident or on purpose is the same thing in the eyes of the law. The instructions clearly state "D. If either you or your fiancé(e) were married before, give copies of documents showing that each prior marriage was legally terminated." If it is discovered they will only assume you are hiding the truth, they will not believe the OOPS blink.gif factor.
So, you got lucky and nobody caught your error yet. Your thinking "So somehow they made a mistake or they let it go by?" is wishful thinking. It was overlooked and not caught at the first stage of this process, there is a LOOOOOONG way to go yet where it may be caught. YOU SHOULD really be thinking "I DO NOT WANT THIS TO BE DISCOVERED WHEN WE ARE FILING AOS"

Not trying to be the sour apple in the group but you need to step up and get real with the decision making processes going on in your head before you make a very "&(%*$#" big error.

Consulates have leeway when it comes to requirements for the interview, many consulates have different requirements that differ from other consulates.
When it comes to the I-134 this is the case more often than not, it is a non-binding agreement so many consulates actually use the I-864 requirements and apply them for use with the I-134, which requires proof of income...It only stands to reason they want to assure that you will be able to supply all the needed documentation at AOS time when you fill out the I-864. They are aware of fraudulent activity when it comes to immigration and know full well anyone can write anything on an I-134.
I would suggest you get the tax returns or tax transcripts just in case and save yourself some possible heartache later.
