They would send you another RFE for further information, if it is required. Dont worry you aren't over reacting, this process is stressful.

Comply with the RFE sent to you and submit the information that they have requested immediately. Do read the guides, they are helpful and will help with the next part of the process. They wont outright deny you for not sending in information, but if you dot submit the information required you will continue to get RFE's and this will slow up the process.

Oh yah to the original poster get those letter ready as they need to have original signatures so you need to get from you fiance and sometimes it take a while to get them together and in your hands don't wait for the RFE which will probably come as it is a requirement in the instructions of the I-129F

When we filed our packet we gave a detailed time line of when we met and when she came and went into the country - so assuming someone read our time line the government has to know she over stayed -- but still I'm worried.

Could the consulate general deny her even though the NVC or USCIS already approved our packet? Has this been an issue for anyone else?

Just focus on getting additional paperwork together for the future process. It is frustrating but CSC has been moving at lightning speed lately so it may not be too long if you have everything in you package and get no RFE's.

Let me give friendly advice. Calling the USCIS or NVC is pretty much a waste of time. the answers are not designed to give you information, they are designed to prevent you from calling again. When the NOA2 is sent to you, by the time you receive it the NVC already has your case, any story otherwise is not accurate. But I see a trend developing lately, maybe I am only now seeing it, but it seems that many petitioners expect to track their petition every day for every step of the process and the "system" is not set up that way. Trying to do so will only cause you frustration and running to VJ for a verification of every BS story you are told by NVC won't help. Your blood pressure goes up and blood will spurt from your ears, and your case will not be done any sooner. The "system" is remarkably impervious to any attempt to extract accurate information or speed things along. Won't happen. Telling you it will take "2 weeks" pretty much guarantees you won't call back for 2 weeks and by then the odds are you will have the letter and never call back at all. Like buying a "lifetime muffler" for a 12 year old car. What are the odds you will cash in on that? They didn't answer you, they deflected you.

When your petition is approved, it is sent to NVC, a letter is sent to you. When you have the letter, NVC has your petition. Whether they admit it or not. In about 1-2 weeks you will get a letter from NVC with your case number and telling you whether it was forwarded or held for AP (check my timeline for an idea of this). Any attempt to get information in any other way is a waste of time. I know of several cases where they were told it was forwarded to the consulate but was actually in AP.

This sytem is really set up to be handled by mail. They have no intent of encouraging phone calls. They do all they can to DIScourage phone calls. The only luck I had was in writing the consulate AFTER the NVC said my case was forwarded. 2 weeks after the NVC says your case was forwarded, send an email to the consulate. If they have your case they will say so. If they do not, wait one more week and send another email.

Not all are the same. The NVC letter may come faster or slower than mine did, the consulate may get it faster or slower than ours did. Settle down, in our case it took nearly TWO times as long to go from NOA2 until interview than from NOA1 to NOA2, so you are maybe 1/2 way there. Also your case is moving along even of they aren't communicating. It could be 3 weeks before NVC sends the letter and it would say something like "On March 12 we received your approved petition....." And by the time you get that letter the case can be at the consulate, or you could be 4 weeks into AP.

If you are correct, that by the time NOA2 reaches your mailbox, NVC has the petition, then I am glad to know this, since this morning they said they do not have it. I'm definitely aware that the "2-4 week", or whatever they tell is, is only what they are SUPPOSED to tell us, but it is nice to hear this confirmed!

To be safe add a supplemental page for each page 1,2,3 and 4 due to the fact they are coded so they go to different places as you will see at bottom of pages. That way if they are sent wherever they go to they will each have the supplemental pages. One for sure goes to consulate so they may not stay together forever, its always smart to CYA any chance you get.

You need 3x the amount of difference between what she the USC is earning and the poverty guidelines x125%...so right now it is $18,400. Last year it was $17,500. so as an example...

1st If her father was a United States Citizen then she has citizenship so find out how this works first then you can skip all other stuff.

2nd If you NET WORTH is very high all you need to show is 60,000$ worth of something you could sell as an asset and you would meet the guidelines.

3rd They count the LINE 22 income from you 1040. I don't know if you are setup as a C corp or and S corp but the S corp income is carried to you personal taxes and this line is where it is. I am not sure about C corp information sorry.

When you reopened the case, you resent your petition with a valid address, right? So they sent you a NOA1 and now you check your case online and it still says your case is denied? Is that what is going on?


It looks more like they sent in the petition then were asked for additional evidence RFE and they sent that to the wrong address. But just my guess.... blink.gif

The petitioner can sign the beneficiary's name on the G-325A, as long as the beneficiary is abroad - Sandra/Ahmed found this on the USCIS site:

Yes it is normal, and yes it does last whole time blink.gif our interview is in 10 days and i'm going over for it in 7 days, and I am worry whole time.

Probably because I own a small business and with all the write offs I am allowed to take i'm only $4000.00 over the income limits. If I would have only known maybe I could have skipped the $30,000+ write offs past few years and sailed right through. It really SUCKS worrying.

And also, there is no way I can go see him again during the filing process. I can't get enough time off work to go back in the next few months. I might be able to squeeze in a short trip for his interview depending on when he gets it but I have kids and they create issues with finding someone to keep them while I'm gone. How much notice do you get before the interview? I have to put in my time off request at work 6-8 weeks early to get any blocks of time (more than 2 days in a row) off. Is this going to cause problems because I'm not going back over there between now and then?

What consulate are you working with?

It may not be the same for IR1/CR1 but using the USCIS website is really a waste of time anyway. They don't update it immediately and we received the paperwork before the status changed on-line. If they've told you that it's in the system and cashed your cheque that's a pretty good indication that you are in the system. As another poster has mentioned if they had problems with their computer system then they probably have a backlog of cases to add / update - VJers are probably a small percentage of those who get processed every day.

It would be silly for you to withdraw the application and pay again (you've mentioned that money is an issue in other posts), adding more months to your wait, when they already have your file.

Everyone has to wait, no matter what their visa is - many of us wait to see updates but don't get a single touch recorded before approval - so you aren't the only one.

Same thing happened to the early december filers at CSC. And they skipped over us to the late december filers, but they got to us eventually. It all seems to go very fast once CSC is finished with the case! They will get to you and probably sooner than you think!
