Emailing the embassy is pretty painless - they're quick and efficient with replies, but you will need to call the extortion line first to receive the weekly emailing code. In fact, if you're calling the extortion line you may just be able to request your replacement packet over the phone (but a follow-up email might be a good idea).

This is the info from the embassy website:

Service available Monday through Friday, 8.00 a.m. until 9.00 p.m., and on Saturdays from 09.00 a.m. until 4.00 p.m.; £1.20/min; only available in the U.K., within U.K. may be unavailable from some business telephones and mobile networks.'

Your question about the address: the current address for the fiance is the address that is supplied to London. All further correspondence will be going to the fiance as beneficiary and not the petitioner. It could be confusing to be filling in the paperwork for the beneficiary so it's usually easier if they do it :)

When you submit the forms, in your cover letter explain that you didn't receive your P3 letter and you need another copy sent to you. Make sure you include a correct address JUST IN CASE.


Just to clarify, you can't send your P3 until you receive the letter from London requesting it and giving you a case number. London will just bin it unless they've sent the letter to you. If you haven't received it most likely they haven't sent it out yet.

You can book your medical without the P3 letter as long as you have your LON case number, but you can't attend the medical without the letter.

Call the NVC helpline. Make sure that you have your case number. You can ask if the case has indeed been sent to London and what the LON (london case number is). Once you have that your fiance can book his medical at Knightsbridge and start to fill in the P3 forms, which he will find on the Lon Embassy website. If for some reason your case has gone AWOL they will be able to tell you. I'm not sure what you can do in that case.

However, London can be quite slow and it could be that your case has arrived and they haven't input it into the system. UK schools are still on holiday and many people will be on holidays (remember, they get many more weeks than most people here) so they may be short-staffed.

I would call and find out and make sure that your fiance is prepared for the medical (he can book this as soon as he has the LON number and it is valid for 1 year) and has filled in the paperwork to send straight away as soon as he receives the P3 letter.

Don't worry about the petition expiring. London usually extends it for another 4 months if they haven't sent out the information and the petition hasn't been withdrawn.

Yes, get your fiance to get the vaccinations BEFORE he comes to the US (with his GP to save money, they should be free). If he has an up-to-date medical chart there's a chance that you won't need to visit the civil surgeon as many people have sent their UK vac chart in for AOS and got through with no RFE. That will save you some money too. If you wait until AOS in the US he'll have to have them done here, wait for the MMR booster and you'll have to pay a significant fee for the privilege.

You don't have to go to get SSN twice, but it will make things easier for your wife to be if you do get the SSN in the 74 days before the I-94 expires. In order to prove your relationship it is advisable to have joint bank a/c, her name on a lease / mortgage and bills. A SSN is often required to do these things. Also, the AOS forms ask for a SSN (although I don't think it's a requirement).

I know it's a pain but this whole process is a pain and this is just one more painful step :) It's up to you, really, but the advice is to get the SSN in maiden name before the marriage and change it to married name afterwards.

It shouldn't be a problem for him at all. I came through with no paperwork showing ties and they never asked for anything. I told them the purpose of my visit was to visit a friend (this was the second time in 3 months) and they let me though fine. I suspect that they're pretty lenient when it comes to low-risk countries and I believe that the immigration petitions don't even show up unless you tell them about it (I may be wrong I just remember someone mentioning that).

As to your question, as your petition has been rejected and returned (hopefully they didn't cash the cheque) I don't believe that you have to do anything further. You do not have a case number to cancel so that makes life easier.

There is no such thing as a "Shack Up Visa" only way to shack up with a partner is with another US Citizen, Resident, or perhaps an illegal alien.

A person in the USA on a K-1 that does not marry within the 90 days of the I-94 becomes an illegal alien, so perhaps can shack up with the illegal alien, however like any other illegal alien wont be able to get green-card SSN, DL or any other thing afforded to a US Citizen, or US resident.

K-1 can apply for SSN and EAD during the 90 days of the I-94, but EAD will expire when the I-94 card expires, and the SSN will be marked "Valid with DHS authorization only"

K-1 cannot adjust status based on a marriage to anyone other than the person who petitioned for the visa.



The US unfortunately does not recognise a de facto marriage (a relationship in the nature of a marriage lasting 2 years or more). Therefore they do not offer a visa for partnerships. This is a shame as marriage is not necessarily the route that everybody wants to take. Now that you are here on the K1, as others have said, you will have to marry within 90 days to fulfil the obligations of the visa. Does your home country not offer a visa for defacto partnerships? I know that mine does and I would expect that some others do too.

YuAndDan, I find it offensive that you refer to a defacto marriage or civil partnership as a 'Shack Up' as this is the path that many people prefer to take; I would have preferred that path if the US hadn't insisted that to be with my loved one I must sign a legal piece of paper to prove that we had a relationship. You are entitled to your views but it is quite rude to belittle views of people who prefer a defacto marriage for whatever reason they choose that path by calling it a 'shack up'.

If you have the funds and available time then you should meet as many times as you can. Don't feel that just because other people can't you shouldn't. Not everyone has that luxury and you are very lucky :-)

It appears that as long as you can prove in some way that you've met in the last 2 years they approve the visa (barring any missing answers = RFE). The hard part is the interview and that paperwork. My fiance' is planning to visit next June and stay as long as possible - like the 90 days allowed. What if the call for Interview comes during that time? Will he have to go home for the interview? I just mailed the packet finally - had to wait for one little piece of paperwork I didn't realize I needed until the last minute. We don't have a lot of extra cash for plane tickets but hate to delay his visit. It's so long between as it is. I may have missed this post somewhere before. If so, I apologize. Thanks so much. I did hear just two days ago from USCIS ombudsman liaison that my file was sent to NVC about a week and a half ago - which makes me happy and sad - happy they have it but sad they misrouted or let it sit for three weeks. They said it takes time for NVC to get it into their system. Again, I'm wondering why it takes so long especially with modern technology. Likely understaffing if it is anything like state government with which I am well acquainted. Now I have to wait for NVC to assign a case number and contact us. Sigh.... waiting is so tough. I wasn't sure if this was covered, but I need to vent (or cry) and need some help from veterans of this process if anyone has had this happen to them. I got my NOA2 saying my I-129 F was approved, dated May 11, 2012. So, I am trying to be patient and working on critical work deadlines and trusting the process but finally I cannot take the suspense of waiting any longer so I sent an email to the NVC and they have no record of my file. So, I am hoping that perhaps they just mailed it on to Amsterdam for review so I contact them, and they have not received it either. :oops: It has been over a month and now I am concerned that the files may have been lost and I cannot tell you how depressed that makes me other than to say I just feel like curling up in a ball and crying. :crying: :(

Has anyone had this experience? I sent my I-134 and everything to support the I-129 F to my fiance' in anticipation of his receiving packet 3 - so we could proceed as fast a possible. My last visit was at Christmas and New Year and we aren't wealthy so we were waiting to move forward since that made better economical sense and the price of airfare has skyrocketed so a visit didn't seem a good idea if we are going to need the funds for moving expenses.

Now, I don't know what to do other than wait for a response from the NVC who stated they would follow up by contacting USCIS. I hate being stymied though. Waiting is hard enough as it is, without the added emotional burden of this. :unsure: :cry2:

I also contacted both my congressman and senator. I do so understand how hard it is to be patient and I thought the same thing - if they sent it to the wrong place it was already approved so why would they need to review it again for pity's sake?

And copies of email folders showing many messages back and forth and even another social site plus I had mailed several cards to my husband, who was then my fiance'. I am 15 years older than my husband and they did not make a big deal of it at his interview although I made a big deal of it in the beginning of our relationship until I accepted that he just did not care about that. :luv: I think they just want to make sure the relationship is real and not just so the person can immigrate. Hi guys

I am pretty new to visa journey, but my fiancee and I are in the process of applying for a K1 visa to bring me down to the USA (from Calgary, Alberta, Canada).

We have sent in the paperwork, etc, and received an NOA1. We have set the wedding for August 31st, 2013.

The big question is will we have enough time for this wedding date to work? I just filled out the timeline today, and it is predicting our 129F may be adjudicated between June 22, 2013 and July 30, 2013*.

Is this a pretty good estimate? Or are these playing on the safe side of things?

If you have been in this situation before, please let me know how things turned out!

Hi guys

 

We got an RFE for our case (they looked at it, which is great news!) but they are requesting more information on the relationship that my fiancee (Lauralee) had with her mother.  Her mother was American, and her father was Canadian, and Lauralee has a birth abroad certificate for her American citizenship.  

USCIS stated that the birth abroad form was completed 3 years after she was born (which is true, it was done in 88 and she was born in 85).  The problem though, is that her mother is now deceased, so hopefully this doesn't make it any harder.

 

Has anyone had an RFE like this before?  Why would they need proof of this relationship, when Lauralee is already an American citizen, living and working in the US?

 

If anyone has any suggestions for evidence we could submit, that would be great!  So far they listed hospital certificates, church certificates, residence documents, school records, photographs, correspondence, insurance policies, government papers, passports, deeds, social security records, census records, and affidavits (written legal statements), or DNA tests (clearly that's not an option anymore though)

 

Lauralee and her family were living in Canada until she was 18 though, so any of these items would be Canadian, not American. That should be ok, right?
