I have heard that they will count court ordered child support but it has to have longevity and by that I mean it doesn't stop getting paid in the next few years. You would have to document it thoroughly. I am sure that it is also gonna be consulate specific so you would need to do some research about the consulate you will be going through.
As for cosponsor, your sisters income needs to cover, her and your fiance not you if you are counting yourself as the third person. Does your sister have any children? This also would need to be documented with her tax forms and w-2's.

You send 1 for you and 1 for your fiance(e) to be sent with the I-129F. At embassy/consulate stage you will need some to include with the forms you submit at that time, and at AOS stage you will need more also. Probably gonna need about 12 depending on which country you are working with and how many needed at medical and any seminars that may be needed.

If you are saying you entered on a K1 visa a left before you got married then the answer is NO you will not be able to enter the US on that visa again.
You must get married within 90 days of entry and then file Adjustment of Status and Advanced Parole which allows you to travel after you receive the AP which is generally 60-90 days after you file AOS.

We're thinking the 22nd of May, 2010 which is 269 days from today. Based upon the research I've done on here by looking at the previous 20 cases sent to the same processing center (California), same consulate (Vancouver Canada) the average time from NOA1 to Visa interview is about 170 days. We are mailing the application package this week so we should have about 100 day cushion... simply based on the averages.... I know this is not a perfect way to plan things but still we want to have a traditional wedding, not just a JOP at the local courthouse...


While I don't recommend making UNCHANGEABLE plans. You should make 100% sure that the package you send in and also when you get to the consulate stage YOU COVER EVERYTHING leaving nothing out.

There hasn't been too much discussion here on VJ of HCMC CO's rejecting income that meets the requirement. If you're just barely over the mark and the prior year's income was significantly less that may cause a concern.

And HCMC doesn't typically accept co-sponsors for K visas.

My thinking is that you are ok with current year income over $19K.

Exactly, it is just a different letter for the same purpose. All petitions go to NVC for dispersal to the correct embassy/consulate.

If that is the case you would probably need a bank letter stating WHEN the account was opened to show it has been in the last 2 years or it will not help.

I also understand that the letters of intent don't have to be notarized, but by having someone certify that we were both there signing it at the same time, I was hoping that it would count too.

I am pretty sure that you have to use a US address to file the petition. Many people have asked before about filing from abroad and the answer was always find someone in US to do the mailing and receiving correspondence.

He is more than likely asking for a letter from your employer verifying your employment. Should be on company letterhead, state when you started, how much your yearly pay is and that you are generally going to continue working there in the foreseeable future. Copy of Your Three Months Bank Statements

Take your bank statements for the past 3 months and copy them

Original Letter from Your Bank on Bank Letterhead proving the day you opened your account(s) and the account's current balance

What I did was took my bank statements for the last year and made a letter showing when I opened the account at my bank, then I listed the past years deposits for each month and what my current balance was. Took it to my local branch and they made me one up on their letterhead took about 3 days. Some banks you can call the customer service line and they will generate one of these and mail it to you, tell them you need it for immigration purposes, you might get lucky and they MIGHT know what you mean. Again, By ORIGINAL he wants the one they give to you so the signature is ORIGINAL. Make sure you keep a copy for your records.

It was delivered in 3 days and receipt was received by me 2 business days later,
followed by the NOA1 2 days after that, dated 3 days after I mailed the package.
The total cost was $11.35.

This page lists all the forms you will need at each stage of the k1 process as you can see the I134 is listed at the visa stage there is no I864, you will also notice at the AOS stage there is the I-864 listed again there is no I134. I can assure you if you do the items in the process according to the guides and the example forms page you will have very few questions throughout the process aside from procedural items.

Getting upset because someone points out the obvious after you say you have read the guides will only make the process that much more strenuous.

OH yeah...if you are gonna change you ss card to new name do it before you have elapsed 76 of the 90 days your I-94 has. BUT even if you don't get the ss card changed to the married name fill out the AOS paperwork in the married name so all AOS documents will have it. The certified record of marriage will be all you need to prove it.

They will tell you anything to make you think they are NEEDED. All you need to save is ANYTHING you pay for, your tickets and boarding passes, copy of you passport and the stamp from when you enter and exit the country, buy something in shop if you have a layover in another country that will show on your tickets. Take pictures they help but they are only secondary evidence as the timestamps can be photoshopped. Get picture when u arrive in airport in front of arrival departure signs that show dates.

Have her make an account on VJ also if she want to get read this stuff, can't really add any other email addresses for your account.

It means they want you to bring original documents in case they ask to see them, you GIVE them copies. Your birth certificate and passport copies should be certified copies.
Unless specifically asked for there are no documents that need to be notarized, including the I-134.

I don't want to take a chance, I'd rather pay the $10 and not have any delay. I would think that the I-134 wouldn't have a place to have it notarized if you didn't have to do it.

It would if you have an OLD form that used to require notarization...BUT things change and they have it is NOT a requirement at MOST embassies but I have heard of a few that still want it done.

Embassies are also notorious for sending in their packets OLD forms because they will still accept them so it is NO BIG DEAL.

Check the embassies requirements and supply accordingly.

First thing needed to know is if you are the beneficiary or petitioner, the address change would be important if she is the petitioner and she needs to move before the NOA2 is mailed as USCIS mail will not be forwarded. If she is the beneficiary like the other poster said you can change it at the NVC or the Embassy stage.
Second thing needed to know is what embassy you are working through and that will stipulate what you need to do after the NOA2, embassies have some things in common but many have different requirements and documents that they expect before they will issue a visa.

Best thing to do is click at top of page on guides and study the K1 guide entirely including the FLOWCHART it will help you immensely.
Also go to the embassies website that you are working through and read up on their requirements, another good idea is to go into the REGIONAL forums at VJ to learn the intricacies of your embassy.

Oh yah, waiting on the embassy to mail you the "packet 3" is not such good advice because some embassies don't mail anything they send you a letter or tell you when you call to set interview to visit and download the info from their website, also some countries mail system SUCK and the things that do get mailed never arrive.

Not unusual for people who charge for this information...websites, lawyers etc. They are in it for the money and don't really have a vested interest in you completing the process because they don't lose anything YOU DO.
VJ is here for people to offer help to those doing the same thing many others are now or have before, just because. While VJ likewise has no vested interest in your success, the people who offer the help KNOW WHAT YOU ARE GOING THROUGH.

The I-134 is used at the interview stage of the procees i.e. The Embassy your fiance will go to for the interview.
The I-864 will be used after you are married and file for your AOS.
