Yes at the consulate stage of the K1 process you and the co-sponsor BOTH will need to fill out the I-134. Just follow the guides and example form for this document and you can't go wrong. smile.gif

The K1 visa has a validity period of 6 months and since Canadians can enter US without a visa it is entirely possible to go back and forth while having one and not using it. Albeit you would have to show ties to Canada if you wanted to come as visitor just like usual, especially with a fiance visa in the mix.

Not sure about the medical tests the 2nd time costing more, BUT you paid Banco De Oro for the visa fee not the medical fee. You should have paid the medical fee at St Lukes.

The "approx $550." you paid was not a visa fee it was a petition fee. You filed a petition to get permission for your SO to be allowed to file an application for a visa.
The actual visa fee paid to the embassy is $131., you will also have to pay for the medical and any other reqs. the embassy may have.

All you have to do is put your new name on the AOS forms and go from there. There is nothing on you marriage paperwork that shows the name change at all, they always show the maiden name and are filed like that with the state. It may be different in some states but I highly doubt it. When you get your EAD go to Social Security office and change name, same with DMV.

Just redo it, it will generate a new barcode and if I remember correctly the confirmation # changed. Had the same problem. It happens, don't worry about it. When you get to the print part print a few copies.

Next, we were hoping for him to be able to stay with the baby and I after its birth while awaiting the visa approval. Since he is Canadian, I know that he doesn't require a vistors visa to be here, and obviously he couldn't work or anything. But would this affect the process at all? Or would he just have to return to Canada for the interview at the consulate?

Any help or comments are greatly appreciated.

I would suggest you read the guides a little bit to get familiar with the different types of visas available...
The K1 is gonna be the quickest more than likely but has a higher cost than the others also cannot work for about 3+ months or more depending on how quick you marry.
You will need to make approximately 22K+ to qualify to sponsor him based on 3 people in family. You may need a co-sponsor depending on your income, can't really answer based on your "I don't make very much".

It means it is heading to NVC...you should be receiving your NOA2 soon...

1) 2 days after NOA2, starting calling NVC: 603-334-0700 press 1 then 5.
2) Once NVC has your case, they assign a new case #. Ask them what date they sent your file to the embassy & also for the NVC case #.
3) Once you know the date NVC sent off the file, track it at DHL's website: http://track.dhl-usa...?nav=TrackByRef For the reference code, enter EXP 10 JUL 2009A (adjust using dates just before the date NVC told you), with a shipping range of that day to a few days later (July 13 - July 14 worked for the example above). Look for shipments to your beneficiary's embassy.
4) To find out if the embassy processed the packet, call the Dept of State before 5pm: 202-663-1225 press 1 then 0

What exactly are you asking. Citizens of Canada are not required to have any visa to enter the US so just answer YES hes here, he came to visit, no big deal.

Nonetheless I've personally not seen an RFE for this reason - in any event, there isn't anything to do but relax - you can't send things to them in the hopes that it catches up with your petition - if you did get an RFE (which I doubt), you would have to wait until it actually happens and you get an official notice, which won't be for many months to come.

The I-134 is used at the consulate stage. The I-864 is used at the AOS stage and is more a contract between you and the government pertaining to your ability to support your beneficiary of the visa.

I see no reason why you would not be able to do what you are trying to accomplish. Age requirements for marriage are determined by each state not at the federal level.
The I-134 is an affidavit of support and not a contract, so it can be signed by someone under the age of 18. It is essentially a form to file a promise with the Bureau to support an alien entering the United States and that the alien will not become a public charge.
An I-864 on the other hand is a Contract between you and the federal government, and I THINK in the US you must be 18 to sign a contract and be held liable to adhere to its contents. From the directions it states: This form is a contract between a sponsor and the U.S.Government. Completing and signing this form makes you the sponsor. You must show on this form that you have enough income and/or assets to maintain the intending immigrant(s) and the rest of your household at 125 percent ofthe Federal Poverty Guidelines. By signing Form I-864, you are agreeing to use your resources to support the intending immigrant(s) named in this form, if it becomes necessary. You will not need this document until you file AOS which would be after February so you would be 18.

You can buy the ticket anywhere you want. Be sure that Expedia or whoever you use issues tickets originating from outside the USA, they may not. What I usually do is use a service like Expedia or Orbitz to research fares as it is fast and compares many airlines. Then I go directly to the chosen airline's website and buy the ticket there. This can save an addtional $40 or so, depending on airline and online service, but I have always received the best price direct from the airline website. Also compare buying the ticket on different days. Same ticket, same flight, same travel days...but PURCHASED on different days will have a different price! No kidding! Sometimes as much as $100 or more! So check prices tonight, then again tomorrow, then again Monday, etc. When I bought tickets for our travel this summer the dfference from NYC to Kiev was $819-$644 just by PURCHASING the ticket on a different day! (Aerosvit airlines)

Having the dates printed on the photos when they are developed is not more solid than hand-writing them on the back. We wrote dates and descriptions on the back of each photo and this turned out fine. I guess you could use post-it-notes, but what if they fall off? I'd recommend writing on the reverse side with pen (as we did) or pencil if you are really worried about damaging them.

After my this post- I learnt that one could print and I tried printing with dates from Kodak kiosk at Walmart- it works!
One can print the dates whereever you wish to the photo- just go to More edits and then insert text- then change options on the directions on screen to move the text printed

Quite easy- but time consuming
you can change the size also

And this is exactly why it does not really matter with dating them, it is so easy to PUT a date on any picture so it really carries no weight.
Just write on back with pencil or felt tip pen per instructions on most documents.

I would say to CYA and you are paranoid, yes it's a good idea but they only ask for the entire book if you are using it to prove citizenship. I would feel entirely comfortable sending just the pages with the stamps if I was also sending corroborating evidence like the airline tickets and boarding passes. I would not send all 20 some odd pages if I didn't need it to prove US citizenship.

Its hard to tell you anything because you have not filled out your timeline and you don't specify which embassy you are working with...MOS# is a giveaway but I don't have them memorized.
So, I guess best thing is to tell you to go the embassy website and see what their guidelines are, maybe start by getting your interview paperwork together.

You have to move the Ref# info around the date they give you so...if they said they sent to embassy on August 28th then use EXP 26 AUG 2009A,EXP 27 AUG 2009A,EXP 28 AUG 2009A,EXP 29 AUG 2009A,EXP 30 AUG 2009A and look for your embassy.

You only need to send in one copy of the I-129F form and 1 copy of the G-325A form ... if you look on the USCIS website and download the newest versions of each form, you'll see that the G-325A is now only one page.

Please disregard my post; the G-325A form itself is only one page but you should be submitting 4 pages, as per USCIS instructions ... which presents a problem for my fiance and I as we only submitted one copy of the form. Man, I can't wait to get our RFE!

This process hasn't started out too well for us, lol tongue.gif And not being able to contact them from Canada = fail.


I wouldn't worry too much it will probably end up being ok, it's just with the confusion and lack of real training at USCIS (imho...only because i have read memos and some of the adjudicators don't seem to know about them). It has been changed more than likely but who really knows and for safety I am just sticking with the send 4 rule for now.

You don't send any copies of the I-129F you send the original and just one, make 2 extra sets for safety purposes. One for you to keep and refer to if needed and one to send to your fiance(e) so they know exactly what has been sent.
As for the G325A, yes the new version has 1 copy but its instructions say 4 so which is right, as per this page http://www.visajourn...is-g-325a-form/ from VJ for safety send 4 copies just in case if they don't need them they can toss em, if they do need them they won't have to wait for you to send them. smile.gif

I have heard others doing this because of the way the document is formatted, i'm sure any NORMAL thinking adult would know they weren't born in 1854 etc...but this is a government employee and they just make movement with not much thought. So, I would print the documents and then WRITE IN the dates according to the format asked for.
But, that's just the way I roll.

I forgot to add...the child support is in effect at that amount until 2013. This is documented in my divorce decree. I have proof that I have been receiving this amount since May of 2007.
