Send her over for the medical at least 2 weeks before the Interview dates...you can call embassy and set the interview instead of waiting for the package.
Many nice places near St lukes to stay. I had my fiance take the CFO course also while there for the medical ... tickets from CEBU to Manila can be found for around 2000php roundtrip...so its not that bad to fly back and forth.

Good Luck

I would call St Lukes and ask them if they will do the medical without the passport ... other than that you will have to reschedule the interview. You have a very good reason so I would not worry about red flags. biggrin.gif

Maria got her Pink Slip on Wednesday June 10 after her Manila interview, and we paid the fee at the counter in the Embassy for Air 21. I checked the online web site for Tracking with Air 21, and whether i put in the Tracking Number or the MNL Case Number, it still shows Number Not in System. Does anyone know if this is a concern, or does it take a few days after the interview for the tracking number to show in the Air 21 system on the web.

Thanks,
Carl and Maria

It takes a few days for the visa to be printed and sent to Air21 to be delivered, they will text you when it is in their hands.

You don't really need either one unless you are not at the poverty level on income and trying to use assets as a basis for your support documents.
Anyway bank statements from last year or a letter from bank stating deposits for last year, balance at the time are pretty much the same thing.

Hope this helps good luck.

Forget all about the business income. Ask him what line 22 on his 1040 says, that is the easy way..." you says with this that they only consider the $$$$ on line 22/1040 of the individual tax return page?...this is the count of money that has to be reachto the count of $18.212 to be my sponsor?

Yes that is exactly what he is saying if your fiance has only himself and you to support, no kids or other dependents. Family of 2 is $18212.

Note Barcode contains all data entered into the form, you will need to fill in another and print it out, perhaps save the PDF file generated for future use.

Note the online system does not save anything, just uses the data entered to generate the barcode.

Moving this to consulate/embassy forum.

The forms won't let you save them in any format. The only way is if you have access to program that will print a .pdf file. I use PDF995, its a great program and all you have to do is print it and it saves the print file as a .pdf... smile.gif

Yes and it will have a new barcode but don't worry, it will be fine. You have to have copies for yourself so make at least 4 , I can't remember but I think you need 2 for consulate, and a few for yourself as extras JUST IN CASE.

Yes you will have to include your W2's with the I-864. What I would do would be to explain the temporary work in your cover letter when you submit the entire Packet 3.

From the I-864 instructions even though he is at consulate stage and will be filing a I-134

25. Federal Income Tax Information.

You must provide either an IRS transcript or a photocopyfrom your own records of your Federal individual income taxreturn for the most recent tax year. If you believe additionalreturns may help you to establish your ability to maintainsufficient income, you may submit transcripts or photocopiesof your Federal individual income tax returns for the threemost recent years.

You are not required to have the IRS certify the transcript orphotocopy unless specifically instructed to do so by aGovernment official; a plain transcript or photocopy isacceptable.

Hey ladies and gentlemen. All of this is for the interview.

When I filled the G325 form, i did not list 2 companies that i worked for last year because they were temporary part-time. Now that my fiancee said in the packet 3 it says she needs 1040 form. While on the embassy's website it states this: acceptable forms of proof are a letter from your employer that indicates your current earnings and job history; most recent federal income tax returns; and bank statements or documentation of other assets.

You only need the bank statements and other assets if you do not meet the poverty guidelines.

I just got the Tax return transcripts (it does not state which companies i worked, but it states my income for last year which is $35,000)

Do i need to send both the tax return transcript and 1040 w/ W2 forms? If I send the W2, there will be two W2 from two companies that I worked last year but did not state it in the G 325. Should I write with pen on the W2 forms of two companies not listed on G 325 "Temporary part time"???

No all you need to send are the transcripts...when using transcripts there is no need for your 1040 or w-2's and 1099's.

For this year I started to work for a different company as full-time, as well another part-time since 2007, got work verification from both companies, and pay stubs collected.

Send the letters and paystubs to show this years income also.

What should I do??? Please help me sad.gif

No, they didn't give us a slip of paper and they did not ask for any additional documents.

We left the passport and the prepaid envelope with them (they gave us the tracking #).

If they kept the passport and prepaid envelope + give you a tracking # for the SHIPMENT I would only assume they are sending the visa, along with the CONGRATS this would be the only conclusion. Consulates are not in the habit of building up you hopes only to let you down, usually if they have a problem they tell you about it, they are not by any means shy.
I think your past AP experience may have you rattled a bit, I would start getting ticket prices.

Good Luck and Congratulations on your approval!

US Embassy and Consulate DiscussionConfused - I-134
QUOTE (blueskys @ Aug 2 2009, 02:04 PM) <{POST_SNAPBACK}>
Hey Everyone,

I am currently working on getting around the I-134 Affadavit of Support. I will be traveling to visit my fiancee in a few weeks and since we have already started the process, figure I might as well take it down there to him.
Here is my question:
It is stated on the embassy website for Guatemala that he will need to take with I-134, copies of the last three years of my tax return, letters, etc.. Which is not a problem. I have those. However, the poverty guideline is not met in all three years. I was serving with a mission organization over the past couple of years and therefore I did not reach the poverty guidelines. Since being back home and starting the process, I have full time employment where I will be making more in a year than the poverty guideline. However, I just started the job earlier in July. My question is this, what year do they base this off of? Should I go ahead with a co-sponsor since I have not been above the poverty level the past three years consistently? Will this affect it at all?

They will be more concerned with your employment NOW, letter from employer and copies of last few paystubs is vital. Past year tax forms really just show your ability to earn income, not necessarily held against you if they don't meet the guidelines and you show good income as of today.

I do have my parents who would be willing to co-sponsor and am under the impression I need to have them fill out the copies and get all of the same stuff I will need when filling out my form and then my fiancee will take my information along with theirs as the co-sponsor. Is this the correct impression?

This would be the best idea at this point to get the visa approved and when you have a little more time on job and file AOS and the I-864 you may be able to more comfortably make the guidelines. Yes you and they will have to fill out the I-134 and provide the necessary documentation needed you are still the sponsor they are just co-sponsors

As well, do the forms need to be notarized?

None

I hope this makes sense and could greatly use some clarification before I go ahead with this. Thanks for your time and advice.

Have a great day

Good Luck to you

Wife and son are dependents. From what you have posted he will have to use the poverty level for 4 himself, wife, baby and your fiance.

Update and if I read your other post correctly then your fiance and you have a child so that would add another to the mix so poverty level of 5

Both

is w2 and a letter from employer enough?

No you need most recent tax years tax return or transcript (2008)

and if the co-sponsor is not married but has a baby is his girlfriend added to his houshold?

Girlfriend - No, baby - only if listed as dependent or will be listed as dependent on tax returns.

I'm going back to school for my masters and will not be working during the time of the interview. I'll be funding my masters fully on grants, scholarships and loans (mainly loans). I am wondering in terms of the Affidavit for Support at the embassy interview, would that be considered income to prove support? The thing is that is not counted as income for tax purposes, so I wondered if it can be considered living expenses. Would it be a case where I would just bring my financial aid package from the university? Also, it would be just a few thousand dollars over 125% on the poverty line- do they legally have to abide by that guide or do they ever get very picky and expect the support to be more?

All these items you have listed have a particular use, i.e. paying for your schooling and nothing to do with income.

I'm just trying to explore all options before I ask for co-sponsorship from my parents.

Time to hit the parents up.

Yes they are fine, but they have the right to ask for originals. Will they, probably not. You can get transcripts from IRS for free and then you have no need for the w-2's.

It'll take about four days via USPS Express and it's quite expensive just to mail about three pages of phone records. Are we ok with just records from January to July?

You should be good with what you have sent. The consulate understands there is a lag in mail and will surely not need a few weeks extra.

Yep

at the provided blank there.. is that right?

It seems repetitive but make sure you fill in the amounts it ask for on the I-134, even with everything attached its safer to go ahead and fill the document out. They want it for some reason or else they would just ask for the evidence and there would be no need for the form.

USCIS knows people have lives and sometimes things change during this process.
That said use the new job and send the taxes, w-2's from last year. Also, make sure to take a few months worth of paystubs so they can see what type of income he now has. It would be well if you could also get a letter from the new employer.

Photocopies are fine they can ask for originals but I don't know anyone who has ever been asked for them.
If you have the time still you could order TAX TRANSCRIPTS. Call 18008291040 to order them it generally takes about 2 weeks to get them, the consulate likes them better cause they are hard to fake AND you don't have to worry about tax forms or w-2's.

I am not able to find my vaccination record, will I have some problems during the medical if I go there without it?
It is best to have it to validate your past vaccinations, some medicals allow you to just tell them what you have had in the past by answering a series of questions.
I will bring the tax return of 2008 and the last paystub my fiance sent me is dated 06/06/2009. Do I have to ask him to fedex the latest asap?
You will need w-2's/1099's to go with the tax returns also, and more recent paystubs may serve you better.
You should ask this in the regional forum for Italy to get a better answer as to how they will treat these items
Thank you!

Good Luck on the interview

US Embassy and Consulate DiscussionWrong Info on G-325A
QUOTE (Future Mrs Disney @ Aug 17 2009, 01:36 PM) <{POST_SNAPBACK}>
Hello,

I realized that, on the G-325A, on the jobs question, I put the wrong length of time for one of the jobs. My petition was approved and forwarded to the consulate, and my interview is next week. What do I do? Do I put the real info on the forms for the interview and tell the consul I made a mistake on my G-325A form? It is relevant because it concerns a job while I was in the States, I don't want them thinking I worked with the wrong visa. If that kind of information is wrong, will i have to reschedule my interview? What's the protocol for wrong/mispelled info? Please help.

Is this the same time period you said you worked illegally?

US Embassy and Consulate Discussionaffidavit of support pls help
Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return.

This is from the I-864 which is the affidavit of support for AOS. This is the one that matters most and most consulates depend on its instructions for eligibility.
I understand where you might have questions because it states "any dependent children under the age of 21, no matter where they live, any other dependents listed on your most recent Federal income tax return". While it may seem it is saying and any children under 21 and any dependents listed on tax return. The main focus is children under 21 not listed on the tax return are not considered DEPENDENTS to the government for qualifying purposes. NOW if you are sharing claiming the kids with your ex and you intend to claim them on next years taxes then you may have a problem with AOS. But as long as you do not intend to claim them it should be ok.
Paying child support does not make them dependents for this purpose.
This is only my interpretation of the instructions as they are written, and the past experiences of others who have posted on VJ.
If it would make you feel more comfortable maybe you should spend some cash and seek advice of an immigration attorney to ease your mind.

Good Luck

hello..my fiancee and i are having problem with my income and tax return..my 06,07 tax return was below poverty guidelines, then my 2008 was i become a dependent on my stepdad tax return because i go to school..fe filed the petition last feb09.i got a new job last april09.,i got an employment letter stating that i earn almost $28,300 a year..the problem is..i got 3 kids from my ex wife who is from mexico,we divorced last nov2008..And my ex has the full custody of my kids,so means my ex has the full right of them,,they were not included also on my recent tax return,i do live alone, but i do give for the child support..will they still be included on my household?my fiancee interview is so soon so were freaking out about my tax return and income
The Embassy/Consulate will look at your most recent proof of employment/income - so your pay stubs and employment letter will be looked at the most, your current income may/may-not match what is on your previous income tax returns - so this is not a problem.

If your children are not claimed as a dependent - you should not need to count them as members of your household for this purpose.

and we hear that they do not accept co sponsor
They do accept co-sponsors. They may not accept co-sponsors from folks that are not an immediate relative/family-member (for example).

so does it means we will only count my income for the 2 household?me and my fiancee?

yes
