US Embassy and Consulate DiscussionConfused Embassy question
QUOTE (Minya's wife @ Oct 22 2009, 04:39 PM) <{POST_SNAPBACK}>
The consulate is looking for the following finanials:

I-864-filled out by you
I-864 filled out by your father as he is your joint sponsor because you said you don't make enough. They sent back the I-864A because it was not the correct form. Your dad needs to fill out the I-864 and include the correct supporting documentation. Is your dad's income above the poverty line for the size of his household + the intending immigrant, your husband?

This is incorrect...per the I-864A instructions:
Form I-864A, Contract Between Sponsor and Household Member, is an attachment to Form I-864, Affidavit of Support Under Section 213A of the Immigration and Nationality Act. It is an optional form, completed and signed by two individuals: a sponsor who is completing Form I-864, and a household member who is promising to make his or her income and/or assets available to the sponsor to help support the sponsored immigrant(s). The combined signing of this form constitutes an agreement that the household member is responsible along with the sponsor for the support of the individual(s) named in this form.

A separate Form I-864A must be used for each household member whose income and/or assets are being used by a sponsor to qualify. This form must be submitted simultaneously with Form I-864.

Form I-864A may only be used when a sponsor's income and assets do not meet the income requirements of Form I-864 and the qualifying household member chooses to combine his or her resources with the income and/or assets of a sponsor to meet the requirements. The obligations of the household member under this contract terminate when the obligations of the sponsor under the Affidavit of Support terminate.

Maybe you missed the part where she lives in the same household as her father, hence the I-864A.

QUOTE (mrsean @ Nov 12 2009, 04:03 PM) <{POST_SNAPBACK}>
does the ds 156 have to be typed in [filled out online] and then printed , or can i copy it then fill in by hand.and how about the 157 and other last k form

They can be either typed or written, except for the ds156. When you print it it also prints out a page with a barcode and who knows if it is really needed or not. It is always best in my humble opinion to do all forms on the puter and print them, they look much more professional.

Good Luck

Well done so you can look up a few timelines, how much knowledge do you have of the London Embassy over the many years people have been posting here. I have just had a pleasant lunch this afternoon with a friend on vacation from the UK where she works in the Consular section of the US Embassy. She still seems to think 2 - 5 days for a visa after the interview is the normal but heck what does she know.

There is some hiccup which has slowed things down but that doesn't make it normal.

When I answer questions I tend to stick to facts NOT WHAT SOMEONE says MAY HAPPEN and lately they have not been in 2-4 days and telling someone it is does nothing but prolong their angst waiting thinkin "HOW MUCH LONGER" so whatever you wish to think.
Just like you said SOMETIMES they do run slower....and NOW IS ONE OF THOSE TIMES...
He spoke to someone at the embassy that told him 5-10 days was NORMAL for them b4 they are sent to the courier service...
So who's right the lunch date, the person he spoke to on the phone, jellyfish the previous poster whos been on hold for 10 days now and no visa, the timelines.... who really cares who's right, the fact is now it's taking longer than NORMAL.

Hi Guys

I was at my Interview last tuesday....and am still waiting on the visa from the courier service.
i have checked and traced it on the courier website with the reference number but nothing coming up
on the system.
I call the courier service they say they have not had anything sent to them for me and to
contact the embassy, which i did, the person i spoke to said that the process would be between 5-10 days
before it is sent to the courier services for them to deliver.

If they said the above sentence, then why would the below sentence be anything but normal?

My question is is it normal for it not to have been delivered yet, 5 working days later?

how long did it take from the interview until you actually got the visa delivered?

thanks in advance.

US Embassy and Consulate DiscussionLondon Medical
I'm in a similar position, although F, 28. To make matters worse, any records that I have will be in NZ! There are certain jabs I know that I've had eg Hep A, diptheria because I had them as an adult for travelling in Asia. There are others that I know I had, eg, MMR (required at age 13 in NZ) and Hep B because I had them at school but it was done at school so I doubt there are records. The only one I know I need a booster for is tetanus. I don't even know what TD/Tdap are! I recall that I found some info that said there were lots of shots to have but once you reached a certain age they were no longer applicable. It may have been on the NZ consulate website because that is a good source of info. I will just have any jabs that I think I need to have when the time comes because the more paperwork you can show the happier I think that the US government officials are. Good luck!

In SA immigrant cases are assigned case workers. They are the contacts for the petitioner/beneficiary at the consulate stage.

Because of the volume of immigrants from SA?

I really need guidance from someone who is or has went through this process as a business owner.

Ok, I have a small business and I have not really paid myself through payroll as I have always left the money stay in the business while it was growing, this year will be the first year that I will draw any significant income in payroll form. My past w-2's are not even worth talking about. My company is an S-Corporation which means all the profits from the business are taxed on my personal income taxes which show what that I do in fact meet the requirements for the threshold.
I have read many things about people being denied due to income obviously and I am wondering will my lack of w-2's harm our chances. You will say well how do you live, well honestly I live off the money I have made in my previous years jobs but it has been many years since then and I have now run low on savings. I own a restaruant so I get most my food there good.gif , I have used my credit pretty extensively also, so I do have a bit of debt at this point. wacko.gif I pay most of my bills thru the business so I have never really needed to take anything up to this point.
I have also read that assets help also, but can they carry most of the burden if they won't count the business income, or do they know small business (s-corp's) in particular pass the profits thru to the personal taxes of the owner, and it is not thru a w-2. Income is derived thru capital gains etc and reported and carried thru a form (ironically it is a K-1 form).
My business is paid off and I own my home with a modest amount of equity, own car etc....would these assets in addition to my business profits be enough, or are the just looking for W-2's.
The reason I ask these questions is I have read on forum about people with a little better income over the threshold getting denied and ask for more info on income. I am just concerned and really don't know what to do at this point.
If I could turn back the clock I would have done things a little different, but giving uncle sam ALL my money is something my accountant helps me keep from doing but i'm afraid I probably should have just skip the write offs and depreciation of assets to show more income even though it would have cost more, but then this process would be a walk in the park.
Am I foolish to think I can handle this myself or should I consult a immigration attorney. blink.gif

Thanks for any help u can offer.

Generally, self employed people use tax returns to verify income. USCIS and Consular Officers assume if you reported and paid taxes on an amount, then you actually had the income. Aren't the I-134 instructions pretty clear about self employed people providing a tax return? Best practice is three though. They understand self employed income is mostly or all non-employee (no W2) income.

I know the instructions are pretty straight forward I just concerned about all the stories I read and I know we only see what they tell us so maybe don't know entire story Ijust like to cover all bases, my past years this year filing 2008 and last year 2007 exceed the threshold but 2006 does not, I have assets to an extent and I just am trying to comfort myself somewhat I suppose and want to make sure I do it right the first time around. good.gif
Thanks for your responses to my posts they have been helpful.

US Embassy and Consulate DiscussionK1-Stressing Out About 125% Above the Poverty Line
QUOTE (GJen @ Jan 20 2009, 10:38 PM) <{POST_SNAPBACK}>
A Bit of Background:
After doing a bit of research, I've heard some people say 100% was needed and others say that 125% was needed for the I-134.

I don't want to take any chances. If the Fiance Visa is anything like the Tourist Visa, (Rejection= No Refund) I want to be for sure that money wondn't be any source of a problem for being approved. My fiance applied so he could visit and meet my parents, but it didn't happen most likely because they didn't believe he had enough money.

My yearly salary for my full time job is roughly $2,000 under the 125% poverty line. I figured that I only needed $45 per week to make up for the difference. I also do some waitressing. I figured out that I could work 7 hours there in addition to my full time job and I would be covered.

A Few Questions:

I've looked over the I-134 form.. I only see one blank to put in your job. So how would I list my other one?
What is considered a good amount of money to have in savings? I've just finished school full time and this is one of my first jobs. =/
Will I be frowned upon if I don't have any personal property or real estate?

thanks!!

One thing that will help you meet the guidelines is to have money in bank...I have heard that they consider it at a rate of 3 to 1 so if u need $2000 to meet minimum threshold u need $ 6000.00 in bank.

What are you planning to list in the real estate asset section of the I134? This economic downturn has put a lot of people in negative equity situaitions. Is it ok to not list anything? What if your tax returns say that you've paid mortgage interest? Or in my case that this has been listed as a $10,000 real estate loss in 2008 on my tax return? I'm not sure what to do. My w2 says I made $46,000 this year, but my adjusted gross federal income is listed as $32,000 on the 1040 and other forms on my tax return.

Does this property exist in Arizona...just quit worrying and asking about it, as has been stated in the other posts u keep making about this condo. Believe the people when they tell you IT WILL NOT MATTER DONT LIST IT you do not need it with your income. You are going to go nuts if u keep worrying about this same thing, you are well above the poverty line unless u have 3 or 4 kids you have not mentioned and it is not required that you list it, AND IT DOESNT matter if it shows up on you taxes or not IF YOU ARE NOT USING IT AS AN ASSET.

They should be able to do that. (Talk to a Lawyer/Notary - they will do it for you)

Thanks for your response. However, I called a notary public to inquire about this and was told notaries public in my state do NOT provide certifed copies of passports. Are there any other options?

Call your town hall, that is where I got mine taken care of. Seek out the person who is the notary or the one who makes copies for city, town...it's usually a secretary or someone located in the records department.

hi all

we have FINALLY got our interview date. its is april 7th at 9 am ... Just a few questions.

I still need to send my fiance a letter of intent to marry. and a letter from my employer.
The London consular sent my fiance this email:

On the day of the visa interview you will be required to furnish a notarized statement from the petitioner confirming her intention to marry you within 90 days of your arrival in the United States.

Sincerely

Consular Information Unit

When they say notarized do they mean notarized by me???
(sorry if this is a stupid question)

also i am a bit nervous about my affidavit of support. I am a bartender but i work for marriott hotels. So my hourly wage is low (i work mostly for tips) and with my tips i make way more then enough to support kevin. But there is really no way of me showing that i make this much money so when i get my letter from my employer what should it say??? I do have a co sponser as well.

I gave my fiance the I-134 one from me and one from our co sponser and i gave all my pay stubs from this year and my 2006 2007 and 2008 W2 forms . My co sponser only gave her 2008 W2 form.. is this sufficiant enough or is there anything else we should include??

thanks for your all your help and helping me along the stages of this process

If they want notarized Intent Letter you need to take to a Notary Public (look in phone book) and they will notarize that it is actually YOU that signs the document and apply a seal/stamp on it.

If you tax forms don't show your tips (which they should if you claim them and pay your taxes on them) and you don't meet poverty level then YES you will need co-sponsor. Likewise you will need their w-2 and tax information to send with the I-134 they supplied to you.

Good Luck and hope this helps you

Funny thing, opened my mailbox today and I received my fiancees embassy letter about setting appt for interview. Its no wonder so many of them never make it to the fiancees. Luckily my mail guy knows me and left it because usually if mail in US is delivered and name is not on mailbox or post office doesn't have name tagged to address they don't deliver it. headbonk.gif

Regarding you not receiving any notification: You are not applying for a visa, she is. Your part is done. Communication from the consulate now is only with her.

Maybe u should check up on your info a little more...this really depends on the country....

Excerpts from Actual Visa Interviews at Consulate:

#1 Our interview experience in Manila US Embassy went really well..
Our appointment is at 7a and arrived there approximately 5a. The first hour was mainly triple checking our documents and a whole lot of waiting game. At about 6:45a all applicant with 0700 hrs appointment were then allowed to go inside through security point. We sat for another 15 minutes before we were told to take our appointment letter, DS-157/156/156k out. We were told to make sure all fields were filled in before obtaining our ticket # which then were used through out the whole process. Approximately half an hour after, our number were called for biometrics (fingerprints) this took only about 10 minutes. Then again a whole lot of waiting game.....it was somewhere between 7:30-8:00a...and yes more waiting..hmmm..hmmm...Alas! our number were called for the second time for pre-screaning at 8:15a. The set up was pretty straight forward, a glass window between Filipina lady and my fiance and I. She was very pleasant and kind. First question was addressed to benefiaciary, plain and simple (your name and date of birth). Next question was similar to question 18 in the I-129F (how did you guys meet?), with this question we were both talking to her since it was addressed to both of us. Third question was addressed to me (petitioner). She simply asked me how many times I have visited her? I simply stated "this is my 4th visit" and that was that. Then she asked for my I-134 (affidavit of support) along with supporting documents such as, 2008 tax statement (1040) and W2's. She also asked for emails, YM archives, photos together and phone bills.....etc.....

FYI: during question and answer portion she was jotting down everything we said. At this point, most question was addressed to me as if it was my interview. In the end she congratulated us and asked to take a seat while we'll wait for our number to be called. All this took only about 10 minutes..Wheew! that was nice! We took our seat for another 15 minutes or so..Then the final moment arrived, interview with the consular officer! the set up was almost the same as the pre-screaning, a glass window between CO and my fiance and I but with a bit more private (small room) with closed door behind us. First and foremost casual greeting, (Good morning! How's it going..blah blah blah..)The CO was about in his early 30's very cool guy, he even apologized for the waiting we all had endured..I simply said It's all worth it! he smiled. Then he had us sweared in under US law that all information and statements were true..We both said yes and thats where the question came in..

#2 YAHOO! we just received our family-based immigrant visas via courier. i just want to share our experience at the us embassy in manila. we got there at 6 am for our 6:30 interview. we had to line up outside, but the line moved through quickly. more lines and waiting inside, but they were very organized. everyone from the security guards to the fingerprinting agent, to the document screener, to the american interviewer were friendly, courteous and helpful. we were done and out of the embassy by 9:30 am. my only advice is to relax, be yourself, be honest, be courteous and make sure all your original documents and forms are complete and valid. as long as there is nothing fraudulent or incomplete about your case, you should have no problems.
GOOD LUCK to all who await their visa interviews! may the LORD bless you as HE has blessed us.

Sorry if it seems terse, I just get sick of people giving information to others about such an important event when they have no clue.... wow.gif

There isn't anything on the I-134 about the beneficiary's income being used. iLove makes sense, you should call the consulate.

Is your fiance currently eligible to work in the US? If so, that will be applicable to the I-864 at AOS. The I-134 is just for the period of time between entry and AOS. The K1 does not allow you to work any more.

OK, nevermind about the letter from employer for my fiance. What about the tax transcripts? I know I can order them, but don't want to wait another month for them to arrive. Can I print anything from Turbo Tax and send that?

Wait a month? I called the IRS line and in 15 mins or so, had them faxed over to me.

Also when i ordered them via the phone 18008291040 they only took about 7 days by mail.

Woah!!! Serious? For free??! I'm definately calling in the morning if that's the case. Thanks for your quick replies, I appreciate it. Super stressed right now!

thank you, we got a person they say it went through so fast that they wouldnt have a record of it

They will have a record no matter how fast it goes through...you should ask them for your case # but if they have already sent the packet from consulate you will have it anyway soon enough.

US Embassy and Consulate DiscussionAt the embassy interview, do you need to present pay stubs aswell as a tax return and employers letter?
QUOTE
It is also an extremely rare thing for a self employed person not to owe "self employment" tax, which is not the same as "income" tax.

Sorry rofl.gif

Could you please explain what "self employment tax" is then....?

US Embassy and Consulate DiscussionMy fiance went to Cuba
QUOTE (Roxyroo @ May 7 2009, 08:57 PM) <{POST_SNAPBACK}>
Hi VJers,
My fiance went on a trip to Cuba last year as a chaperone at the high school where he teaches. However, it being Cuba and all, there is no stamp in his passport and we don't know if there will be a record of it on the letter of entries and exits from the country (which we are really hoping is delivered to us tomorrow). Maybe that will answer the question of how to answer question 9 on the DS 157 "all the countries you have visited in the last 10 years". If Cuba doesn't show up anywhere, do we just not list it, and lie by omission, and assume we won't be asked? Or do we list it and then the embassy asks us why it is not in his passport or on his letter of exits from the country??
Please help!

Thanks!

List all where he has been just because no stamp does not mean it will not be in a computer when they check if they do...if u leave it out and they do find out you wont like it probably...
